City does the Insane to Zane

In The Matter of T. Zane Reeves….

On Tuesday, May 1, 2012, City of Albuquerque’s CAO Robert Perry sent notice to Dr. T. Zane Reeves informing him that “effectively immediately” he had terminated the city’s contract with Dr. Reeves. This action comes after the city’s personnel board denied having any jurisdiction over the city’s issues with Dr. Reeves. Astonishingly, Mr. Perry’s action comes after district court Judge Nan Nash denied the city’s effort to obtain a restraining order against Dr. Reeves from hearing any more city personnel grievance appeals hearings. Having failed in all other areas where an objective review of the city’s allegations against Dr. Reeves were found to be without merit, Mr. Perry simply, and some say personally, took matters into his own hands and fired Dr. Reeves.

For over twenty years, Dr. Reeves has been a hearing officer for the city of Albuquerque. Under the city’s Merit System Ordinance, employees who receive discipline in excess of five days off (and up through termination) may grieve and appeal their discipline though an administrative hearing. The hearing is run much like a bench trial with the city represented by a department executive and city lawyer and the grievant represented by a lawyer. By city ordinance, the hearing is presided over by a “hearing officer” who acts much like a trial judge. While paid by the city, the hearing officer is an independent contractor and is hired as a neutral third party to determine facts and render a recommendation. This recommendation is then taken into consideration by the city’s personnel board which either upholds or declines to follow the hearing officer’s recommendation. Hearing officers are hired on a competitive basis and are generally lawyers, academics, or certified arbitrators.

Dr. Reeves is a retired UNM professor and holds a Ph.D in political science from the University of Southern California. He is a member of the prestigious National Academy of Arbitrators and has been recognized as the most competitive candidate to operate as a hearing officer for the City of Albuquerque. Dr. Reeves travels the country hearing cases as an arbitrator, training arbitrators, and holding administrative hearings.

On February 6th, 2012, Dr. Reeves rendered a recommendation concerning former APD officer Russell Perea. Dr. Reeves recommended to the city’s personnel board that they reinstate Mr. Perea because the city failed “to demonstrate employee wrongdoing, much less that he deserved to be discharged.” It was during this hearing that Deputy Chief Allen Banks was caught lying under oath, and where the testimony by Chief Ray Schultz, Deputy Chief Paul Feist, Commander Doug West was successfully challenged and defeated. Following this decision the city embarked on what can only be described as a smear campaign full of intimidation and retaliation. The city claimed Dr. Reeves’ recommendation was the result of internal bias. The city’s evidence that he acted with bias consisted of the following: a 2011 editorial concerning the Wisconsin labor/management crisis, post hearing ex parte communication with labor union representatives, and soliciting buyers for his book on Hungarian victims of the Holocaust.

The city (through lawyer Rebecca Wardlaw who failed the city in the Perea hearing) argued that these elements comprised a “pattern of conduct” and are proof of Dr. Reeves’ bias and thus invalidated the Perea decision and compromised any future hearings held by him. The city argued unsuccessfully in front of the personnel board and an openly irritated Judge Nash that these elements were proof of his bias and that such bias was in conflict with the state’s code of judicial conduct. Upon failing in all other regards, Mr. Perry then took matters into his own hands, and by absurdly claiming victimhood at the “stacking of a deck”, arbitrarily terminated Dr. Reeves’ contract.

Reviewing this matter in daylight presents many troubling issues. But instead of repeating what the personnel board and Judge Nash have already done, determine that the city’s arguments hold no merit, we are concerned with the larger picture this effort raises:

-If the city is so concerned with reinstating Russell Perea, why are they NOT appealing

the personnel board’s decision? The city makes no effort to dispute Dr. Reeves’ findings.

-If Russell Perea’s reinstatement is not the target of the city’s efforts, what was Dr. Reeves scheduled to hear that the city so desperately sought his removal?

