Governor to Change "Ethical" Judicial Standards Commission, to "Unethical" Judicial Standards Commission

Newly elected Governor Martinez ran a strong race only to politically shoot herself in the foot. Martinez appointed Albuquerque’s Public Safety Director, Darren White, to the Judicial Standards Commission. This commission must be comprised of a person’s high ethics. Governor Martinez, this appointment gives you an "F." It is also rumored that White is set to be appointed to another commission for athletics. White has a string of questionable ethics violations dating back to his first political appointment.

White in 2003 partnered with current Senate Candidate Heather Wilson and TruTouch to develop an alcohol detection machine. White used $1,100,000.00 to develop and purchase three machines. White never used the machines claiming that TruTouch never showed them how to use them, however, in a signed Bernalillo County document; White claimed that his department was part of the field trial use of the machines. NMDOT later purchased a similar type of machine for $13,000.00 each from TruTouch compared to White who paid $126,500.00 per machine. When including the development of the machines, White spent approximately $366,000.00 for each machine he authorized his department to purchase. Our current ethical Sheriff, Dan Houston, has called for an investigation into the matter by the New Mexico Attorney General.

White was investigated by the New Mexico Attorney General in 2008. White allowed APS high ranking officials to use the NCIC data base to conduct background checks on their girlfriends and whistle blowers in APS in order to harass them. In one article located by the Eye it claims, “The Attorney General's Office found that Darren White, personally, had broken the law, the NMIPRA, in his effort to suppress the truth.” You get that part about "suppressing the truth" Governor Martinez? In 2008 White also received money from TruTouch for his campaign for Congress. White was trampled by Congressmen Martin Heinrich. The money TruTouch gave to White was not immediately disclosed causing other troubles for White and the County.

More recently Darren White was at the center of another debacle where Sheriff White and the County of Bernalillo will have to pay out $3,000,000.00 for the Sheriff's Department illegally seizing money from different people. The City of Albuquerque Police Department under the watchful eye of Chief Ray Schultz already paid out an additional $882,900.00, as reported in the Albuquerque Journal. $3,000,000.00 Governor; let's spell this out in plain clear language, Three million dollars!

The newest questionable ethical caper by White is the Brad Arensfield federal trail. It is alleged that White may have leaked information to a target via his girlfriend, now wife. In a story only seen here on the Eye, we talked about Arendsfields’ recent appeal. The story states in part, "In the appeal, Mr. Bryan admits that the information received by his wife was via White's wife. Mr. Bryan states that he was provided intimate details from White’s wife, which was provided by her husband, Albuquerque’s Public Safety Director, Darren White. Mr. Bryan considered Darren White to be a friend, another allegation White denied on the stand."

And last but not least, White has received two "NO CONFIDENCE" votes. The first one was from the New Mexico State Police and the second blow was a vote of "NO CONFIDENCE" by the men and women of the Albuquerque Police Department. White should have three; one was scheduled to be conducted by the Bernalillo County Sheriff's Department but White left before it was done. Governor, if the cops think he is unacceptable, you should be following the facts presented.

Governor Martinez appears to be a very bright, sharp, educated and a seasoned professional with a potential to rise to a much higher level. Now that she has a self inflicted political gunshot wound to her foot by her own choosing; her chances of running again or gaining support for anything is dismal at best. Did Governor Martinez do her homework? Is the Governor going to now change the name of the commission to the "Unethical Judicial Standards Commission?" Does the Governor really want her name tied to Darren White? White out of respect for himself and every citizen of this State needs to resign and step down. Governor Martinez, wake up, based even on the appearance of impropriety you should rid yourself of this cancer. If you leave this appointment; the "bar" will be lower than dirt. Bear in Mind Governor Martinez; you are only as strong as you weakest link. This newest link is as flimsy as a cheap single piece of toilet tissue.

