The Piercing Truth

This is right from the dictionary and seems to describe Albuquerque, Berry and Schultz. Fascism (f ash ,izem) noun An authoritarian right wing system of government and/or social organization. (in general use) extreme right wing, authoritarian, chauvinistic and/or intolerant views or practices. Fascism tends to include a belief in the supremacy of one group over another, national, ethnic, especially social strata or monetarily; a contempt for democracy, an insistence on obedience to a powerful leader, and a strong demagogic approach. Downtown Bars= Full Immunity, Isn't That Right Mayor Berry and Chief Schultz?

Chief's Overtime is a program that seems to benefit many. Theoretically, private businesses contract the Albuquerque Police Department to provide a security of sorts for their business or event. The business pays the City of Albuquerque $52.00 an hour for officers and even more for Sergeants and Lieutenants. The City obviously profits from this service, as it is well known that the Officers do not make near that amount. Some businesses, like Graham Central Station, rely on Chief's Overtime Officers to maintain a safe environment. In fact, the opening and continued operation of Graham Central Station was contingent on the employment of officers at their business.

Recently, the Chief of Police,Ray Schultz, ordered that ALL contracts with liquor establishments be immediately null and void and no longer honored. Scratch that, not ALL businesses, just those businesses that Chief Schultz ordered. For example, contracts with Tumbleweeds and Graham Central Station are no longer honored, however Chief's Overtime is still applied at all Lobo functions and Isotope games. For those unaware, all Lobo events and all Isotopes games sell alcohol.

Now for the really big twist; the Downtown district (a district famous for the large amount of bars in a relatively small area) is provided with FREE police service. By free, we mean the bars do not pay the city a SINGLE penny for the exclusive use of an entire police squad; sometimes more. For example, EVERY single Friday and Saturday at least one ENTIRE squad makes themselves unavailable for calls for service and is ordered to stay solely in the downtown district.

Is the crime downtown SO BAD that it needs ENTIRE squads to be there non stop during operational hours? The answer is simple, YES! One on Saturday (October 8, 2011), while the bars were open, ONE squad handled nine dispatched calls, ten on site calls, one misdemeanor arrest, ten separate disturbances, and four separate fights. One of the fights was so violent that the victim had to be transported to the hospital with a skull fracture. On August 26, 2011, there was one stabbing, one Fire Marshall call (overcrowding at the One-Up bar), a tasing call, four traffic stops, ten separate disturbances, three misdemeanor arrests, two investigations, one theft, one traffic problem, and eighteen on site actions. In fact, our Eyes tell us the Fire Marshall is dispatched EVERY week due to overcrowding.

This is just the tip of the iceberg, these are just two examples and the Eye has many more statistics involving downtown. With all of these problems, why is the City allowing the businesses to remain open? Why is the Criminal Nuisance Abatement Unit allowing these businesses to remain open when in fact, they violate the Nuisance Abatement Ordinance EVERY SINGLE WEEK?

According the the Ordinance, "A public nuisance shall include and is further defined as any parcel of real property, commercial or residential, that is the subject of or that has been involved with calls for service to any law enforcement agency(ies) for violations of the criminal statutes cited in § 11-1-1-3(A) defining public nuisance and shall include a repeated pattern of calls for service and complaints of vagrants, suspicious persons, suspicious cars, general calls for welfare checks, disorderly conduct, domestic violence, domestic altercations, domestic disputes, loud parties, loud music, neighborhood complaints, noise ordinance violations, and public drunkenness and shall be subjected to the imposition of penalties for public nuisance as provided by § 11-1-1-11 ROA 1994."

Chief Schultz and Mayor Berry have thrown a wool blanket over everyone's eyes. They are turning less violent businesses away, and are allowing VIOLATING businesses to thrive, and even provide FREE security. The city has once again discriminated against. By allowing this to continue, the city has shown a complete disregard for the safety of its officers and the safety of the public. Next time you make a call to 911 and the officers take a long time to respond, just have a peace of mind to know that they are probably taking a long time responding as they are too busy dealing the havoc, chaos, and violence of downtown. A havoc, chaos and violence that is not only condoned by the Chief of Police, but financially supported as well.

Funny never see any command staff downtown getting their hands dirty. They are probably to busy viewing video of officers trying to keep the peace and keep their families safe.

