Schultz uses Cronies to his Advantage

As expected, New Mexico’s LEA board rubber stamped and accepted APD Chief, Ray Schultz’s proposal to automatically have a law enforcement officer’s certification be placed in suspended status when that officer is charged with a felony crime. As our Eyes reported, fellow board member and “citizen at large” Nate Korn, and owner of Albuquerque city police contract supplier Kaufman’s West, also voted in support of this measure.

“The misconduct definitely occurred, but the officer on a technicality slipped through the cracks.” For these reasons, Chief Schultz apparently thinks its ok to subvert, and side step, the Constitution of the United States. As Chief Schultz stated in an interview, an officer’s certification is like a license and failure to meet certain requirements may lead to its suspension. Yes, thank you Chief Schultz we are aware of that. And like your statement about officers needing probably cause in order to stop a person for DWI, you are once again wrong. A person’s driver’s license gets placed in suspended status when they fail to do certain things or are to have been found to have committed certain violations NOT when they are accused of wrong doing. A “certain thing” necessary to deprive a person of their license is more than a suspicion. As with a criminal indictment, an officer facing felony charges is again accused of doing something. While Chief Schultz seems to routinely forget we are not in 1933 Germany. Under OUR laws, a person is presumed innocent until they are proven guilty. Our Legal Eyes tell us that what Chief Schultz and Mr. Korn are proposing is simply a violation of due process in an effort to remove a person’s property interest in their job. With an officer’s certification suspended, the means by which Chief Schultz can terminate the officer’s employment is clear and fast. We are not saying people have a “right” to be police officers. What we are saying is that once a person is employed, the courts recognize one’s employment as their property. And you cannot take away a person’s property without due process.

Look, we recognize that if an officer has been charged with a serious misdemeanor or felony crime, their ability to function as a police officer is all but impaired. However, remedies exist to deal with this scenario in order to respect the presumption of an officer’s innocence. The officer is relieved of their badge and gun and they are assigned an administrative duty outside of sworn officer responsibilities. In some cases administrative leave without pay may be justified. The case the media loves to point out is former APD officer Levi Chavez. But our Eyes tell us endless supervisors tried to have Mr. Chavez disciplined up through termination before the suspected murder of his late wife. There’s only one person who kept Mr. Chavez from being terminated: Chief Schultz. Now, Chief Schultz wants to put the cart before the horse and terminate officers before they’ve had their case adjudicated. There is considerable precedent where officers have been cleared of charges who have been reinstated because it was found that their termination was unjust. Chief Schultz likes to say “a prima facie showing” is all that is necessary. Maybe that logic works in his office but it doesn’t work in court or the real world. Ask former officer Timothy Chavez who was charged with rape and later cleared. He continues to collect payment from the city because APD terminated his employment unlawfully.

Given the mass exodus of the most senior and talented personnel from within APD we have to wonder to what lengths Chief Schultz will continue to go to deflect his failure upon people other than himself. Our Eyes tell us the lieutenant who has all but coordinated the Albuquerque Balloon Fiesta will be retiring. Instead of anticipating this event, Chief Schultz assigned rookie supervisor Dodi Comacho as the balloon fiesta coordinator. Our Eyes tell us that her depth of experience in managing large scale events (remember the Downtown fiasco she was responsible for last winter?) has resulted in Chief Schultz assigning Commander Harold Medina and Lieutenant Fernando Aragon to assist her with this project. Instead of having one lieutenant manage the event, we now have two commanders and a lieutenant. And people wonder if the loss of experience and talent will cost the taxpayers??? Let’s also not forget the myriad issues other commander leaders have within Chief Schultz’s inner circle: DCOP Warfield has one confirmed excessive force judgment against him and one more pending. Commander Gonterman also has a judgment of excessive force against him which resulted in a bill of over $400,000 to the city’s taxpayers. Are these people going to be subject to the new LEA policy? Our Eyes tell us of course not because they are sworn to protect Chief Schultz.

Then, our Eyes tell us the APOA and FOP are all but silent in this matter. While we know many of our readers do not value organized labor, and we respect healthy dialogue, having labor push back on issues such as this is important to maintain balance. In the absence of balance, city and department leaders run amok and the effects of a demagogue such as Schultz are being seen in the spiraling debasement of a once fine agency. Now, under the reign of Chief Schultz, APD is the embodiment of arbitrary and disparate treatment of its officers. And the citizens are feeling the effects of this with poor policing, lack of trust, loss of experience and expertise, and constant scrutiny.

