Trouble in the Air

Wednesday, the Albuquerque Journal ran a story on a recently filed lawsuit. Apparently, the city and Bode Aero aren't playing well in the Double Eagle Airport sandbox. Among other things, the lawsuit alleges that the Almighty Alcalde made some shall we say... inappropriate demands last year when he was running for Gov, uh... Senate.
Bode Aero Services claims the retaliation occurred after it "declined to provide free or discounted air service" to Mayor Martin Chávez for his brief senatorial bid in 2007. The suit doesn't provide any specifics about the claim.
All of the Bode hubbub got us thinking about other Aerospace legal proceedings. In this case bankruptcy proceedings involving Eclipse Aviation. You know we've always wondered about the viability of a company built on the concept of selling personal jets. It's not like jets were ever an everyday purchase for your average family. But hey, if there's a market... But apparently there really isn't.

In any case, a few weeks back we received documents from the Delaware bankruptcy proceedings involving Eclipse Aviation. A little disclaimer here. We have been unable to independently verify these documents but they appear to be authentic and if they are the city and the Almighty Alcalde have a lot of splainning to do. You see according to these court documents, Eclipse Aviation is holding a large amount of property owned by the City of Albuquerque. What's most disturbing is that much of the listed items seem to our admittedly untrained eyes to be specialized equipment that the city has no business owning. For example a $128,496 MTS for fatigue and metals testing, a $56,472 LPT laser projection system, and the coup de gras, three paint booths worth over $2.5 MILLION. And those aren't even the highlights.

From these documents it appears there are millions of dollars of equipment in the possession of bankrupt Eclipse Aviation that appear to be owned by the city - much of it specialized equipment.

It looks to us like there are two possibilities here. One is that Eclipse is using a whole bunch of specialized equipment courtesy of the City of Albuquerque (that's all of us who pay taxes in Albuquerque) or two, Eclipse is using the city to shelter assets from creditors in a bankruptcy proceeding. The latter could be criminal, the former... could be criminal -either way, there's a lot of trouble in the air and a lot of splainning to do.

This is the best explanation that we've heard (or shall we say read):
Those are the items purchased with Industrial Revenue Bonds (gross receipts tax free). The City has "bare legal" title to them under the IRB system, but does not really own them. They will likely be sold to pay off Eclipse's creditors.

All of which makes perfect sense, except... we don't see the bond repayment listed in the creditors section. If the city has "bare legal" title, then the city has ultimate responsibility for repayment of the bond.

This is outrageous. The documents speak for themselves, and no amount fo 'splanning' or spin should allow this to be just swept under the rug.
This is illegal in any judges eyes, except of course here in this third world back assward, 'patron' system of government called New Mexico. The citizens should demand that the District Attorney or the AGs office throw the book at the Mayor and who ever else in his administration that is involved in this latest "pay to play" scandal.

Time amd time again, this mayor always gets off the hook. No one, but no one holds him accountable.
That includes the DA, the AG, FBI, the newspaper,the business community and most of all the taxpayers and citizens.
Is this 1930' Chicago? Is he Al Capone? Why is everyone including the above mentioned so afraid.

the EA500 is (was) a great aircraft - if eclipse had been able to actually produce them on time AND the economy didn't crater it'd be an entirely different situation now.

how much do you think a new piston or turboprop aircraft costs?

Nick Bakas who is dirty as they come is the Director of the City of Albuquerque Airport. You know full well that is is up to his eyeballs in this scam. The guy is always making deals that are sweet and will get him extra money or gifts!

He got his job by getting loads of cash from the Greeks for Marty Chavez.

Nick Bakas should be targeted by the Attorney Generals Office. He is a crook!!!!!!!!

The “my way or the highway” Marty just proved his true colors, AGAIN. When he doesn’t get his way, like with Bode Aero, the retaliation starts. Usually covert, but he’s gotten away with so much he thinks he’s Teflon and now the overt retaliation has become clear.

As far as Eclipse:

Why is the bankruptcy filled in DE? Shouldn’t it be filed here? Just looking for an answer. I was thinking maybe they thought if they went to the state furthest away from NM that nobody would find out. Too bad, for them, they didn’t realize the Pony Express is long gone we now have the internet!

