Arraignment Kirby

We got a heads-up that former Officer Ben Kirby is set to be arraigned Friday (today) at 10 am. Apparently, he's being charged with assisting escape, tampering with public records and conspiracy to tamper with public records.

Looks like the DA found it a bit too difficult to answer the whole "who's the other conspirator" question that according to our Eyes, was raised by an astute member of the grand jury. For a while it looked like Officer Fisher was going to be on the hook for the conspiracy role in the whole fiasco, but as of early January that option seemed to be taken off the table (read it here).

The DA has obviously changed tactics and decided to directly charge the former officer which is interesting in its own right, but what about the escapee? Amateur (or immature) race car driver, developer, and general traffic menace Jason Daskalos was the prisoner who made his own prison break. Despite his acquittal on DWI charges, to our knowledge he hasn't been charged with his own escape.

It's hard to imagine Kirby dragging a struggling Daskalos away from the paddy wagon against his will. Perhaps it's time for the DA to show a little equity in prosecution. Shouldn't all of the parties involved in a crime be prosecuted for that crime?

Kari Brandenburg (DA) has a propensity for "overlooking" those committing real crime and charging others instead. We have seen her office, for example, call single parents and threaten them with felonies if they did not produce children to convicted sexual and physical child abusers. How did she initially respond to Judge Brennan's cocaine fiasco? "He's my friend . . ."

No wonder APD is having so much trouble recruiting. Leadership never backs their officers. They just protect the scums that contribute to their pals campaigns. They're probably hoping Kirby's mishap will make everything go away.

what ever happened to Brennan? And wasn't his attorney also his supplier, along with a group of other lawyers? Kari sure swept that one away.

Once Kirby takes the rap Jason's family members can use the tag line "Not my hito, my hito is a good boy".

He was on the news the other night, he is the President of the infamous rehab center on the westside that claims the cure addiction with steam baths and massage. When they introduced him as the president of the company my jaw hit the floor.
Eye - you ought to see what you all can dig up on that scam!

As for Kirby: I dont believe Ive ever seen another escape case where the escapee wasn't prosecuted. Sort of like charging the get away driver but not the bank robber, if you all will pardon the analogy.

I agree wholeheartedly - a baby is nearly killed and found to have preexisting injuries and conditions - only father is charged and claims made he confessed - mother is primary caretaker - no charges ever filed against Mother, ADA will use her as witness against father, other child who was removed from home also has issues and no longer in mother's custody. Mother is free to harrass and terrorize both fathers!!!

I am in noway defending that scumbag road menace Daskalos, but you know what Kirby wasnt obligated in any way to help Daskalos escape. If Kirby had half of a brain which obviously he doesnt have, he could of told jason "hey you know what, im sorry i cannot help you out" Kirby should of thought of what he was doing before he did what he did. Kirby is the one that f***ed up

Yeah, yeah, Kirby F***ed up and we all know that he did and he needs to be held accountable for his screw-up.BUT the point that has all of us (citizens and officers alike)ENRAGED is the fact that DASKALOS WHO ASSISTED IN HIS OWN ESCAPE, IS NOT BEING HELD AS A CO-CONSPIRATOR FOR THE ROLE HE PLAYED IN HIS OWN ESCAPE? And that, my fellow co-blogger, is why the Eye and the rest of us have to ask if SOMEONE, SOMEHOW (gee I wonder who) is lining the pockets of the D.A. & perhaps other city/state officials to get them to look the other way.....hmmmmm.....
So, this case has more questions than answers.

McE was disbarred in Tx and Nifong in NC.

There is so many articles exposing their coruption it would take weeks to read.

The night Kirby let Daskalos go, I was working at city hall and Kirby was on his cell phone, (or someone's cell phone) and Daskalos was being allowed to go to the portapotti that was set up there, w/o handcuffs. Maybe someone ought to find out who was on the cell phone, it had to be either Kirby's or Daskalos'. Duh, how hard was that?

Also, the camera's in city hall show the area that they had the checkpoint set up in, maybe someone should pull that video, unless Shepherd has gotten rid of those too, he's always up to his ass in debt to Marty for his job.

Kirby did this to himself. There really is no other way to look at this. Even if Daskalos wanted out of the Bat Mobile, Kirby should of realized "gee if i do this, hmm i might risk my job and actually go to jail over this scumbag" Hello!!! didnt Kirby take an oath before he became a police officer to uphold the law, not break it. Its too bad he got mixed up with the "wannabe" Jeff Gordon, but as a "former" police officer he needed to and should be held to a much higher responsibility than Daskalos. Sorry there is no other legit way to look at this.

It's too bad that Chief Schultz does not protect his officers.

Kirby should have been punished and maybe fired, but I don't think this dept tried hard to find out if others up the food chain were involved with Daskolos' release.

It seems that Chief Schultz has a different set of standards for his deputy chiefs and himself.

"The quality of a leader can be seen by the set of standards he/she sets for themselves"

If appears that Chief Schultz has not set any standards for he or his deputy chiefs they do want they want and punish officer for doing the exact same. Do as I say, not as I do mentality.

In addition, if you want to test the character of a leader, give them power and see how the use it.

Chief Schultz uses his power like a tyrant. Not a very effective leader.

It would be nice if the truth in the Kirby came out. However, with this administration's past history, it's not going to happen.

Will we ever know if Daskalos called Kirby directly? If so they are both guilty. If Daskalos pulled one of his family's political strings and called someone else higher up in the police and that person gave an order to Kirby......Kirby is screwed. Disobey and risk the job. We may never know....but Daskalos needs to answer for this!

ummmm Im assuming that someone subpeonaed the cell phone records of both persons for the date of the offense? Logic would dictate that it was done but does anyone know for sure that it was? Seems to me - if so - it would go a long way towards ensuring the public that there was not another co-conspirator? This "Daskalos called a high ranking guy" argument seems silly on the surface, but his (Daskalos) family history of magically getting contracts at the airport and access to Paseo for the new build etc. tend to make the general populace a bit hesitant to believe they dont have a really good connection or two.

If the phone call(s) was/were made on a city phone, the records don't have to be subpeoned. They're public record.

So subpeona or not KARI needs to get off her ass and start working for the public that voted her in and not for her corupt campaign donaters. The public can see right through her. She's ruined her future in politics.

Phone records, are you kidding, we don't even get them on homicides, but we got the top Detectives in there. What a joke. I wonder if Bakas used his home phone and not his cell??? It may be to late to get them now?
