Is There No Line He Won't Cross?

The Eye has been keeping tabs on the APD Social Media Policy that has recently come out. We have yet to figure out how Chief Schultz is able to overpower the Constitution of the United States. It seems that officers are not allowed to voice their opinions, about anything. This includes ALL officers at ALL times regardless if others know their profession or not. Officer Pete Dwyer was recently terminated for his personal rants on a social media outlet. Although his opinions were to many tasteless and racist, they were after all his opinions. The same opinion and freedom that has been guaranteed to us by the Constitution. Recently an officer was contacted by his Lieutenant. It had come to the Lieutenant's attention that there was at least one inappropriate picture on this officer's Facebook page. This officer is a well known, tenured officer and makes no apologies for being an Atheist. The photograph was a depiction of Jesus on a cross followed by some Atheist "inside" joke. The officer was told to immediately remove the photo or face certain discipline (which according to the social media policy can mean termination). The eye, although not in agreement of the atheist ways and point of view, completely believes that Chief Schultz has crossed the line. There is a certain line of church and state, it is there for a reason. You may not agree with a certain religion, or lack there of, but you should agree that the individuals have the right to express their opinions and feelings. This is one of the many aspects that make this country what it is today. Nothing on this officer's Facebook page makes any indication that he is an Albuquerque Police Officer. In fact, all of the information on the page is only accessible if you are a "friend" of this officer. What is the difference between this page and a private conversation the officer is involved in? To make it worse, after the officer was forced to remove the photograph, he was told he still MAY receive some sort of discipline. This is indeed a clear cut violation of every right this Officer should have. The Eye finds it ironic that while one officer is getting threatened with discipline, city employees are getting emails from the Chaplain unit. It seems that the Chief of Police not only picks and chooses WHAT officers can say, but he also picks and chooses WHO is allowed to speak. Chief Schultz you are supposed to be a leader, not a dictator. We predict many lawsuits to be coming out of this, and many checks to be written.

So let me get this straight; chief dipshit is not only telling people what they can do in their personal lives but he is now telling them which God..or lack there of..to pray to? What's next? Is he going to start telling us when we can have sex too? This is a clear depiction of religious discrimination.

Where is the ACLU? Who is monitoring this asshole? I honestly hope this officer has the guts to stand up to this lousy administration and tell them to go screw themselves. This is getting out of hand. I for one think that if we allow this shit to start snowballing, what type of country are we living in? Certainly not the country that so many brave men and women have fought, bled and died for. Dictatorship at it's friggen best!

Well I agree with officers free speech, I would also say that APD should have fired Dwyer for all of the other crap that he has pulled over the past years. Why it is that he has been given a free pass for all of this time is beyond me. He should have been terminated for all of his involvement with the Levi Chavez case long ago. Not to mention that he clearly has some serious anger management issues. (Just the kind of person you want carrying a gun and have a badge.)I don't think so! Also, he should have been terminated for his racist beliefs along with his issues of mental instability. NO COP WHO WAS EITHER SOBER OR IN HIS/HER RIGHT MIND WOULD HAVE POSTED THAT CRAP! He made APD as a whole look like a bunch of lawless, racist thugs who clearly have no direction. I know most of APD to be professional, hardworking good people who would never tarnish their badge and spit on their other brothers in blue the way Dwyer has!

The ACLU will step in, but they need to be requested. If the party that is being harmed doesn't ask for help, the ACLU can't step in. This officer needs to get an attorney and sue Ray Schultz as an individual.

I know the officer who's first amendment has been wronged. I would like to say this - SHAME ON APD! This person has defended our very country with their LIFE, not only with this pd, but for his COUNTRY IN WAR.

What a way to repay a person who has fought for their very own freedom. Their LT and the people backing the lt/chief should take a second look at this.

Also, where is the proof? Is there an active I letter? Is there a physical form of proof that this lt requested this? I sure hope so. If not, it's a lost cause.

If there is not official documentation, I would suggest to this officer that they repost their photos until one is given. No need to play this he said she said.
Get proof and you will be GOLDEN!

It's not just the officers that are getting calls....it's ANY APD personnel.....people in dispatch are getting calls from their supervisors as well even if there is no info on their facebook pages stating where they work. Everyone's afraid to leave any comment anymore. I myself have closed my facebook page and made one under an alias just for family! I need my job.

