Payoff?

In the land of Pay to Play, the pay is done by the taxpayers and the play by elected officials. The game is to cover each others, uh... backside and pick up some cash along the way. Wednesday, The Almighty Alcalde and the Queen of Root Beer Floats - Kari Brandenburg - held a news conference to announce that the city was going to pop for a couple of attorney's and a civilian staffer to work in the DA's office ostensibly to help prosecute those that have been prosecuted before.
The city of Albuquerque will start paying the District Attorney's Office $275,000 to prosecute repeat offenders.

At a joint news conference Wednesday, Mayor Martin Chávez and Bernalillo County District Attorney Kari Brandenburg announced that a team of prosecutors will be formed targeting suspects who have multiple convictions. The city will provide funding for the team for one year.
Of course Mayor For Life Marty didn't bother to get council approval he simply committed the money without all of that legal mumbo-jumbo required by the City Charter. More interestingly, the money comes almost a week to the day after Kari's major flip-flop on investigating APD.

Last Thursday the Journal quoted Brandenburg as saying...
"I think it would be prudent for it to be turned over to an investigatory agency so they could look at it," she said. "We are interested in any injustice being done. I would certainly think the circumstances warrant for an independent investigation."
By Friday...
District Attorney Kari Brandenburg said Thursday she will look at the cases her office prosecuted. She also said she feels APD can investigate the allegations involving the reserves making arrests.

She previously said an independent investigation was warranted, but clarified that APD should do its own independent investigation.
Perhaps Brandenburg was no longer interested in "justice being done" because Marty got out the city's checkbook in order to dump $275,000 into the cash strapped District Attorney's office. In the process Marty gets to go out and look like he's doing something to discourage repeat offenders.
One of Chávez's opponents in the October mayoral election, Richard Berry, issued a statement after the news conference saying the announcement was "disingenuous."

"This is nothing more than a $275,000 smokescreen," Berry said in the statement. "In the last weeks of the campaign, Chávez is scrambling to appear tough on crime in the hope that voters will forget his record, but after 12 years as mayor, he has been unable to solve the problem."
Of course none of this makes any sense. The city is going to provide two lawyers and a civilian for one year at a cost of $275,000 in order to get the DA's office to pursue repeat offender sentencing enhancements that they should be pursuing already. Exactly how does it cost more money and require three people to pursue a sentencing enhancement? The previous DA seemed to be able to do so.

The only way this makes any sense is in the context of a payoff. Brandenburg knows that she's facing a shrinking budget (No root beer floats for you!). Marty knows that an independent investigation of APD will turn up all sorts of embarrassing problems with The 5th Floor. The Almighty Alcalde simply can't afford to have a sitting elected official - particularly the DA - calling for an investigation of his administration.

The funny part is that we'll bet that Brandenburg has been had. The money ain't Marty's to blow and by the time the $275,000 doesn't show up the election will be over along with the mayor's incentive to fight the council for it.

Even more funny is that we're hearing rumors that outside parties are already poking around in the PD's past. Marty's move was most probably a payoff - one that Brandenburg will never receive.

Actually, in other parts of the U.S. such as, Louisville, Kentucky there is what is known as a "FAST TEAM," that responds on the scene to crashes involving DWI that cause serious injury or fatalities. The District Attorney in Kentucky has at his pleasure all the Assistant Prosecutors willing to be on call 24 hours a day to respond at the scene to assit Police and the Judicial Process. For example, the Attorney guy that was driving drunk and hit the man in Santa Fe would have been the perfect case to send an Assistant DA out to. Below describes what "FAST TEAM" is all about. (The Attorney in Santa Fe charged with DWI and vehiclar homicide is doing everything to try and get out of it). Excerpt below from DA website in Kentucky.

"At first, some police officers were reluctant to request the assistance of a prosecutor at the scene. FAST Team members worked to gain the confidence of the police, never interfering with the investigation but assisting in the preparation of legal documents, giving charging advice and streamlining the judicial process. Experience has taught that this first-hand knowledge is invaluable when prosecuting a case. Being at the scene and participating from the beginning of the case saves the prosecutor (and police officer) many hours of preparation time. Additionally, the Commonwealth's Attorney's Office is able to more effectively "screen out" cases which do not merit felony criminal prosecution. An added material benefit to the community is an increased opportunity for an expedited resolution of the criminal case. As a result, over the years, law enforcement agencies have come to value the assistance provided by this team.

