Lynch Found Guilty

We're getting reports from our Eyes downtown that Peter Ryan Lynch has been found guilty for misdemeanor destruction of property. The sentencing is supposed to take place later today and our Eye tell us that Mr. Lynch faces a fine and up to 6 months in jail for his actions.

We have no doubt that Mr. Lynch destroyed the Mexican flag - he admitted as much. What astounds us is the fact that The Center of the Race (El Centro de la Raza) and the UNM ROTC are utterly incapable of taking any responsibility for the incident. Both organizations directly contributed to inciting Mr. Lynch by failing to live up to their respective responsibilities - the ROTC for not removing the Mexican flag when The Center of the Race failed to show up to do so, and The Center of the Race for not showing up in the first place.

It's too bad that a Mexican flag met an early demise, but it leaves you asking the question - if Mr. Lynch had destroyed Old Glory would he have been prosecuted at all. Something is very, very wrong here and it goes far beyond the torn fabric of another nation's flag.

770 KKOB is reporting that Peter Ryan Lynch has been sentenced to 48 hours of community service, court fees of some unspecified amount and to replace the Mexican flag - which he had already offered to do. We've got a great idea... Perhaps, Mr. Lynch could spend some time teaching patriotism to children. You know, love of country, respect for our flag, and dedication to duty.

For some reason there has been some confusion about Mr. Lynch's sentence. Our Eyes tell us that the sentence is 48 hours of community service (agency eligible) and $71 in court fees. The replacement of the Mexican flag was part of a preexisting agreement with the university. The conviction itself will be expunged from Lynch's record if he stays out of trouble for 6 months. One other item... we're not hearing anything about anger management class as part of the sentence.

Our question is if Lynch had already agreed to replace the flag, why did the UNM Police and the District Attorney's Office feel the need to get involved and prosecute? In our opinion, The Center of the Race missed a golden opportunity by not accepting an apology and a new flag. Instead they called for hate crimes prosecution and insisted on prosecution.

I just found a Mexican flag online at United States Flag Store, for $35.00. It's 4'x6'. I've bought flags from this site before and they're top quality.

I'd be willing to buy it for Mr. Lynch if he would send his contact information to this site. He may not want too, but if so it's on me. If he wants 2 of them I'll buy both, that way he'll have one to replace and one to burn. Like a previous poster stated "free speech".

Mr. Lynch claims that a few days after the event, he appeared at La Raza HQ with a replacement Mexican flag as well as a new U.S. flag, and he apologized for destroying its property. La Raza refused to accept the flag he offered. Given this, it is utterly reprehensible that Brandenburg proceeded with the prosecution. Everyone should remember her actions in this case and the Elton Richard case when it's time to vote!

I just heard an interview with Lynch & Jim V on KKOB. Lynch sounds like a stand-up guy that relalized he'd made a passionate mistake, tried to appologize to La Raza and replace the flag, like the above poster stated. La Raza refused his offer and made comments to him that he didn't want to repeat.

He was trying to make restitution, which for most HARDENED criminals is enough for Brandenburg, but not this time.

Lynch is a college student, trying to get an education and living on a fixed income. Now he has to pay court fees, etc. He no longer feels welcome here and I don't blame him. He plans on leaving when his probation is up. How sad, and backwards we are here in Old I mean New Mexico.

Any country's flag can be flown as long as the "American" flag is flown above it. At least it's suppose to be that way in the US. I'm sick of this backward discrimination and if I were Lynch I'd be leaving also. I'd go to a place where the streets aren't paved with gold for the Mexicans.

Well, once again the "justice" system in ABQ has railroaded a military veteran for doing the right thing by custom and common sense but apparently not by law. While we've all been busy with our day to day lives, liberal actvists have been changing laws so that protecting our property and persons (as Elton John Richard did) is now potentially a felony. So too now is protecting the Nation against possible foreign invasion (a rational if unlikely conclusion if one were to see foreign flags hoisted in place of our own....remember the movie 'Red Dawn"?). Having served on a jury 3 years ago regarding an elderly man protecting his front porch from unwarranted (literally) intrusion by the APD and finding in his favor, I am sickened by the thought that pro-active actions to protect ourselves is now subject to prosecution and that juries are becoming such sheep that the Prosecution can convince them that such actions are criminal!!

