Some Things Speak For Themselves; Some Things Never Change

Nevermind That Man Behind the Curtain!!!

When faced by one of Albuquerque's many homeless in the open space area of Albuquerque's foothills of the Sandia Mountains, this was the police response:

When faced with harsh and substantive criticism regarding the failed investigation and criminal case against former 2nd Judicial District Court Judge Pat Murdoch, this was the police response from APD Special Investigations Commander Les Brown:

“I think they handled it completely properly. I don’t think they did anything wrong,” he said. “They did a very thorough investigation. Obviously when you’re dealing with an official, especially one that has notoriety like a judge or a public official, we’re gonna be very extra careful in how we do the investigation. Obviously we’re not gonna play any favoritism. It’s disappointing obviously because the officers and the detectives worked very hard,” he said. “Their job is to protect the community, to enforce the laws. So it is obviously a little disheartening because we tried to do the best case we can.”

And when given his first opportunity to himself before the community, to show leadership, integrity, and honest, this was the response from APD chief of police Gordon Eden:

And when in response to genuine criticism by a reader and citizen about the Albuquerque Journal's inept coverage of RJ Berry's police department, Journal editor Rick Nathanson wrote back:

"You couldn't possibly be under the impression that just because some police officer or spokesperson declines to immediately answer a relevant question, that Albuquerque Journal reporters will not keep asking that question until they get an answer??? !!!  I can't speak for TV, but as far as the Journal goes I can tell you that doesn't happen. I would suggest you start reading the newspaper on a regular basis. If you did, you'd know the Journal has anything but a "cozy" relationship with any police department. There is no script, no collusion. It was partly the Journal's reporting of past police shootings and subsequent Journal editorials that forced a Department of Justice investigation into APD. Thanks for your email. -- Rick Nathanson

And when the president of the APD police union writes about a fired NMSP officer who is once again in the middle of a national fiasco says by playing the sympathy card:

"He does have children and his children, the first thing on their mind when he was arriving home that night, was that he was safe and he wasn't in danger and he came  home safely to them. It takes an emotional toll on his family. Sandy's father was also an Albuquerque police officer who was shot in the face, leg and chest in the line of duty. Keith having been a child and having been exposed to a police officer that is shot, is very emotional to him"

And since RJ Berry is in hiding like a little cricket, after growing outrage of the incident's "management" (that's what you call a press conference held on a Friday afternoon when the Lobos are playing), CAO Rob Perry, came unglued and stated the following unbelievable statement:

 “This case was an incredibly dynamic situation that involved a standoff for four hours with an individual that had a history of mental instability, threats of violence against police officers … and numerous attempts to end the situation peacefully. At the end of the day, a determination about the justification of use of force by law enforcement, officer safety considerations and legal determinations are made by those people who are responsible to make them.”

If it isn't clear by now, then we at the Eye don't know what will make it any clearer. The people running APD and the city not only have no clue what they are doing but are making things worse.

Remember this Albuquerque, when these leaders and officers act, they are acting on OUR BEHALF. THEY ARE REPRESENTING US. ARE THESE THE ACTIONS WHICH REPRESENT US?

Disagree with you Eye on this one. Boyd was known to many library staff as a ticking time bomb just waiting to go off. He would stalk little girls and when security confronted him it turned violent and when APD arrived, he punched a female officer in the face breaking her nose.He chose to do this just like he chose to pull knives out and threaten officers who were trying to talk him down and trying to get him to comply and come out of the foothills. Officers chose less lethal force, deploying bean bags. Still Boyd chose to show his knives one in each hand.Boyd is a large person over 6' tall and extremely paranoid. In New Mexico a person with a diagnosis of mental illness cannot be forced to take meds which is an additional barrier LE had when trying to deal with thr mentally ill.

I don't know why anyone would have voted for Berry. He hides, he doesn't lead.

Of all the questions that must be answered regarding this shooting I have this, why was an undercover detective working a SWAT call? APD has a professional SWAT team. It contains around 15 full time SWAT only officers. They are always in their SWAT fatigues. They train together as a team and are all certified through SWAT schools.

