Retribution - APD Reacts

Wednesday was a wild day to say the least. It started with 770KKOB reporter Peter St. Cyr reporting that APD had initiated an investigation of senior Sergeant Paul Heh notifying him of the investigation immediately following his testimony in front of the city council. By the end of the day the story had grown legs with Jim Villanucci picking it up and challenging the rest of the media to do the same. The Eyes have it that during the Villanucci show the 5th floor was frantically trying to kill the story before it could get out of their control.

At one point we were told that Chief Schultz and crew believed that they'd managed to put the genie back in the bottle only to have Councilors Winter, O'Malley, and Cadigan drop a press bomb on their efforts. The result was the lead news story on KRQE, and KOAT with KOB running it later in the newscast. APD ended the day in full bunker mode sending John Walsh out to express hastily cobbled together outrage.

We got our eyes on both the press release from the council that included their letter to the chief, and an incredibly poorly written reaction from APD - part of which was read on-camera by APD's spinmeister John Walsh.

We would respectfully request that before APD releases a written statement to the press or the public that they proof read it, run it by an English 101 student, or at least run spell check. We have to read these things after all and we would prefer it if the sentences made some sort of well... sense.

OK, so maybe the APD outrage wasn't feigned. On camera, John Walsh looked to be shaking with rage. The 5th floor is certainly not happy with elected officials sticking their noses behind APD's curtain. One would think that city councilors have not only the authority to ask questions of the Chief of Police but have the obligation to do so when it appears that administration officials may be abusing their authority.

APD's reaction contained a bizarre mix of denials, admissions, outrage, and accusations. They deny the investigation had anything to do with Sergeant Heh's appearance before the council and admit that his public comments were directed at the APOA. (To criticize the Chief, Department, or the Almighty Alcalde could be construed as a violation of APD's SOP.) APD makes the claim that "complaints were voiced" by sworn officers of the sergeant creating a hostile work environment over the APOA contract. They also claim that said environment "was being perpetrated by other sworn members of the APD."

By the way that last part is the basis for APD's IA investigation. According to APD's "complaints" the sergeant managed to create a "hostile work environment" relating to a contract that was presented and voted on in 24 hours.

Folks, these are cops. They deal with hostile environments on a daily basis. We have a hard time believing that a lone sergeant even with determined help could create an environment hostile enough to even be noticed by most officers.

If one would like to talk about hostile work environments, let's talk about officers having to keep their mouths shut - even when they're not on duty - for fear of having someone on the 5th or 11th floor take offense and start an IA investigation that could take away the retirement that you've quite literally bled for. That's a hostile work environment and that's the environment our Eyes tell us the 5th floor has created for all of the officers that have taken the oath to protect us. We imagine that it's pretty difficult to deal with the criminals in front of you while trying to protect your back from being stabbed by your own department's leadership.

Moving on to the rest of this ridiculous illiterate reaction... The Chief wraps himself in altruistic stupidity claiming that "[he] will not tolerate any possible intimidation or interference in any way regarding fair process, such as the recent voting that took place." Huh? Won't tolerate intimidation? (See previous Sidebar)

The next few points of the APD statement basically take the council to task for doing their jobs telling them to butt-out and "chastis[ing] them for trying to turn internal workings of the Dept. into politics publicity." (Walsh actually read that last part on the air.)

Finally, one last claim - one that the 5th floor probably felt was the coup de grĂ¢ce. They voiced their "great" concern that Sergeant Heh may be working on Councilor Winter's Campaign and "this might have political motivation." Fortunately, the TV news guys gave this all of the coverage that it deserved... none.

As far as we're aware, there's only one semi-announced candidate for mayor. At least there's only one candidate that has sued to make sure that they can run for mayor should they decide not to run for governor - which of course they've already decided not to do because they decided to run for U.S. Senate, something they found out they couldn't do only to have to sue in order to keep their current job which they would have lost. Yes... we're talking about the Almighty Alcalde - Mayor Martin Chavez. And yes, he's running for the only position that he could possibly win - at least three years ago.

Floating the idea that this whole thing is more about Councilor Winter than the shenanigans of the Albuquerque Police Department's leadership is just one more way to try and kill the messenger and distract the rest of us. It shows just how politically involved the department has become. It shows that they're more concerned about keeping their jobs than doing their jobs. It shows that we're all in trouble - not just a sergeant that steps up and speaks his mind.