Berry we all know you read this site can you tell we are begging for new leadership?

FYI homicide detectives havent solved their cases. Start providing cases because we know that FSB catches them or dna seriously Barboa? Why is everyone leaving violent crimes.

Mayor Berry, you led us to believe that Marty Chavez' police chief would be gone if you were elected, what happened?

Ask the Downtown Action Committee why downtown businesses get free service and skate on violations

Doyle and Woolever just got fired because Ray Schultz wants to show us how he bends it over his strongest cops. Is this for real???? Schultzian Logic: It's ok to leave a position of cover and shoot a guy with a butter knife but it's NOT OK to kick a fleeing felon wanted for murder. Or is this another Levy Lie???

Where is the APOA in defending these cops?

Good luck Albuquerque, you're gonna need it.

Of course the downtown bar district isn't getting shut down! Where would Darren White's wife go if the bars weren't open? Duh!

Berry you say you want transparency are you kidding me? Have you not looked at APD. Let me give you a few examples, openings are pre-determined, we have Sgt's and Lt's going TDY to positions to ensure that they are later placed in those positions. APOA you arent off the hook either. The CBA needs to be enforced that means all the narcotic detectives that have been there for 10 years need to be transferred.

There is no transparency in APD because we are to corrupt and ass kissing.

Ray Schultz wants to show that he is "in charge" in trying to supposedly clean up his force. Well, he just fired two of his best officers. Heard it more than once about these two guys. Chief and his co-horts don't like the truth when it looks them right in the face. It's like the devil when he sees the crucifix. He doesn't have the spine to support what actually happened that night and support what these officers had to do to apprehend this well-known felon. This did not have to go down this way if he knew how to do his job. I know that to some people the video might not look good but these officers got the job done where others failed. There is reasoning behind these actions...which is the truth... which isn't being told by APD and the press. The articles aren't even anywhere near the truth. Who knows what else this Blume guy would have done if not apprehended. Chief is lucky he wasn't faced with one of these officers losing their life that night. He put this thing out there months ago and now he and the press have created a crap-load of lies within less than 24 hours. How does it take 6 months to investigate this "very short" video that was secured at the suggestion of the officer that night. Did you all know that? Was this investigation a project for those involved toward gaining their law degree? Well,I think they all failed the course. These two officers are good officers and did good police work everyday. What enjoyment is gained by ruining their careers and lives. Remember everyone, there are two sides to this issue.Unfortunely, you all are only being exposed to the lies.I hope these officers get the support they will need to get through this ordeal. Be safe. I apologize for being wordy.

Yeah, Eye. Where is the Criminal Nuisance Abatement Unit? How is it that there are 8 detectives and not a damn thing gets done? Lack of intelligent leadership? Lack of supervision? Lazy detectives and scared leaders? Yes to them all. Wake up 5th and 11th floors. Make some worthy, wise changes.

I see where Chief Schultz was guest speaker today on a series called "School to Careers, Professionalism in Criminal Justice". How coincidental on a day he took away the careers of two of his own. What a joke.

I had heard about the large APD and AFD downtown presence and went out to see for myself one Saturday night this last summer. It was pretty amazing to see close to 25 or so officers and firemen getting off for about a half an hour watching a very inebriated young lady in a very short skirt sit in the drivers seat, where they had hoisted her up, of a full size fire engine. It would have been a real crime if she had fallen out and landed on her face in the middle of Central Ave. I don't think the firemen's helmet she was sporting would have done much to protect her.

After watching the video of two criminal cops committing assault on a handcuffed suspect I find it more than disturbing to see so many of our fascist police force supporting these rightfully terminated criminals. No matter what a POS Blume may have been , there is no excuse for what is shown in that video. Now lets see these two former cops prosecuted to the fullest extent of the law ................maybe then you officers will learn you are not above the law and the public will not be putting up with your bullshit much longer

Actions like are in that video are why the public now pulls out their cameras ever time you clowns puff up your chests and want to play tough.