Remember that, in Chief Schultz’s own words, your civil rights are a mere technicality.

How about Schultz moving to decertify his own detectives when they screw up an officers life like Officer Zuni. For four years APD detectives went after this guy for rape, this entire time there was video tape evidence at Hard Rock that exonerated him. APD either ignored the evidence or just did a horrible investigation. Either way this guy lost his job and APD didn't back off of prosecuting him until the day of the trial when the evidence was shown to the DA. Those detectives should be ashamed of themselves for ruining an innocent man's life. So is Schultz going to do anything to them? NOOOOOOOO. Zuni will sue and the citizens will pay, that is Schutlz's MO. Remember the $2,500,000 for the retarded kid that APD detectives let sit at MDC for 2 years? The detectives knew after a couple months this kid was innocent yet they did not move to release him. In fact they and the DA office conspired to keep the DNA evidence hidden. At the end of it all the Bernalillo DA was hit with a fine from the courts (This never happens) and APD paid out in a civil suit. Or should I say the citizens paid. Then move on to the two traveling salesmen who were arrested and kept in MDC for 18 months for murdering the asian couple. Same detectives as before, same DNA evidence excluded them and yet APD kept these guys locked up. We, the citizens, paid each one of them $1,000,000 and yet nothing happened to Schultz and nothing happened to the detectives who cost three innocent men their freedom and cost the taxpayers $4,000,000! Let's pile on and add the Camacho and Costales civil rights cases. In both cases Schultz was found to have violated officers civil rights. Costales cost the taxpayer $1,000,000, I don't know what Camacho cost us. So is Schultz going to suspend his own certification? This is why Schultz has lost all leadership ability at APD. He violates his own officers rights daily, they sue, the courts find against Schultz and the citizens pay up. And now he wants to ruin officers lives by decertifying them, because they might get off on a technicality? I think that is up to the judge and jury to rule, not up to Ray to decide. If a judge and jury acquit an officer, who is Ray to say otherwise. We already know, from his courtroom tweets, that he has great disdain for our justice system. Why wouldn't he? It was the justice system that found he is a civil rights violator.

Officers need to go to the ACLU and request that they put a stop to this. Like them or hate them, the ACLU is the only group that sees this for what it is, a blantant violation of police officer civil rights. Time for the ACLU to be requested to step in and protect officers civil rights.

Schultz knows that he has been illegally terminating officers based on accusations and without cause. He knows you can't be terminated based on prima facia evidence. It is case law nationwide. Rights are protected by due process. This is his blatant admission of that by trying to cover his ass for future terminations. By getting this rights violation passed, he can in essence have a way out by being able to fire an officer because they don't have their certification. This is a disgrace. Yet again another disgusting act by schultz to abuse the system, and place officers at a disadvantage by having their careers ruined by default with everyone else taking the blame but schultz. This punk constantly puts others in positions to do his dirty work so that he does not have to get his weak little sissy hands dirty. Enough is enough. Everyone needs to boycott Kaufman's Army Navy, and a class action civil rights lawsuit needs to be initiated in this matter if it goes through. I think the city of Albuquerque has had enough of a slimy, manipulative sneak, that is so verse at having others take the fall for him by doing his dirty work, costing the city millions of dollars in lost lawsuits, and laughing about how he gets away with it every time by saying he'll be long gone before the lawsuits hit and that it's not his money.

I have never seen one person cause so much distruction to one city, and agency, violate so many rules and procedures and civil rights, retaliate and cause a hostile work environment so mant times while trying to promote his agenda on the bacs of everyone like this. I have never seen one person cost an entire city so much money as this one, yet still be given any credence at all at any hearing. The guy lies, it is proven, yet he is still given the floor. Everyone knows his MO. He rides every place he goes into the dirt then runs off right before the crash.

When is the board going to review the Chief for federal civil rights violation of Sam Costales? I believe there is a charge for intimidating a witness for ordering the IA against Costales while the trail was still in process. Has the board reviewed the court transcripts? What kind of board only investigates non-board members.

