Chief Schultz Thinks Seriously, Maybe he Shouldn’t…

In today’s Albuquerque Journal, Chief Ray Schultz publicly took a female’s dignity. A female employee tested positive for alcohol during a random drug test when she arrived for duty last month. According to the article, on Feb. 15, Schultz said, this female officer resigned under “threat of termination.” There seems to be several possible problems associated with this scenario.

Here are a few questions to ask;

Is this case still considered a personnel matter?

Is the Chief supposed to be publicly speak about personnel matters?

The Journal could be considered a “social media,” is this a violation of Chief Schultz’ most recent policy?

Does this employee have a lawsuit for wrongful termination now that Schultz publicly stated that she resigned under duress of termination?

Now that this former female employee has been publicly humiliated, does she have legal recourse?

What gives Chief Schultz the right to ruin this female’s chances of getting another job?

According to Schultz, “we pushed it very quickly through the administrative process.” Is this done for all employees or just for this female employee?

This case appears unfortunate to all concerned. APD prides itself in having a 13-step process to weed out undesirable employees. What happened that this employee was able to get through the process? As you noticed in this story we did not mention this female’s name. It would be hypocritical to point out what Chief Schultz has done and then do the same. Does this smells like another Sam Costales case coming down the road? The Journal article is shameful at a minimum and this female deserves dignity. Every single human being deserves dignity.

The Eye is sure Chief Schultz received permission from the City Attorney, CPSO White and Mayor Berry to disclose this information, right?

Mayor Berry is this true? Did you give Chief Schultz your permission to run with this story on this female officer? Mayor Berry, you knew Schultz was baggage left behind from Marty. It was your decision to keep him, right?

Mayor Berry???

Watch out, rank and file, because they will now use every possible opportunity to present themselves - APD command - as noble saviors of the General Public at YOUR expense. Your lives, your families' lives, your jobs, your rights and your basic human dignities mean NOTHING to these men. By crucifying you individually and as a group, they intend to earn valuable PR points - creating a smoke screen to cover their own unethical and illegal activities now coming to light. This is one of the best posts the eye has ever had. The female officer need to contact Sam Costales and his attorney and sue Schultz again. Just how much taxpayer money is the city willing to pay out, for dumb things Schultz does, before they dump him and hire a new chief?

In the hope that the female officer reads the Eye, here is the attorney that represented Sam Costales. Her name is Randi McGinn and I am sure she would love to sue Schultz for violating another officers rights.

Hello, I watched the entire Sam Costales trial, (I am his sister) and trust me Schultz is not all that intelligent, deviant yes, intelligent NO. If so, he would have prevailed and he did not. I watched him lie on the witness stand and countless other powers that be, at APD. If any citizen heard the things I heard about APD, their SOP's and the IA Department they would have never allowed that idiot Berry to hire Darren and keep Schultz along with a few others. What a lack of judgement that was.

It's too bad that the FBI won't go after Darren White for his shenanigans,with as much Vim & Vigor as they have for Ponzi schemer Doug Vaughn.
Let's see; we now have this Cheyenne girl who has apparently resigned and disgraced over some policy ( which by the way she should have been disciplined internally) but it was certainly not worthy of an article in the Journal and been dragged through the mud like some trallup alky tramp. That will cost us taxpayers an arm and a leg, with no consequeces for their actions
(Ray & Darren) All in the name of throwing out distractions to the real criminal behavior down there.
Then we have an audit where 44% of computers and other equipment is JUST missing. (Gee what a surprise there) We have the "Transparency" web site, that is a joke. Nobody has expenditures posted for travel, etc. Transparency my ass. (Now you see it, now you don't)

How sad it must be for the reporters and journalists that KNOW what's really going on, to have to be silent, because of the policies set by their News Directors. Not all want to play the game in not reporting the truth. A lie is not telling the truth. It can be equally a lie for not saying anything.
So; like in any business or organization, if you deceive, withhold information, or are forced to fabricate a story,lie or swindle someone perhaps in a sales scenario, you should move on to another company or industry to make a living.
So here's the question; channels 4,7,13 and those who work for the Journal, are you amongst those who participate in this and are a part of the fabrication of lies? If so, shame on you. If not, either do something, or move on. Like in any industry, ethics should be one thing that you should never compromise.

The answer to the LEVI question posed above is: YES, according to the news last night he is still being paid his cop salary and still working at the animal jail. This has been going on for over TWO years. So it takes two plus years to do an investigation huh? Sounds like the police brotherhood is looking out for each other. So much for justice and taxpayer waste but then those aren't a concern for cops or APD management anyway.

STEALTH - you wear the union label don't you. While I agree this issue is not newsworthy I also feel it doesn't merit a push for legal action. Any public servant who is drunk on duty needs to be fired without exception. I imagine too the drunk lady cop drove to work. Should this info been released to the public. No, unless some reporter started asking questions.

Who knows anything about this TrueTouch technologies no bid contract that was awarded by Darren.
This story has apparently re-surfaced.
Seems as though Feds are looking into this one now. Supposedly TruTouch was a large contributor to Darren for his Congressional run and campaign contributions were not reported properly. Send in what you know to the EYE.