-What will be the chilling effect upon the other independent hearing officers by the city’s arbitrary action to terminate Dr. Reeves’ contract?

-Because the city breached Dr. Reeves’ contract by wrongfully terminating him, what liability has the city burdened the citizens with?

-What additional liability has the city burdened the taxpayers with by contaminating the hearing process with their arbitrary and threatening behavior and thus prejudicing all pending and future grievants from having fair and impartial hearings?

-Dr. Reeves’ past decisions include upholding the termination/discipline of many APD officers including Ben Kirby, Al Walck, Anthony Zambrano, John Messimer, Lt. Paul Rees, and Sgt. Bret White, given this action by the city, do these parties (or estates of the parties) now have new claims against the city?

-The “interim” chief hearing officer Stanley Harada’s objectivity was challenged when he summarily dismissed red-light camera tickets in the spring of 2007 when confronted by the media, can we expect him to similarly fold under the pressure of Mr. Perry? (our Eyes also tell us Mr. Harada almost lost his law license in a malpractice claim where he missed a statute of limitations deadline.)

In the matter of Dr. Reeves, our recommendation is the time has come to hold Mayor Berry, Robert Perry, and Mayor Berry’s police chief, Ray Schultz, to the same level of scrutiny they so comfortably hold on others. Given the unfolding and on-going saga of ex-APOA president Filiberto “Joey” Sigala, we’re sure to see the threads of stolen money, stolen property, and other criminal issues cross over from APD’s 5th floor to City Hall’s 11th floor…but this time it is agents of the New Mexico State Police following the trail…we wonder if they will see what is an obvious pattern of bias, intimidation, and quite frequently illegal conduct.

The city did not appeal Perea's decision because they know that the lie under oath that Banks told would be a hornet's nest for them if they proceeded to a trial. They knew how public that lie would be made by the media if it were to hit district court. They are playing a chess game trying to protect themselves, yet the evidence is already there.

Now with Reeves, that is a disgrace. They know his stance on wrongful terminations, and they think firing him will stop the reversal of illegal disciplinary practices, and wrongful terminations? Perry and company under the mission of protecting the crooks running APD fired Reeves, no doubt to stack the deck as THEY say, in THEIR favor. There is no doubt that these weasels figured that the "TAX" money that they will pay out at settlement for Reeve's blatant illegal termination and breach of contract will be better than the exposure, forced policy changes, and embarrassment when they lose more hearings because of this arbitrator's willingness to do what is right and not be intimidated into a decision by a facist administration. The citizens of Albuquerque do deserve better, They deserve an honest city government that values integrity rather than attacking integrity because THEY have none and don't like the fact that people know it and are not afraid to stand up to them.
I hope Mr. Reeves says screw the settlement and takes them to court for reinstatement to make a point. It is a guaranteed win for him and piont that needs to be made. It's principle now.

Funny how no action is taken upon those othe fools who fucked up this investigation INCLUDING the Levi Chavez fiasco. But when somebody calls them out on it like Reeves did they fire him. The firing of Dr. Reeves should come as no surprise. As it became routine for 34’s to be over-disciplined under the current administration, I believe that Dr. Reeves saw through the questionable tactics used by the 5th/11th floor and took appropriate action with his recommendations. It is common @ APD for a 34 to have his/her discipline “aggravated” by the use of creative language and liberal interpretation of SOP’s to make the recommended discipline so drastic in time off w/o pay or even proposed termination, that 34’s when “allowed” to maintain their employment they are expected to be “happy to still have a job.” But really what is going on here? The administration is abusing its’ authority by this practice of “over-discipline” as a form of coercion and are further violating the right of due process of its’ employees with the next oh so common tactic. “If you agree to NOT file an appeal or sue, the proposed discipline will be lessened (to within SOP parameters) or the proposed termination will be withdrawn.” There is a high volume of these cases within APD, but cases like these never make it to an arbitrator or hearing officer. And, Dr. Reeves in all likelihood was not ignorant of their common occurrence. Is it possible that the city’s failures in sustaining discipline and terminations all these years directly correlates with the selective and malicious nature of which “they” enforce SOP’s/Rules and Regs? I think so. How many 34’s out there have received discipline for the very same conduct that other 34’s are rewarded, quite a bit I‘d say. And for the 34’s (including supervisors) on the dept who wear that “golden halo” who could do no wrong, there are hundreds of hard-working guys/gals who go without praise and recognition. How many 34’s have been placed in highly sought after positions or have been ushered through the ranks when their work performance did not support it. Their moral and ethics, or lack there of, and for some, their conduct which may have also included criminal behavior, sure as heck does not make them worthy. The status quo and upkeep of hypocrisy of the 5th/11th floor only acts to insulate the individuals and behavior that taints APD’s image. But just as Dr. Reeves’s contract with the city was terminated, they will look to get rank and file removed from the department who have been here long enough to know better and can see right through their wicked ways.

