Suspicions Continue

Last week we told you about APD officer Levi Chavez whose wife had apparently committed suicide after finding out that husband Levi was having an affair (read it here). KRQE News 13 reported a few days later that investigators told them that the case wasn't "clear-cut" and that they were taking an "extra look" (KRQE News 13).

Today we got word from our Eyes that the "extra look" has resulted in increasing suspicion that Mrs. Chavez's death was not caused by a self-inflicted gun shot wound. In addition, the Eyes have it that there are questions about officer Chavez's statement and his actions prior to and following the incident. Investigators are currently waiting (along with the 5th floor) for the results of forensic tests on evidence taken from the scene.

APD's top brass is said to be nervously awaiting information that could further shake the confidence in the leadership of a department that is already suffering from one too many black eyes.

Brings to mind another high profile death of a NM police officer's wife. Hopefully, NM law enforcement has learned its lesson from that fiasco and will stop covering for cops whose wives die under mysterious circumstances. Unforunately, don't expect any assistance from Lemuel Martinez, the DA in the 13th, his track record proceeds him and it sure ain't good.

If you are saying the "other" is a whore of some type, then that means you are referring to another dead person? have you lost your mind? What kind of person would say such a thing? I can see if you want to voice some issue like so many do here, but this is a terrible tragedy, people are dead and it involves 34's. no one has been arrested or charged with anything. is there no benefit of the doubt with us anymore? When did we become so self-righteous? This administration just also left two of the hardest working 34's we have on this department hanging to dry. WE DONT EVEN KNOW IF THEY DID ANYTHING WRONG!!! If you count the number of APD officers who have been arrested during the time Schultz was DCOP and now Chief the list is very long. He owns that and as a citizen I demand a better police department. The Eye needs to produce this list of rogue officers, going back to Schultz's DCOP days. When produced it will be very long and will hopefully cause his resignation. Schultz owns the problem officers, he hired them.

I mean I didnt hear anyone one of you defending the state police officers who wear arrested by APD downtown when they got mouthy. Is it a different standard when it involves one of our own?

The bottom line 34s are held to a higher standard and it reflects bad on the others who wear the uniform. THEY chose to go to a bar, get drunk and fight with the bouncers, so quit blaming others because ultimately we are all responsile for our actions and there are consequences for those actions.

5 posts up. I feel bad for these guys but you know what, every officer needs to use some common sense and avoid those places that trouble brews in, when off duty. I mean come on, find another place to go instead of a bar. Drinking, adultery I don't feel sorry for anyone who does those things. Think about it, almost all the officers who have been in trouble recently have either been associated with booze or with adultery or both. Ethics, morals, using your head, come on folks this isn't brain surgery. Think about the consequences of your actions. When I was out of town or in town I avoided bars like the plague. And I stayed away from other mens wifes.

Now I am not saying I know anything about what happened, I don't really care. All I am saying is don't put yourself in those situations and bad things normally do not happen.

Not everyone who psots here are command, I think most of the troops are just tired of all the lack of ethics and bad conduct that crops up from time to time. This includes some of the troops.

To say the ones who do their job and stay out of trouble are the problem only reinforces that some are just trying to justify the misdeeds from their buddies.

How can we use the term "pay us professionals a decent wage" when we act unprofessionals?

Stop condoning this type of behavior no matter who it is, fool!

Without condoning bad behavior, lets not be ridiculous about this "avoid bars and beer" thing. I see no law against being in a bar, off duty, unless you are armed. That being said, if you are ANYWHERE and some jackass accosts you, you do react like you always will (i.e. like a COP). I avoided bars as much as I could compared to my peers over the years and I still have seen at least 10 bar fights involving 34s. All but one were the result of some jackass knowing they were off duty cops and starting crap. Some of the Ft Smith locals & some of their officers are reknowned for exactly this. I never fall back on the old adage that "I know these guys and they couldn't do something like that." However, I do know both these guys and I find it highly unlikely that they just arbitrarily beat up some poor innocent doorman who was wandering past.
As to the poster who made the cracks about the adultery I concur, I had an fellow 34 take my ex from me and frankly he got what he deserved -- he got HER, stupid liar is still with her and Iim sure he has bleeding ulcers by now.

I regret to say this, but, and since I was at that incident, there is some weight to this observation. Those two staties got what was coming to them and they were DICKS! Having said that, doesn't mean I like the Chief's comments but I do agree that a higher standard of personal conduct is expected. Sigh.

Take the last bunch. The Chief and his Deputy chiefs were drinking and going out with tons of other women, not their wives. Gilbert Gallegos, Ed Sauer, Fowler Johnston, and lets not forget DCOP Paul Chavez who let his admin substation girls run his command! I know I was there. The girls(Luceia) ran the command!

That 5th floor was the absolute worst example in APD history!!!! So, when you wonder why we have problems with booze and wife stealing, and loose women, our officers are just a reflection of our pasted leadership!

This current leadership is only guilty of not respecting the officers or our rights! They are just in it for themselves!!!!

We need command staff that cares about its officers and dept!