What baffels me the most is why does the general public fall for your crap? You use a script everytime you talk and act as if you care when you don't. You couldn't handle a 20 year career as a full time certified peace officer, so you put on kneee pads and sucked up to Gary Johnson, I'd like to see What Gary Johnson has to say about you?
What alot of people don't know, is how angry you were when Pete Deminici was supposed to retire before his last term. Had he done it when planned, you might have been able to pull off a win in congress. But Karma has a strange way of working it's way into our lives. The only question now is, what kind of karma is waiting for you after the Brad story and all the other things you have done?

Well let me say this, as a lifetime dues paying member of the Republican Party you sir are the picture of corruption, the poster child. Because of you I am dropping the Republican Party and registering as an Independent. Becaue of you, Schultz, and Berry Republicans all, you have destroyed my faith in the Party. Now it appears that Gov. Martinez is in bed with you. I will not be a part or support this culture of corruption, which New Mexico is famous for. Last in education, first in corruption. I wonder how many more of the Grand Old Party feel the same.

Please everyone who knows the truth call this number! The person I just talked to listened and was very receptive. She said they had had several calls already about this and she would let the chief of staff know. This appointment is sickening for all the reasons listed here and so many more. City, Fire and Law Enforcement I was not asked ID info, so no need to worry about job risk - just do it!!

In today's journal - it states the texts didn't start until after the investigation had been thwarted. Don't you think that shows they at least knew each other and Darren and his wife could have been giving a verbal heads up about the investigation. As a juror, I would seriously questions why "Peaches" would be involved at ALL. I think this at least spells perjury for Darren - if he stated he didn't know the Bryan's.

Pick for Judicial Panel Draws Criticism

The governor has named five individuals with strong ties to law enforcement to the commission that judges the state's judges, with sometimes controversial Albuquerque Public Safety Director Darren White heading the list.
Gov. Susana Martinez this week filled five of the six slots available to her on New Mexico's Judicial Standards Commission: White, the former two-term Bernalillo County sheriff; former Albuquerque Police Department deputy chief Michael Castro of Los Ranchos de Albuquerque; Malinda Williams, executive director of the Community Against Violence Inc. in Taos; Larry Tackman, ex-director of the Crime Victims Reparation Commission; and legal secretary Darla Wax of Las Cruces.
The 11-member commission includes six lay members appointed by the governor, two attorneys appointed by the Board of Bar Commissioners, and three judges, including one magistrate, appointed by the state Supreme Court. Rules governing the commission require the chair and vice-chair to be selected from the lay members.
The commission is charged with investigating allegations against judges of "willful misconduct in office." It conducts hearings and makes recommendations to the Supreme Court about disciplinary action. Commissioners are required to keep all matters pending before them confidential until documents are filed with the Supreme Court.
Earlier this month, 2nd Judicial District Judge Nan Nash — a Supreme Court appointee to Judicial Standards — ordered White and Bernalillo County to pay more than $3 million in damages to people whose cash was seized by officers working on a drug task force. She found White violated the New Mexico Forfeiture Act by depositing seized funds with the court clerk's office. White has said the decision could have a "chilling" effect on law enforcement partnerships and an appeal is possible.
Another judge found White failed to enforce traffic laws on the West Side and awarded damages to the estate of a man killed by a jail transport officer in a traffic accident. That case is pending before the state Supreme Court.
Bill Lang, retired chief judge in the 2nd Judicial District, said it's the governor's prerogative to appoint whom she wants. Her new appointments are "not altogether surprising given her background" as a prosecutor, he said, adding "Law enforcement is a little unusual in my memory."
Albuquerque trial lawyer Ron Morgan said he has heard lawyers around the state express "serious disappointment" that the governor would appoint a person who was recently found to have violated the law.
"His fitness to be a judge of judges has not been proven by his conduct. I hope the governor reconsiders this appointment," he said.
White defended his position on the commission.
"I'm not surprised that a liberal trial lawyer who has contributed tens of thousands of dollars to soft-on-crime and soft-on-corruption Democrat politicians would be opposed to a career lawman being on this commission," White said.

