Caught Lying (AGAIN)


Several days ago our Eyes broke the story about how Albuquerque Police Chief Schultz and Deputy Chief Feist committed egregious violations of department procedural SOPs by releasing officer lapel camera video of the recent officer involved shooting prior to the completion of the investigation. Now KRQE-13 has filed a lawsuit against the city for the APD’s violation of the Inspection of Public Records Act (IPRA) stemming from an incident back in May 2012. You see, reporters routinely request copies of video and audio footage recorded by officers and that material is subject to the IPRA. In this case, it seems there is some controversial footage that APD does not want released to the public despite the fact they have no protections in this case to withhold it. Our Eyes tell us the video involves a suspect who is surrendering and gets Tazed anyway. The department and the city have asserted because there is an on-going investigation into the officer’s conduct, they have an exception to the IPRA requirements. The chief attorney for the city of Albuquerque, David Tourek, stated:

“The City is withholding the video at this time under the law enforcement records exception of the Inspection of Public Records Act due to the fact that law enforcement is currently interviewing witnesses in a criminal case. The release of the video prior to their statements being taken could compromise what they say and the integrity of the investigation. Upon completion of the investigation, the full video will be released."

Excuse us? Did Chief Schultz and Deputy Chief Feist not just release video footage of an officer involved shooting just days ago? Was that video not released before the completion of the criminal investigation? Were the statements by Chief Schultz and Deputy Chief Feist of such detail and particularity because they were spoken before all of the witness interviews were completed the integrity of this latest shooting is now completely compromised? And from being compromised has APD not just once again failed the officers who were involved in this latest dangerous incident AND compromised the criminal investigation against the heroin dealers who were the targets of the original investigation? Are Chief Schultz and Deputy Chief Feist going to be held accountable for actions monumentally against the city’s interest and in direct conflict with the City’s Chief Attorney Tuorek and the City’s Chief Administrative Officer Rob Perry?

The media and other bloggers, Joe Monahan in particular, wonder why all the states around New Mexico seem to have their economies revitalized and growing in prosperity while stagnation runs rampant in Albuquerque and most of New Mexico. Could it be that when hypocrisy is this gross and obvious it impedes any hope or optimism? If they lie about the simple policy regarding videos, what else will they lie about? If they choose to violate state statutes like IPRA, what else will they violate? Of course Mayor Berry is nowhere to be seen in this, for that would require leadership. We’d say it could not be more obvious that the leaders of APD are out of control and are not interested in doing what’s right but only in evading responsibility for their mess. But our Eyes tell us, it is going to get worse. And the citizens and businesses are clearing enduring fatigue from this on-going miscreant behavior by many of the state’s leaders.

P.S. We at the Eye wish to congratulate former Officer Tank Guenther for being cleared of all of the heinous charges brought against him. We applaud the Santa Fe county District Attorney, Angela Pacheco, for dropping the criminal action against Mr. Guenther. Of course APD was quick to terminate Mr. Guenther for the unsubstantiated felony charges. But now, as Mr. Guenther ponders the effort to restore his name with the department, PIO Officer Robert Gibbs asserts that Mr. Guenther was not fired because of the charges but because of “administrative issues.” We at the Eye would like to know what exactly those other “administrative issues” are because our Eyes tell us, no other issues were asserted during Mr. Guenther’s Lauder mill hearing. Could it be that once again, APD’s Chief Schultz is caught lying???

I'd like to know when "Group Transparency" plans on posting APD's SOP, General Orders, Policies, and whatever other operational orders that exist on the city's website???? The SOP used to be there, but it appears Legal Beagle Perry got his nose out of line about that, as they disappeared soon after he became the third bar stool leg of the ruling clan.....

Even the Metro Court Judges are in the dark....

These liars want to use the words maybe, seems, appears, could be, I think, may have, to put their trash out there. Everyone knows your game LIAR. Intentional misrepresentations are the same as lies. Someone needs to download that entire CD containing the SOPs to a website and expose these liars. Nothing but liars in city government. Nothing but liars on teh entire 5th floor. What is there to do when an entire police department and city are run on liars.