So why was there this ROP detective in the middle of a SWAT call? APD command staff seems to have no control over their crime scenes (mary han) nor their officers. In the old days only SWAT team members would be allowed on inner perimeter and arrest team. Who with APD command allowed a non SWAT officer into the middle of this? Those in command bear as much responsibility as the detective who did the shooting. Will anyone above the detective be held accountable?

This entire incident goes right back to Ray Schultz.

You notice that the only non lethal is Taser. Bean bag wasn't deployed until Boyd was already shot and down.

Maybe if the makers of Net Gun would have given Ray Schultz a kickback like Taser did, the officers on scene would have had other tools to bring him into custody.

This is a direct example of why Ray Schultz and the Taser contract should be investigated and criminally prosecuted. Schultz signed a $2,000,000 city contract with Taser and then two months later when Schultz started early retirement he went to work for Taser. This is in violation of City Ordinance, State and Federal Law. Boyd deserves answers to why he was killed. The answers are much deeper than just what happened at the scene. The answer to why APD does NOT have a entire supply of non lethal weapons and the Schultz kickback need to be investigated and prosecuted.

Tasergate is one reason why Boyd was killed.

Gordon Eden's press conference was very embarrassing and outright disgusting. Eden's body language and "dry mouth" said it all. How could he pronounce in no uncertain terms that the shooting was a justified use of deadly force if there was is an ongoing multi-agency investigation? Now Rob Perry is seriously back tracking with Berry conveniently out of town. Was Berry in town last Sunday when this whole thing went down? Was Berry and Perry being kept in the loop, as he was in the Han case? During the press conference, Eden cited "case law" incorrectly that in fact covers fleeing suspects and argued the video showed things that it did not show. The video shows a lethal shot fired after the guy was face down but Eden said the guy was going after the canine officer when he was shot. It was as if Eden did not even look at the same video.

A question the press failed to ask was where was Eden and his Deputies at during the 6 hour confrontation involving SWAT? Why did not Eden nor any one of the Deputies take charge, intervene or question the escalation of use of force? Also, was Kathy Levy or a City Attorney at the scene? Levy in the past has tried to give orders to cops during confrontations sticking her nose where it does not belong.

The only thing the press conference did show was that Eden is a man totally in over his head and that he is a political hack that has no business being Chief of Police. It was clear he was taking "q's" from some one in the audience during the questioning period and read from a prepared text. Eden could not properly handle giving spontaneous answers even after having 5 days to prepare. Eden was signaled to walk out before questions could be completely answered. Berry and Perry need to admit they made a very big mistake in appointing Gordon Eden, but no doubt Sherman McCorkle thinks otherwise. What was not disclosed in the Chief selection process is that Gordon Eden has been a very close personal friend of Rob Perry's for years, to the point that Eden has been somewhat of a mentor giving Perry advice and guidance during his career. Eden was recruited to apply for the job, not because he was qualified, but more because he is a political operative within the Republican Party. Eden needs a "high 3" salary so he can retire, hence it was the money and not the service that really attracted him to the job.

When ROP was created it was to target ex convicts who were most likely to go back to a life of crime. I wonder what the original ROP detectives think about their old unit? It appears ROP doesn't do anything like it was first designed. The current ROP detectives are run by a commander who won't supervise or critique them. The current ROP detectives don't know how to put together a criminal case for prosecution (Murdoch). The current ROP detectives like to grow their beards and hair and run around with all their SWAT gear on. That wasn't what ROP was meant to do. Maybe it is time to disband ROP or at least rename the unit. The current bunch are doing a disservice to those who served before them.

And here is one for Les Brown. Joe Polisar created the ROP unit as a LT. If one of his detectives had a case that was so slammed by the District Attorney as the Murdoch case was, Polisar would not be making excuses. He would have demanded a complete review of the case to make sure the work turned in was complete and professional. If the detective couldn't do his job Polisar would move him. Polisar actually read and approved all the cases when he was in charge of ROP. Brown makes excuses and does nothing. He fits right in at the current APD.

I retired just as Tasers were being introduced in the 90s. Thousands of calls I handled with angry drunk armed bums. Never had to shoot one. I'm not impressed. In fact I'm very said. What has become of the department I loved.???