The success rate of cases in which the FAST Team and the police have worked as a team has been outstanding. Statistics show that the highways of Metro Louisville have become safer since the inception of the FAST Team. In the future, as new opportunities for developing and enhancing enforcement of motor vehicle criminal laws arise, the challenge will be to see that even more defendants who commit felony motor vehicle offenses are held accountable, thus making the highways of Louisville and Jefferson County safer.

In summary, upon notification by police, a member of the the FAST Team will respond to all injury crashes, or fatal wrecks that may result in felony criminal prosecution. Especially targeted are crashes, collisions and wrecks involving excessive speed or the use of alcohol, drugs, or both. (The FAST Team sometimes handles other motor vehicle related cases.) FAST Team members are available for consulation regarding evidence collection, drafting of search warrants and charging decisions"

Actually, the fact that Marty is just now getting to that on the eve of an election.... when lots of other cities have done this beginning in the 1980's just shows you that even though he has been in office for almost a decade..... that he is just now... playing catch up with other cities across the U.S. That's why Albuquerque has had such a problem with repeat DWI offenders.

If you ask me, then that is probably the only way that Marty set Kari up to get any funding.... which was to look the other way on his messes. That program could have easily gotten enough support in the State Legislature, in City Council years ago....

Look, I'm just surprised that Marty isn't promising 275,000 for another Skate Park or the infamous
"Lagoon," to appease his peter pan (in my opinon) syndrome. Ignoring of course the entire teenager female pregancy rate and not finding sports for teenage females.

I like the idea of a Prosecutor called to go to the scene of the crash involving DWI and serious injury or fatality. The Prosecutor will see the accident, the tragedy up close and the smell of the death or serious injury. The Prosecutor will be less likely to make a plea where the guy gets out in a year or something ridiculous like that. People would be less likely to drive drunk knowing that the DA Office would be there at the scene.

I guess its going against the constitution when the judicial of the state (branch) is bought off by the executive (branch)of the city. One tends to wonder what else did the mayor buy? a flip flop from a weak DA? How does city funds pay for what the state should be providing? So know taxes that should be for city are paying to the mismanagement of the DA's office. Can any one say Manny Aragon de Brandenburg?

The Public would be forewarned about driving drunk... if you get that assistant district attorney out of bed at 4:00 am to go to the scene of a crash involving DWI, then you know that assistant DA is not going to forget that come court day!

I actually believe Kari do be a decent person and wouldn' t be involved in something like that.... sure, if you were DA and given money to help your department, then "no" you wouldn't decline. Ok,.... if David Young were to have sex with any of the suspects he arrested, then "yes" I would expect David Young's actions to merit jail time. Really, maybe the Prosecutor should be called out on other calls not just DWI to help police interpret state laws in executing state and city laws!

I am tired of all this stuff, vote our good old mayor Marty Chaves out of office. Adds for the mayoral race are to begin airing soon, interestingly, just in time for early and voting absentee voting, which begin on September 1, and September 8 respectively. I would strongly encorage voters to look with their eyes, listen with their ears, vote with their hands, and in the process boot our good old mayor out of office. Remeber, without the votes for office, our good old mayor does not have the power he is so clearly willing to abuse.

The Mayors debate at the FOP was interesting last night. All three candidates were there and answered some tough questions. Marty Chavez took the endorsement. Marty was the only candidate to support the death penalty and grow APD. Therefore he won the endorsement. Hold onto your hats folks. It will get interesting