Its time some dirt is found on the upper echelon.To many people are having their rights violated. Instead of doing this the "right" way some stuff should be revealed about their lives on or off duty. My enemy's enemy is my friend. The ACLU is to complicated. The media is to biased and their are to many loop wholes and ties to the department head quarters. One should start putting their private lives on the net. Maybe then they will back down with their policy when it backfires.

I know the officer involved in this. I did not know that he is an atheist. The officer is a very good dedicated officer . It is not any of my business what this officers religious beliefe are. It is no ones business what my religious belief are. It is damn sure not the business of Ray Schultz to attempt to interfere with how a person believes. Lets wait and see if Schultz does something really stupid and stops the Chaplin Unit from sending out E-Mails. In my opinion The Culture Of Corruption is alive and well at APD, lead by Ray Schultz by leading the department by FEAR ! You officers are good people who will face bullets. Are you really afraid of the administration ?Stand together.

Ray-ray would do so much less damage to the department if he would just sit in his office and collect a paycheck. Instead he speaks, acts, and attempts to think. And that is when he hurts the dept. This example makes as much sense if Ray disciplined an officer because of what he told his neighbor, how he voted, or whether he bought tobacco or porn in the store. All because he works for APD. Somehow even with a doctorate degree I can't figure this out. Must be something you learn on the street, or while being a conniving stealing officer trying to rise to the top. If the union had real guts, they would encourage the officer to stick to his guns and not remove his post. Tape you meetings with supervisors. Get your discipline, have the union contribute to help you out instead of flying around the country to attend seminars, then sue the living shit out of Ray and take his double dipping retirement. This is what the ACLU wakes up every day hoping will come along. Let me add that the company man (or woman) Lt should be ashamed. At some point you have to have some dignity and respect for the Bill of Rights, yourself, and most importantly your officers. All the B.S. they make Sgt's and Lt's read for the test, then they throw it all out the window. Why the hell has everyone lost their courage to stand up to Schultzie? All this putting yourself (as a supervisor) first and backstabbing fellow officers sounds a bit like Judas (for those inclined to Christianity) or Brutus (for the more secular view). I'd be happy to donate money for a one way trip for Ray to fly first class anywhere in the world (or space on Virgin for that matter) as long as he never came back!

With the rumored retirement of DCOP Paiz LET THE ASS KISSING SWEEPSTAKES BEGIN. To enter, you must have good supply of vaseline, lube, or monkey butt (we know who will be using the powder). I think I will invest in all three make some money for my ICMA.

If Berry wants to make changes he should not allow Schultz to pick the DC because it will not be based on ability but on soft lips and how much shit their lips can hold.

If this is true, it is a good reason why the ACLU is going to stop APD and BCSO from holding their graduations in churchs.

I would follow this up with a complaint that my tax dollars are paying for an APD police officer to serve as a christian chaplain. This is wrong. This police officer should be doing police work, not doing christian religous work. This is a great example of Ray Schultz forcing his religous beliefs upon his officers and misspending our tax dollars. Come on ACLU, this is your tax dollars also, file a complaint and take APD to court over the police chaplain unit.

But, as you would have it, this girl apparently didn't have the sense or care that all of her stuff was set to public viewing. If you do not have the common sense to keep your social media page private, then what happens after that is just your own fault. Comment on not letting Schultz name replacement for DC Paiz when she retires in June: It was Darren White with the approval of Berry that went in and fired the entire 5th floor EXCEPT for Schultz. Berry wanted to be able to say he was the first Mayor to a hire the first female and African-American DC, hence DC Paiz and DC Banks, even though both had about one year as Commanders. Now that Darren is gone, watch for Rob Perry to be the one who will be making the ultimate selection all based on a hard right Republican and anti union agenda.

This is unbelievable. No, I am sorry it is like following a trail like no other. Does anyone here see just what is going on. This is one narcissistic individual running things and it's all about himself. You have to be a clueless idiot to NOT see just how this man is setting himself up. It's like writing up your own commendatory letter.