FYI: All of the witnesses called who (quoted flag code) misquoted the flag code and most people do. National banners are to be flown with the same prominence since they are both nations. This is not a race issue; it is a sovereignty issue, simply and ONLY. The United States does not fly foreign flags above nor in place of it’s own. Mr. Lynch, if he did indeed try to replace the torn flag in the following days, had no reason to be prosecuted other than as a figurehead to teach the rest of our citizenry to stay in it’s place. I spent many years in law enforcement and saw plenty of crimes go un-prosecuted that were far more grievous and frankly far more provable. Some group pushed this issue to the point of prosecution and the media assisted in forcing the DA’s hand, making darn sure Mr. Lynch paid his pound of flesh. I have family from both camps on the racial issues that have been drummed up and not one of us can figure out why this was such an important case vis-à-vis the entirety of the things that go on in this city that are far more deserving of prosecution.

Now rest assured that everyone of us has learned our lesson to worship at the altar of diversity, to never question another person’s cultural beliefs or flag nor country of origin, for we will all remember this and feel sufficiently put in our place. That at least is the message they wish us to “get” from this, what in fact happened was a bunch of animus and ethnic pride slogans and some overt racism on both sides. Mr. Lynch’s sentence has one glaring issue and that is the “anger management class” part of it. I submit that everyone who has raised their voice on both sides of the issue appear at least as “angry” as Mr Lynch, however the rest of them have only a petty misdemeanor to lean on whereas Mr Lynch had the US Flag code and 232 years of our being a sovereign nation.

Historically notable, the land where that flag was flying at UNM was part of the Republic of Texas from 1836-1845 based upon the Treaties of Velasco between the Texas republic and Mexico In 1852 it was ceded by Texas to the US Federal government in return for the assumption of debt owed by Texas.

We all know that Mr. Lynch could have driven drunk for the 10th time, run from police and probably peed in the patrol car afterwards and not gotten this much attention, sentence or retribution.

I must be the craziest person in the entire city. I mean here is a guy who tears up someone else's property, is convicted of this, and ultimately sentenced fairly, and there are still people who are outraged. They are not mad that he was denied some due process, or tricked or scammed by the powers that be. No people are just mad because the system functioned the way it was supposed to and the result sucked.

I read this blog and how often do the comments speak about how the rule of law is never enforced and how everyone gets off. Every person out there who consistently reads and comments about this blog expresses frustration that the law in never enforced or enforced poorly.

Well this time it was, this time a jury of Mr. Lynch's peers heard the evidence Mr. Lynch had able counsel, and a fair judge who gave him broad authority to present his defense. Prior to trial, Mr. Lynch had a chance to determine who he wanted on his jury panel. Mr. Lynch had the option to raise legal motions excluding evidence that the DA would present. After the state rested, and Mr. Lynch decided to not tesify, the jury determined that he did indeed destroy property belonging to another. The jury didn't say he was a rascist or a hero. Just a vandal. That's all. And that's all this case is about.

Might it have been different if he took the stand, presented some evidence of his mindset or motives. Absolutely. But he didn't. He chose to limit what the jury would consider, and for that he is responsible for the result (and for those of you who are thinking "it is not his burden to testify" I agree. But once the state makes their case, you gotta rebut it somehow).

And so, whether you like the result or not, the rule of law prevailed and Mr. Lynch received a fair trial. To argue with the result, rather than the process, defies the entire purpose of what this blog aims to remedy.

Mr Lynch should appeal as the DA brought these charges on behalf of the flag's owner (the La Raza group). I would contend that they are not the flag's owner as they abandoned the flag for several days even after being contacted by Mr. Lynch.
I would also suggest Mr. Lynch bring slander charges against the La Raza folks for publicly calling him a racist.

I am on Supervised Probation for six months... I was sentenced to Six months in JAIL that was deferred to Supervised Probation.... I have to pay for that $150 + $71 in Court fees. I also have to pay for the Anger Management. I also have 48 hour Community service that's 6 Weeks!