Okay... but all that aside, some seem to be missing the point. Irregardless of what the Chief or Deputy Chiefs are doing, each officer with APD is responsible for his or her own behavior. You may not be able to control what the Chief does, but you can control what you do.

Some very good points were made further up about personal responsibility, and that's what it all comes down to. I will always support the police. However, alot of officers seem to struggle much too hard with what's right and what's wrong. With what's approppriate and with what's unethical.

Good common sense should always prevail in your minds. You probably should'nt be hanging out in bars for example. Bars are where the more unsavory of society hang out. The people you arrested last week may be there. You should'nt cheat on your spouse. What are the ramifications if you're found out? There are consequences that go far beyond a moments lapse in judgement.

A higher standard must prevail. I have friends who are APD officers who complain all the time about a general lack of respect for law enforcement. Ironically, they also have no trouble admitting their own on and off-duty indiscretions to me in the same breath.

I really believe the public wants to support it's police department. But I also think that for the public to buy in, the APD will first have to stop crapping in it's own mess kit. In the end, it does'nt matter what the Chief does. The street cops will still be around after he's long gone. Nor does it matter what the State Police do. Take some personal responsibility. It's the only way to truly change how APD is percieved.

You have every right to go hang out at bars in your off time. But when you do that, take the responsibility of your action if/when something bad happens. Don't go crying saying cops in other towns were in with the bad guys. YOU PUT YOURSELF THERE, accept and be responsible for your actions.

Whenever I travel out of town bars are the last place you will find me at. I take pride in my badge, love my family and would never want to bring any shame to APD. No one made me pin the badge on. I made that decision freely. As such, I try to live my life to a higher standard.

Don't get me wrong, on almost accounts there's virtually an "anti-leadership" mentality within this department. How so? Its symptoms are easy to see:

1. Staffing trends reflect negative growth.
2. Reduced academy classes with class sizes reaching the point of open mockery
3. Decreased morale, job satisfaction, and productivity
4. Reduced applicant numbers.

Are these symptoms the result of the current Chief and DCOP’s? Probably not but they do a great job perpetuating this and they are a hard reflection of poor policy and gross mismanagement.

What is obvious is that there is media and public outcry and the administration is silent. There is open outrage amongst the ranks and the command is silent. The union, bless its heart, is emasculated in that sure there’s the fight behind closed doors and there’s the passivity of a well placed ad but there’s no obvious or otherwise visible leadership.

In fact the only time anybody speaks up is when some officer is about to get disciplined or fired. That action stands alone in speaking for itself. The hallmark of this period of APD, its nadir, is “we fire officers but promote sergeants, lieutenants, and captains”

P.S. "Bars are where the more unsavory elements of society hangs out" Yeah, every time I've been to Elaine's in NYC I see some really bad people....WTF???

As a citizen, I would like to see a dept that does not have the issues and problems that I have read here from your administrative bosses. The double standard that seems to be going around APD is just uncalled for!

I can't believe Mayor Chavez just lets all this mis-management go on. He did very little to curb the last administration and seems to not care what is going on with this one!

Although APOA President at the time, Paul Pacheco gave him $40,000. of the APOA's money, he has never helped the dept. Hey APD here's an idea, since you're going to be blamed for mishandling the Red Light Camera system and the political demise of Marty's senatorial bid, why don't you just be a man, stand up and leave politics to politicians.

Chief and the DCOPs, do the right thing before this phase of your career ends. Tell the public like it is and go down fighting for your troops who fight for you everyday. There is no better time than that coming up. He's wounded and will be thrashing about blaming everybody but his own poor leadership. You however still have a choice whether you want to leave with your head held high.

Remember what integrity means: doing what's right especially when others aren't looking. Well it's time to cowboy up.

It is amazing how so many things get blamed on lateral officers with APD. I think APD has hired their share of bad cops who are not laterals. There is currently one officer with an indictment for killing his step-father and another one facing rape charges. Not to mention the past officer who was a bank robber and the one who crashed his police car while he was drunk. These officers were not laterals.

Yes, APD does make some bad hiring decisions, both laterals and non-laterals. This administration is more concerned with meeting their "quota" of 1100 officers than they are with the quality of the people they choose to hire.

APD cannot compete with other agencies and are forced to take some less than desirable candidates due to the low pay. A recent study showed that Albuquerque is one of the most violent cities in the nation yet our officers receive the fifth lowest pay in the state. I am sure if APD wages were compared with the wages of other comparable sized departments throughout the nation we would be at the bottom of the list for pay and benefits.

If APD paid better they would draw more applicants to their testing process. If we had more quality candidates we could pick and chose who we hire, not be force to hire candidates with questionable histories just to get the numbers we need. The only way we will start getting more quality candidates is if we are competitive with other agencies.

The administration should be more concerned with taking care of the good officers they have and with recruiting quality candidates than they are with simply getting the numbers the mayor's office demands.

The citizens of Albuquerque need to tell mayor marty that it is time to take care of the people who risk their lives for us everyday. APD officers have not had a raise in almost 5 years.

There are some officers who need to go, but the majority of our officers are truly Albuquerque's Finest.

If we keep paying such low wages we will keep getting the same bad results.