Ok, so the way I understand this correctly from now and moving forward, for the interim and future hearing officer... the city employs a supposed neutral 3rd party in an act of being "just and fair" to its' employees, yet the "neutral 3rd party is PAID by the city (therefore financially influenced or bribed) and after this most recent event is further coerced by the threat of termination if the city doesn't get its' way. How is the funding for this position even justified, what's the point if it isn't even designed to be fair??? When Dr. Reeves made his rulings and leveled the playing field I suppose the thought of being just and fair went out the window. perry/berry/schultz would much rather have the deck stacked in their favor by having its' judge and jury bought and paid for. Now imagine these same tactics being used in a court of law. Wouldn't that be a violation of ones' Constitutional Rights. Does the corruption ever end?!?!?!

at what point will the department get a legal department or a payroll department that is worth a damn? There is a sgt that was not present for DWI overtime sign up because he was on military leave. well he got to put his name in the book before everyone and so on sign up day all the sergeants that were there lost out on the spots they deserved. So the sgt goes to the city and cries out "USERRA" because when he came back he was removed from the overtime as it was not fair. So the city lets him know work overtime doing absolutely nothing because he cried USERRA foul. Guess what USERRA does not involve any sort of overtime issues. USERRA is designed to protect your job on deployments, mandatory work, etc. This is the same sgt that got a ton of money becuase he was a lateral and wasnt able to test because they changed the rules. This is the same sgt that spent all of us time studying for his pharmacy test, not working. This is the same sgt that works overtime at the PTC and walks in, claims 5 hours and is there for maybe 1 or 2 hours. This guy is worthless. the city is so ignorant on rules of military that they allow anyone and everyone to violate. what about the sgt that play by the rules?

Education for the uneducated. So if youe really read USERRA...instead of that version on the DOL website you would realize that it states a service member will not be denied benefits afforded to any other employee. Scheduled overtime has been deemed a benefit by numerous agencies. It goes to specify that a service memberwill be afforded those benefits as though he had never left. So.. OT sign-up and he can not be present due to short term military duty but can be here for the duty itself...he notifys the Dept of said leave and they are required BY LAW to accomidate him. Nothing under law states how that is to be done....so all aside maybe letting him sign up before was not the right decision....taking him off was certainly not...so what are you left with? If you feel he did not fulfill his obligation wotking OT or cheated on his OT slip then you are just as equally obligated to report that to the proper authority. Otherwise just STFU! All your petty ill feelings aside for the SGT and the feel you are being cheated or...I would suggest look at how many service members have been allowed to phone in or have another stand in for thier Bids...how many have had others sign up for Chiefs in thier absence. I suggest if you dont like this you get off your lazy ass and put on a uniform...serve your country instead of your self for once and worry about the true abuses going on instead of USERRA. And if you pull the crap...."I served" then double shame on you...I am sure your unit was proud of you.