How can any officer defend the actions of these two officers? The first officer appears to do what he needed but the second one is WRONG. Therre is no need to kick a person that many times to make them comply. As a retired APD officer I am embarrassed by these actions. I don't know why the first officer was fired as it appears he was trying to cuff the suspect but the second officer deserves to be fired. How can the citizens trust the officers when they can't even be honest about this bad video

The EYE is right on yet once again. I know because I worked that area command . Downtown at night is a very dangerous place and I have the statistics to prove it. If anyone would like to see them contact me. Any other business in the city would of been shut down long ago,but downtown businesses are permitted to continue with the rampage of violance and criminal activity brought on by alcohol and a complete disrespect by some for the law and the rights of the public. Please don't blame The Nuisance Abatement Officers, In my opinion I am sure they have their orders of hands off. You can disagree with me, but I lived it. On another subject Schultz is on a rampage firing officers, some without due process. I guess he needs to show how he is cleaning up the department by firing good officers. So far I have been in contact with three of these officers and have sent them to a very renounded civil rights attorney. If you want the name of the law firm contact me and I will set you up. Dont allow Schultz to ruin you and hurt your family, FIGHT BACK ! No I do not get anything for setting you up with the law firm nor would I accept anything if offered. I take that back, I get the satifaction of helping these officers. It does not cost anything to talk to the attorney and find out if you have a case. By the way the A.P.O.A should have to pay for you to defend your termination. Now you know my opinion I welcome yours. I will not respond to anonymous comments.

The problem with the two cops video is the subject was not in handcuffs yet...he was not bringing one hand out from under his body, and he was wanted for several major felony warrants. Perhaps they should have just shot him dead...that seems to be sop for the Schultz-ites in APD..these officers brought him in alive to face justice.

Anonymous said...

Exactly, why was the first officer fired? He was doing what he was supposed to do...cuff the subject. Don't know why the second officer was kicking him, perhaps they were concerned about a gun that he was thought to have had...that was later found in the vehicle he had wrecked, as if he had dropped it out of his pants as he fled. I feel sorry for the people of Albuquerque...with a "kinder, gentler" police force I'm sure the Southeast will become a war zone again and gangs will run rampant. Ya'll get what you deserve!

Anonymous said...

Why didn't Berry fire Schultz after the Federal Jury found him guilty of violating Sam Costales civil rights?

Anonymous said...

The fellow has multiple warrants, in a stolen truck, and had a gun in the truck. If he wasn't subdued, what do you think he was going to do? Putting myself in the officer's place, I would have chest-bumped too. It was a dangerous situation and they handled it.

Until two years ago, downtown bars and the Downtown Action Commitee NEVER got a free ride. In fact, the Safe City Strike Foce closed down, prosecuted and convicted the owner of Club 7 on Central for code violations. The owner was latter indicted for felonies. Other down town bars, including the Library, were force to enter into nuisance abatement agreements whch required more secutity and bringing their properties up to code. The Safe City Strike Force closed down and demolish three of the most violent bars in Albuqueerque that became a nuisance: the Blue Spruce, Rusty's Cork and Bottle and the Last Chance. When Berry was elected, he put Darren White in charge of the Strike Force and it never was the same. Darren did not view Downtown as a priorty and he was more interested in the camera.

"Stop crying!"- President Obama said...

I don't get the intent or context of this story either.

I to have been downtown and yes I have seen individuals that were in no particular order; drunk, loud, obnoxious, fighting, cussing. So what? Albuqueruque downtown bar scene is no worse than any other downtown such as Denver, Phoenix, Dallas, Las Vegas, Nevada (downtown/strip), or Austin, Texas.

Is the point of the story to point out a problem that the police chief, the Mayor, and or bar owners need to addresse or is it to point out something else? No matter who the Mayor is or the Chief is APD will still be assigned downtown during the weekends. The taxpayers and business owners expect it as a matter of fact every beer purchased downtown has a gross receipts tax included. Why is that important? It's how your (APD/AFD) salary is funded.

What's more disturbing to me is the intentional gawking of some of the patrons of these establishments by both departments AFD/APD on weekend nights. Your wives and girlfriends would not be too happy with anyone of you if they were to take a stroll down there while some of you were on duty and watch how some of you act in that enviroment. No it's not all of you but yes it is the majority of you who act like a bunch of lurking pervert mooks in uniform.