Martin may have gotten the FOA endoresement, but Berry has an ad out right now that kicks butt! Romero would also be a decent Mayor, too. Those FOA guys really were just following APOA in the Joey mentality. Too bad, because Martin won't run again for another term and can't win as Governor, Senate or Represenative in Congress. About mid way through his term next term, Martin will
stop caring about the APOA and FOA.
If Martin did say he was pro death penalty and if that's all it took for FOA to endorse him, well then.... he was doing lip service (in my opinion).
In the early 1990's, I believe Martin was against the death penalty. Martin is an attorney and does lip service (in my opinion)! Berry and Romero would be the type of Mayor that would not only run out and get a Hot Fudge Sunday for the APOA and FOA in trying to get another term as Mayor, but Berry and Romero would make sure that the whip cream and cherries were on top, too! (in my opinion). Martin is going to hand the APOA and FOA a melted Hot Fudge Sunday with no hot fudge and no whip cream, no cherries and melted ice cream that is too sour to eat! (in my opinion)

When Martin Chavez becomes Mayor again, which he probably will..... the City is going to run on numerous indictments for corruption followed by a 300 million dollar Trolley that if built, the decent, hard working people in Albuquerque will come to despise the ugliness of the Trolley and the slowness of the Trolley. The businesses will have less money because the Trolley taxes and TIDD's force the small businesses in that area to pay more money. Property taxes will also increas in and around where the Trolley is located. Midway through the term, the Mayor will not have money to give APD or APOA any kind of pay increase. The potholes in city streets will continue to expand as money runs out.... Businesses won't relocate to Albuquerque. The Space Port will be up and running probably in 2011.... the people will briefly stop in Albuquerque, but Las Cruces will generate the most tourism from the Space Port. Meanwhile, Martin will build a Skate Park all for the male teenager... while female teenager pregnancy increases. About midway through, Marty will begin to understand that what he said on campus in the early 1990's in backing term limits.... was what he should have stuck with in 2009 in that belief.

In two and a half years, Mayor Martin Chavez will look at the state of the economy in Albuquerque and realize that he should have stuck with what he stated in public in the 1990's that he was in favor of term limits. Albuquerque's economy will take a huge downfall in two and half years under Mayor Chavez.

Payoff? Pay to play? Tell me it isn’t so. How many times have officers been told to drop the charges on individuals because they had a connection to the mayor’s office? I know for a fact that Animal Control was told to drop charges on two different cat hoarders because they had connection to the mayor’s officer. I also know that APD’s Criminal Nuisance Abatement Unit was told to drop charges on the owner of the Beach Water Park because of political ties. CNAU shut down the Nob Hill Motel when there was no criminal activity and the list goes on and on. I was told that when the Federal Court House was built Marty Chavez waived all water hook up fees. Come on folks you better open your eyes. This same crap is taking place at the local level, state government, and in Washington. It’s both Democrats and Republicans. These politicians forget that they work for us, the people. We need to hold them accountable and we need term limits.

Ok.... if what you say is true...., then Martin Chavez, Nick Bakas and Martin's other "in" crowd need to realize the following story because eventually that kind of behavior will lead to fate turning their lives around in a way that never expected. For example, an attorney by the name of Eugene Sisco, Jr. from Kentucky
went through law school using brail to read because he was legally blind. As an Attorney, he looked down upon the Kentucky people and spent an awful amount of time and money writing, "Translation Guide to Kentucky State Courts and Other Observations from a Rising 3L." The entire contents was about an Attorney coming into contact everyday with people in court and making fun of how awful those folks talked. Well, that was published in 1999 and about 7 years later (every 7 years the entire skeletal bones is completely new)... the Attorney who forced the DMV in Kentucky to give him a Driver's license when he was legally blind was driving and killed a State Trooper in 2006. He survived the crash, but because he felt so intellectually superior in thought, he somehow thought he could drive because so many people that didn't know how to speak in court were driving.... well... now, the Attorney, Eugene Sisco, Jr. is donating all his spare time to helping high school young adults prepare for college.

That is just my observation. So, to Martin Chavez and Nick Bakas... we will see what fate brings to you, too! For all those horrible lies you told to the public... for all your lip service.... well,
"marty for life"...... we will see......

For a second there... I thought the hole that you were referring to was the one at the Balloon Fiesta Park when Marty's plan called for wasting water to build a water/lake, so Council vetoed Martin's wasteful spending.... and Martin left a hole in the ground next to Garduno's on the Green. Recently, the City put up solar lights to fill the space.