First, APD is under heat for the number of shootings, along with the high profile Chavez case, then more accusations. All of the sudden, it's hammer time under the guise of cleaning up APD. The obvious deflection on the backs of the rank and file officers. The social media issue put APD in the spotlight, and there was nothing that could be done earlier, NOW a new policy is drafted, and officers are being hunted on Facebook for every little thing. It seems like all of the rules are set up to keep people's mouths shut. MEANWHILE the chief can contact the same journalist at the Albuquerque Journal, and violate the due process of officers at any opportunistic time of his choice. Officers are being thrown under the bus for things that were never even a fireable offense before. Joey Sigala goes on record in the newspaper backing the chief like a stage act, right after he throws two officers under the bus for fighting for their lives with a Skinhead Felon. Joey looks like one of those monkeys on a string attached to one of those carnival popcorn music boxes dancing to the chief's tune and cutting officer's throats bu failing to represent them and refusing to support them.

Doesn't anyone think it's just a little coincidental that the chief goes to the newspaper about the two officers who were fighting with a wanted felon who was reaching for a gun, just recently AGAIN, and now he talks about hiring better cops who are less aggressive, and confrontational?
Does this guy even thing before he talks? I think not. He only cares about his own image. Those statements were DIRECT insults to every officer currently employed on the Albuquerque Police Department. It was also an insult to the hard working and highly educated employees of the APD Psych Services
In essence, he stated that there are better candidates out there than the current officers were when they were candidates. Law enforcement is not rocket science. Now the city is going to spend $1500 per candidate for psych tests. That's not for the hired ones. IT'S FOR THE HUNDREDS WHO APPLY!!!!!!!!! Why is this guy allowed to spend the city's money like it's his own trust fund?

And after all of this, He continues to slander officers in the media.

Every one of this guy's media circuses is a grab at public opinion. Why the need to play the media game? That too is now about to cost the city millions when those two officers sue.

You heard it here first. The Chief is going to use every officer who even makes one of the slightest mistakes as a SCAPEGOAT because he doesn't care about what is right or how much the city IS going to be paying out in a few years. It's all about him. He is meticulously calculating and mapping out his options in a way to make himself look good on the backs of everyone around him. The next lawsuit that he causes is going to be of such proportions that heads will spin. Just wait till the coming several million dollar federal lawsuit coming to a federal courthouse near you soon.

$15,000,000......... You might as well add a few more digits because it's about to get pretty expensive around here.

Social Media policy or not? 2010 an AMR (American Medical response) employee, complained about her job, to her friends and on Facebook. She was terminated, sound familiar? The US Supreme Court heard the case and ruled November 2010, that social media has the same voice to veil symbolic speech, therefore freedom of speech. She was reinstated with back-pay etc. Just because APD, AFD, or the City of Albuquerque makes a policy, sorry Rob Perry, it doesn't trump our constitutional right and privileges. Nor does City Policy trump State Laws etc. Clearly our department heads don't care, and the only way to teach them right is right is to fiscally punish them, therefore law suits.

Soon they will all learn that they are not above the law, and are just citizens like the rest of us, not social elite as they so believe.

Memo to Athiest APD officer: Always, always have a union rep. with you whenever ANYONE higher up the food chain requests a sit down with you. I am not PD, but I am city, and the crappy department I work for is run by elitist snobs who think that everyone lower than them is stupid. That's their first mistake: thinking everyone is stupid.

By having an Albuquerque Police Officer, paid by taxpayers, to only do christian religous work, APD is endorsing a specific religon.

This is wrong and inviolation of the Constitution. Here is another example of the ACLU needing to step up and file a lawsuit to make APD include all religous (and non religous groups) on their payroll. Or get back to police officers doing police work and leave religon to Sunday (unless you are a Seven Day Adventist).

Cops are paid to do cop work. If you want to get paid to do God work become a minister. My tax dollars are being misspent and someone needs to call Schultz and Berry on the carpet on this.