Sgt HEH is trying to 1)establish a lawsuit with the city so he can continue to receive a six digit salary once he retires and 2) establish a position for a high salary city position and/or position given to him by a elected official that he supports. He manipulated the facts, and had the blind follow him. He was being invesitaged prior to his public ramblings and chose to use the media and the council (at the expense of all Oficers) in an attempt to salvage his retirement. What a dirtbag! Anyone that supports him and his unethical practices should seek shelter elsewhere.

All the smoke and mirrors he talked about concerning the APOA and the contract is just that..smoke and mirrors.

What are his simplistic followers going to do now?

This is really a stretch.
Walsh can't come up with something better than that. Well, I guess everybody who helped in Winter's campaign, or Eric Griego's campaign is suspect in this anal 'witch hunt'. Talk about rounding up Jews, or the McCarthy 'witch hunts'in the 50's. This is pure and simple, a reflection into the past, as Nazi Germany HAD to be defeated. His (Walsh)reponse letter was rushed and sounded like a third grader wrote it. John, enroll at UNM or one of our high schools and take a basic English writing course. Can't imagine, you could be a spokesperson for a used car dealer, let alone the APD.

First off, All you APD officers that claim that SGT Heh is only in it for himself and that he and the senior officers are causing a division. Officers that have less then 7years on have no clue about your own departments history !

APD has been divided and fighting with it self since the early 80's.
After Chief Stover retired they brought in SAM "it's all about me" BACA. He taught the officers that were going for promotion the fine art of self-promotion: Compromise your integrity, lie about others if it help's you, dig up anything you can on anybody and expose it to show loyalty, defend and lie to cover your new boss up to and including jail time, (hoping to have it squashed before it gets to court.) try to get your competition fired to clear the way, and of course the liberal mantality and creed; (MINIMIZE, DENY AND BLAME)... destroy, destroy, destroy any and everyone who is a direct or in-direct competitor.
SGT Heh is fighting for you younger officers and you don't realize it. The citizens of Albuquerque are not stupid, they can all see the in-fighting at APD and were all tired of it. It's only obvious that YOU OFFICERS are going to have to take care of your self's. Nobody but nobody in this Administration-elected or appointed is going to look out for you. Your proof is in the contract, how it specifically takes care of the young officers and not the veterans AND the final nail in the coffin is the notifaction of the IA in public at the counsel metting.
Personally if I were APD admin I would of gotten on the agenda and served SGT Heh in the meeting in front of everyone.(sarcastic)..

All I'm saying to all of you APD officers is to say what you have to say in private, face to face and not on this blog, not that this blog is bad but your given the Mayor and your administration the satisfaction of the in-fighting .

Again the fighting has been going on for quite awhile, It's never been checked by the officers or the union, It's easy to make derogatory and condescending comments on this site, but remember that these officers are your back up and if this continues to go down the same road with the same intensity one of you (officers) could get hurt.
IT AINT WORTH IT.... YOU ONLY HAVE EACH OTHER...

The citizens can only back you so much. It's about time the media got involved, if they would continue to put pressure on the administration maybe the wimpy Fed's would look into the evidence room.

Paul and the greedy Sgt's have split this Dept not the contract. I saw the contract the night before voting and I saw it today. I still would vote for it and I have been here for 11 years. There area a lot of people between 6-10 years on that voted for the contract, because we were getting hosed at 19.00. If he had his way we would still have two different pay scales for two officers that have been here the same time. We would only go up to 24.00 after three years..WOW...In three years we would be the 10th highest dept in the state..Rio is 25, SF is over 25, BCSo will be 23 in july, SF County is 26, Sandoval is 23...the list goes on and on. Heh does not spaek for me...the contract passed...so deal with or file a lawsuit and shut up...oh that's right no one will take your case for free..sorry..I used to think the 5th floor was evil, but now I know they have partners. Heh keeps telling the TV, "they didnt get to look at the contract". I think over 350 of us liked what we saw.

Ok that was about a stupid post that Paul and greedy Sgts split the dept. The union and the 5th floor is the people 95% of us are pissed about. We will always 82 eachother, rookie or not. The 350 or so that liked what they saw......give me a break. All you saw was greedy dollar signs and thats all you care about. Its all about me and I dont care who you steal it from. Never give something away in a contract. Youll never get it back. Think about the direction of the city finances. $28 an hour when gas is $5 a gallon along with milk and see how much of a raise you have. Remember when ur stuck at $28 an hour for $7 years like we have been. And what, no longevity to ease the pain. Grow up and think before you open your mouth.

I'm retired (at the command level) from APD so I don't really have a dog in this fight. It appears that there may be some issues with how the vote was conducted that may be valid. But the idea that the younger officers are pitted against the older ones is silly. Both do the SAME job. Of course senior officers have better days offs/shifts/assignments which is as far as their seniority should get them. They will make more more in salary as will the younger officers just by a smaller (maybe too small) a percentage that is structured in a way that for some of them to benefit they would have to stay past what would have been their retirement goal.