Just saw the unedited video on YouTube. It appears the "criminal" pulled a knife with a 3 inch blade after being attacked by the K9. Why was the dog released? Why was a flash bang used? Why wasn't the bean bag used BEFORE deadly force? Over reaction of a poorly trained police department and the new chief justified this murder? The suspect was giving up and was chided into doing something to allow the cops to murder him. Albuquerque cops, MURDERERS! The city should be proud of these killers and their new chief! This is sickening and those cowardly cops are getting away with murder! Pure and simple, the cops over reacted and shot the man in the BACK! But what can you expect from gun-slinging fools? The citizens of Albuquerque deserve everything these outlaws, or cops, give them!

Sandy shouldn't be a police officer if he has emotional issues due to trauma surrounding the shooting of his father. Check with any mental health professional, PD, etc that mental health trauma has a direct impact on response in police intervention. Even more reason he shouldn't be on the streets. The statement only makes it more apparent he may enjoy killing.

I would like to go off topic for just a moment to send my prayers to Rico for a speedy recovery. And to ofc . Ronzone (sp?) and his family during this most difficult time. A very very long time ago. (1988) I got a DUI.. was stupid and totalled my new truck on freeway entrance. Ofc. R was arresting ofc. His professional manner and concern for my well being made me realize not all cops are bad . Long story short, i went on to stop partying, got squared away, went to work for the City and now am getting ready to retire at end of year . Thanks. Ofc. R for unknowingly being a role model and helping someone so many years ago . I pray Rico makes a full recovery .

Who was the SWAT commander that allowed ROP detectives to be on the inner perimeter and on the assault team? Whatever Sergeant, LT or Commander allowed non SWAT officers to do this should be in a large amount of trouble. The SID commander should be jerked because he was allowing his detectives to play SWAT and not do detective work. Hold the command staff accountable for putting these officers, who were probably not trained for SWAT stuff, in this situation.

Blame the guy at the bottom but it is time we go all the way up and start holding the command staff accountable too. All the way to Ray Schutlz and Tasergate. Hey Ray hope you making millions on your Taser kickback, while officers at APD don't have all the tools they need. Accountability folks.

One thing I learned many years ago as an officer, things are not always as they appear. Does the video give a full context of what transpired. Are the tapes a form of evidence and if so are they required to be released to the media while an investigation is under way. I have serious concerns as to how the cameras are utilized. So much for all the complaints about the COPS program making he City appear in a bad light Mr. Mayor and City Councillors.

Where was the Open Space supervisor? His officers were the first on scene. Where was the Field Supervisor? Why was a ROP Detective there on a weekend? No Lieutenant initially on scene because they do not work weekends, the same with Commanders. After the shooting I bet the Lieutenant and Commander showed up. I have viewed the video and it is not the actions of the officers that will be ultimately in question, it is the handling of the call that lead up to the shooting. A complete goat fuck that violates so many Standard Operating Procedures and common sense. The officers may get off criminally but the settlement will be huge if a family member files a wrongful death suit. If the FEDS get involved, there very well could be some jail time for those who pulled the trigger. This city needs to look for yet another Chief of Police. Eden has no clue how to lead a department just like Berry has no clue how to be a Mayor.

I can certainly understand your alarm at this situation, but I recommend that you don't even joke about attacking the police.

They read this blog, and while we understand that you are PROBABLY being facetious, I couldn't guarantee they will too.

We can see in this video that APD officers aren't afraid of needlessly escalating a situation to where they need to use force. The experience of others points to this trend as well. If anyone thought that officers wearing cameras would slow down bad behavior, this video also shows that's not true either.

Moving toward my point, I doubt it would take much work to figure out who any anonymous commenter on this blog is. How hard do you think it would then be to have an officer pull you over, then use any number of means to jam you up?

Don't put it past these people. They've shown that they can act with impunity.

Moving on, I can tell you that anyone with some training and/or served in that dusty shithole has thought about what you wrote. Wondering if one might survive any encounter with APD, regardless of what they did or didn't do, is not how the relationship between police and the public is supposed to be.

