You can't help if you can't get there.


One of the first things taught to a recruit officer by an instructor, if in fact that instructor was a cop who actually did police work on the street for a substantial amount of time was "you can not help anyone, if you do not make it to your call." This was a saying used to demonstrate the common sense behind driving defensively, not offensively while responding to emergency police radio calls for service, and getting to that call in one piece to effectively do what you were called there to do.

The administration running the Albuquerque Police Department just does not seem to get it. For them, it is all about appearance, "what it looks like," and making sure they come out of it shining, while they continue to bamboozle the Federal Department of Justice, evade transparency, while acting as if they are the champions of it, and manipulate people's emotions by distorting what the main issue is, in lieu of playing on your feelings, like they did with this case. When all else fails, the administration, has a hissy fit, a tantrum, and then lashes out like in their Facebook screen shot below.


APD PULLED THIS CRAP FROM THEIR FACEBOOK HOURS AFTER POSTING IT, AND PROBABLY AFTER BEING TOLD HOW PATHETIC AND JUVENILE THEY SOUNDED.


This week a mother and her two children were struck broad side in their car by an APD police unit at the intersection of Eubank and Indian School, while they were making a left turn, and the APD officer was responding to a priority 1 person with a weapon call. All those in this city administration could do was cry about not being given exclusive footage of this tragic event, because it could affect the investigation, while prematurely, and callously claiming the officer had the green light. This is quite ironic, and the hypocrisy is clear in the Albuquerque Police brass, and city administration stance on this, considering their criminal behavior regarding the way they hide video, or obstruct Inspection of Public Records Requests (IPRA) concerning high profile cases, when they want to manipulate the information flow to affect public opinion, and guide investigations to their desired preconceived outcome. Maybe those behind the scene were just worried about how it would affect "their version" of how this event went down, but unlike them we will present the facts, and wait for the objective outcome.

We have a little advice for you Simon (SAY AS THE BOSS SAYS) Drobik, you can have 1000 green lights, but if you travel through them all at 40MPH over the speed limit you are WRONG when you hit a car. You can thin slice it any way you want, but the law, and operating procedures clearly lay it out. We want to state that we do not have the speed stats for either vehicle that day, but neither did Drobik, nor did he have a completed crash investigation.

Below are the state vehicles statute for emergency vehicle operation in the state of New Mexico along with the Albuquerque Police Department Standard Operating Procedure 2-56.



As usual, APD's consummate spin doctor, and resident shoveler of horse shit makes his appearance on the local news, claiming the officer had a green light before there was an accident investigation completed. But....as you can see above, it is only irresponsible of everyone else in the world to have something to say in reference to releasing information during an investigation that could slant or affect the statements of officers or witnesses involved in such critical incidents. This is not the first time bigmouth, water carrying, cabin boy Drobik has done this. And since grease ball PIO Drobik is such a media darling, he is never called on it. The way we see it is that the media may have wanted to keep the administration honest in this matter.

Well, we are going to call them on it.

There is a such a thing called overdriving your visibility distance. That means you are driving so fast that your stopping distance is further than you can see. There is also a phenomenon called overdriving your emergency equipment. This usually happens around 60-65 miles per hour, as you are driving faster than conditions needed to factor in as safety issues permit. They fade, and your emergency equipment becomes ineffective. Reaction times to hearing sirens for oncoming traffic, visibility, stopping distances, decibel levels are all drastically affected with the application of speed.

Emergency vehicles need a certain decibel level to be audible through rolled up windows. The maximum warning distance you can get with a 100 decibel siren @ a ten foot distance in front of it is 160'. At only 30 miles per hour (44 ft/sec) that only gives you 4 seconds of reaction time. Factor in that everyone reacts differently, their reaction time, fear, lack of a reaction, and some may not even know where the siren is originating from, and you may see someone left with no reaction time to an oncoming emergency vehicle. 1MPH=1.467 feet per second.