Seems like the city attorney, perry and the whole bunch of them are insane in the membrane. These city officials are using our tax paid dollars to fight their personal vendettas. It seems that this is a hate feud. The city is wrongfully terminating people, losing because they violate their rights, attacking those that judge against them because the city officials are lying and fouling up the employee's due process, then terminating the arbitrators because the city did not get to win. Every city official involved in this is an extortionist, and abuser of power. If it were their money, they wouldn't pursue a damn thing. Since the tax payers are footing the multi millions of dollars being spent, I guess that is ok.
Each appeal of an arbitrator's decision is going to cost the city hundreds of thousands of dollars per employee in back pay, legal fees, and punitive damages when they sue for the maliciousness behind these actions. No wonder why the citizens of this town are on the verge of revolt.

USERRA levels the playing field for work. The key word here is "work". You don't get away with not working because you put on a uniform. It is a great law and a necessary law but it makes other hard working members of the military look bad when someone yells USERRA and demands special treatment. Getting paid not to work because people are afraid of you is getting special treatment and hurts everybody.

Don't kid yourself... the same shenanigans happened under the former mayor and his administration. The personnel board board and those hired in that office were stooges for the mayor and were in his back pocket.

The antics ranged from city legal, the personel board hearing officers, and the mayors office all acting in concert to either vigorously fight against an employee, or to deliberately dump a case on others.

I'm not defending this administration, but the personnel board and some of it's officers under the past administration took part in some pretty shady concerted efforts against employees the mayor or his henchmen wanted gone.

I spoke with a friend the other day who is the chief of a large PD. He is amazed at what is going one here. In his opinion, this lying fact dodging manipulative chief would have been out the door with the first public lie. Another thing noticed was how this chief avoids responsibility at all cost, the last thing a true leader is supposed to do. This crap perpetuates because one covers for the other, creating dirt that one knows on the other, vise versa, and so on and so on. They can't get rid of eachother. They all drank the Kool Aide. This department is so dirty now that they are putting out media stories to deflect attention away from sigala's mess now. Why? Because they know he knows dirty shit from the top. The feds do need to make enrty here, and it has nothing to do with the shootings. It has everything to do with extortion, intimidation, theft, tampering with investigations, harrassment, setups, and anything else that a well funded criminal enterprise uses as their tools of the trade. The top end of APD is dirty and it is corrupt, end of story. I do not know of any other department in the United States where the entire top part of the command staff of a police department has confirmed issues with truthfulness, rights violations, harrassment, retaliation and conspiracy between them all to commit the above against it's employees while using tax dollars to do it and lying to the public about it.

USERRA is enforced by the VETS office. The DOL only comes in against private employers. Read the law before you start posting misleading info

Anybody can go to school to include police officers. I know officers from several departments from the surrounding area who are enrolled at either UNM, CNM, or both.

Can it be tough, both working and going to school? Yes! Can it be done? Yes! The sacrifice, juggling of schedules, the loss of personal/family/friends time to studying makes the academic achievement of a college degree or graduate school that much more special because not everyone else is willing to go through the aforementioned.

I've met firefighters and police officers who have managed to find time to do both, work and go to school. These academic achievements include nurses, physician assistant, pharmacist (not APD), law school, business school, med school, one currently completing a Masters of Public Administration (UNM). The point I'm making is, the opportunity to go to school is a benefit that every city employee is encouraged to do and compensated for doing as such.

Nobody should begrudge another person for seizing upon an opportunity that is afforded to everyone. 20 years goes by at the blink of an eye. Start thinking about life after the uniform, if you choose not to that's o.k. to, it is your decision, but understand you have only yourself to blame.

I concur. Getting your education is a must. About 1/3 of APD officers have some sort of degree. Even an associate degree like state police requires is something to be proud of.

I agree with the mandatory 60 hours and military experience except most recruits now fail the polygraph because they lie about their drug use in college or military. Thats the downside.