I got an idea for APD/AFD. One is stay off of Central unless dispatched to a specific addresse for a call for service. APD can post a makeshift command post and perform a walking presence from there however; AFD absolutely has NO NEED to park a fire engine, ambulance or ladder truck in the center lane of Central unless they are dispatched to a specific event/call. Once the event/call has concluded immediatley leave the area and return to the station that is 5 blocks away. Secondly allow cabs to park on central in the center lane to move the drunks safely from the area. This has long been rebuffed by APD because of the "what if" war stories. Cabbies stay with their vehicles if their ever is a "what if" situation tell them to move their vehicles.

I as a taxpayer could care less about who is or isn't paying chiefs overtime. APD and AFD should not be crying about anything to do with pay. The salaries of you individuals were released for all to see on the city website in this down economy and job loss you men and women of both departments are doing just fine overtime or not.

I was horrified when I saw the video. There are two sides to every story, of course, but these two blowhards have not told their side and it is doubtful they ever will. They don't need to - the guy was handcuffed and got the holy shit kicked out of him. If I had a choice, I would rather be shot by APD than kicked half to death.

Anonymous said...

Defend these officers? HA! Easy, the actions are justified. As a retired APD officer you should know better. Are they kicks as you call them or foot strikes? How many kicks does it take to render somebody unconscious? Not many, yet this officer sends a dozen or so foot strikes and still the subject continues to fight. Why is that? Because they are not targeting the head and they are not kicks.

And yes oh wise retired officer, I have seen peopled kicked in the head. If you haven't then I guess that speaks for your Hx on the force.

APD, just sit in your parking lots and wait for dispatches. Act like firemen and wait for the call. Your chief will not back you. Never has, never will.

Anonymous said...

To Retired APD officer and to the post above yours...You need to be embarrassed by the leadership of this APD. You are just as blind as they are when it comes to the truth. These officers told the truth from the beginning and provided the video. You really need to look a little more closely to see where these kicks were placed. Maybe it would have been better is they shot Blume instead. Blume's hand is in the waist band until they got it out according to the video. No kicks were thrown after that point.I know when I look at the video, I don't see any kicks thrown after he was cuffed, do you??? Also, from what I have read on Blume and his demeanor that night I believe if he had the chance he would have shot these officers and not looked back. You are looking at it from the rotten side of the fence. It is very, very, sad. I can understand what you see when you look at this, but you unfortunatly are not being told the truth because your APD doesn't want anyone too know it. These two officers are being used as the examples for the APD to defend their past actions and to now hire the "meek and mild officer" age 25 instead of 21 who will have more maturity. OMG !!!

Anonymous said...

Blume never went unconscious, continued with unruly behavior all the way to the hospital, and inside the hospital, and was released after being checked out due to the auto accident he was involved in. Hospitals admit anyone who has suffered concussion or who has lost consciousness. The scrapes on his head are all unidirectional and consistent with road rash. If you watch the video, you can see him land face first and slide on his face. That was a punch, not a baton to the head.
He was high as a kite, he admitted it along with drinking a 40.
He was wanted for the murder of Brandi Kent inside the Quality Inn Suites located at 1500 Gibson SE on 1/30/11 at 9am. If you search channel 13 for the surveillance video, you can see him on it and read about how he was listed as a suspect in the case. SOMEONE PLEASE TELL US WHY APD IS SITTING ON THIS INFORMATION AND WHY IT WAS NOT ANNOUNCED THAT THE PERSON IN THAT VIDEO HAS BEEN APPREHENDED!

NEWSFLASH

Schultz's press flunky TJ Wilham and Journal reporter Dan McKay spotted Downtown today at 2 pm sharing a very long and leisurely lunch.

After, the two strolled south on 7th street before sauntering into the Journal's satellite office on Silver.

WHAT'S WRONG WITH THIS PICTURE?

McKay is the Journal's beat reporter for City Hall. His job is to report on waste, fraud and corruption at City Hall.

So what did McKay report when Wilham WAS FIRED, had to TURN IN HIS SECURITY PASS, TURN IN HIS LAPTOP, had a NERVOUS BREAKDOWN in the MAYOR'S OFFICE and was DRIVEN HOME AND PUT ON SHARP'S WATCH because everyone thought the Pillsbury Doughboy was going to OFF HIMSELF?

McKay wrote NOTHING.

Hope TJ and his $85,000 a year city salary picked up the lunch tab, Danny Boy. It's the least a john should do for one of their tricks.