If the woman driving the vehicle struck by the police unit was 250 feet from the police unit when she saw it, and that police unit was only traveling 50MPH, she only had 3.4 seconds to react. The Monday morning quarterbacks need to know that if her field of view forward was that which would have allowed her to maneuver a left hand turn legally, without constituting a hazard to oncoming traffic, there is a big problem. You can not blame someone for getting hit by something they did not hear, or see coming due to excessive speed, when or if all legal avenues were adhered to by the other driver, they would have had a fair chance to stop, or get out of the way. Let's see how Simon Drobik likes how that balances out his green light theory.



This is where this administration proved once again that they just do not get it. They are so insensitive to what happens to people around here, that all they care about is manipulating the flow of information to play on the public's feelings, in order to protect their private interests.

Just a month prior to this tragedy, the city settled the civil case stemming from the 2013 crash where Adam Casaus crashed into Ashley Browder and her sister, killing Ashley, after he sped through a red light. His cell phone information mysteriously disappeared, but Drobik does not call anyone irresponsible for that, does he? This was settled for $8.5 million. You would think they would learn some compassion? No. No guilt is ever admitted. Nobody owns their fuck ups, and nobody ever apologizes, and makes things right. They clam up and the city settles with a non admission of guilt clause.


The comments from this administration still promote an "us against them" tit for tat mentality. Drobik's statement about the officer having the green light was not only inappropriate, but disgusting, insensitive, and malfeasant, considering two small children, and their mother were in the hospital, with one dying. That is right. This administration knew this child was not going to make it, and withheld that information for days.

Preliminarily looking at the footage of the accident below, you can see from where the police cruiser enters at the right, to where it impacts the turning vehicle. It can be estimated at about 5 car lengths. The average car length is around 15 feet. That is about 75 feet. The cruiser appeared to have closed the distance from the right of the screen to contact in approximately 0.75 seconds. A modest calculation of speed would be 68MPH prior to contact, had the officer not accelerated or applied his brakes prior to being captured by video. That is one second of reaction time.

The public, and media should demand the name of the scum bag employee who posted the admonishing remark on the APD Facebook page that was abruptly pulled down. This conduct is getting old, and frankly the assholes sitting in the wings responsible for it need to be dealt with publicly.

How many more times do we have to lose children because of the fallout caused by this administration, and their cronies who cut and fled? From road rage incidents, to multiple homicides, rapes, mutilations and abuse..... there are no officers on the streets, because nobody wants to work for a criminal enterprise, so what officers we do have are flying around, trying to keep a lid on things. The response times are nonexistent. Children are now paying the price for all of this, and this administration makes it worse with their arrogant conduct, and the blood on their cowardly hands, because all they care about is getting over the goal line. They are short timers, and do not care about anything but getting to retirement.

We are sorry for this tragedy that occurred. Nobody wants to see something like this happen. Pointing fingers like this administration likes to do, does nothing but make it worse. We try to even the odds on issues like this, so we point the finger right back at them for those who can not. A 6 year old boy named Joel died. It is not about the traffic lights, or the asshole in the store with a knife. It is about a child who only got to live for six years, and a mother who lost her baby. There are no excuses when things like this happen. When the so-called leaders of this city realize that it is how you handle these things that paves the future, they will realize they have been deficient all this time, because they were raised wrong as human beings. In essence, they got to live past 6 years, but they squandered their lives. The filth in this administration will never understand a loss like this, because their parents failed in raising them. The loss of Joel should teach all of us a little bit about selfishness. Joel, who never got a chance is worth more than all of you selfish bastards.

Because of "liability" nobody wants to say they are sorry. Not once has anyone in this administration just once said "I AM SORRY." Regardless of guilt, the decent human, standup thing to do is offer your sorrow for a loss. Mortal enemies on a battle field respect each other enough to at least offer such to the other side, as in the warrior code so many pseudo wannabe warriors here proclaim to be, but we never see it do we. A police agency, and city administration postures up, digs in makes counter claims, gets defensive, and tells the public "sue us," and they wonder why we have what we have here in Albuquerque.

After reading this, please keep the Family of this child, his sister, father and mother, the officer and his family all in your prayers, as they all have many different pains and obstacles to overcome in the future as they try to recover and deal with this tragedy in their own ways.
We hate to be so direct sometimes, but this needs to be done, because those in charge pick and choose who they want to trash and burn according to the in-crowd rules of the day, and the political, agenda at the time of the critical incident, and of course to protect the administration from getting egg on their face at all times, regardless of the amount of lives they adversely affect.

