Gone are the Days of Diego

The Days of special treatment are over for Firefighter 1st Class Diego Arencón. Tuesday, the Albuquerque Journal reported that Arencón - the IAFF Local 244 Union President - was instructed to report to Fire Chief Breen for assignment. Until Monday, Arencón was pulling down the tidy sum of around $90,000 (read our take here). Not too surprisingly, the suddenly poorer Arencón wasn't happy about the new arrangement.
The union negotiated for the president's salary when it reached a contract agreement with the city in 2008, and the city should honor it, Arencón said. The salary agreement is separate from the main union contract.

Arencón said firefighters "absolutely" will consider going to court to enforce the salary agreement. Refusing to honor it will cost the city legal fees, even though mayoral executives know "full well that their accusations aren't justified."
But don't worry, back in December the members of IAFF 244 re-elected Diego to another term which means so he's still got access to the union credit card to pay for his coffee and trips to the local watering holes (read it here). What will be more interesting is whether or not the union membership will agree to pay for a lawsuit for the express purpose of getting Diego Commander's pay and out of having to do fight any fires.

The side agreement entered into by former Mayor and Not-So-Might Alcalde Martin Chavez was determined to be illegal by attorney and current CAO David Campbell.
In a memo to Arencón, Campbell said the salary agreement:

• Violates the anti-donation clause of the state constitution, which bars the city from providing a gift or aid to someone.

• Might violate state law making it a felony to use or accept public money for "services not rendered."

• Wasn't properly ratified.

• Violates the city's "Merit System Ordinance," which calls for employees to be paid according to a classification plan.


What we're wondering is how Campbell - an attorney - can determine that Arencón's little side deal with Marty is illegal when he's got an even bigger fish - Ed Adams - making a lot more over in Municipal Development.
An agreement signed in 2006, when Martin Chávez was mayor, says Adams can keep his $147,000 annual salary even if he's moved into a lower-level job.

That's where the 2006 memo comes in. Bruce Perlman, Chávez's chief administrative officer at the time, signed a memorandum telling Adams his "rate of pay will be maintained" if he ever returned to a regular city job.
The legal arguments used by CAO David Campbell in the Arencón case look strikingly similar to the ones made by policy analyst and attorney Bruce Thompson on behalf of city council despite the opinion of one of Marty's Minions - City Attorney Bob White - that the Adams' deal "does contain the essential elements of an enforceable employment contract" (ABQ Journal - Subscription).
Thompson's eight-page opinion outlines some potential problems with [former CAO under Marty] Perlman's action:

• It probably violates the city's Merit System Ordinance for employees, which says regular "classified" employees should be paid according to a plan based on their rank and classification. It's not clear that a CAO can "ignore the MSO by issuing an administrative instruction" on someone's salary.

•An administrative instruction that apparently gave Perlman the right to determine Adams' salary came from Perlman himself and may not be valid. In any case, it's not clear whether Perlman complied with it.

• The Adams' salary agreement could be considered a "professional services" contract that requires City Council approval.

• The Adams' salary agreement may violate the anti-donation clause of the state constitution, which prohibits the city government from making gifts. Adams' salary guarantee could violate that clause if it's intended to reward him for past work, and not compensation for future services.

Then there's Lawrence Torres who slipped in and out of APD and like a thief in the night stole a 20 year retirement and two months worth of an $80,000 a year salary from the department aided abetted by Ed Adams who signed a similar "agreement" with Torres.

Look... If Arencóns dirty deal with Marty is illegal then so too is Adams' deal signed by Perlman. If Adams' deal with Perlman is illegal then so is Torres' deal with Adams and for all of the same reasons.

Paying Firefighter Diego Arenón the same as other firefighters and requiring him to well, fight fires is a good start. But while the Days of Diego may be over, those benefiting from dirty side deals with the devil, uh... Marty are still in play and we're paying for them.