I was just reading an article on the termination of Zane Reeves from the hearing board. Does the Chief and the Mayor keep track of what comes out of their fool mouths? I found the below written in the statement.

"The mayor and chief thought Zane Reeves was biased and too political in recent cases, particularly in the case of Russell Perea."

Are you kidding me? Is this chief a 5 year old? This idiot keeps trying to stack the odds in his favor. Now with this certification nonsense,and then with getting rid of someone who was a proven neutral arbitrator. If dodi the dodo makes it to DC it will be purely a political play. On paper she is a shoe-in. A double minority with a degree. But for those you have worked around her know that she is absolutely lazy and has no common sense. Heck, it wasn't too long ago that she was investigated for failing to respond to hot calls that her squad members were dispatched to which required other supervisors to respond on her behalf. How many shootings, stabbings, etc. did she NOT respond to? How many chases were her officers involved in that she DID NOT monitor or intervene? And, wasn't it not too long ago that she was found to be routinely going home, in Rio Rancho mind you, to sleep while on duty because working nights was just to hard on her? These examples only describe her work ethic, when she actually did get involved in police or supervisory work all she did was muck things up with poor investigations and bad arrests. But in the end, maybe dodi the dodo will become a DC. This is APD by the way, where you gotta fuck up to move up.

What a joke... I guess the days are long gone when the Traffic Unit supervisor, usually the Sergeant with minimal oversight from his Lieutenant, would handle the entire event. And it was the Traffic Unit officers for the most part that would assume the vast majority of the event issues since it fell within their expertise. The very expertise that Camacho definitely does not have, nor does Medina/Aragon for that matter.

And amazingly, but a very few were high ranking personell. The true senior experience and talent was among the lower rank and file. Maybe APD has managed to grow or maintain its' numbers (for now), but how scary is it when APD has become so young and inexperienced, while at the same time promotes the most incompotent individuals to lead them.

The citizens of Albuquerque will be enraged at the money you have cost them in lawsuits for your civil rights violations, negligence, vindictiveness, retaliation and overall stupidity could have paid for new school buildings, programs for children, food for the homeless, shelters for abused women, improvements to recreation centers, programs for the elderly, and about a million other quality of life improvements for them. But NO......Little baby ray has to get back at everyone and surround himself with people to fight his battles for him, protect him, insulate him, then eventually take the fall for him. Now you're seeing it boy. Right is right, and a whole lot of right is coming at that bogus crap of an administration. Good luck getting out of the volley of lawsuits coming your way. The city attorney is going to need an army of private contract attorneys to clean up your superfund legal mess. The Chief only promotes people that have alot of time left on APD so he can't be told to Kiss his ASS and then they retire. The Chief wants only YES men/women and people that he has crap on and use it against them later. The article in the paper in regards to the Lt's lawsuit is exactly what has been happening for years and Dodi and Rowe only got where they are because of their ethnicity. Dodi has no clue and should not be in charge of Homeland Security the Lt that has been ORDERED to get her up to speed is the one that should have been promoted and given that slot it only makes sense but the Chief does not do things that make sense its obvious..

When these cases start coming to trial, there will be enough proof between witnesses to bring those witnesses in on other cases as cross witnesses that their heads will be spinning. Impeachment of credibility will be the game of the day. There is absolutely no way they will able to keep track of their lies in reference to all of these cases. The Tsunami coming their way is insurmountable, and not one of the plaintiffs should accept a settlement in lieu of trial. They have bought their way out of trouble way too often at the taxpayer's expense. AND if one of them lies again under oath they should be prosecuted. It is point now. They have finally met their match in the masses whom they've wronged. You can't screw with that many people and expect to get away with it forever.

There is one common denominator in all cases on the upcoming docket regarding these idiots. Their attorney is doing the same thing across the board; lying, denying evidence that exists, delaying progress through deceptive tactics, and outright disobeying court rules. This is unacceptable. This all needs to be linked up, and someone needs to present this to the State BAR association. This is blatant, arrogant, and out of control delaying for one reason, so someone can run out the back door with their pension.
Hopefully all of this will eventually go criminal federally and all of their little civil games will be over. The citizens and officers need to collectively give this bunch a Leonidas kick to the back of the unemployment line then to the front of the docket list to Federal Court.