Everyone who knows the truth needs to step up now. This is the time.
Just think about it this way. You could be the next one getting thrown under the bus for doing your job. Nobody could catch this criminal. His street moniker was "quick" because he liked to brag about how the cops can't catch him. No one caught him till this and now two cops get trashed for risking their lives to catch this criminal. This guy is beyond criminal. If everyone knew a fraction of how bad this guy was, there would be no issue here.
Think about your families being exposed to someone like this and the length these officers went to capture him. Think about what could have happened if he gained access to that hotel full of families that night. A severe swat situation was avoided by the actions of these two officers that night. Think about this before you condemn someone for doing what few can do.

"Funny never see any command staff downtown getting their hands dirty. They are probably to busy viewing video of officers trying to keep the peace and keep their families safe."

Second guessing the actions of good cops. A pure disgrace. Maybe they should take their lying sacks out on the street and try arresting a violent felon. Does anyone even believe in taking "in progress" violent felons into custody anymore? Seems like it's all about report taking and lip service. This world is doomed.

To the nut ball above who would rather be shot to death then kicked half to death, it appears you may have already had too many kicks to the head for you can't see straight. You are pathetic. In that video, Blume was not handcuffed at the time of the kicking and was not treated for any injuries due to the kicking. Did Ray or Beth watch the video with you? That might explain why your seeing things differently then the rest of us see it. You people really need to wake up about what is happening here. This is certainly going to affect how officers react on the street.

Where was the union on the issue of the two fired cops? They weren't there...the union and its president are tools of the police administration, how else could you explain their inability to enforce their collective bargaining agreement? If all the officers that are truly upset, left the union, and joined a national representative group, then without dues, this do-nothing group of Schultz yes men (& women) will go away. I do have info about the subject that was arrested in the video...he was taken to the ER to be checked over for injuries that might have occurred when he wrecked the stolen truck he was driving. If people would look closely at the video they would see that the foot strikes were delivered to his left arm, still under his body, and his side. If those footstrikes had been aimed at his head, he would not have walked out of the ER. But there are cop-haters that will always think the worse and it is fascinating that no media outlet tried to get the cops' side of things! How can a man found guilty of violating another's civil rights still have his job, much less pass judgment on other cops? The hypocrisy in APD is rampant. How could this incident have initially gone all the way through the chain of command and all involved state that the officers followed sop? Where are these cowardly supervisors? APD officers, take this to heart...your sergeants, lieutenants, and area commanders DO NOT HAVE YOUR BACK! They are all tools used by Ray Schultz. Find other jobs and let the "fine" people of Albuquerque muddle through.

No wonder the general public considers APD criminals. You earn that reputation every time you ignorant tools open your mouths.

I hope you idiots realize ever time one of these incidents comes to light it makes your job's even more dangerous.......If I saw a APD officer in danger at this point, I would just turn and walk away and not think twice about it.

How pathetic. Does anyone here see a pattern??? Schultz exclusively uses The Journal and it's affiliate channel 7 to spread his lies, disinformation and propaganda. Case in point, Channel 13 should have gotten that video first in regards to the FOIA request. Schultz and Levy got together to give the journal exclusive through their inside man at APD to Proctor, so that they could control what was released. They spun the article in a slant towards the officers to paint them in the worst light they could. There are so many lies in that article. It is pure fiction. Woolever is not holding that suspect down. He is fighting to get his hands behind his back. Where is this imaginary baton? Woolever punched that guy. It doesn't look like that guy went limp at all. It looks like he tensed up as resisting. Looks like He was kicked until Woolever could get his cuffs out and get his hands cuffed. If the officers think he is going for a gun, hecould have been shot. This guy wasn't even admitted to the hospital. I don't think he had any injuries other than his scraped up head from the tackle.

Sgt Heh - although I totally respect you - are you kidding me - that Union stick up for an officer. Really? They also settled with Sam (my brother) for attacking him. They stood shoulder to shoulder with White and Schultz. Haven't watched the video of what happened with these two officers, so I hesitate to comment, but APD is rampant with abusive officers and the majority of the force who did speak out, also attacked Sam. Problem is when good officers cross the thin blue line their career is over, so thank goodness for videos! Perhaps, one will think before they act like the judge, jury and executioner.

Anonymous said...

