Binding or Not?

Contracts are considered to be binding instruments of an agreement between two parties. The two sides involved agree to provide goods, services, or employment based upon specific compensation. The City of Albuquerque regularly enters into contracts with private companies and with its employees. We're beginning to wonder whether or not those contracts are worth the paper they're written on.

Last week we told you about Deputy Chief Michael Callaway's email instructing supervisors to ignore the black letter stipulations of both the current and the new APD/APOA contract (read it here). This week our Eyes have told us about another provision of the contract that is and has been blatantly disregarded by the command staff occupying the offices on APD's 5th floor.

It won't come as a shock to many of our readers that retired APD Captain Rob Debuck is returning to the APD ranks. Back in 2006 Captain Debuck hung up his cuffs to pursue an acting career (ABQ Tribune). Now Debuck is stopping back at APD as an SRO - School Resource Officer.

An SRO is a sought after position for officers who are looking for a stable Monday through Friday schedule without a lot of overtime. It'd be particularly attractive to an officer whose double dippin' - receiving both their PERA retirement and an officer's salary.

The rehire program was instituted to bolster the Field Services Bureau. Both the old and the new contracts place limitations on how and where these officers can be used. The primary assignment is FSB. Further, our Eyes tell us that under the current contract only two PERA retiree officers can be SROs and under the new contract starting July 1, no PERA retirees can be an SRO. Currently, the Eyes have it that there are around 17 PERA retirees serving as APD SROs.

According to our Eyes, the 5th floor has taken the position that we know we're in violation of the contracts... sue us.

All of this makes us wonder whether or not the city intends to abide by any of the contracts that it signs. A lawsuit is certainly one way to force the city and APD to abide by the agreements that they are contractually bound to follow. It seems that there's a pattern developing where APD is willfully disregarding the terms and conditions of not one but two employment contracts.

Meanwhile, we've got a mayor talking ethics reform. We might humbly suggest that The Almighty Alcalde worry more about living up to the city's contractual agreements than creating unenforceable and ineffective ethics legislation. We'd think that ethics would start with living up to the terms and conditions of the binding contracts you've signed... But that doesn't make a very good press conference does it?

I'm not surprised. To a lot of us, a law is broken when rules are not followed. A contract is binding!

Capt Debuck is Chief Schultz' best friend, as well as the Mayor's. The Capt is the one that got Schultz the Chief's job by his influence with Mayor Chavez. The Capt was constantly up here on the 11th floor pushing for Ray Schultz to be hired as APD's Chief, so it does not surprise me that Schultz is paying the capt back. Since the capt retired, we have not seen much of him. However, prior, he was always up here in the mayor's office all the time. We are glad he's was gone, but I guess now he is back. Will he be chasing all the teachers and young girls at the schools like he chased the admin staff women up here. There could be problems at the school!

“sue us” has always been the attitude of this administration at City Hall. Marty doesn’t care, it isn’t his money. Check out the Cities litigation reports (public information). Allot of pay outs for employees and citizens who filed suits and won. The Mighty Mouse will let anyone sue before he’d admit he’s wrong. He just rolls the dice and hopes that he’ll hit seven, or uses covert intimidation tactics to get people to back off, which sometimes work. When the payout comes it’s the taxpayer’s money, not Marty’s, Ray’s, Nick’s or any of the other bullies.

The old adage that “You can’t fight City Hall” is not bona fide anymore. People are sick of the poop this administration pulls and the litigation reports prove it.

It should be a union president's responsibility to try to resolve any contract issues with the government. If he does not succeed, it is his responsibility to file a grievence.
Maybe when he crawls out of Marty's pocket he can ask to borrow one of Marty's pens to prepare the necessary paperwork.

This chief has hired all those bad apples back. So, when people wonder why this department's officers are so down on the administration, here is another reason why. Do as I say, but not as I do mentality from our brass!

This is not just a SRO issue, another retired rehire just came back into IA in the last week.

I wish I could get weekends off and dayshift hours, but Schultz keeps us FSB guys from transferring.

This is why so many of us hate the retired rehire program. It is also why so many of us dislike this chief. He does not set the example. He does not hold himself to a higher standard.

The APOA president has addressed the issue with the DC, then when the DC refused to correc te problem, then City Labor was contacted. City Labor contacted the DC, explained the problem, and was met with the "I'm the BOSS and I make the rules". The APOA then contacted the legal counsel and the PPC is prepared to be filed. The responsibility for this decision and the impending legal action should only fall on the shoulders of DC Callaway for issuing the order and the Chief for allowing his DC to willfully and knowingly violate the contract even after the issue had been addressed. The APOA has taken action. Please inform yourself before you make statements.

And still it continues. Sad situation when those who are theoretically doing things for the city, continue to fill their pockets and forget those of use who put it out for them to steal. If we do something like that its off to jail for us. And the all mighty one thinks he's going to be reelected. Wish on idiot.

So stand up people spread the word, the current administration is NOT to be trusted. Get rid of them.

So you have about 17 PERA employees assigned as SROs and you are now preparing the PPC paperwork. I'm sure these assignments happened overnight.

Rehires are in a lot of slots that some APD Officers would like (cold case unit to name one). Some other rehires some how get placed inside (valley impact unit) for "personal" reasons and then remain there untouched and unchallenged. All seem to be day shift slots with weekends off. Now that Patricia Paiz is retiring I wonder if they will hold her job in the crime stoppers unit until she comes back as a rehire.

The cost of Marty's at will friends is way into millions of $ a year. And for doing what? Taking the mayor to lunch in city vehicles.

Mighty Mouse Marty is talking about cutting cost by not filling many positions that are minimum wage, most at rec centers. If he got rid of his worthless at will bully-buddies he could fill those positions and the city could keep those important rec center postitions.

Or he could build his stupid reflection pond, in the middle of the desert, at the balloon museum. That's certainly a way to save water!!!

Trish Hoffman is getting the choice Crime Stoppers spot. She is a Sgt and the slot is for an officer, but Schultz takes care of his friends. This is a New Sgt that will never see the field and will get promoted without field time. The Chief promotes everyone without field time. So, if you want to get promoted to the next rank , don't go to the field.