I accept it, but that doesn’t make it right!

This is crazy I am the only one punished? I am the only one Accountable? Why doesn’t someone else get so much as a reprimand? The Army ROTC Commander should lose his commission! The university Administration should be investigated.. Since Rita Martinez-Persons, and Cheo Torres called me a Racist and Xenophobe on the news before they investigated what happened!

This is not a State of the USA, I'm leaving New Mexico ASAP... You can have it ... Obviously nobody gives a damn about the US flag in New Mexico, and this state holds the Mexican flag in higher esteem. FUK NM! IM OUT!

It seems like that's all you got, and I am sure the vast majority of the people who make comments would disagree with your only tactic-ad hominem attacks. That's how children argue when their brains get overheated. Hang in there and have an aspirin.

Like I said, the case is only about one thing-other people's property. I don't care if the PROPERTY Mr. Lynch tore up was a Nazi flag, the fact of the matter is that it belongs to someone else. And that's my point, you are arguing the moral side of this issue, while I am arguing the legal side. If Mr. Lynch, in a fit of outrage, tore up a Nazi flag, he would have my moral support, but I would agree that he would legally have to pay for the flag he tore up. It's that simple. WHy is it so hard for everyone to simply say, "Lynch, I agree with what you did, the statement you made, but you gotta pay for the flag and deal with the criminal (legal) repercussions of that statement."

And by the way, how many people who claim to support Lynch's actions showed up to court, asked to be heard at sentencing, or even sat outside metro court with a sign.

Anyways, all I can say is good luck Mr. Lynch, New Mexico ain't all bad, and you need to go to law school.

Thanks for posting news about the heroic and patriotic Peter Lynch, the Air Force veteran who took down a Mexican flag after he found it flying on U.S. soil without the Stars and Stripes flying high above it on the same -- or an adjacent -- flagpole on the University of New Mexico campus!

Despite the fact that a jury found him guilty of criminal damage to property, I say he did the right thing and should be pardoned by Gov. Bill Richardson. After all, people have fought and died for our flag!

That said, I invite all who feel the same way to join me in a new effort launched today.

Don't cry for Peter Lynch because he's no saint. In his MySpace "Manifesto" he talks about everything from running over people with a semi truck to a vaguely veiled statement of anarchy in which he says, "over through the government". (Did he mean "overthrow"?) He has a record for disorderly conduct, drag racing, speeding, driving without insurance, driving on a suspended license, etc. Look for yourself what he's done in Arizona and Albuquerque:

Your quoting this is exactly why an “Expunged” Record is still a record… a Deferred sentence is still a sentencing…

What is he actually guilty of in New Mexico?
Only the following…
Drag racing
Not wearing a seatbelt
And now Criminal Damage to property (even if it was differed his record will still show it)

In Arizona?
Misdemeanor Disorderly conduct (Non-Violent Non-Repetitive)
And Speeding

So stop your finger pointing this guy stood up and took his punishment… takes responsibility for his actions. The same cannot be said for the person who retired the colors, or the University.

As a mater of public record Verónica Méndez-Cruz, director of El Centro de la Raza. Perjured herself on the witness stand. You can see this in the courts records, no other validation is necessary other than her testimony.

Furthermore Rita Martinez-Persons and Cheo Torres are guilty of libel with the letter they put out shortly after the incident.

Is he a “Saint” no … Are you?

I propose that it was entrapment… The flag was left up intentionally for someone to create a “Racial incident” that could bring attention to El Centro.