WOW! Speaking of the freedom of information act, I would be willing to bet that this whole circus was staged around that.
I am beting that if someone files a freedom of information act on the freedom of information act forms filed by the news channels for that video, they will find out that Schultz and Levy waited until the Journal's FOIA request was approved even if all of the other media outlets were approved before the Journal's... just so that it could have been released exclusively to the Journal. The reason being that Schult's stories are always slanted in his favor with the Journal and Channel 7. He only speaks to them because they report his lies. Maybe all of the other news channels should look into this. It seems that this was staged from the beginning. Those officers have their hearing with the chief, the video is released the next day, then they are fired. All a little too fishy. The article states that the video was released by Levy to the Journal after their FOIA was recieved. I wonder how many people were in line before the Journal. This smells rotten as hell, and is an obvious staging in an attempt to try these officers in the media.
You can lie for only so long. The truth on this crap is going to come out.

Beth Paiz lied. There are several people who know that she told those officers that they had nothing to worry about, and that they would be fine during the entire investigation. Murray Conrad told the truth. This will all come out. Now they want to say that they watched some bullsh:t enhanced tape, she sees something different. I watched that tape. I didn't see 13 kicks to the head like she said. It seems alot of brass are going to be eating it on this one.

The answer/solution to APD/AFD problems (appointed leaders) is at the ballot box. The stories written here or in the Journal are of no use other than to line the bottom of ones bird cage.

Collectively both departments need to come together and start discussing a favorable Mayoral candidate. The Republican party/McKlesky machine will stick with the hand they currently got which is Berry. Get a majority of members from both departments to include their families and start the opposition discussions with everyone you come in contact with.

Politicians from both parties dislike opposition cohesiveness, planning, and dialogue. They know it typically spells defeat at the ballot box.

To the criminal officers that consider "foot strikes" good police practice Here is something to keep in mind has you abuse the citizens

“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529

“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).

Concerned citizens are making sure the public is aware of these legal precedents..............

The days of rampant abuse of power and excessive force by APD will end

We are watching recording and prepared to take action when necessary.

To the anon poster above accusing officers of being criminals.

First off, arresting someone with over 10 felony charges including kid napping, robbery, aggravated burglary AKA HOME INVASION, aggravated battery with a deadly weapon, Homicide, and a few other charges along with being an armed felon eluding the police in a stolen motor vehicle with an accomplice and reaching for a weapon is hardly the kind of person you describe in your case law. Educate yourself before you rant about something.

Kicks may not be politically correct, but they are not an illegal tactic. Officers are able to use any means necessary to gain control of a violent subject especially when that subject poses an immediate threat of great bodily harm or death.

It is a shame that you feel that you need to come to the aid of a murder suspect who is actively resisting the police and reaching for a weapon. Maybe someday you will do that, and the bad guy will show you his appreciation by shooting you when he is finished.

Your outlook is very sad, especially with the growing rate of violent crime in America. There are so many officers out there that would risk their lives to help any citizen being victimized by the criminal that was apprehended that night. Those two are a prime example. God knows who would have been killed or injured had that person not been captured that night. I seriously doubt that the people blindly judging those officers could have accomplished what they did that evening. That is why he was on the loose after getting away from officers so many times.

To the person who thinks supporting criminal behavior that endangers the lives of the citizens of Albuquerque.....

Walk a mile in a Police Officer's shoes before you judge them........

....And know all the facts before you speak.

The damage is done...two careers destroyed...all the bitching on this web site will do no good unless it is followed up with actions. One officer under threat of indictment and the second, having had one ass't DA state in the media that his actions do not cause him "pause", Schultz is now shopping for a corrupt ass't DA who will do the 5th floor's bidding. How are the officers trained in the academy to handle such situations? Why doesn't someone there speak out? Easy, they fear for their jobs from the administration. Truth is buried because no one is willing to come forward. Officers, don't be proactive, answer your calls, do not drive more than 10 mph over the speed limit as SOP requires, do not engage on foot chases, let a "kinder, gentler" force come to the front. Albuquerque already has a national reputatioin for being a violent, crime-ridden city...why should APD try to change that? Schultz and Berry love it that way. The best way to allow tyranny to reign is for good men to say nothing!

Are we really at the point where we reduce the crimes of a suspect so that we can increase the charges against the cop. Are you people out of your fucking mind??? Itvsurecseems like that's the case with Schultz's attack on Doyle. Great department RayRay. Well done.