It is easy for APD officers to come here and bitch, but that will not change anything. The APOA needs to camp out on Civic Plaza and do it now. With Marty running, a public dispute with the police, after Albuquerque was named one of the most violent city's in the nation, will stir up some action.

Lawrence Torres sold APD down the river....That guy was for himself from the start. Torres and Bakas first worked a deal to get him, Torres on APD, then after he f*#ked the APD membership, the Mayor moved him to the 11th floor. A position that is way above the guys head!!!!!!

He sucked as an Open Space Officer, always kissing ass to his buddy Ruben Griego, who Bakas made an APD Lt. They will also use what influence Griego's dad, ex-city councilor Vince Griego has left. The infidelity on APD is HUGE. It starts from the top.. Look at Fowler, he had the audasity to go to Smith's funeral, talk about their friendship, then bang and marry his widow....Boy that was fast. Fowler went up there and said "we all envied him for marrying the homecoming queen" then he goes and leaves his wife, moves in with Rick's widow and then gets married. I know of two other officers that have done the same thing.. NO INTEGRITY...

OH hell, you must be young, I know of a lot more than two. It is honestly the worst aspect of policing, and the one that leads to the most infighting and disrespect. An old friend of mine once said "Come to APD where any of us can donate a kidney to the other as we are so incestuous." I still dont know whether to laugh or cry at that statement since it is so sadly true. Otherwise decent guys do it and so do some lowlife lying scum, it is the great equalizer that keeps us all at such a lowclass level. And being viewed as lowclass, dumb, blue collar types is why and how they hold us all back.

FYI Can't camp out on Civic Plaza, we tried that before, was told by administration if we didn't leave we would be charged with criminal trespass and discipline. Let's not leave out the PD dispatchers..it's there for the taking (no,not ALL of them). One in particular MW who screwed a big fat Lt (now retired) and another Sgt RB (now retired) for YEARSSSSSSS. All the while married to another 34. He got smart and dumped her 400 pound ass. She always thought she was the only one RB was doing. What an idiot. He did everything that had a hole in it. Now that she's retired, I imagine there is a line of APD cars at her house 24-7. Maybe she was the elevator bandit. Wouldn't put it past her. The tunnel used always be famous for BJ's when dispatch was downtown. Now that they are out in the boonies, God knows what goes on in the sand dunes....My partner always says BCSO's kids and APD's kid can never date because they are all related.

If you are going to post messages that could be so harmful to others then you need to post the proof that goes with them. All this rumor crap is what makes APD seem like the keystone cops.

I don't know this Donna Dean but I think what is being posted about her is horrible, without any facts. I would urge the EYE not to allow these types of personal attacks without proof.

As a citizen I am ashamed of police officers who smear each other like this. It amounts to school yard bullying. I sure hope no one in this gals family reads these horrible comments.

I don't need to post my name as I am not naming people and defaming them publicly. I am not accusing anyone of adultery. These other posters have posted a persons name for the public to see and have accused that person of doing horrible things. I am only telling those who bully and smear people publicly to have the balls to post their real names.

The comments you make can be harmful. When you attach your real name to it, you think about what you are posting first and are not so quick to smear someone.

You can't?? I saw him at a local SW restraunt b4 he was divorced with a certain working girl, late night, drunk. Twice!
A few years later I saw another certain city official there with that same working girl!! All this within the last 7-10 years. (somwhere around there.)
Something needs to change here. Someone gave way to the corruption and it is a big mess! They didn't even care that they were being seen??? That sucks. Tara dying and leaving 2 beautiful children hits home, too young with so much life to live!

See today's Journal, Marty admitted that APD only has 998 officers. Now we know he counts the part time CSA's so when you remove them APD is below 950! They graduate 9 officers right before Christmas and are expecting almost 70 retirements by Jan 1, 2007! This city's police department is in crisis with it's staffing. They are not growing they are shrinking.

APOA you need to get these facts out to the media ASAP

APD will have only 900 full time sworn officer by January 1, 2007! And God knows how many of them are under investigation and indictment. Good job Ray and Marty, you have finally driven the car over the cliff.

FYI: Officer Levi Chavez was not a lateral from Los Lunas Police Department. He was actually hired from within. He was with APD Aviation for a little over 2 years.

Levi was los lunas first tried to come to apd they wouldnt hire him so he went to aviation and layed low, then when standards lowered he came to APD then all hell broke loose and the greeks got ahold of him. Waallaa we have the conumdrum we have now!

Someone's research was incorrect. Levi was first with Rio Rancho PD. Then went to Aviation. Then to APD. NEVER with Los Lunas PD.

The VCSO is still working this case. One thing for sure Tera Chavez did not commit suicide and she deserved a better person in her life than the scumbag she married! As for her affair with Nick Wheeler she could not get break in life; another scumbag! I truly believe if the family knew what she was going through, they would have interviened.

Is there any truth to a statement made by an APD Officer that Mrs. Wheeler informed the late Mrs. Chavez's husband of the affair between their spouses and in a jealous rage he took her life? As I sat for breakfast in Duran's Pharmacy this was the topic of conversation by Albuquerque's finest.
