APD Admits Fault after KRQE 13 Re-post our Story

Over the last few weeks, several stories broke regarding the efficacy of the Albuquerque Police Department’s leadership. Most recently KRQE detailed allegations where several applicants and a cadet of questionable qualifications are being processed or were admitted as cadets into APD’s “highly competitive” basic police certification academy. As soon as the story broke, it disappeared. Apparetnly it touched a HOT nerve within the Berry administration. Many of our Eyes indicated that the station’s manager, Ian Munro, pulled the story under threat of litigation from city CAO Rob Perry. Other Eyes suggested that APD threatened to withhold information from other stories thus depriving KRQE of possible ratings. Either way, thanks to you, loyal readers, KRQE reposted the story. However, our Eyes tell us it came with a caveat from APD lawyer Kathy Levy. In a trailer to the story the additional confessions include:

"No one is a member of the Albuquerque Police Academy without going through a very rigorous application and examination process. Each applicant is tested for physical, psychological and decision making skills.

We can confirm that Gary Carlisle was a cadet in the Albuquerque Police Academy and recently resigned.

Ms. Medina is currently in the application process for the Albuquerque Department. She was never prohibited from applying for the academy.

We can confirm that Mr. Hetes was an applicant and he is not a member of any academy class."

Notice the legal finessing of NOT addressing the issues raised. Silence equals consent. By being silent regarding Cadet Carlisle’s egregious sexual harassment conduct, APD grants confirmation of the allegation. By being silent on Ms. Medina’s academic qualifications, APD grants confirmation of the allegation of her not satisfying the 60-credit hour requirement. By being silent on the allegations against Mr. Hetes’ polygraph measures, is APD not confirming he indeed committed such actions? Still, it appears there are more issues coming out of APD. It seems there are several current officers that, despite having “NEVER TO BE HIRED” memos placed in their application files or were terminated during prior academies, are now rookie officers. In the department’s desire to staff itself (as dozens of senior officers retire as early as they are eligible…Deputy Chief of Police Beth Paiz for example) are we not witnessing the reinvigoration of the same issues that plagued the department in the last years of the Chavez administration where standards were softened and deals were cut? What environment is created when new rookie officers have already had a shield of protection from issues that would otherwise result in termination? Are these the type of personnel that will withstand the scrutiny skilled lawyers will layer upon them in deposition or in trial? Given the advances of the internet, you can be sure that every litigator practicing in Bernalillo County will be sure to Google search any officer named as a witness or defendant in a lawsuit. As if the job for front line officers is not hard enough, we seem to have an active effort of the department’s leadership trying to make it more difficult.

What are the consequences of hiring deficient personnel? Almost a year ago, Judge Murdoch was arrested for charges of criminal sexual penetration. The lead detective in that case had had his credibility impeached in a previous criminal trial. Not surprisingly, the Murdoch arrest was fraught with errors and mismanagement despite being presented as a seal tight case by DCOP Feist. Incorrect statues and incorrect elements existed in the complaint. (Yes this is the same DCOP Feist that was excoriated by the Albuquerque Journal for needing a lesson in Investigations 101 a few days ago). Not surprisingly, the Murdoch case was dumped and as of today has not, and is not expected to be, refilled. The lead detective in the Murdoch case was APD detective Keith Sandy. Sandy was a lateral from NMSP who, despite his controversial resignation from NMSP because of co-employment allegations, was aggressively greeted by APD and rushed into and graduated from a lateral academy. In the aftermath of being “giglio’ed” in federal court (where the officer was found to have lied and hence forth had tarnished credibility), APD retained Sandy’s position as a detective. This obviously presents no problem where cases are settled, but in such a case as Judge Murdoch where the officer/detective’s credibility WILL BE challenged, they will not survive such scrutiny. Whatever the reasons that led to Detective Sandy’s impeachment aside, APD leadership has a duty to ensure its personnel retain credibility. Is it reasonable to think that we at the EYE know of these issues but our friends on the 5th floor do not??? As Mayor Berry’s police chief has a fondness for holding officers accountable when they affect the department’s credibility, we wonder to what extent APD as an entity has credibility?

If APD were subject to the same standards Mayor Berry’s police chief routinely holds officers to, how would it fair? Would it be consistent with its own SOPs or would it be in violation of holding itself in disrepute and violating misdemeanor and felony laws? What issues does it mean where an officer was fired from a previous academy but then ushered through a subsequent academy? If our friends on the 5th floor think nothing…then perhaps they need to look at the pending docket of several prominent cases coming down the line…