Why has no one questioned why a Foothills officer was running code to a NE area command priority one call? Could it be that NE officers were all tied up on calls and no one was 10-8? Where was the Foothills officer starting from? Was this due to the officer shortage? Will Berry go into hiding again? ABQ citizens will never know. Berry is almost to his finish line, but does he have a conscience? Can he ever say "I'm sorry"

Gorden Eden should be fired this week! He presides over a police department whose command staff bears no accountability and a department that is spiriling out of control. Since Eden has been chief he has caused harm to the department and the city and as such he should be held accountable. First we had the Boyd "justified" press conference which set off a week of rioting and millions in damage ($6 Million settlement). Then we had Lt. Brachle violating all the rules and shooting his own detectives 9 times. For 15 months Eden refused to act against Brachle and allowed him to retire with full benefits. To this day Eden has never finished the Brachle Internal Affairs investigation and has not sent an LEA 90 complaint to the NM Law Enforcement Academy to revoke Brachles law enforcement license (this cost us another $6 million). Then in August of 2016 SWAT loverboy Anthony Sedler (and others) were caught by APD Sergeant Amy Sedler having an affair with a female officer. Anthony went nuts and discharged his firearm causing a multijurisdictional response to find his sorry ass. When Anthony discharged his gun he was on the phone with Amy, that's domestic violence. But APD Major Tim Gonterman covered it all up. Months later Amy Sedler, in court documents, accuses Anthony of using his SWAT sniper rifle to stalk her when she is working in the Northeast Area Command, still Eden does nothing. What will it take for Eden to act? Anthony Sedler gets his retirement time in October 2017. Will Eden "Brachilize" Sedler so he can retire too? Doesn't protecting Amy Sedler matter to Eden? Maybe he can pray on that this weekend with Bobby Huntsman. Then we have the outright lie that Celina Espinosa told the media and public when she was asked if APD had investigated a March 2016 CYFD referral regarding Victoria Martens. Espinosa told the Albuquerque Journal that detectives were dispatched and that they spoke directly to Victoria and her mother (and killer) Michelle Martens. ALL OF THIS WAS A LIE! The ABQ Free Press exposed this and Celina had to admit publicly that she lied. No officers were ever sent. Victoria could have been saved but wasn't and that is the fault of APD Command who did not dispatch. Yet Celina, on orders from Eden and Huntsman, blatantly lied. She got caught and nothing happened to her. And now we have Drobik and his bull shit statements making people believe the mother in the accident was at fault. The people who currently run APD are amongst the most horrible people you will ever meet. They only care about themselves. They lie to cover up the brutal death of a 9 year old girl, they lie to allow one of their own to retire after he almost kills his own detective, they lie to cover up one of the SWAT darlings who is stalking and threatening to kill his wife (who is an APD sergeant) and now they lie to blame a mother who has lost her son to the outrageous conduct of a police officer who should not have been driving up Eubank like he was in the a Nascar race. APD command and APD itself is out of control. The city council should demand that Eden be fired NOW (Dan Lewis if you don't do this you will not get elected). We deserve a better police department but so long as Eden, Huntsman, Celina, Gonterman etc are running this place it will only get worse.

Does it matter if the Officer was running code or speeding, the vehicle still made a left hand turn in front of a vehicle, regardless if it was a 34 car or not.

We rush to judgement to bring down the 34 regardless of what department it is. The fact is, a left hand turn was made with an oncoming vehicle. I've taken a lot of 44s when we don't have the advantage of a black box, witnesses, etc, and the driver who made the left hand turn is at fault.

Ask yourself that question if it were your son who was killed, and your daughter and wife in the ICU.
You are obviously one of those who want to have their way by what ever they have to do to make it happen.
The state law and the statute lays it out as clear as a bell. Yes it does matter if the officer was speeding. You are not exempt if you are reckless. If that woman was legally turning because the police car was so far away and he closed the distance because of speed, it is his fault. The state statute for left hand turning vehicles, below lays it out. You do not have right of way just because you are going strait, and the way you explain it is like saying something should be done wrong, just because that is the way you have been doing it. Pretty stupid, because this exactly what is wrong with APD. This is the mentality that brought thus department and city to where it is. Being a cop you should know every accident is different.

The driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard, but said driver, having so yielded and having given a signal when and as required by the Motor Vehicle Code [66-1-1 NMSA 1978], may make such left turn and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right-of-way to the vehicle making the left turn.

Criminals like Gonterman couldn't shine the shoes of a few of the good officers who were railroaded by the likes of him and his crew, but guys like him get free passes for dozens of fuckups in which any one of those infractions, had it been committed by an officer who wasn't on the in crowd or fucking someone would be fired immediately. A question off the topic. As a citizen I don't know all the things that go on behind the scenes with supervisors. But I have been trying to get ahold of the Southwest Area Commander for almost a month. I would assume they are busy but I don't even know who in the hell it is. The website still has a commander named Banez but I heard that changed awhile back. It there some sort of coverup where the supervisor tries to ignore you until you go away? I don't have a complaint I actually want to thank an officer. Not the best way to show your support for officers when you wont even call the citizens back. And on topic, I do know Gonterman, and he is an asshole.

I get that officers are human and make mistakes, but how can the citizens trust them to tell us the truth, when they directly lie to their supervisors and get away with it. Eden has got to go. How much more can this city tolerate. Just goes to show that this police silence shit will never end. Problem is Eden has no idea how to be a cop and he is trying his best to fall in line. What a major piece of shit.

Regarding Whitten, liars are now allowed at APD. And the RTCC supervisor he was having an affair with,,,,, yeah, during the investigation she was hired as a cadet at APD Academy. She was under IA investigation and Eden still hired her to become a sworn officer. APD has no standards (Yes Jessica Tyler you are included in this) they hire anyone. Crystal is now a police officer. Makes you feel like its 2007 all over again, Levi Chavez would be proud.

How long have we, that is everyone and ppl who are EOA journalists and readers of this blog, been complaining about this Administration: Berry,Perry,Eden and all of their favorite corrupt minions. Ditto for Schultz and his gang of underling criminals in suits and uniforms? Forever. And ironically all that ever happens to every one of them is promotions, raises, cleared for retirement, and leaving this God forsaken hell hole they helped to create for promotions and much greener pastures ($$$) without penalty. Can the DOJ not connect dots? Have they even tried? I think the DOJ is of the same ilk as these empty suits. All the DOJ wants to do is go for the path of least resistance and that is to penalize and criminalize the lower echelon easy targets such as the 34s field officers, rank and file. In other words make them look responsible and guilty of all the DOJ violations and because they work with the public and come face to face with them every day, that way the public can verbally abuse (or hurt) 34s while the real perpetrators responsible for the violation of Abq citizens human rights crimes are sitting behind desks laughing it up with the liberal ass clueless DOJ. smh.

Damn how things have changed. Back in the day if an applicant lied in any way he/she was dropped from the process. If an applicant successfully made it through the process and became a cadet and was caught lying, cheating, stealing they were immediately kicked out of the Academy. And none of this shit that they could try again in a year or two. Working in Law Enforcement takes a shit load of common sense and compassion. Which the APD does not seem to have.

APD can't fire people for lying. Why??? Because Schultz would have been fired in 2004 for all the stuff he did on the evidence investigations. Schultz looked for any 34 to blame for the investigation. When things got hot, he wouldn't respond to media but when people called him out, he sat behind his desk like the COWARD he is. Yes, he is a COWARD.

Your article about the science behind this accident is very informative. I would like to add one thing that I've not heard brought up anywhere....

My girlfriend and I were sitting in that exact same spot as that lady was with her kids 2 days later waiting to make a left hand turn to go east on Indian School...we immediately noticed something wrong with that whole story about the accident....

The first tree in the median just south of that intersection is obstructing the view of any anyone trying to make a left hand turn because you can not see any northbound traffic approaching in that lane they are past the tree. That lady had zero chance to react to that officer driving at such a high rate of speed. We called the city (311) to ask them you come trim that tree. To our knowledge, that have yet to do it.