I bet a court will rule in Diegos favor on his MOU, a court will rule in favor of APD/AFD contracts if they choose not to open them up for talks.


1. Diego will win in court on his MOU.

2. The Union contracts by both APD/AFD are legal, and binding.

City Legal can posture, and flex all they want, it doesn't make a bit of difference.

To your point of Local 244 members, allowing Diego to use Union money to fight it.... I suggest "The Eye", City Legal, Berry, White, and the rest of City Admin research The IAFF, it's not some piss ant association.

Here's what you're missing.

Campbell isn't going after Adams because they have a "relationship". Adams helped out Campbell and Campbell's clients when he headed up DMD and as CAO.

Campbell CAN'T get Adams because Adams will rat Campbell out if he does.

The "outrage" you're seeing from the Berry Administration over the Adams deal is bullshit. It's a show. Anyone who thinks it's anything else is a sucker.

Your wrong on all fronts. Read the Union Contracts, and or the Merit Ordinance System. I will not be laid off due to the small fact I have over 17 years on the job, and my man #, and Seniority within my Department.

You can pass that bit of "Nation wide lay off" information to Fire Chief Breen. I'm sure he will want to review it for personel reasons as his Son is so new it would affect him.

Thank You for your concern, and please while we are on the subject of depression, and money can you ask Mayor Berry why he needs a PIO (Chris Ramirez), and why each APD/AFD have PIO's but Berry hired another member of the media T.J. Wilhelm to do the same thing?

P.S. The IAFF has huge (money) legal defense pockets.... How much is it worth Mayor Berry, and his deflated budget???

The answer from the City will tell you how fiscally responsible they truely are.

All the re-hires would be laid off first. That's about 120 officers. The only places laying off police officers are where the police departments are overstaffed. There are still plenty of police departments hiring officers because the police officer, like the true conservative politician, is hard to come by.

All the double dippers should be laid off. This will save money and the jobs of younger workers. This must include public safety. There is no hiring crisis in public safety, we have many good vets who would make great cops and firemen if the double dippers would quit and open up those jobs. Our vets deserve this.

I also think all APD officers who are working on computers, doing chaplain work, etc etc etc, should be forced back to field services where they do real police work. I mean isn't having an officer assigned full time to be in charge of chaplains a total waste of police manpower? Cops and firemen need to being doing cop and firemen work, not all this other stuff that civilians could do for a lot less money.

Got to love those firefighters. They have the biggest scam going on and they want even more. Think about it tax payers, we pay them to sleep and essentually only work 8 days out of the month, they get paid to eat and sleep while on a 24 hour shift. What a scam, I bet hey fight like crazy to get to stations in the heaights so they do not get woken up. The only ones I have real respect for are the poor medics who never get any sleep cause they have to run med calls all day and night. Medics should not be on 24 hour shifts but a 12 hour and firefighters on an 8 or 10 like police officers. Go ahead and threaten the tax payers of the city with your frevilous MOU covering your assoc. president, it would be way to much of you all to just do the right thing and ask him to go back to the floor and take the salary cut like a proffessional. everyone is getting sick and tired of hearing about unions and the special deals and priveledges they want while the rest of the tax payers struggle. I say the city should declare a financial crisis and take all the contracts to court and get the District Court to void them.... How about that firefighters?? If Diego is getting all this money from the city and is classified as a firefighter, there is something wrong. Exactly what does he do that justifies the extra money? Too much politics and too many hands in too many pockets. The sad part is that if he is coming to the fire stations, he hasn't made it to the county stations. Diego is the President of the local 244, he should be working for all of the firefighters with both agencies. We never see him at our stations. I sure hope my union dues aren't going to be paying attorney fees for him to keep his salary, when the county firefighters can't even get a raise.