It would be wonderful if KRQE ran a story specifically on the “threats” that were made to them by perry, why wouldn’t they? Unless KRQE presented fabrications presented to them by this unidentified police officer they did nothing wrong. But that’s not what happened is it? They presented a factually based story that “named names” and provided specific details that obviously rustled berry’s feathers. So what does he do, berry has perry go in and use the same “scare tactics” of threats and coercion that are so often used against its’ officers and civilian employees. This mr berry is not what a good leader does, but it is exactly what a dictator would do. Inept leadership promotes these tactics. Just like a school-yard bully who can’t rationalize a situation and finds himself lost in a debate that reveals his deficiencies what does the bully do, he’s quick to a physical encounter because that is all he knows. “SCARE TACTICS,“ THREATS and COERCION… The fondness that berry holds for schultz is self-evident now isn’t it? Like two peas in a pod. Yet, it is the officers @ APD who are villainized for the “thug” mentality that it is mis-managed by. It is things like this KRQE incident that sheds light on the “trickle-down” effect of corruption @ ABQ/APD. But certainly, it is far easier to label individual police officers as rogue and redirect the public scrutiny to them. That’s exactly what the admin does. But to be crystal clear, unlike the school-yard victim who wins the debate but then gets beat beat up by the bully, WE WON’T!!!

An idea for one of the news stations poll would be should shcultz be fired for all his errors. He is so quick to fire his troops when if he looked in the mirror he should fire himself. Dont ever say Schultz that you left APD in better shape than when you came. Of course you will just another lie.

Murdoch lawsuit will be record breaking I bet. Go JUDGE we are behind you.

We should be looking at all big APD cases that hit the news big then fell apart and no prosecution.

Here's a TIP for news reporters that don't have relationships with Apd PIO's: Concern about prostitutes missing and disappearing was expressed by field cops and detectives to their chain of command in the SE, DC Calloway, and Schultz at least two years prior to "discovery" of bones on the west side. In fact street ppl were talking about a homicidal serial rapist as early as '04. Yet brass in Apd chose to do nothing and kept cops from working this case. How's that for a big case. Now Schultz and Feist want to grandstand behind nat'l network TV? Fuck that. They knew what was going on but could care less. Just like they knew or should've known there was a spike in shootings but could care less. Like they know about a spike in the city's homicides this year but are doing nothing.....

Interesting, we now have the "Old APD" and the "New APD" The former for the most part had integrity, a work ethic, a brotherhood, they took care of each other and made a career of their chosen profession.

Under the "New APD" the 5th floor has deminished all of the above mention attributes. Officers rat on each other for the most minor of things, discipline is not fairly administered, hires are made to fill quotas.

Makes a former officer just want to grab the " New APD" by the jugular and shake the hell out of it until all the problems fall to the wayside and the "Old APD" reemerges.

Wake up Mayor make the required changes.

For this story your focus is severely skewed. The media failed you because they did not take a stand. They either ran a story without sufficient fact finding or their leadership is running scared.

If there really were an honest majority in the rank and file at APD, Ray and Rob would have been gone a long long time ago. Silence and continued servitude is condolence.

The only conclusion I can come to, is mass stupidity.
And from the official actions I've witnessed, on multiple occasions, by the rank and file, that isn't a stretch to say. It must be the consequences of those lowered hiring standards from a few years ago.

If a supervisor commits a crime against an employee....say voyeurism for example.....not only are they liable for the criminal offense but they just bought PERSONAL civil liability for the tort. Sue the fuck out of him and into personal extinction.

Why is Berry, Perry and AWOL Schultz allowing Sigala to sit at home and collect his pay? Levi Chavez was charged with murder and he had to work at animal control, Sigala is being accused of lesser crimes, yet he sits home. Perry runs this city so there must be dirt on him.

Smith, don't you think you need to have background and experience as a supervisor before becoming the sgt of homeland security? Sgt. Hoisington a sgt in charge of background and recruiting? what is your background as a sgt, absolutely none. It is a true disgrace and what happened to the chief wanting more training? To 8:55...Hoisington was the only SGT in the entire department to put in for it. If he hadn't then the junior one on the list would have been placed there.

As far as the Homeland Security position it is a TDY assignment (right now) and not a permanent transfer or position.

Your embarrassment should be that you have never put forth the effort to get promoted yet bad mouth those who do.

Crawl back under your rock where you can take the least amount of responsibility then tell people you are better then everyone else. What a douche bag!

When did the police decide that they were above the law? Just go on ride alongs and listen to the rudeness, see the excessive force and all goes withe the belt tape off.

There is domestic abuse that in cops homes, that are covered up and never investigated correctly. The victim,s life is ruined by lies and the victims are afraid to files reports.

some officers are so above the law that they break laws and considered that achievements. Part of the game is hiding the facts and the thrill of getting away with committing crimes is the rush.

Update of Michael Hetes...he ended up going through Albuquerque Police Department Academy...and is now a mighty Rio Rancho Police officer. His drug abuse history and domestic physical abuse is known within this community. The Albuquerque Journal made it a spectacular rewards. The curse of Hetes continues to the next generation.

As for Schultz, someone told me he is to run for mayor of Albuquerque. Wouldn't that be a treat?

talk about a power team. nepotism thrives in the city circles. hope no one else dies because of the birds of a feather kill bums together.

I know an a few of these guys from Rio Rancho highschool. David Sexton is doing ride alongs with one of these guys. Hetes' sister Nichole spins free trix on thursday while the kiddos are at the academy on Zirconia Blvd.