On the filing it stated that $4,050,000 worth of land was donated. Was that something Marty gave Eclipse? If so, does it still belong to Albuquerque? Or was it city land to begin with?

Lots of unanswered questions, hmmmm! Marty’s spin doctor’s have a lot of work ahead of them.

Hmm wait a second...When the Mayor seems to be in trouble, ol Pete D and Adams seem to vigorously defend the Mayor but the Mayor can't defend himself? The Bode's are such nice people. This smells of Nick Bakas. He works behind the scenes to do Marty's bidding. However, puts everything in his pockets along the way.

This guy should be in jail for all the corrupt shit he does. When he was the Dep CAO of Public Safety, he covered up the evidence scandal when then pre-fired APD Chief Gil Gallegos was letting those two women steal everything(drugs/money) from the APD Evidence Room because he was having a relationship with them.

He protected his best friend who was an APD Deputy Chief who was trying to rape women while using his badge to do it, amoung many other things He hired the new APD Chief, Raymond Schultz to finish the APD Evidence cover up.

This guy is just as corrupt as they come and now he runs the airport/aviation !!!! Come on people, you put the fox in the hen house, what did you expect him to do?????? Bakas hired Marshal Katz as the Airport Chief. Katz is worse than Bakas when it comes to paying to play and now they are both at the airport. Your problems have just surfaced, give it a few years.

I can't believe Chief Schultz said Albuqerque does not have a SERIAL KILLER in todays paper. We, the Detectives of APD's Investigative Division TOLD him YEARS ago Albuquerque had a serial killer stalking and killing women on Central, engage in prostitution and drugs. He just brushed it off like he does everything else. He is so full of shit, lying to the public saying there is not a serial killer out there. The Chief has us digging out there and wants to try to keep as much of this case as secret as possible, not to alert the public.

Folks, Albuquerque has a serial killer on the loose and we, the police, have no idea who it might be!

WHAT A LYING WEASEL, HE SHOULD NOT BE A CHIEF OF ANY TYPE OF POLICE DEPARTMENT ANYWHERE!

Were you all asleep during the 60's when we learned that "power is with the people"? Why is it that states and cities in surrounding areas flourish while we are ghetto.

New Mexicans suffer with some sort of a inflated sense of self importance. Get over it. You had a few artists stop by and some Spanish come and conquer and Native Americans that live in disgraceful poverty despite government handouts. Imagine the sense of fierce NATIONAL pride those on the east coast feel, where the real history of the country took place.

There are NO problem solving skills here because the races hate each other so much. The corruption is so "in your face" that it leaves honest, law abiding citizens incredulous.

Oh Yes, I am not from here. An unfortunate transplant due to job. We were told when we got here that if we had a complaint, concern, etc, we had better do it on an anonymous basis because the rate of retaliation is off the scale, which I why I guess all of you do everything on this little blog and don't come out in the open to form citizen groups to overtake what is going on here.

New Mexicans dismiss any criticism coming from those not from here. Keep it up. This state is caught in a terrible time warp and we are a national laughing stock.

Is it no wonder we can't get any competent medical doctors here and we all have to go to other states to get medical care. Children are treated like animals; police lie and thieve; animals suffer such abuse and the legistlature can't even pass a DWI law that keeps us safe because they are all drunks or protecting those who are.

Now you can start your rant that I am racist and not from here, blah, blah, blah. But there are groups all over this city that feel the same way who are trying to live their lives peacefully while trying to get to a more civilized place.

Hey Hey, not all of us "Police" Lie. If you knew us, you would realize there are a whole lot more of the good ones, than the bad ones. The bad ones are the ones who lie, cheat and steal to get to the top and those who have no business being a cop in the first place. Many of us just go to work and do our job without thinking about the Schultz and Whites of this world. If we worried about them and what they were doing, we would never get anything done. The lack of progress is because of the stale thinking at the top. Those with good ideas are shut down because it wasn't the an idea that came from the top...