The video shows a disgusting display of police brutality. I seem to remember 2 or 3 years ago a video hit the media showing 2 cops dealing with that Blume guys who was just recently on the news again. I understand he had several felony warrants out, was known to be armed, and from what I have heard had a knife in his waist band that night (that fact was judiciously suppressed). That guy lived, denied medical treatment, and faced justice. Those cops were fired! Now we have a man MURDERED and that political hack of a chief justifies it? What hypocrisy! Where is the DOJ? Also, there is something odd about the barrel of the rifle held by the cop from whose perspective the video was taken. I am no expert, but it looks like a suppressor. I've done some quick research and suppressed weapons are now allowed to be used my police departments in states surrounding us. Texas, no; Arizona, no, Colorado, no. But I guess cops can used suppressed weapons in Albuquerque so they can be more stealthy when they commit their murders!

A really good point is made by 12:08, where are the Lt's and Commanders? APD for being one of the nations largest police departments still doesn't require Lt's or Commanders to work weekends!!!!!! Who manages this place? This was brought up to Schultz many times and he just ignored it. Remember Chris Chase back in October? That was a Saturday and no Lt's or Commanders were working to take command. It is all dumped on the field sergeant. This is a horrible way to run a police department.

And what SID commander would allow his undercover detectives to go play SWAT on their weekend? What SWAT commander would allow an undercover detective to take point on a SWAT callout? I know Brown is the SID Commander, who is the SWAT Commander? Were they even at the scene? Apparently they don't even know what is going on in their own units.

There should be a Lt and Commander working every shift and every day somewhere in the city. A real police department would do this.

Suppressors are legal for anyone to use in the states you mention. Whether they are legal for police use depends on if they are approved by the Chief/policy. Suppressors have numerous benefits for LE use including reducing muzzle rise, reducing blast and report and lessening the risk of igniting dangerous chemicals such as are commonly found in meth labs.

So, your comment makes no sense. As to the shooting? Angry cop said all that needs to be said as far as I can tell......

I am talking to every honest A.P.D. Officer, active and retired. WE ARE BETTER THAN THIS ! I do what I can do to try and make a difference to hold the politicians accountable but I feel like I am a voice in the wilderness. Is anyone going to join with me and demand accountability no matter who they are. It is past time to come out from behind anonymous and demand change. Do you really think a politician has the answer ? I was a Police Officer over 30 years in New Mexico and never shot anyone. I was a Police Officer for A.P.D. for over 24 years and a Sgt. for over 19 years. I with my squad faced many tense situations were we could of taken human life but we didn't. WHY BECAUSE WE KNEW WHAT THE HELL WE WERE DOING ! I am not saying human life at times will not have to be taken, and I don't judge unless I am there , but I again say we are the only ones that can restore A.P.D. to greatness. APD's patterns and practices are all over the place. Blume was wanted in connection with murdering a woman in a hotel. Blume also had two warrants for agg batt with a deadly weapon, extortion, intimidation of a witness, kidnapping, robbery, false imprisonment, and aggravated burglary (home invasion) and narcotics. He was listed as one of Albuquerque's most wanted. It was a known fact that officers were told this criminal had threatened to kill police officers. Blume was known to be armed and dangerous. The night he was arrested, every unit in the city was looking for him. He fled from officers in a stolen truck almost killing motorists in oncoming traffic as he was going the wrong way trying to get to yet another hotel where he was hiding out. This guy was fleeing police the whole time armed with a loaded handgun, and accompanied with an accomplice before crashing into the side of the Barcelona suites hotel, bailing out, then running. After he was apprehended, he was found in possession of knives. Blume resisted arrest as he reached for weapons with his right hand inside his waistband. Blume was intoxicated and high on narcotics. He admitted to drinking a lot of beer and using crack cocaine. A loaded handgun was found on the driver's side floorboard of the stolen truck he crashed.

What people don't know is that he was trying to get to his room in the Barcelona suites where he was hiding out. That room was hit with a warrant, and APD is keeping that part very quiet.

Due to the lies told by chief Ray Schultz concerning this incident in an attempt to hang the cops, and make the whole thing sound like Blume was "just a suspected car thief" Ray Schultz put another criminal back out on the street. Blume's charges in reference to that incident were dropped, and they were solid charges. He went to jail on his warrants. Those warrants and charges were plead down to one charge of robbery. He received 3 years. 2 years time served, and one year parole. The murder charges were also dumped because of Schultz. So, this guy is put right back out on the street to do evil again and he does. He beats his girlfriend and gets locked up,wit two more guns.mone if them was an assault rifle. Because of Schultz's lies and deception, an innocent civilian or an officer could have been killed.