Not misleading. DOL is charged with being the outlet to file complaints on the form 1010. VETS will look into it and decide if its legit....will also try to solve the issue...then it goes to the US Attorney/US District Court. Problem on this blog is everybody knows everything. You try to simplify something and someone slides in and throws in thier 10 cents to dispute it. I agree that this does not matter...its stupid from the start and like it or not sounds like he did nothing wrong. Dont worry there is someone else around the corner for you to be jealous and bitch about.

I spoke with a friend who is the Chief of a large PD and he is amazed.....HA. I call BS. Lets look at the laughing stock compared to other large depts. Our crime stats are dropping twice as fast as anywhere else due to the efforts of the officers here. There are more cutting edge initiatives targeting property crime and other criminal activity taking place that anywhere else. We are establishing partnerships in the community, business, and other agencies that are leading the way. These LARGE DEPARTMENTS are coming here to copy what we are doing. Darren White created our Officer involved shooting problem so he could spotlight himself in the media and be the Savior of Albuquerque...only he is not smart enough to pull off the illusion..and the media is stupid enough to keep chasing that squirrel. YOU guys are creating the lying, cheating image that You are giving us. Laughing Stock. Any Chief worth his weight will step up and make his comments publicly...have your Chief come out of his closet...otherwise shut up because no one believes you either.

People have a problem with unarmed individuals getting shot. Plain and simple. If I shot an unarmed individual, I would have a problem with it. That is where the problem stems from. Darren didn't help the matter. A chief who condones retaliation, disparity in treatment, covers things up, and lies like a fucking rug IS the problem. When your cheif tells just one truth, you can talk. Until then, you really should shut your trap. Your chief runs and hides every time the shit hits the fan leaving his smurf of a DCOP to sound like an idiot in front of the media. And these fools keep holding the bag for this clown.
Liars, smurfs, woman abusers, money stealers, back stabbers, welfare defrauders, cowards, and criminals are who you support, and YOU say that people here are creating the image portrayed of these dirtballs today. Bosses who are laughed at, incompetent, running scared, retiring in disgrace, have absolutely no respect from the rank and file, and who have sold their asses for a position and pension? Hope it is all worth it. Hope the stomach ulcers, hemorrhoids, heart disease, cancer, insomnia, acid reflux, fat stress pot belly, daily diarrhea, migranes and stroke are worth that pension when your quality of life suffers from the toll your sorry ass paid for your shitty lifestyle. The mayor promotes out of a concern for diversity throwing out the book on ethics in the process. In Albuquerque you can be a high ranking police deputy chief and a criminal liar if you are black. This guy goes around womanizing and carrying on like a hoodlum when it would be the end of the world if those actions were carried out against his blackness.
We all want diversity but not at the cost of integrity and competence. Schultz and this fraud mayor are about appearance only. Their infrastructure is hollow and without foundation. I hope every lieutenant sues APD over the last batch of promotions. Schultz told us at the union that the promotions were not his choice. Was that teh truth or was in Schultz talking out the other side of his mouth? Who Knows? But he said it. He will go after anyone who disputes those promotions too. Another case of out of control threats, intimidation and retaliation, extortion style.

If your fat and can't run as an Apd cadet, don't worry about it. The dept is so starved for officers they will create special positions so you can get in shape withe a dept provided personal trainer and then when you start your next class you don't even have to worry about getting caught sexually harassing female cadets. That's how Cmdr Tim Gonterman runs the academy. I guess that's what other depts want to see when they come here to look at our high standards.

When Joey's soon to be ex wife was arrested her car was seized due to her being revoked.. Joey had to have known this plus she (they) are allowed to receive EBT, WIC whatever the hell it's called now... So she (they) had to have lied somewhere to get those benefits.. Or she(they) have someone on the inside allowing it to occur. I am sure Joey kept that a secret while he was alledgely stealing funds...