There are so many good candidates apply for APD that Chief Schultz said last year he gets to pick the cream of the crop. APD has no hiring crisis. Old timers that are good cops hmmmmm. Let's see one old timer just sued the city and won for $1,000,000 and he was a lazy slug. Another old timer was drug tested after he was already back and working and he came back dirty for Oxycontin, without a perscription. Most of the old timers are sitting behind desks doing nothing. So don't lie to us that you guys are so great. A lazy bunch is what I would say.

Getting rid of the double dippers has to do with helping younger people get work. Helping our New Mexico veterans, who after serviing 4 years or more come out of the military and can't find jobs. If a military guy retires you don't see him taking a job back in the military. That is what we are saying, if you want to retire and go back to work, go ahead, but don't come back to your old job. No matter what you say about younger officers (they are good officers), they deserve the same chances you had. Move on and make room and help these younger officers out. That is what solidarity is all about. All we hear from the rehires is selfishness. It is all about them. Well I hope the fat lady (richardson) is starting to sing so we can repeal this bad law and move forward.

Rehires are young, then as a taxpayer I think we should change the PERA system to a 30 year minimum age 60 for retirement, just like the private sector. I pay the majority of your retirement contribution. We just changed the teachers to a higher age and years served. Since you cops are so young and apparently you have many more years to do the job, let's save some taxpayer money and change your retirement also.

I also think, as a citizen looking in at this, it is horrible to bring up the two officers who died. Would you care for them less if they were not rehires? These officers can no longer speak for themselves, so don't drag them into this. Stand on your own two feet and debate this issue.

A penny? The last time I looked at the PERA website the police plan employee only pays 4% into their retirement plan. My tax dollars pay the 21%. So if you are unwilling or that dumb to not know the facts surrounding your own retirement you should probably not blog anymore. You need to address issues from a factual standpoint, not from the anger and fake world you live in. If you truly represent the police, then APD is in a sorry state.

Mike and Rich are true police officers. Neither you nor I could ever, or should ever, speak for them. For you to bring them up to try to support your issue is a sign of cowardice. As I stated earlier, I believe fallen police officers (true heros) and their families are off limits.

But what I see on this blog is officers slamming each other and their families all the time. You should hold yourself to a higher standard, You are the "brotherhood" aren't you?

It's the rehires the young officer is knocking down so get back to your home work, the rehires paid alot into their retirement. Unfortunately, there are no greener pastures out there - the state is furloughing everyday peons (not execs.) and a friend in public safety is also furloughed one day a week. The county, forget about it-they pay crap anyway, and the private sector is not a place to work if you have a family, want job security & benefits. So yeah, we are stuck here at at COA at the whim of the contract-violating middle managers who actually have put a temporary worker in charge of "real" city employees (cultural services). We now answer to a temp! We wouldn't still work here if there were greener pastures out there, believe me. So here we are, having a temp. tell us (who have been here for 10 years) what to do! I wonder if it's even legal? Probably is, since the union isn't very concerned about it.

I've waited to see the type of comments before I expressed my thoughts and it seems that you all don't know him like I do. So, I will take you back to a time before he was elected president...

If you guys think Diego is all that, let's remember back to when he use to trade out shifts so he could go play in his little band while getting paid to be on the clock and never paying us back. I could never get him to work for me when I needed it because he always had something to do. This is our "stand-up, honest guy?" Maybe someday we will get paid back! Funny thing is, obviously the majority won the vote for him to be re-elected and he has done some good things but he's a crook, a liar and a cheater who wouldn't know how to tell if he had to. He's one big lie and some of you are still buying his crap. You'll learn! He uses the union credit card for "official" (personal) business and has not had to explain or more appropiately defend his fiduciary misconduct. The other union I use to belong to had the same problem and the union president was impeached and was under investigation by both the international union and the IRS for tax evasion. Are we really going to use our union funds to fight his pay adjustment? This is a win-win for him because he can fight it as long as we allow him since it's not costing him anything. Like my grandfather use to say in regards to accounting "figures never lie but liars figure." WAKE UP Brothers and Sisters!