After reading today's paper, I wondered; what a disgrace it is that someone of Darren's ilk has risen to such power.
His appointment to Chief Public Safety Officer comes to mind.
This position should not exist.
If he wanted to be the big cheese, then I guess he should have been made police chief.
But no, as a favor to Ray, his cohort, he makes a deal with our newly elected mayor to keep Ray and to keep the Public Safety Director position. A very costly endorsement, one that we will all dearly pay for including mayor Berry.
The South valley coalition groups protested both of these individual's roles as racial profilers to no avail. It is now up to the Democratic party, The Eye on Albuquerque and the FANS of the Albuquerque Police to expose the injustices that these individuals have done in the past and continue to do presently as well.
Appointment to the Judicial Review Commission; WHAT A JOKE. Seriously, can this really be happening?

As a life long supporter of the Republican Party and of Darren White, I no longer can condone or support this individual.
In the past year, I've had too many conversations, have been presented with too much evidence, that suggests that Darren White is not the honorable person I was lead to believe. My background is not law enforcement, but in the private sector. I don't follow these blogs religiously or seldom at all. From all that I know now, Mr. White is contemptuous, self serving and would not trust him to watch over my house, let alone the public safety of this city.
Now I have to wash my hands and turn my back.

There was lots to like about Darren White, the Albuquerque cop Gov. Gary Johnson put in his Cabinet as public safety secretary back in the mid-1990s. The young Army veteran took a gung-ho approach to the job, as Northern New Mexicans soon saw: His was a high-profile presence in the multi-agency raids that were a strong response to the concerns of Chimayó residents under siege from drug gangs.

White got a taste of what norteños are up against one day as he got out of his unmarked, but antenna-laden command car: A local thief dying for a fix came up and offered him a good deal on a leather jacket — stolen from an Española store. Busted. For a while, at least, the drug scourge was lifted from Chimayó — and he's not forgotten in the Santa Cruz Valley.

Secretary White relished his crime-fighter role, and the attention that went with it. Politics appealed to him, and he appealed to voters — especially right-wingers: He was twice elected Bernalillo County sheriff, and is a darling of the law-and-order bloc.

But halfway through his second term, he got the itch to run for Congress — and was solidly thumped by Martin Heinrich for our state's First District seat in the 2008 election. Now he's Albuquerque Mayor Richard Berry's director of public safety, where he's received a vote of no confidence from the police officers' union — a badge of honor, to many people's way of thinking.

But as sheriff of our state's most populous county, he did no great honor to the office, it turns out: He was especially generous to a campaign contributor, buying drunken-driving monitors from him that proved worthless.

Worse, his war-on-crime zeal drove him to order his officers to seize cash and property from people they arrested — before bothering to charge them with a crime. His callous regard for the Constitution, and his failure to return money to his arrestee/victims, got him taken to court — where a judge found him and the county owing $3 million in confiscated assets.

But such behavior must be music to the ears of our new governor: Susana Martínez has appointed White to the state Judicial Standards Commission. That supposedly bipartisan and independent commission investigates complaints of judicial misconduct.

For the commission to have any credibility, its members must be absolutely above reproach, and they're expected to demonstrate judgment untainted by partisan politics.

This guy plays to the tea-party gallery with great gusto. He was an active campaigner for Martínez, and appeared on TV commercials with her. Pretty clearly, he's got some political payback coming — but Judicial Standards? That's crazy.

The governor should return to her senses — and huddle with White over a graceful exit from the commission. She ought to consider another appointment for him; one where he can complement her prosecutorial enthusiasm, and one necessitating his resignation from this position where ethics questions come up so often.