Two officers were placed on administrative leave for months while Schultz, Peck, Feist, Mason, and Sigala, concocted a scheme to fire them to make it look like Schultz was the man for the job to clean up APD when in all reality Schultz was looking to obstruct the DOJ investigation into the Albuquerque police department on their backs to cover up for the illegal grant misappropriations he and the top,administration were involved in, to cover up for his plans for Tazer Gate, the bid rigging, and hiring of his friends into personal businesses built by them with city tax dollars.

Three years later Blume is back in a federal holding facility on the exact same charges, plus many more, that the two other officers got a true bill on without bail. Had Schultz had an ounce of dignity and honor he would have answered to his own illegal activities without being a coward and trying to use two officers to protect himself. This scheme devised by Schultz could have cost the city lives. He has already cost the city hundreds of thousands in this matter and his involving of outside entities to further his scheme will probably cost himself, them, and the city millions more.

Even sadder, is that a murder of a woman is unsolved and not prosecuted because of the sefishness and cowardice of Ray Schultz and a few others who were taking orders.

Here is an idea. Everyone who marches in protest bring your tent and pitch it on Civic Plaza. Camp out on Civic Plaza. Do this in support of the homeless and mentally ill of Albuquerque. Camp out of Civic Plaza until Berry comes out of his hole and fires this police chief, investigates Tasergate, stops using the police to terrorize the homeless and mentally ill.

The cops camped out on Civic Plaza back in 2004 and got themselves a big pay raise. Well I think it is time for the citizens to camp out and demand change at APD, accountability, and better care for the homeless, mentally ill and poor.

I am afraid to drive or shop in alb what is going on over there. I also heard in the torres court trial that one of those officers held a gun to a woman during a traffic stop with a 3 year old in the back seat. Why all the shooting in the back. Why poor weak people. Why the mentally I'll. What is going to happen is the police are going to pull over the wrong guy and they are going to get shot. The bad news is this time it might a good guy cop. The community is jumpy and have guns in there cars. Watch out. I feel I would have to protect my daughter from one ofthese crazy guys. I'm sorry that is just how ifeel. Apd and the whole administration top to bottom is to blame. The community must stand up or we are just as much at fault.

@3-24, 10:21am: You equate "man up" with "put on a uniform"? Current events seem to contradict your claim. For way too long in APD the more realistic equasion would be "put on a uniform" and "chickenshit up" (or down). One point you make is true, though; "actions speak louder than words". View the tape again with the volume turned off (no words) and try to justify the "actions" of your chickenshit brethren. Putting on a uniform does not change the person wearing it. If you're a chickenshit and you put on a uniform you're still a chickenshit, but wearing a uniform. Being in APD gives you a lot of company you wouldn't have otherwise. There are a lot of people, just like the shot to hell for no real reason camper, sleeping on the ground and cold tonight. Why don't you "man up" and go put your uniform over some cold kids and go figure out what "man up" really means, comic book warrior.

10:21 a.m. "Put on a uniform...."So, police officers should not be criticized for their actions? Being a cop is truly a thankless, dangerous job. Everyone seems to second guess the cop; however, this does not necessarily demand an "us vs. them" mentality, or "put on a uniform and see what you can do.." argument. I thought officers were trained in the academy in the art of self-defense to allow the officer not to have to use deadly force in every situation. It seems APD has far too many deadly force incidents and now, after seeing the current victim having a knife with an approximate 3 inch blade in his dead hand, that seems to have been drawn AFTER the officers lied to him, urged him to come down, threw a flash bang and set a K9 on him, then shot him in the BACK; one must wonder where the concept of peaceful negotiations has gone. I would assume all of the officers were wearing vests and were trained in hand to hand self defense (one would assume the vests and training would have offered some protection from such a small blade at lease more protection than just a T-shirt), yet the approach taken was to lie to the victim, attack him, then shoot him. If those out there really believe that a person should "put on the uniform" I say the uniform has been tainted by a few bad players and a corrupt administration. Don't attack the comments here...turn your ire against those inside the department that have sullied its reputation and have encouraged this lawless, violent atmosphere polluting a once fine department.