I will support any measures to expose the corruption, and framing of officers. If you can provide any information without divulging sensitivities, please let us know. I am sure that right about now most, if not 90 percent of officers are totally disgusted, and exhausted with facing oppression and not being able to speak up about it... out of fear of retaliation. If the Federal Bureau of Investigation were to interview officers of this department confidentially, they would prove that over 90% of them would not speak out against command staff violating someone's rights, or mistreating them, or a co-worker out of fear of being hunted down and retaliated against. The retaliation here is legendary, and the outright setting up of officers is even worse now. All of this in an effort for what? All everyone has to do is open their eyes. Now the chief wants to bring the Police Executive Research Forum (PERF) into the picture along with their recommendations, yet PERF'S recommendations on everything else is ignored??? Public criticism is responded to with thoughtless knee jerk reactions, the likes of which shows that no thought, other than preserving oneself, through the sacrifice of others, is the only motivation. Why were things let go so long? It seems that as things reach a boiling point, these same people turn up the gas. Talk about diffusing, they throw gas on the fire with their blatant, and obvious illegal and selfishly careless actions. The people with integrity are being run out by those with no morals, or fortitude to do what is right. Is it no wonder why so many people are retiring at an alarming rate. People who used to love this job. Just look at who retired recently and who is going to retire at the first chance they get. I have heard a good bit of them say that they have had it. They are sick of the direction things are going within the PD. Anyone who is so phobic about the slightest bit of respectful criticism, that they label it disrepute and make it a fireable sanction. In this day and age, there is something very very wrong. I welcome criticism, It helps me improve. Why is it so feared and loathed by one man on this department, that it makes people walk around substations whispering, and looking around corners prior to engaging a coworker in conversation. I have seen this done prior to even the most benign conversation being undertaken by two coworkers. This is heartbreakingly sad for a profession where you have to rely on the person next to you, to the point that your life may depend on it out there.

There are police departments who have had corruption that was out of control over the years. Places like New Orleans, DC and LA, that was criminal, and related to the officers on the street. The problem here lies at a much higher level, and it reaches outside the department, to the media, and other political channels. Theoretically it should be much easier to dissect, dismantle, and expose due to who is involved, and the fact that it is not a close knit microcosm of individuals loyal to eachother. I truly believe the "me first" mentality here will be the downfall on those who choose to partake in this destructive behavior especially when their well runs dry. But the time has come for people to stop standing around.
Facts need to be brought to light.

I truly hope things make a turnaround and good starts to outweigh evil again. The officers deserve it, and the citizens they serve deserve it.

And the hiring of mindless yes men who are timid submissive, indecisive report takers is not the answers. I thing even those with anti-police thoughts would support that notion.

Hang in there. At this point, how much worse can it get?

an speaking of lines, I think its great that Sgt Mike Guiterrez is in IA now. It's always nice to have somebody in IA who has practicl experience in screwing fellow officers.... Especially when they happen to be recruit officers.

This comment is really meant for the topic about the Chief's temper trantrum from October 30th but it also fits this post as well.

Wow, the posts on this chief's temper tantrum and other comments on this site have really painted a nasty picture about this police chief and "some" others in power in your department hierarchy. How is someone so vindictive with this type of temperament allowed to remain in this leadership role? Especially, managing a police department where men and women have to make split second decisions each day and then possibly face retaliation for doing their job or speaking up. Such leadership should not continue and these officers shouldn’t be subjected to this type of treatment. As stated in one of above posts, this behavior may remain in office until the next election and even longer. If this were to happen, my prayers are with all of you that are on the streets everyday in your city and working under these conditions. I would also pray that someone, at some point, will stand up, be heard, and put a stop to the politics and lies that seems to be occurring.
I believe that people of this personality, at some point, will eventually topple from the top. Unfortunately, how may lives will have been ruined along the way. I am sure there are a few more in his crosshairs as I write this. Being in a leadership position, does not give a person the right to act in such a manner.
Does honesty still exist in this world? It appears, him and his people definitely would not know how to handle honesty when confronted with it or have any type of conscience.
I have read other articles and comments on the EYE, not just this one, and I have to believe that the majority of what is being said must be true.
I normally do not post to these types of sites but I have read so much about this and it really upsets me when people in power abuse that power over people and truly believe they have the right to act in such a way. They don’t have any problem with lying, manipulating the truth and using whomever and whatever means in order to get it “their way”. The people who support this conduct and do his dirty deeds will topple too when the truth be told.
I wish you officers success in dealing with this situation and certainly hope this reign will end sooner rather than later and the truth be told.

