Adiós DONKEY

Today is Thursday, June 21st, 2012. It’s frequently interesting to note what occurred on the same date but many decades ago. Reflecting on today’s date but in 1960, we at the Eye wanted to see what significant historical events occurred. Perhaps there was some stunning action in Vietnam? Or maybe an event between the United States and the Soviet Union? In all of our searching of the internet, we found….nothing. Nothing of significance happened on today’s date in 1960.

This really shouldn’t surprise us, because it’s symptomatic of what Mayor Berry’s police chief, Ray Schultz, has done for the citizens of Albuquerque and the Albuquerque Police Department. He has contributed nothing of positive significance. But Chief Schultz can claim to have made a horrendously negative impact. In fact he can claim (and we’re sure our endless readers can add more to this list):

-Schultz was found guilty of violating an officer's civil rights resulting in
damages in excess of $500,000. The jury found Schultz lied under
oath.

-Schultz oversaw and white-washed the entire David Young reserve officer
debacle which is still being litigated upon.

-Several of the twenty-five plus police shootings are dubious at best and will continue to haunt
the department until they too are played out in civil proceedings. How
many "bad shoots" can a chief endure?

-The Evidence Room scandal never really was addressed. In fact,
current CAO Rob Perry was a lawyer for, and successfully defended, one of the
parties Schultz tried to smear as being at fault for the problem.

-Arbitrary and desperate promotion practices run rampant as merit is the last
thing Schultz considers when promoting people to Commander level positions. The latest round of promotions sets a new low for required knowledge, skills, and abilities.

-While two officers have been killed on duty, more than twice as many have, or
made efforts to, commit suicide.

-Calls for dispatch remain at an all time-high and response times remain the
same despite there being the manipulation "en route" and "arrived"
statuses by dispatchers.

-There exists a culture that by the chief's own words is defined by him.
"Sue me, because in three years I won't be here." Honest
criticism is met simply by vindictive actions and overt retaliation.

-Officer's due process rights are routinely violated in efforts by Schultz
to regain lost credibility. How much will the department pay because of
his harm upon Tim Chavez, Orlando Comacho, John Doyle, Rob Wollever, Sam
Costales and others?

-Despite being forewarned about the history of conduct by Levi Chavez, efforts
to discipline were blocked at every level until it became too late.

-Then there's the Darren White debacle as Schultz openly professed his
ignorance about the basis for DWI investigations.

-And let's not forget about the two fellows that were wrongfully accused of murder and coerced into self-incriminating statements only to be fully exonerated.

-Anybody remember Pat Murdoch? Do we really think this poor investigation was not reviewed and approved by Schultz himself?

-Consistently claiming to be unaware of significant issues (where do we really start with this?)

-APD’s SWAT unit losing its Federal certification/status.

-Endorsement of sexual harassment and sexual discrimination at APD’s Police Academy.

-Fiscal mismanagement as the department’s $160 million budget spins out of control while manpower remains at early 2000 levels.

So on today’s date, we note that what is memorable, is that given all the failures of Chief Schultz, it is abundantly clear, he holds something against Mayor Berry or others for in no other setting would somebody with such an endless string of failures remain as the department’s leader.

Rumor has it; Schultz is finally on his way out. We hear Schultz is purchasing a home in Colorado and possibly has a job lined-up. We here in Albuquerque are pleased with this information but are saddened that a community in Colorado will fall victim to this fascist dictator and all the liability that goes with him. Be sure to thank Berry for the big fat pension you will take with you Sergeant Schultz.

Will believe it when I see it. Schultz will not hit his "high 3" until December. He could "early out" using annual and sick leave meaning the city would carry him on the payroll until December. However, if Schultz waits until December, he can cash out all accumulated anual and sick leave in a single lump sum worth about $75,000 (six months salary OR more)

I find it funny how these cruds have to find another host to infect before they leave the one they just decimated.

Hopefully sigala is carrying this criminal's bags with joy wherever he may go.

Looks Feist is an even bigger liar than Schultz. Gee the transcript of a recording contradicts all ur statements Feist! Imagine that. If you'd lie about these things what else would you lie about....? Once again our "chiefs" model to the rest of the department not only is it ok to lie to the media nd the citizens but also that it's ok for them to do but not for anybody else. Feast also said that Zach was relieved because of a preliminary investigation. Really??? That goes against personnel rules and prior statements by the chief. Ur gonna have another nice lawsuit Feist.

If another dept hires schultz they better have a good insurance plan because he will cost that dept money just like he is apd. Wait till the suits come down from all the crap cases that vice submitted. DA's office is immune.

I wouldn't be surprised if the company who carries liability insurance for city drops us soon to avoid the murdoch, etc cases.