Officers are leaving in droves in the SE Area Command. Commander Gier or what ever his name is has 34's doing the hot spot crap. Which takes away precious man power from calls for service. Hey Gier get your ass out there and take some calls with Swing! Its bad right now and all you care about is looking good with your stupid hot spot shit. You dont care about your 34's! Gilhooly said alot in that journal article, and all of it was true. Krueger seems to print strait forward articles without the slander, but why won't they fully step through the door and call it like it is? They again mentioned the officers locking up that "MURDER" suspect. The fact that he was wanted for murder is a "FACT", yet they still never mention that and they say that he was "possibly" dangerous. It was also CONFIRMED that he was armed with a handgun and knives. DOES ALL THIS NOT MAKE THIS SUSPECT DANGEROUS? What is with this situation? What is going on here? The reason officers are scared shitless to do anything is because the first time they have to do something to protect themselves that is justified but might not look great, they will be hung out to dry by their chief and his underlings, who are terrified of an investigation into their own behavior. Every officer out there knows what the chief and IA has done in this matter and everyone knows it is dirty as all hell.
The question that needs to be asked is what is the chief, city attorney and the rest of the 5th floor so horrified about that they will go to any legnth to conceal and prevent it from coming to light? What have these people done that they are actively trying to cover up by using the lives of their hard working officers? A very high level outside agency needs to step in and investigate the dealings of the 5th floor. Phone records are just the beginning. It will show the conspiracies and alliances of who is who behind all of these messes. Linking up significant dates with acquired phone record chatter will show who is behind all of this. I think everyone needs to see all of Schultz's phone records for all of the years he has been chief. Having a secret phone says something right there.

Gilhooly did not have to say anything to anybody. He did the interview to show 34s that other 34s care and that APD is broken from the top down. I read the article and I got that change is coming and change is mandatory. Have some faith, watch eachother's backs and don't let the 5th floor continue to fragment. The union is gone, don't count on their support but other 34s are still here. At least for now. Thank you Gilhooly for saying what needed to be said.

Finally, an article from the journal putting blame exactly where it belongs. I don't know why other writers at the journal see fit to attack the rank and file, when they know who is responsible for the mess @ APD. Tiptoeing around the culprits only creates animosity and the feeling of favoritism. With events unfolding, it is inevitable that there will soon be no place to hide, because all other media outlets will be ahead of the game by reporting the truth. Competition will make for a good outpouring of the truth. Everyone who feels the need to speak up about the 5th floor corruption needs to reach out to all channels. And I hope every treacherous deed done to those officers is exposed. Hold them to the fire.

D-202-CR-201100884 clearly states Blume was charged with:

1. Receiving/Transferring a stolen motor vehicle
2. Receiving/Transferring stolen property
3. Possession of firearm by a felon
4. Resisting/Evading/Obstructing an officer

OR maybe you were looking at D-202-CR-201100469 where Blume was charged with:

1. Aggravated burglary with a deadly weapon
2. Armed robbery with a deadly weapon (2 counts)
3. Conspiracy to commit aggravated burglary with a deadly weapon
4. Kidnapping (2 counts)
5. Conspiracy to kidnap
6. Bribery of a witness (3 counts)

