A Conversation that Hurts...

Four and a half years ago, in December 2009, Richard Berry took office as the mayor of the city of Albuquerque. Ray Schultz was chief of the Albuquerque Police Department then, and if that wasn’t bad enough, Berry brought Darren White in to be Schultz’s boss. And with them came Rob Perry as the city’s attorney. White and Perry, two politically connected players with a faction of the state’s fringe Republican party led by their White and Perry’s legal anti-sage Paul Kennedy and a political stooge known as Richard Berry. Who had anything to worry about?

Under this triad of Berry-Perry-White, Schultz was let loose without controls to keep his machinations in place as he focused on things OTHER than professional policing. And as Schultz abandoned his post as chief, questionable shootings occurred. Then when there was no accountability for the questionable shootings, officers pushed the envelope and used force at anything that moved or appeared to move. Then grotesque actions of misconduct followed with the nadir exemplified by the direct and deliberate actions by the very leaders Berry appointed, or retained, to run the city: Perry, White, and Schultz.

Then the citizens started to push back. Push came in the form of speeches at city council and in the form of litigation. Finally demands for an outside entity echoed across the country into the halls of “Main Justice” in Washington, D.C. While Schultz abdicated his position as chief to build his resume, nurture business relationship, and practice “nature at play” with the ladies the city and the department was under the microscope. 

Realizing an outside investigation would expose all the other things that have been going on in the city and in APD, Schultz started to make wild and bizarre actions in contrast to what he’d been doing. He even actively sought criminal indictments against his own officers whom he had previously openly praised..

Now with the DOJ concluding that APD has been run as one of the worst and most violent police departments in the nation, Berry completes the circle of lies in last nights In-Focus program on KNME with Schultz’s two buddies from Taser: Greenwood and Streicher. Under Berry’s view of the last few years, he’s been “committed” to the department and the citizens of Albuquerque; right, because that’s why citizens have taken to the streets, to city council, and to the courts and are winning on a such a level the national media refers to our city and department has being legendary in its corruption.

As Taser’s Streicher and Greenwood point out, there’s a desire to improve the image and effectiveness of APD and the city; this of course CONFIRMS the failure of the last four and a half years. They also confirm that for 4 ½ years the community and the officers who have been treated like Omaree by Berry have been left on Berry’s sidelines. They also CONFIRM rules and regulation changes, like the superficial one’s Berry put into place are not effective.

He’s going to ask DOJ to make sure the Federal Monitor is meaningful and will support obtainable milestones. Again, Berry CONFIRMS the failures he’s responsible for over the last 4 ½ years of running the city. Berry also finally makes the audacious statement that the lawsuits that have plagued this city are Marty Chavez’s fault. In saying this, he CONFIRMS his failure to keep Ray Schultz as chief and sidesteps the Ellis trial which wholly falls at his feet for the city’s largest police related judgment (nevermind what’s coming from all the others and especially the James Boyd killing). As Berry said, “April 11 started a new era of policing” and that we should get to “effective and Constitutional policing” again confirming the previous four years have been a period of darkness and failure. But he hedges his statement with making sure things are “balanced.” We hope Luis Saucedo from DOJ heard that loud and clear. Berry continues with his pontificating about bringing the community together (after all he’s done to let it fall apart).

In light of all these acknowledgments and admissions that the city and department has been not all the great things he said it was while fighting against DOJ from coming in, Berry was asked about the city’s handling of the suspicious death scene of Mary Han, and whether he was ready to “adjust the city’s posture” in response to the NM Attorney General’s condemnation of APD’s handling of the scene. Remembering Berry’s response was to call the allegations “frivolous,” Berry’s response was to say he wasn’t “familiar with what the legal department is doing with that…the mayor doesn’t run investigations” and that city’s handling of the Han scene is “not related to DOJ’s findings.” Berry also adds that “they’ve always been willing to come to the table.”

In making those remarks Berry confirms he will only do those things he is compelled to do. And when finally he is dragged to the “table” he will spin it and make it look like he’s been at the table all along. The reality is, and his comments throughout this interview reveal, that he has been feasting on this city like the fat man above and now we are seeing him scramble….and Richard Berry, this is a conversation that is going to continue……..and get much worse.

Please allow me to clarify. The link to the In Focus interview that you include in this article is for the “WEB EXTRA” PORTION ONLY. The link to the actual interview that is shown on PBS has not been posted online yet. Once it’s posted, I’ll include the link. The interviewer, Gwyneth Doland, railed Berry with her questions in the PBS interview and you could see by the look on his face he was none too pleased. The only thing of value that I found on the Web Extra video which you’ve linked to is at 2:24 where you can see in the lower right hand corner Berry getting a drink from his sippy cup. In Focus was kinder to Berry than the Journal when Berry did his dog-and-pony interview with them in that they didn’t show him drinking from his sippy cup every 5 minutes, even when it was empty like the Journal did.

LET’S BE CLEAR, BERRY. THERE IS ONLY ONE RELEVANT QUESTION. ARE YOU GOING TO REQUIRE THE LAPEL CAMERAS ON WITH ANY CITIZEN INTERACTION, SHARE IT WITH THE MEDIA ON A TIMELY BASIS AND IMPLEMENT SEVERE CONSEQUENCES FOR OFFICERS WHO DO NOT HAVE IT ON? IT’S NON-NEGOTIABLE. YOU WILL REQUIRE THE CAMERAS ON AS IT’S OUR ONLY LINE OF DEFENSE. WE GET YOUR PATTERN OF MEDIA PROPAGANDA TACTICS. THEY ARE OLD AND WORN.