Can somebody please explain what DC Paiz has actually done? We got 1 hour lunches is all I can think of. Things still and will suck. I just see how shee gets any praise for being DC of the FSB. Resubmit if you ask me.l

I was in the store tonight speaking with a woman in line. She was talking about APD and all of the problems. She was very supportive of the police in the conversation, but she stated that it is noticible how the chief is overdoing it with the "trying to be the good guy stuff"
It's not the fact that everyone is starting to notice. Everyone has known all along.

Saw Channel 4 tonight which said APD is starting new hiring standards. They want to hire more mature officers who are kind and more gentle. You have got to be kidding me. What about teaching the Cops they can lay hands on these crooks who try and hurt them or others. I am embarassed for APD and the Chief, What a joke. I feel real safe knowing we are hiring AKAL security guards. We might as well have the fire department patrolling our streets.

Volunteer chaplains at APD work very hard.

We just shouldn't be paying a full time police officer, who is also a christian minister, to do religous work with taxpayer dollars.

Do any of you know what the Constitution says? You swore to uphold it, you ought to read it.

AKAL? AKAL security guards will have more initiative than these so called new breed of neutered police officers. People don't want cops out there who back down. The citizens deserve to be protected in a way where cops use their heads. There is nothing wrong with controlled aggression, when the person using it has the training and maturity to turn it off when needed. This guy wants to say that cops need to be less agressive, and confrontational. Well just when would be the time to confront the growing violent crime issue plaguing this city. They have no clue how to attack the issues causing concern here, other than to paint out lower ranking individuals as the problem.

The problem is not the officers. It is the UPPER command, Namely one or two men. The other problem is policy, and training. The policy is also the fault of these same individuals.

APD officers have been taught to shoot when they believe someone is armed and they ar ea threat. They are taught to disengage and create a distance. It has always been frowned upon to use less lethal in a deadly force situation, even if you know it will resolve the situation without death. A truly truthful officer will tell you this. You don't hear it, because it is TABOO to go against it or admit that maybe an officer's actions given the situation were correct. It would wreck the precedence set here, along with the way it has been done for so long. It would rock the preverbial apple cart. God forbid we admit that every single situation is different, resulting in very different remedies and outcomes. Well folks, the stage is being set here for a case that is going to abolish the apple cart. The chief thinks his plan of action in regards to cleaning up the police department is not transparent for it's motivations. He is wrong. People, and officers are not fooled by self serving actions.
Him, the ex reporter he has working for him that sets up his planned propaganda articles along with his henchmen will all be explaining themselves pretty soon.

In reply to the comments about a christian chaplain: Im sure an APD chaplain can be any religion perhaps no one of other faiths have applied for the voluntary chaplain duties. Chaplain Dennison does not push his christianity on anyone. I have seen him talk to a jewish officer and was not preaching Jesus. Sadly all of you complaining about a christian chaplain probably call yourself christian...go figure....concentrate on schultz and leave the good guys alone.

Personally I like Briane but I don't think his position is appropriate.

Instead of taking god out of the context and more so out of society(schools, work, social norms, public affairs, business conduct, policing) we should do the opposite. Ever since we or the public became so overwelmingly politically correct it went down hill. God (which ever one you want) does not need to be a bad thing. If everybody would follow the bible for one minute each the world would be a better place.leaders should stand up for their staff and not settle foolish law suit and send them to TRU. the public should go to MOE for a change and learn how to respect police.
On a personal note: in reference to all the aledged shootings APD is involved in. APD is obviouly doing the right thing since "defendants" as the call it are starting to get scarred.

Braine is a great guy. But he is getting paid to do police work, not God's work. The Chaplain program should go back to being run by volunteer chaplains and Braine should go back to doing police work.

Then again, Schultz has so many officer that are being paid to do nothing like police work. If APD were to put every officer who is currently not doing police work, into the field, we would have a cop on ever corner.

Nice story, but any good atty would ask what type of loss has this officer incurred? So what - he or she had to remove a face book post. Is that prohibiting this person from practicing their beliefs or lack there of? This is a weak case. Is it morally wrong? Perhaps.Where is your proof? Is it in writing? Is it a big money suit? No. My suggestion is if you would like to spread your beliefs, go door to door, just like everyone else and see who cares. This is not a story.

How sad to believe in myths from thousands of years ago. The only miserable people I see are those who walk around with a make believe God on their shoulders, making them feel bad for being human. Come to the 21st century, it is great here. The earth is not flat and the sun does not revolve around us.