It is so great to see that there are those who truly believe in those officers and are speaking out against those that have no understanding of what occurred that night or the truth. The truth has been told over and over but APD doesn't care to support it or speak the truth. It has been discredited with lies and assumptions. It is great to see that people are seeing right through the charade and lies APD has put out to strenghten their so called reasons for firing the officers. Chief Schultz, you have insulted the intelligence of your officers and the citizens of your city.

To law abiding citizen ........... well the record is clear you just have to look at the details of the dozens of recent police shootings to see, no APD officer is willing to risk a scratch in the line of duty much less give their lives........

Great post and great citations of case law! I noticed all the uneducated cops could just criticize but had no substance to their arguments. The same old rhetoric from the boys in blue...if you don't agree with me, then it's me versus you. Get over the playground politics boys and be adults....adults take responsibility for their actions while kids point fingers to the others in the playground trying to pass blame. APD and these APD posters must have sore fingers from all the pointing lately? Lastly, are you guys really justifying the actions of these knuckleheads..Doyle and Woolever? Let me recap...foot pursuit with a possible murder suspect, vehicle thief, etc...suspect gets caught, beat and cuffed....All that, and yet he was never searched and cleared of any weapons from what appears on the video. In fact, they make it a priority to "chest bump" but no search on his person for weapons and/or drugs. I bet if Doyle or Woolever would've had their asses handed to them by this guy then you guys would be condemning them for a lack of officer safety. Once again, APD's credibility = 0!

Anonymous said...

Chest bump??? Really???Chief Schultz stated in that video that they did not know what happened in that video. He also stated that the officers said that they checked on eachother. It seems that Schultz put his little spin on that to paint the officers in a bad light. That seed was planted to villify the officers and nothing less. Watching the video, the one officer doesn't look too good after the struggle. What it actually looks like is one officer walking into the other one. It doesn't seem like anyone is passing the blame. The officers themselves wrote what happened in their reports. It is comical how the chief speculates and assumes what happened that night. That is what this comes down to??? It's a shame that two officers defend themselves, and take a known violent felon into custody without shooting them, and still no one is happy. Nothing but a bunch of armchair quarterbacks who wouldn't even attempt to engage an armed felon. OR occupants of the 5th floor playing the propaganda game.

You all need to get the word out on this. This investigation was dirty from the start. Schultz re-opened it after it was already signed off on by the current chain of command of these officers. Re-opened it hoping it would take the heat off of him and his inadequate leadership that has brought the APD down. Ray, I think your treachery may come back to bite you in the butt soon. I pray everyday, that you will be seen for what you really are and what you have orchestrated here and you pay dearly for it. No one directly under you has a backbone to speak out against this. There was one, but you got to her. The outrage I feel when I hear what you have done and continue to do to these two officers actually makes me sick. I firmly believe what goes around comes around and everyone will pay for their evil ways in this life or in the next life.

Chief Schultz has tripped over himself when speaking several times last week over that tape. You fire two officers, call them liars, criminals and trying his damnest to get an indictment and then when talking about the so called belly bump, he "assumes" they belly bumped. How can you assume something like then when you just destroyed their careers. He never ceases to amaze me.

@ Nov 21 10:07am.

Those citations are weak Was Blume a fleeing felon? Yes. Was he resisting arrest? Yes. Was he known to be violent? Yes. Did he sustain any significant injuries? No. Was he the recipient of deadly force? No. Is the video a mere slice of what happened? Yes.

Go shut your pie hole and the assumptions your little brain is making.

Those officers have more honor in their ass hairs than Schultz and his punk Feist who are actively trying to stick it to them.

Happy Thanksgiving and Merry Christmas to the upper command staff of the APD. May you treacherous scum choke on a turkey bone.

They didn't fuck over two bums. They fucked over two good cops who were hard workers and everyone knew it. The outrage has just begun over this.

If my assumption of a "chest bump" is what you are talking about then I apologize. They indicated they were checking on each other and hugged. That doesn't negate the fact that these officers overlooked some basic officer safety protocols. As I mentioned in my original post, if these guys would've been hurt by the offender then you guys would be criticizing their officer safety skills. I watched the video again and didn't see them check him for weapons once he was cuffed.