And the community is coming together. That’s why we have the protesters and the Movement. It’s the only way to effectively get this resolved.

And this is why we need NM In Focus and reporters like Regina Ruiz. Great reporting! Don’t let KOB and the other media outlets compromise your journalistic integrity like Erica Zucco did when she falsely reported on the City Council meeting as being calm. Consider going independent to report the truth. It’s the future of journalism. Here’s what the future of reporting looks like and they are hiring. We desperately need this for Albuquerque and NM. If Martinez gets reelected and Berry isn’t recalled, you will have four years of reporting a massive amount of revelations about our government that should be able to get the company off the ground. I have a lot of evidence to give you if you do.

Gwyneth specifically asked Berry about the Mary Han death scene at 7:20 and Berry manages not to answer the question. His only response is that the family brought a lawsuit.

Doland's interview with Berry was pathetic and very disappointing. She allowed Berry to put a spin on the lawsuits and the outrageous settlements saying that 85% of the 120 some lawsuits settled were from the Chaves administration and the backlog created by the "no settlement" policy. It was Berry and Perry that changed the "no settlement policy" to benefit Berry's lawyer buddies like Paul and Joe Kennedy.

There was a scathing audit and report that came out before the "no settlement" policy was implemented saying that the City was paying out way too much in settling frivolous claims and police misconduct claims which was the reason for the no settlement policy. The Kennedys and Perry did not like the policy so they changed it after Berry was elected the first time to get the cases settled.

Doland did not press Berry on the fact 27 shootings and 19 deaths occurred during Berry' first two years in office and that his 58 reforms did not stop the excessive use of force or shootings. Many lawsuits are still pending from events that occurred all under Berry's watch and that will be costing the City millions, but hey, blame it on Chevez if you can get away with it with the newsmedia. Dolan did not press Berry on his admissions after the DoJ report that a lot of the information in the DoJ report came as a surprise to him and his admissions that he had not done enough and that he did not know what was going on.

Berry's comments on the Hahn case were downright disgusting and Dolan did not push it. Berry saying he did not know what the lawyers were doing in the case and he was not involved with the litigation was probably a lie seeing that Berry was on the phone with Schultz getting briefed when White, Banks, Perry, Wilhman all went to gawk at the body of Mary Hahn. Steve French, the brother in law of City Attorney David Toureck, was paid over $200,000 last year to defend the City in the Hahn case, the very case Berry and Toureck labeled "frivolous".

As far as the "wonder twins" it was painful to watch as they spouted off their rhetoric about what needs to be done without knowing very much about Albuquerque. They admitted at the City Council meeting that Schultz was the one that contacted them. Dolan asked no questions about what they actually know about Albuquerque, APD rank and file and community groups they have met with. They came across as two bland, middle age white guys promoting themselves by coming to Albuquerque to save us from ourselves and our police department. These so called experts fit right into Berry's world of incompetence.

The big question about lapel cameras is how big of a kickback Ray Schultz got for getting Taser the contract? The next question is will Schultz be prosecuted and will the city void the Taser body camera contract and actually test all the different models on the market?

When an Officer shoots someone the press conference should be done by the Chief, making excuses about who is running the investigation indicates yet another Chief who is not aware of what his own department is doing.
I understand that after the last one went so poorly Eden would hesitate to go thru it again. There are very few things that are clearly the duty of a Chief, and briefing the public about that which the public is most upset about is one of those things.
Other things include Office memorials that are public, and on City Plaza. Not done with shame as a last minute appeasement.

Granted that Doland didn't force Berry to actually answer a question but sometimes a picture is worth a thousand words. Look at his expression. He is afraid of the question. It is about time that someone asked Berry these questions - up until now no one has had the guts to ask Berry about Mary Han's death.

The Eye post failed to bring up Jay McClusfuck, I mean McClusky who is close to Berry, Perry and Darren White. Jay managed both of Berry's Mayor campaigns and did all of Berry's media. Martinez has hired virtually all of Berry's re-election paid campaign staff to run her re-election, all who are associates of Jay McClusky. Martinez has hired Berry's campaign manager, fundraiser who worked for Romney, the little fuck Hispanic spokesman and field co-coordinator. The Mayors race is the blueprint for the Martinez re-election: suppress the vote, outspend the opponent by millions, blame the previous administration and rely on voter apathy. Sadly, it will work again and we will be stuck with the Hispanic version of Sarah Palin for another four years.

This guy is seriously either stalking these guys or trying really hard to make everyone think he is some kind of UFC blowjob inside cool guy. Either way, it's really creepy. The guys in the Jackson's parking lot the other day were talking about how annoying he is. They were comparing him to a lawn knome and how he always gets busted looking at all their asses.

It is this high-handedness, arrogance and penchant for secrecy that has aided in the destruction of the national and local reputation of the department and with it the city's national standing. That freshly hired personnel are apparently immersed in this repulsive tradition demonstrates that only a complete house-cleaning of the upper brass of the city police department is going to bring the change so urgently needed.

I agree and this is what's been being said for over five years. But like Kent Walz said, Schultz is the chief for APD....

Who does Greenwood and Streicher have as clients? Is it true they work for Taser? Is this why Schultz called them? Who will they represent if the DoJ recommends fewer Taser guns? These guys have lost my confidence when they refuse to disclose who they work for. This is probably the reason they were shown the door by New Orleans. Albuquerque should show them the door also and hire people who are willing to be transparent.

He was on the scene because he got lost and stumbled onto it in a drunken stupor. It doesn't matter anyway, because we all know what he thinks about the integrity of a crime scene. Did I just mention integrity and that guy in the same paragraph? What was I thinking?