Then, I thought you were being sarcastic and by "hole" referring to the female prostitutes.... which if your Nick Bakas, then your used to calling women "NASTY." Under Martin's 12 years, Lorenzo Montoya, was created and the attitude to committ violence against prostitutes began. Nick Bakas goes to church on Sundays and sits in the first pew looking down on females he deems unworthy of Police Protection. Even those women he falsely deems "NASTY" are nothing compared to his low life being that belongs in jail for the amount of violence his speeches has created against women both "Nasty" (true or not true) or not "Nasty."

Then, I read the above comment about "Hole" being the hole in the economy..... could that be the Bode Aviation economy, Elipse economy (until just recently) and GE's economy... all our local business companies dealing with aviation.

Four more years of Marty.... huh.... the taxpayer couldn't take another four more years of violence against females, extortion on an aviation company and the kind of leadership that Albuquerque can do without! Thank you very much!

You just have to look at the obvious... Nick Bakas will get to know those that gives money.... he will gladly keep his door open to those that give money to Martin or him. Nick went around getting Martin money to run for office and basically backs people that donate. Sure, in reading this and if your a Corporation, then the head Executive would get out their Corporate checkbook just in case.
That' s why Martin selected Nick Bakas as Public Safety Director for the City and then Aviation Director for ABQ Airport. Nick Bakas lied in the paper about not being so close to Martin and that is a boldface lie! Extortion is an ugly word. When Bode Aviation
didn't want to give freebies, then Martin cut their contract and did Nick Bakas listen to Bode Aviation or the Martin? Nick knew Bode was getting screwed...., just thought it would be business as usual..... and that Bode wouldn't win in court. Bode did win in Court! Can somebody say indictments are coming......?

and actually... I should have said hole in the ground where those 12 females were buried by that scum bucket Lorenzo Montoya. I'll I'm saying is that the leadership in Albuquerque directed hatred at women believed to be NASTY whether or not those women were actually NASTY or not. The spirit of Lorenzo Montoya was created by Albuquerque leaders such as Bakas and Martin (in my opinion) who seemed ambivalent toward the female plight and suffering and had no business writing laws on females whatsoever!

While it is difficutl to feel sorry for women that can' t seem to find jobs in a line of work that doesn't invovle prostitution... it is troubling to keep leaders such as Bakas and Martin in Office who seem to perpetuate violence against women by turning a blind eye to the problem.

Frankly, it is annoying to see the amount of people living on the streets of Albuquerque who seem to be on drugs, homeless and no place to go and no direction. There are tons of social services available for people, but those steps are not taken until a person is ready.
In my opinion, a change of leadership will offer people such as the females the opportunity for advancement with less worry about violence being directed toward them when we get a new Mayor into Office for the City of Albuquerque! Vote anybody but Martin Chavez.

As a female... just trying to stay afloat, save money and pay my gross receipts, I found the attitude of the Department heads under Martin's administration to be disgusting to a female business woman. For example, while Martin Chavez's Department heads were double dipping and earning more than 100K annually..... one of those Deparment heads believed that other females need to "volunteer" their time instead of getting paid. Sound familiar to other business female leaders trying to present their ideas to the City on how their business could grow and enhance the City at the same time? Well, under people like Nick Bakas and Martin Chavez who basically control everything, then it is unlikely that their opponents will ever get any kind of contract with the City! Well, to that City Department head that expected other females to not get paid for their work and to volunteer their time... I hope that double dipping lands you in prison!

Prohibition doesn't work with alcohol. During prohibition the only place in New Mexico to get alcohol was at the Winery where the Bernalillo County Wine Festival is currently. The deal was struck between the Archibishop of Santa Fe and New Mexico to allow continued sell of alcohol at the winery in Bernalillo because the proceeds helped out the Boys and Girls.

Does anyone know if the Chief of Police for APD did anything to those supervisors that had signed the fraudulent time sheets for that Reserve officer knowing he was a volunteer?
From what I have heard about him, I'll bet he covered it up!

The repeat DWI offenders are always being followed by the APD and are always the targets of APD to meet their quota. If an APD Officer looks up the license plate number of the vehicle and see's DWI arrest, then the APD officer already begins to tail that car. (Not speaking from personal experience as I have no DWI anything whatsoever). That is how APD operates. I'm just wondering if the stats show that repeat DWI offenders are the major cause of DWI accidents that involve fatalities and/or serious injuries.