The journal today contained typical Chief and DCOP bullshit. They fabricate cases against their cops as scapegoats for their own personal gain or vendettas and when they get caught they have no comment. This sounds like another instance where Feist and the chief are involved in a case where the feds were fed lies and disinformation AGAIN in an attempt to railroad someone. Feist and the chief need to be indicted for lying to the Feds. They are both bonafide and confirmed liars.

Behold the downfall of this regime!
It is over folks. They are getting demolished over their corruption and half the cases haven't hit yet. Just sit back and watch the next six months. When a DCOP lands in jail for perjury they'll think twice. Scumbags.

The city is a "self insured" entity under state law and does not have any kind of insurance to cover lawsuits or settlements. Each year, the City Council must allocate millions in reserves to cover litigation claims. The money is taxpayer money and goes to the general fund. When Schultz worked for Chavez, he was allowed to "double dip" and got his PERA pension and salary. When Berry kept Schultz, he did not allow Schultz to double dip and Schultz suspended his PERA pension and started to pay into PERA again. Therefore, Schultz started a new high 3. When Schultz retires again he will be paid 80% of his $150,000 salary or $120,000 in pension for the rest of his life.

To June 22, 2012 9:00: Your dead wrong and your the on that is an idiot. The PERA pension law was changed in 2009 involving double dipping and return to work after one year. You can no longer double dip by getting a pension and still work full time for the same PERA agency. The pension can be suspended when you return to work full time after one year so long as you start paying back into PERA. Your pension is then re-adjusted under a new high three when you retire again. Schultz retired from APD and was paid a PERA pension and went to work for another police force in Arizona and worked there over a year when Chavez brought him back and allowed him to get his PERA pension and Chief salary. State law changed in 2009 and Berry did not want Schultz to double dip, so Shultz suspended his PERA retirement and started anew on the contributions. What is interesting is that Berry has allowed others to double dip including Lou Hoffman and Tito Madrid who use to head up constituent services.

If you suspend your pension, you can build a new retirement through PERA. Know the law.

Ok, to the person who thinks they know about PERA. Schutlz was a double dipper. When Berry was elected Schultz "voluntarily" suspended his pension, therefore he became an active member of PERA again. Page 52 of the PERA handbook states:

How to Increase Your Pension Benefits:

You may voluntarily suspend your pension in order to accrue additional credit under PERA and to re-retire in the future with enhanced benefits.

Under this provision, a retired employee who suspends his or her pension once again becomes an active contributing PERA member....

So there is your proof. Once Ray voluntarily suspended his pension, he become an active PERA member and begain enhancing his pension. Go read the PERA handbook, page 52.
By the way, I don't think your an idiot, just uninformed. Too bad you believe you can call people ugly names, because you are anonymous. I would not call you an idiot.

I have read the law and you are the idiot and a fool. Read 10-11-8 Sections C, D, and F of the New Mexico Statutes Annotated entitled "Normal Retirment; Return to employment;" You can return to work, but you are required to suspend your retirement and both the employee and employer have to make PERA contributions again. If you return to work at a higher pay, your monthly retirement is re-calculated when you retire again. Never challenged Ray-Ray's entitlement but pointied out how he went from a $75,000 PERA pension based on his first retirement on a DC salary to a $120,000 pension based on a Chief's high three salary.

Where is the bullet point about the flubbed death investigation at the Han home. How interesting is it that the attorney "top cop" hated most, supposedly commits suicide and all procedure is thrown to the wind before the case is closed. There is blood on the chief's hands, Kennedy's hands and all the 34s who trampled through the scene.

I have no respect for Schultz for his position and as far that goes for anyone that he has promoted. I must say his retirement is not any of our business.

As far as the city being self-insured. I don't know if that is true but we will find out in a few years. That money has to come from somewhere and that means no raises for any empoloyees much less public safety.

If Schultz is leaving we will still have same attitude on who ever replaces him. In you havent noticed Schultz set his poor ledership into everyone of his promotions. You need examples: Freezeframe, West (opps I had affair with Sgt that worked for me.) This place needs a major reorganization all the calls of service holding in each area command is gonna bite the Berry admit in the butt on a DV or violent crime. Schultz attitude of kiss my ass to get promoted brings corrpution and thats what we have.

At least BCSO somewhat backs their deputies. I just read the article on the deputy's gun that was left in the bathroom at Presbyterian Hospital, and stolen by a doctor there. Thank God that wasn't an APD officer. The punk bullies running APD would have intimidated and threatened the officer into resignation. APD is run by a disgusting bunch of treacherous liars and criminals who victimize their employees.