Re: Alcohol Treatment is no longer an option. Which side of your mouth are you talking from? You said, every time an officer gets into trouble it’s a personnel matter. Personnel matters are not for public disclosure or are this employee’s medical condition. Schultz’ disclosure violated several rules, policies and laws, like HIPAA. This was not the “rats” leaking information to the press; this was the Chief of Police Ray Schultz. Question is, are you calling Schultz a “Rat,” if you are, I agree completely.

Larkin was arrested for shoplifting, true. If I remember right it was less than $10, but a crime is a crime.

But, he reached an agreement whereby his either was allowed to resign, or the department agreed not to release his termination information. Someone in the command structure went ahead and released the information to another potential employer, and he didn't get the job.

If you agree to keeping certain personnel actions private, then keep them private. Drinking or stealing is wrong, but releasing confidential information is just as wrong.

Two wrongs don't make it right, even if you are the Chief.

Was alcohol just detected or do they have an actual level. It could have been mouthwash or something else. If it was just detected then watch out Schultz. OK, here's a question for APD personnel. I was married to an officer for 6 years and we have a child. Our marriage ended because of his affairs. (Yes, you can include TH in the equation.) He paid me about 1/3 of the child support that would have been required for a few years and then none, but I haven't pursued it because I make a decent living and he's threatened that his resentment at paying would affect his relationship with our daughter. My ex and I have remained 'friends' for her sake, but I never understood these ethics. From what I picked up, both affairs and lack of responsibility to family seemed to be part of APD culture - the brotherhood. What do you all think? Is this right, or am I just jaded? And if I am right, maybe when you clean your house of White and Schultz, you could all take some individual responsibility for creating a new morality you can be proud of. Just a point to put on the table. And BTW I have great appreciation for the work you do. Thank you for that.

There is only ONE reason the city settled. they were ordered to produce information on various officers that had been caught in extra marital affairs and were not disciplined at all. In fact, one actually was promoted from sgt to lt after he was caught in an affair with a detective that worked for him. HE WAS HER SUPERVISOR! He was relocated, no discipline and then promoted to LT! She killed herself.

Then, you have another female that is on camera a lot that has been caught at least THREE times in extra marital affairs. One, the other officer left his wife (of many years)got married, then caught her with another officer, they get divorced. Now, shes caught with a big wig and guess what, he is leaving his wife (of many years).

You have a SWAT officer that is told to stay away from the academy after he was caught with an officer there. A LT actually caught them in the parking lot and guess what... NO DISCIPLINE!

This "code of blue" is so very rampant in the higher ups, because they are involved in these extra marital affairs. Maybe APD should mirror the military view on adultery. demotion, loss of pay, actual discipline! The chief prides himself on saying officers are held to a higher standard, but is that only for what benefits him? For what it is worth, I would go for the full support and the PERA, not out of spite, out of the fact that is what you deserve. The relationship with his daughter is just an excuse for him. YOU PLAY, you pay.

Shame on the city for settling the Tera Chavez lawsuit.

As a citizen I would demand the command staff and lower officers at APD, be put on the stand, and under oath lets have them speak about the culture of infidelity that has eroded APD for the last 15 10 years or more.

It was always bad, but under Chief Gallegos adultery rose to a new level at APD. I would like to hear the testimoney of Chief Schultz and past deputy chiefs and commanders to what they knew, and what they have done. It would be an eyeopener for the citizens.

But it won't happen, City hall takes care of their own. They already were on the losing side almost $1,000,000 with Schultz (the Costales case), I am now sure that they will settle any lawsuit where Schultz might have to take the stand. Too bad that the citizens don't get to know the truth.

apd didnt have to produce anything on affairs, brad hall was going to have them tesfity in person. he was going to call so many cops to the stand it would of showed a pattern of past paractice. when we say past, we mean past, like 15 years. everyone knew that the suit would be settled out of court. anyone hear what brad hall's fees are? of course schultz dont' care he let hall do all of his depo's then it was settled and we still had to pay. oh but he has his squeeze i forget, sorry kathy.

I saw it coming, that a PIO would be promoted only to be PIO. Mayor Berry, Darren and Ray are all responsible for paying a Sergeant's salary to someone doing an officer's (at best) job. Why not put the sergeants or officers in jobs that are an integral part of police work, and hire a reporter to be PIO. Judging by what new TV reporters make, it would be about 1/2-2/3 of what an officer makes. Or do it like most professional organizations. The higher ups rotate being on call and take turns being PIO in addition to their duties. It is only fair. The officers are going to court on the hours and days off, why does the command staff get all the perks with no additional responsibility? Thank you to the officers who put up with this crap. You make me proud to have worn the badge, not the buffoons in charge.

PS putting real monkeys in charge might be a better idea...

Hello - It starts at the top and filters down. When you have good people at the top for role models, who abide by the law instead of thinking they're above it, then most will follow suit (not all, but most). Look at the stuff we read about with these 3. If even 1/4 of it is true, heaven help the city of ABQ. How much more do the taxpayers want to pay out in these troubled times.