Saw the Darren interview on KOAT 3/25/11 reference his appointment to Judicial Standards Commission. What a joke,making it look like democrate against republican. Here is a flash for you KOAT,it is about right and wrong. How can you call yourself a news agency ? I am a life long dues paying republican party member, soon to become independent. I called Gov. Martinez Office to voice my discust in Darren White. I spoke about Brad Arensfield , Tru Touch, and votes of no confidence, seizing of money, and oh yes never being a real cop much less a real veteran. The man I spoke to never asked my name but I would of given it to him if asked. I never thought I would say this, but it is time for all true republicans to leave The Grand Old Party and become independent. I will not renew my membership in the republican party for 2012.

The APOA should definitely write a letter to Gov Martinez and issue it as a statement to the press, expressing their ""disappointment"" in White's appointment to the judicial ethics committee, and referencing his Ahrensfield trial perjury, TruTouch, cash seizures, and the no confidence votes at the very least. This appointment is a real slap in the face of APD rank and file, very unfortunate. Please don't take it laying down. There is another issue brewing around Mr. White.

As arguably the top Public Safety Officer in our state, I would like to know what role he played in allowing a federal agency (BATF) to operate an illegal gun running operation (fast and furious) in Albuquerque and collaterally across our state?

This unauthorized/rouge BATF operation allowed thousands of weapons to cross into Old Mexico out of the BATF’s reach and control into the hands of criminals, which eventually resulted in the death of a US Boarder Patrol Agent.

Did Mr. White allow the BATF to act in such a reckless manner in our state or did he not know of this illegal activity? Either way, I believe he holds some responsibility for the Agent’s death by not doing his job and for endangering the lives of the citizens of New Mexico for some time to come.

Darren White will be the sole reason why so many loyal Republicans will leave the New Mexico Republican Party. If this continues, the candidates running for Senate, Congress will surely be left in the dust by their Democrat opponents. We need every vote we can garner for those upcoming races. If Darren White remains a player in this party, I'm afraid he and he alone, will be the down fall to the Republicans in winning these elections.
Wake the hell up candidates, he's not worth the baggage. This is no joke.

Either Darren isn't getting any sleep or someone ought to check his meds to make sure the one's he's taking are prescribed or are illegal.
That interview last night showed him in very bad condition. If he's stressed or worried (like he appeared) then there is something beneath the surface here. He showed signs of a person very much worried about something, as he should be. NONE of this is going away, NEVER. Questions are circulating all over as to his ability to lead and hold his current position let alone be appointed to yet another super critical position to serve on the Judicial Review board.
Whether Sam Bregman is a Democrat or not, should have no bearing on whether or not Darren should serve on this board. If it does, then why are so many Republicans against it as well?
Channel Seven's and the Berry administration's attempt to spin this story into something positive failed miserably.
Resign now, quite while you're ahead, it WILL only get worse. Save our governor the embarrassment as well.

COMMON SENSE AND A PRACTICAL VIEW

Let me as succinct as possible. This is my first time placing a comment, so here goes. I don't think this blog has followers of JUST "Twelve Angry Men" as Chief Schultz suggested on an interview several weeks ago. I also don't think it's just police officers upset over take home vehicles or pay raises. The word in my circles is that this Darren White debacle has some very serious implications, that are just below the surface and will have some very serious ramifications. As a life long Republican, who has been very involved in my party's causes, I'm concerned of it's future when the party ignores what's going on here. If Gov. Martinez doesn't see it, then we as a political party are in trouble. Mayor Berry, in my opinion is a lost cause, as I'm convinced he knows what's going on.
Does the Governor really understand what's at stake here? If so, and she too ignores this, then we, in fact, ARE in trouble.
Elections have consequences its been said, and until this party realizes the fracturing that has occurred, prepare for some major losses in the future. As an observer of recent Republican forums, caucuses and conventions, Mr. White has systematically attacked members of his own party and has created such a polarizing and divisive atmosphere that I'm not sure we can survive as a party that's capable of winning elections anytime in the near future as long as he is involved.
Because of his own insecurity and jealousy, his antics are reminiscent of a grade school bully. (Just ask the thousands of Allen Weh supporters)