Looking at public record shows that Blume was wanted for agg. batt. with a deadly weapon, agg. burglary, conspiracy, and false imprisonment. If you know what those charges are, YES that does tell you about a GUN. Looking at that same public record, you will see that he is a convicted felon. An oficer knows that a felon in posession of a firearm is facing a long stint in federal prison. Felons don't want to go back to prison. Looking at media files online you will see that this convicted felon had eluded police, and was considered armed, and very dangerous even back in 09 when he fled from police in the UNM area. During that incident, APD shut down an entire portion of the university area in response, and searched the area door to door for Blume with K9 (LOBO NEWSPAPER). He escaped. Does a PD routinely shut down a portion of the city for someone who is benign? If you further search media files, you will see that this guy is the subject of yet another video where that video was released in an attempt to locate him after the above homicide occurred in a hotel where he was seen leaving in a hurry, and he was a suspect in that homicide. That video was posted on channel 13's web site asking for tips to help identify him and two other possible accomplices. If you contact APD violent crimes or homicide, you will find out that Blume was the suspect in the homicide of Brandy Kent, who was shot in the head on 1/30/11, @ 09:00 AM, inside her room at the Quality Suites hotel, located at 1500 Gibson SE, at the time he was arrested by these officers. Every officer worth half his badge in the city knew that. One would ask why a chief of police would downplay this fugitive suspect who was listed as APD's most wanted, to that of only a suspected car thief? Especially when a document posted here shows that the chief knew exactly what he was wanted for, and commended those officers. If you further inquire, you will find out that this felon was indeed armed with a stolen handgun at the time he was apprehended. If you talk to retired impact detective Kruger, you will hear about how this wanted felon threatened all officers of the APD.
The information is all there and indisputable. You only need to know where to look, and who to interview. The chief and his deputy do not want you to find this out, but that will be their unravelling for the things they have done to these officers especially when the information surrounding this latest officer involved shooting gets out. Dignity, truth and the citizens and officers of this city are suffering for selfish political reasons and to insure the arrival of one lying civil rights violator at his lucritive pension and retirement on the backs of everyone. They also will do ANYTHING to thwart the entry of an investigation into the department out of fear of what will be found on the 5th floor. There goes all of your elements. The problem is not the rank and file. It is the top. The rank and file are being used in a perverted attempt to draw attention away from the real problem; the ones causing the diversion with their lies omissions, witness tampering, and shoddy investigations, led by a city attorney who promotes unethical behavior. You can't deny the inevitable. You can't deny the truth. How would the family like to know that a homicide investigation is purposefully stalled on their daughter's death so as not to validfy the wants of this suspect. That is the shame and treachery that is stooped to every day within APD. A catastrophy was averted that night when those officers prevented an armed homicide suspect from entering a populated hotel and possibly taking a hostage or hurting another innocent person. What a shame.

It's only poetic that on one side of the chief dirty one is there a cop confirmed as a LIAR (BANKS) and on the other side a cop convicted of EXCESSIVE FORCE himself (Warfield). I give these 34's for credit for at least working. Guys remember you have a camera on and you went in a house without a warrant. You really did that and then filmed it ? Get real guys. WOW, Its a sad day when fresh pursuit becomes a reality TV show for the KOB 4 reportere Chris Ramirez. Its unfortunate that he gets the stories first for keeping his mouth shut with all the crap he learned while being Berry's Citys PIO. Great reward Berry.

APD is becoming a tainted place with a bunch or YES MEN.

BCSO and NMPS do this on a daily basis as part of thier job but APD gets rammed in the media. Sounds about right.

Discipline the officers if they violated polices, but dont make up crap. They did what they are taught in the academy (Fresh Pursuit).

Maybe Chief Stover would come out of retirement and get this city back on track.

"John Gonzales comes up to me yesterdy and is like umm, I was not aware that catching a bad guy got you in trouble anymore but apparently it does, so watch your back." How much do you wanna bet that JG is now a target of the 5th floor? A clear message conveyed by an APD supervisor as to the malicious and retaliatory ways of APD. Oh, and let us not forget the further motives of kukowski to go after Solis (former sgt). A little personal vandetta maybe???

Certain aspects of the news and activities reported about today's version of APD are starting to remind me of my military service. Back in the 1960's, LBJ ordered the Draft Board to lower the mental and educational standards that were in place regulating who was drafted into the Army. The purpose was to make many more men eligible for the draft so they could go enjoy Vietnam. He also made certain criminal records no longer a deciding factor. We, who were voluntarily serving at the time, came to know this project as "The Johnson 500,000". As these new "draftees" cycled through the training programs and were assigned to duty, we suddenly found ourselves serving beside some people who should have been in cages. My opinion: thanks to Ray Schultz and Marty Chavez, it looks like APD currently looks a lot like the US Army in the 1960's and 1970's.