True we can't let this incident overshadow the honest officers serving the APD. They are as deeply impacted by what happened to Boyd as the citizens, pissed off that there are officers degrading the PD they work for. Sgt. Heh is right, it's time we speak up, ask for the opportunity to talk to the feds and request protection from these idiots for speaking up. It's time for the feds to open their eyes, all the way to the mayor's office who is running for cover, just like the City Council. They are all just as liable, it's called chain of command. It goes all the way up.

I wish someone could explain how Sandy ever came to be on active duty to begin with. This site appears to have some APD members participating. I'm hoping one of you can explain why Sandy was on active duty when the public was told he would not be? This seems like a pretty serious breach of public trust to me. I also read somewhere that Sandy never repaid the state for the double dipping? Was he ever required to? Was this a debt that existed when he was hired? I just see so much wrong with Sandy. Seems like everything he touched went down the toilet. Why hasn't he been called out before now?

I had this moment today, when my three year old wanted me to play the bad guy(he's turned a toy into a gun) so he could shoot me...I was going to ask him about where he learned "Cops and Robbers" and then just started laughing! He was confused, but never mind him! Think of all those messy nuances to straighten out if you're gonna try to play a game pitting good versus bad with your baby child, and you're trying to use common figures! HaHa! Cops: not good, arguably necessary, mostly corrupt and lazy, so how to classify them? And the "Mostly good guys" shtick, well, okay. But I thought of it in terms of the lady who got raped in a bar by four guys while like a hundred people avoided noticing, and I think "Are those hundred people roughly analagous to our "Good apples"? If so, fuck them too, right? Who do you hold up for your child to emulate these days? Which good guys should they be proud to share attributes with? Nurses. Good librarians. Teachers, ah God, yes!
Me. But we're not heroes, not vaunted ones, anyway. I want my boy to love the forces for good, and all our forces for good are so colorfully fucked it makes me choke with rage. I quit cutting my hair a few years ago. I realized that the people who value looking "Clean cut" are mostly amazingly criminal assfaces. And the thing with them is, they're so many nowadays, they don't even really think they're criminals, they're just doing what everyone else does. Blurred lines? Sandstorm, you assholes. How do you tell your child that everyone who says, just like daddy,"I'm a good person" is not really, although daddy really is? All these subtle nuances, and how am I supposed to negotiate them with a simple, joyful little mind like my beautiful kids? I can't, I guess. I'll just raise him to distrust and avoid cops and assorted trash in $1000 suits as "Criminals you can't fight, because they'll always win." Oh, and then later, I'll have to teach him to deal with the fact that all these cops, community leaders, politicians, judges and DAs, everyone ripping us all off all the time; for some bizarro-world, fucktarded absolutely logic defiant reason, they make you tell them they're good people, out loud in front of everybody, on the record,etc., or they find a reason to lock you up and charge you money for the experience to boot. I'll have to teach him the value of insincerity as a survival tool, because these people are awash in a vast, shallow, lifeless ocean of it on a full time basis, and you know what? I don't think they ever had some sense of right and wrong and threw it away in a conscious move to benefit themselves. No, I think they were always fucked. Which is why there's no prodding at them until they see the error of their ways. Their ways are the ways they were hard-wired with. They're permanently, terminally fucked. So, what to do, what to do? I document. And I argue, and I bitch, and suck, fuck and cajole....And I wait for all these blessedly trusting souls to have seen enough to figure out that yet again, these assholes are ripping them off and ruining their community, just like the last batch ended up doing, and the one before that, and the one before that, and.....

What amazes me is the way the press in Alb, in fact the press in general are sweeping this under the carpet. I write as a Brit and I think it's fair to say that if this crime ( shooting) happened in Europe there would be hell to pay. I have always admired the fact that any one can walk into an FBl office and make a complaint ! Where is the justice in this matter, It should be shouted from the roof tops, the powers that be should be down on them like a ton of brick. It should be head line news all over the States.