This is the way that it has always been. There is a real need to recruit & retain the newer officers (who while lacking the experience of the vetran officers) are better trained (the training improves all the time)& without as strong a tie to the APD are more prone to sell their skills elsewhere. No doubt some younger officers & some veteran officers may be unhappy with each other over the contract because in the end its what is best for each, but the idea that the department is devided (other than in opinion) is just a non-issue.

As for the IA investigation, who knows. Past APD administrations have done similar stupid things. Anyone remember Bruce Macalister? He won a cool half million after being the subject of a fabricated IA investigation initiated by then DCOP Nick Alarid. Bruce was not the only one, he just got the largest settlement. There have been many others who either through the stupidity of APD Brass or at the behest of their political masters have been similar targets. Perhaps the Sgt. did overstep the line, using his position to intimidate officers under his supervision & an investigation is warranted. The problem that seems to plague this APD administration is they just don't know how to handle things. If Sgt. Heh did such a thing than the Union should be raising the issue with the city. The 5th floor was just dumb by entering into the fray. Because supervisors are members of the union, are they not allowed to make impassioned pleas to other members to vote one way or another? At what point would one say that is improper? What cause & effect has occurred? If a claim of a hostile work environment is to hold, then what harm was done to whom? While I do not know all the facts, I am all too familiar with the "conduct unbecoming charge" it is a blanket complaint when no other specific one exists. That tells me that there is a lack of evidence. The CUB an offcer charge rarely sticks when appealed to the city hearing officer because it can be so broadly interpreted.
If a specific violation could be cited it would be.

I have known Chief Shultz a long time, all of his career as a matter of fact. He is a fine person with a great law enforcement mind. He has one flaw though (as does the FSB DCOP) & that is he is loyal to a fault. But that loyalty is a one way street. It runs straight to the Mayor's office. While it pains me to say so, Chief Shultz would knowingly target an Officer if told to do so even if no evidence existed. Its just his nature, he is a good soldier who will follow orders regardless of their moral nature. Its not something that he would do on his own, he is not that type (although some would wonder what the difference is). At his core he feels deeply for all of the APD but that loyalty is superceded by the one he has to the mayor. The question is will this administration (starting at the Mayor) be as stupid as past ones & how much will it cost the taxpayers this time?

That's the awesome thing about the country we live in and also fight for. THE RIGHT TO SPEAK OUR POINTS OF VIEW!! In a democratic society you have the lawful right to question and publicly have opposing points of views. As COPS we know what it is like to be demeaned but when did we become second class citizens with less rights and protections offered by the US Constituion. Since when did we become a China or Russia where government is trying to place a gag on citizens for speaking out against percieved injustices?? Due to the airing of laudry in public APOA has now marginalized itself not only to the members but to the public too. Having a unified membership is crucial to the success of any organization. Individuals become defensive and attack personnaly when they themselves have something to fear or hide. Everyone must agree unless you oppose to transparency and unity that it is time for change. Change in a positive and fruitfull light, and for the betterment of the whole and not for a few. To those within elected positions who feel that attacking the membership or a member is not what this should be about, the theme here is SOLUTIONS!! and how to re-unify the organization not drown it. Ask yourself, what would be the harm in having a re-vote of the contract if that is what it will take to move beyond this.

I posted this before and I now repost without it being a personal attack on anyone and I hope all agree on this issue:
It is time for a total overhaul of APOA along with it's affiliation with the FOP. Since the executive board created and allowed this travesty to occurr then it is time at looking at the options to salvage what is left. Maybe it is time to affiliate with another state/national labor union or perhaps it is time to call for a decertification vote and start all over. The first sounds more appealling and requires less work, I hear from fellow cops from Rio Rancho that they are very happy with their affiliation with the New Mexico Coalition of Public Safety Officers. I have also spoken to the president of that organization and he would provide what ever assistance is needed. He recommended that perhaps an outside Executive Director be hired. I think all options need to be placed on the table since current abilities have been marginalized by this contractual rift. It is also time for the AG's Office to come in and make sure things are on the up and up and put all the allegations to rest once and for all.

All i know is that the union does not work for the officers as it should. officers should have had time to review the current contract before voting. When I went to vote, I saw a piece of paper with some numbers on it! What else am I voting for? Sgt. Heh is trying to fix things for all officers (veteran and younger). He should get all the support he needs because after all he is trying to rally everyone together unlike the union who just does what is good for them. At least he knows how to stand up for what he believes in!