If Public Safety Director White, spent more time doing his job, which we pay him well, then going after gangs, drug dealers and other criminals, instead of putting out fires and covering up turds in the sand box, should be his FIRST priority.
That's not going to happen folks, He's "political" first (and not in a good sense) and a lawman 2nd(that's up for interpretation)
His reputation and his actions of past and current are so indignant that it has left many of us "Loyal Republicans" very much dismayed.
As I said above, elections have consequences; so when I go to the polls next time I will vote for whats RIGHT, not WRONG.
I cannot in good conscience support candidates that support this man,political party aside and political party be damned.

I've known plenty of people who have lost everything because of drugs, and he appears that he is going down the same path. Sooner or later, everything is going to come crashing down. First, Please don't tell me the new Gov has no idea what's going on. After all Ray was on the news crying about it. Curiosity alone would have directed her to these sites. Meet the new boss - same as the old boss. Corruption is at its best with these folks. It has nothing to do with party and everything to do with values and ethics and these folks have none. Darren White should NOT sit in judgement of anyone based on his track record. Ray Schultz should have been fired after he was found guilty of violating Sam's civil rights and it didn't even make it to the review board. Please - they all knew and know what is going on and it continues.
Darren is right about one thing he is a BIG boy - porky pig comes to mind when I look at the slob!

Wow, just watched your video on the fans page. Darren looked like a psycho freak one min, then angry mad, in some shots he looked like a jacked up Jim Carrey, then a jack-o-lantern the next. What is up with that grill? Ever hear of a dentist? I am sure the city plan has that on their insurance. Darren keep living the "BIG BOY" lifestyle, you gonna end up on America's Most Wanted soon. Sure looked like a criminal on KOAT. But then again if it looks like a duck, walks like a duck, I am pretty sure it is.

Bravo Eye, for continuing to bring to light the continued craziness in local and state government. I would suggest, however, that as mentioned in an earlier post you really need to get back into the habit of citing your sources when quoting others. Especially other media outlets. Doing so will only enhance your credibility. Keep up the good work.

Patients with combined cocaine and alcohol addiction tend to exhibit the most severe oral disease conditions and symptoms, such as severe xerostomia, advanced periodontitis, many decayed teeth, many missing teeth, and severe tooth attrition from bruxism. Oral manifestations of cocaine use include reduced salivary secretions, increased dental caries, abnormal tooth-wear patterns, and acute gingival inflammatory effects. Brushing wouldn't hurt either.

The bags under his eyes, puffiness and dark circles are usually symptoms of no sleep, staying awake all night, the absence of proper diet. However, research has concluded that drugs may be a contributor as well. The drug types vary, and again,especially when combined with alcohol.
Every man above 50 should have yearly physical, including a colonoscopy. Mr. White, for his own sake should have both.

Finally the Albuquerque Journal (editorial) said something right; that Darren White is not the right man for the Judicial Standards Commission.

Governor Martinez, are you paying attention? Your future may ride on this decision. I for one will not vote for you again should you allow Darren White to join the commission.

Todays Albuquerque Journal reports that Governor Martinez will stick to her selection of Darren White. I assume she thinks little of both the Albuquerque Journal and the Santa Fe New Mexican editorials that came out against her selection. Probably thinks only Democrats read them anyway.

I won't forget Governor. You can count on this independent voter NOT casting a vote for you. And I did vote for you.

Another comment on the editorial page of todays Albuquerque Journal. This one comes from a Republican who was the former state director of corrections. The title of his comments says it all: "Integrity Must Come First in Public Office." He then comments on the likes of Bill Richardson, Manny Aragon, Rebecca Vigil-Giron, etc; then hits on Darren White's nomination. Our governor needs to wakeup.