Anonymous said...

And that officer safety issue is probably a sanction 7 in the SOPs. A verbal reprimand at most, Not reason for accusations and lies after dealing with a dangerous and tramatic situation, then realizing that your partner is ok. Every person, especially the snake that made it up should take a long hard look in the mirror at themselves. Cowards...The whole slandering bunch of them.

Anonymous said...

Now we have a super tactical special forces operator on here critiquing officer safety skills. Well...high speed, why didn't you catch Blume. The entire APD along with BCSO were looking for that guy forever. Every time someone chased him, he got away. Seems these guys did what a whole hell of alot of other people couldn't do. And just the two of them. Not an entire tactical team. Maybe you could do better huh? I am willing to bet that guy was checked for a gun. The video ends with Doyle approaching him. Why was that video stopped there? I can't wait till the truth comes out on this one.

Anonymous said...

The suspect was checked by weapons when other officers arrived. Woolever had chased a very fast suspect for a long distance, struggled with a resisting suspect, cuffed him & stepped away to catch his breath and speak on the radio. It sounds as if you are a Schultz Yes man....okay, does not checking a suspect immediately for weapons deserve dismissal or is is in the sop to have other discipline? I have frequently seen officers cuff a suspect, put him in car and then later go back to search him. This situation was used by the administration as a smoke screen for other problems. I am more concerned about a cop shooting an unarmed man because he had an ashtray in his hand...isn't that what tazers are for? Schultz is very selective in his "discipline" and all those who fall in step with him(Paiz) are as unethical as he.

RE Nov 23 5:41

At least you got backbone to apologize. You can't see what they're doing so leave it at that. That's the point, the video is incomplete. He is searched--this video doesnt show it. And sad as it is, you may be right about the crowd here, I have no doubt if they got hurt then folks we be goin on about their safety skills.

To 11:21 @ 5:51 A.M and 11:22 @10:07

Well, how does it feel to be so pompous and righteous in your posts, police procedures, and quotes of the law. You must be part of the "The Club". No matter what went down that night, no matter how much you quote law, these officers did their job. You don't like the way it looks and it might not be by the book 100%, but they did what numerous others failed to do. I believe there were several times previously that Nicholas Blume was pursued by APD they all failed. I guess Officers Woolever and Doyle should have turned their heads that night like so many citizens of ABQ accuse their officer of doing. Lets think of what Nicholas Blume would be up to right now if he were not in jail. Maybe another murder, robbery, drug violation. How about this, what would he have done if he got himself back into that hotel that night. I believe he was staying there at one point.

Sorry it wasn't by the book people. So, make understand, not patting him down and checking on Woolever is a justified cause to fire these officers, call them liars, and now try to now make them out as criminals. The treatment of these two officers by APD over the last six months was criminal and for you to call them "knuckleheads", you all deserve what this leadership brings to this city.

I see the eye does not appreciate a hard hitting comment regarding officers Mongtomery and Kelly and their shooting cases. What are you afriad of "Eye"...the truth...I appears the "Eye" just might be on the side of Schultz when it gets down with real officer criminality and lack of adequate investigation and punishment.

Anonymous said...

Could Officer Leah Kelly possibly have something on someone (BlueDress)like SO MANY other females 34's have had in the past???? That is why her shooting was justified. Plus she likes cigars just like the owner of the famous Blue Dress did. just saying..........

Anonymous said...

If any one of those who criticize and Monday morning quarterback those two officers were to have just a five minute conversation with the two of them, they would know just how stand up they are.
The last thing they would be doing is calling them names. they served Albuquerque well.

Anonymous said...

Ask Mike Gutierrez in IA about Leah Kelly, he knows all the intimate details.Fto SHAGG'N an RO is bad juju.

Anonymous said...

That guy in IA is criminal itself. APD is one big integrity flaw and it is all supervisor related.

Anonymous said...

IA needs an enema... This Gutierrez guy sounds like a real SCUM BAG he's an APD Sergeant??? The Department is circling the bowl and no one is reaching in to save it...

Anonymous said...

give Sgt. Gutierrez a break, he's married now, he goes to Church, and is a devoted Christian, hahaha wonder how long he'll keep that act up before his old ways reappear...I'm sure the advice from his bestie Hindi will help. LOLZ