Media, Hold on,,,, remember it was DWI Sgt Rsy Schultz at the time that was illegally padding his overtime when he worked as the DWI Sgt. Schultz was one of the highest paid cops back in 1992-1993, he made way more than chief Stover back at that time! This was all the illegal overtime Schultz claimed he worked.

I also am a retired supervisor for APD. I however, retired before Schultz was chief. However, during the Chief Galvin administration I was going to speak against Chief Galvin. The local news station was going to interview me on some issues within APD. Ray Schultz, who was a Deputy Chief at the time, told me that if I made a public statement about APD's problems, he would give me discipline in the form of days off. Even though this was being done on my own time and off duty. Ray still used the threat of discipline as a deputy chief back then for anyone that spoke up against illegal activity within APD.

I see this is the same Ray Schultz, just with more power. He was a jerk back then and still continues on. This guy has no business being a chief!

When Capt Castro was in Metro he would always tell us how stupid Chief Schultz was and that he could do a much better job as chief. He said the Chief did not know how to relate to the troops and that would be his downfall. Looks like the Capt was right!

Sounds like Sgt. Heh and others may have a good case for Freedom of Speech Violations. Farmington firefighters just won their suit.


Farmington firefighters win lawsuit

FARMINGTON, N.M. (AP) - A union representing Farmington’s firefighters has won a civil rights lawsuit against the city.
A federal judge has sided with the International Association of Firefighters Local 2850, which challenged a 1990 collective bargaining ordinance.

The judge has ruled the city violated the union’s freedom of speech by prohibiting endorsements, no confidence votes in city officials and using city property for union business.

The union and the city have compromised on another part of the ordinance prohibiting talking to city councilors during arbitration.

City Attorney Jay Burnham says that when there’s an impasse during negotiations, the union could make its case when city councilors meet on what course of action to take.

HAAHAHAHAH....The Farmington issue was because of use (free speech) on CITY PROPERTY. Read the whole thing the next you open your mouth. In fact look on nmcourts.com and you can see the grounds for lawsuit.....You must have been hired before the college requirement to effect.

Mr. Debuck is loyal to no one except himself. He plays all sides and then jumps over at the last minute to the winning side. This guy has meet with all the last potential Mayoral candidates so he could get in good each one in case they won the Mayoral election. He may be friends with Mayor Marty, but he also meets with Brad Winter and the others. Mr. Debuck keeps all his options open! He is very politically savvy. He knows how to play the system and win. Just look at what he has done to some of his supposed best friends! This guy knows how to stay on top of the political field and make even the seasoned politicians beleive he is in their corner..... Great actor!

Oh yeah, you wouldn't want cops to be warriors or competitive. To the moron poster above, the karate/competitive/warrior mentality is EXACTLY who you want in charge of cops. If you are not a type A personality (what you called "warrior" ) type you probably ought to go sell used cars instead of toting a gun around trying to protect the citizens in the most violent town in the Southwest. Gawd, the mentality of some of these people around the dept. these days is exactly why you are all being pushed as a group towards a future you all seem to despise. Those guys you are referring to as "glad they retired" you did not like simply because they wanted you to put bad people in jail every day. It was not about politics or promotion or who could get involved in a campaign, (or feather their nests after they left the PD). They (we) just wanted you to work at what the job is REALLY about. I'm so glad you regret what you have now - a milque-toast type of leadership that wants everyone to remain complaint free and out of the public eye as opposed to letting the chips fall where they may and simply doing police work regardless.
A bright Training officer taught me 26 years ago that we were supposed to be "peace officers" but that there could be no peace unless the warrior heart was there to back it up.

Ray Schultz on the news asking for women to join APD! Why would he even want 50% of his force women? I'll tell you why, so he can hold them all down! Ray does not like women officers and never will. He has always been intimidated by them! he does everything in his power to keep them from advancing. He has had this dislike of women since he was a patrolman!

Police need martial art skills and the warrior mentality in order to survive the streets. So I don't know how that could be classified as "old mentality type policing".
In fact, police need that mentality even more now considering the gangsters they're up against every day. The warrior mentality trains you never to underestimate your opponent. Part of the problem is that police sometimes underestimate the intelligence and dedication these scum have in conquering police. Of gang-bangers are meth addicted vermin, so it's hard not to underestimate them!

On that note, why is the Gang Registry empty? You can't tell me there've been no "gang related arrests" since it went up on the net? This is Albuquerque!!

Speaking of background checks, why is cultural services making their 12 year old volunteers get criminal background checks? Does this have anything to do with the sex predators in the libraries?