What if the stats show that it isn't the repeat DWI offenders that is the majority reponsible for causing serious DWI fatalities and/serious injuries, but first time DWI people? What is better something like a FAST TEAM approach to actually having the Assistant DA at the crash scene to look over what that person has caused and to facilitate the prosecution of the person suspected of DWI and causing a fatality and/or serious injury at the crash site in being on call 24/7 to repond to those kinds of accidents to help police at the crash cite? Or, a program that helps the DA monitor repeat DWI offenders? Perhaps, both.

HMMMMMMMMMMM extra money to find out who the repeat offenders are? This is....um what's the word I'm looking for? Oh, yeah..... STUPID!! Every time a case is presented, it includes the suspects background. They order pre-sentencing reports all the time..... $200,000 plus to figure out what we already know.
This is the D.A.'s office pretending to be tough on crime... If there are any Defense Attorney's reading this, here is some advice..... I see Brandenburg on the news at least once a week explaining that a sweet plea deal was given because there was not enough evidence to get a conviction in court. Next time you get a sweet plea deal, go to court because you know they can't win.
This is nothing more than a SMOKESCREEN to make the public think they are doing everything they can to fight crime.... it is an election year and they are telling us that they are going to start doing what they should have been doing all along!

DEMAND MORE! EXPRESS YOUR FEELINGS! AND REMEMBER THIS WHEN EVERYTHING GOES BACK TO NORMAL AFTER THE ELECTION...

And P.d.'s fast strike teams? Give ,me a break it sounds as if they are assigning people from the field to go look for stuff while increasing the response time from lack of Officers. Get people out from behind the desk and put them on the streets!

How Martin got the backing of the APOA and FOA is by promising to get 1500 Police Officers trained and on the streets. If you were a waitress, then your boss hired 2 more people to help with your tables only you wouldn't have to give up any of your tips, but the boss would just pay more to help you out and the customer, then that is what would make the waitress vote for the boss. Doing less work for the same amount of pay. Marty has convinced voters that more police would help solve cases, stop crime and keep a better community and he may be right. Adding an additional 500 Officers would take lots of City money to train and to pay and that is why Martin has fell short of that promise!

Totally agree that it is STUPID!! First of all if there is so much money that is left over why not give the overburden city taxpayer a tax refund or at least cut taxes. What next? Are we going to pay mismanaged APS to assist in their bills? One need to wonder the timing of such a large sum of money going to the DAs office, with only six weeks before the election. The city council should stop the funding which amounts to paying money city taxpayer dollars to a state agency to sway a mayoral election. If the mayor wants to involve himself in state agency then he should go back to state government!

I guess you might be right about the Public Defender's Office at least out of courtesy being informed of DWI crashes involving
fatalities and/or serious injuries, too. Just in case the Assistant Pd's also would like to arrive at the scene of the DWI crash. The Public Defender might feel pressured into also being at the crash scene to protect their client, the suspected DWI driver.

I'm surprised how Louisville, Kentucky could have a Prosecution FAST TEAM without having a FAST Defense Public Defender team, too.

So, is that all for show?

So now that the mayor bought himself two prosecutors in the DAs office to target repeat offenders how will this work? Are county or out of state repeat offenders going to take a backseat? Are we going to have selective prosecution because of city money? Who is going to make those decisions? Will the mayor be given a list of city repeat offenders to target for prosecution? Can defense attorneys raise questions as to why city money is targeting their clients only? Was the money given with strings attached?

called and allowed to send their Attorney from the Public Defender's Office might be a way to keep people from driving drunk because if the very idea of getting a Prosecution Assistant District Attorney out of a deep, restful sleep at 3:45 am in the morning would send out the message to all drivers that driving drunk really will cause you to go to jail.

I just saw a campagin commericial supposed to have been released by Martin himself, but..... I watched the ugly picture of him and kept thinking.... is this an attack ad? I honestly believed that Martin's Chavez's new campaign commericial is more of an attack ad put out by Berry and/or Romero. Meaning... everything that was said in the ad portrayed Martin in a negative light and in his own words..... The background seem to say, "Go ahead.... arrest me on extortion... charge me with extortion.... but realize what I have done for this City." Martin tried to take credit for Solar Energy which really had nothing to do with the Mayor's Office and if it did, then probably wouldn't have selected Albuquerque just like that car manufacturer because Martin usually looses contracts for the City. I wonder if Martin's film crew are pro Berry and/or pro
Romero? Probably from watching the video.

I wonder if the Solar Company would even appreciate it that Mayor Chavez used their business for his "attack ad" on himself?
(in my opinion). If I were that business, then I would not appreciate a potential loss of revenue being associated with that guy, Martin.... who is probably going to be in prison on extortion charges... Sorta, like Manny airing commericials from inside prison on people his has supposedly helped along the way.

The Martin's attack ad on himself.... there is a scene where legal law books are in the background and Martin's dressed in what looks like funeral attire (or reminds one of that).... the books look dusty... like collected dust...I'm just wondering if you were to ask Martin any legal state statutues if the guy would even be
able to recall any information because it seems that after over a decade of being in a role not utilizing his law degree that the dust in background on those books are probably because Martin's dinners, trips to Mexico and abroad, judging Chili competitions, host at numerous social events etc... really probably clouded his memory and no wonder those Reserve Officers forgot about the state law and correct state law interpretations! Look who there leader is? During the ad, I kept thinking if a gust of wind entered that room how much dust would kick up on those shelves... like the great dust bowl!

Notice in Martin's attack ad on himself that he couldn't get the Rape Crisis Center's endorsement or the Commission on the Status of Women. Martin's video website features Martin in natural setting where his teeth look like to belong to some kind of sea creature in how their jagged resembling a dualing Martin and the inner turmoil he most obviously shows on camera.... He grinds himself just like he attacks himself. Martin looks like he is talking to a mirror his eyes are watching the mirror as he talks.... there is nothing natural about Martin. He looks fake. Another Martin attack add on himself.

Martins answer... term limits and what he did to over turn term limits. He was for term limits when he was young and just getting started as a Politician.... until he acquired power and freebies, now he is against term limits. Martin during the early 1990's talked the talk, but now we see he can't walk the walk.

Do you really want to know why Pete Denilli keeps trying to defend the Mayor? It's because it's his job and not because he really believes that the Mayor had nothing to do with it either. Deep down..... Pete Denilli knows that the Mayor has something to do with it. It' s just when you want to believe otherwise and time and time again proven that these people are guilty of lying! Do operate with conspiracy mentalities (except maybe the DA who doesn't) and can and will do things like say somebody doesn't live in the City, but the County and not get their absentee ballot until that person calls again to state just that! I forewarn each of you voting by absentee ballot to call back up 768-3030 and ask if their ballot was received. Each ballot has to be scanned in on the bar code on the outside envelope. That way, nobody from the county can call up and say, "change and updated information." With people like Sandra Richardson running around putting up campaign sings for Martin... we don't need any person with a Sandra Richardson mentality to be and work in the City Clerks office. A tally can be done afterwards to determine if the actual amount received matches the actual amount counted.

For about 1,000 dollars I can purchase lots of creative toilet paper and make a Kinko's Poster sign that reads, "Wipe your behind on Farty Marty's face and feel better." I bet with a $35 business license I can sit outside and sell the toilet paper during campaign season and make a profit!

I own a small business and I would like to have somebody present at a Mayoral Forum to sell "Marty Farty" toilet paper. You will get a percentage of what you sell. Just start off by saying... "GET YOUR MARTY FARTY TOILET PAPER WIPE YOUR BEHIND FEEL BETTER" outloud to people walking in." A small table with the stacked toilet paper will be located near Mayoral Forum. Avoid saying the word, "ASS" we wouldn't want to upset the Democratic party because Romero is also a Democrat and the Donkey/ass is symbolic. I guess we could use the word, ASS afterall.

The news reported that the city of rio rancho is building a state of the art sports complex which should generate quality of life and tax revenue. The city of RR is investing a million dollars for this project. In turn the mayor of Albuquerque is giving the DAs office nealy a half a million (of taxpayers money) to buy two prosecutors and any sway an election. What wrong with this picture?