Personally, I do not care if Lynch was a sinner or saint before this incident, because the important part of this incident is not what he did in the past. His past record is no worse than that of many judges, attorneys, and others in power in our state. (Certainly not worse than Marty's if it was not covered up all the time.) It is a common tactic of those who do not want us looking at anti-US sentiment driving our courts in NM to put down and vilify those that they attack. (To smear, arrest and falsely convict them - see http://family-justice.org/stories/retribution.html) The interesting questions are: why did Brandenberg choose this as her "cause" over other offenders like former Judge Wayne Griego or the scumbag Brennan?; if Gov. Richardson is such a standup guy, why isn't he intervening in any of the ridiculous crap that Brandenberg has done lately?; and if Gary King is so great, why is he completely silent while citizens are screaming about nonsensical and harmful decisions by Brandenberg? I happen to like Lynch's attorney. He's one of the few honest ones left. Knowing much about the judiciary here in NM, I can tell you exactly why he left it to a jury. Leaving it to this corrupt judiciary, mostly run by MALDEF-educated Mexican-Americans with an agenda and a chip on their shoulder, he wouldn't have had a snowball's chance in hell. They grew up in the system with Veronica Mendez-Cruz' relatives. At least with a jury he can hope that someone will have some common sense. Not all Hispanics agree with La Raza, MALDEF, or Aztlan, and many despise these groups as much as non-Hispanics because they are Americans first and foremost. There is no way to tell ahead of time how the jury is stacked. But most of us know pretty clearly how the judiciary is stacked. The truth is, there is not much justice in this state. Try if at all possible to keep your issues out of court. They don't follow the law and they don't follow the constitution. If Brandenberg hadn't made such a damned big deal out of it, there would not have been a trial. Remember this at the Brandenberg/Torraco election contest.

If you are coming to this country to make a life and leaving whatever shithole you did live in, you need to live it behind and respect the flag of the United States. If you want to take pride in the flag of the country of your origin than stay the hell out of America and fly your flag in your own country.

Well you can flap your gums all you want about "knowing much about the judiciary here in NM" that still doesn't make what you say right. And to the poster that said Lynch wanted the jury, not his attorney, well that's my point: his attorney should have known better. An attorney is there to advise, to "counsel" that why they're called "counselors". Maybe John D isn't up to the definition.

My question still stands: Was this a unanimous decision by the jury or was there a holdout? Just curious.....

Oh yeah, and ref: Torraco, she's just as much a political whore as Brandenberg. Remember her trying to make political hay out of the Elton Richard case? She would have prosecuted that case same as Brandenberg. So spare me that righteous Torraco attitude!

4. He could have quietly pled (to the act he admitted was wrong) and the trial would never have been a story
5. The jury was unanimous, or it would have been a mistrial

I have been found guilty of a petty misdemeanor… I am responsible … and received a stern punishment in light of the fact that I attempted repeatedly to apologize and replace the Mexican flag.

Now I ask for someone else to take responsibility for the criminal act that provoked me. No one punished for breaking the crime as outlined in the US code. A Federal Law was broken; yes, I did break the law, but not a federal law. I do believe two wrongs do not make a right. In addition, I believe in equality and there should be some other punishment, ether at the University level or Army ROTC, Someone else should be held accountable for allowing the American Flag to be insulted for three days including one that is listed in the US Code as “Especially” important and be punished for that act. I feel it is ridiculous that only my crimes are being brought to the courts, only my crimes are being punished. Who else is going to be punished for this incident? Doesn’t anyone see what is really going on here?

The pledge of allegiance is no longer mandatory in schools anymore. It’s not because of the line “under GOD” instead it’s the last line “And Justice for all.” The state of New Mexico and El Centro got there Justice… Where is the Justice for the American People who were insulted by the act of flying a foreign banner on a public school on US constitution day?

This is whole thing is heartbreaking to me, I truly feel this illustrates what’s wrong with America today, this is a perfect example of the rights of those people in power out weighing the rights of those who are not in power. This illustrates the decline of our nation and in my opinion the death of the idea that was America. The first amendment of the constitution protects a person burning the American Flag, even if the flag is not theirs to burn… look at Brown ‘vs. the State of TX.

I am sure you have all seen the photos of the Mexican flag above and inverted US flag at a school in California. Was not that school taken over, invaded or otherwise? Is not that what the raising of those flags deliberately intended to represent? Was it that far fetched to think this could happen at UNM given their obviously Hispanic bias administration? Look at the letter titled UNM will not tolerate acts of racism or xenophobia, that Rita Martinez-Persons and Cheo Torres published in the UNM Daily Lobo on 9/19/07. This was before any one talked to me, or the investigation was completed! I suppose since I don’t have the power I no longer have a right to due process, these people obviously don’t understand what America is really about. They just don’t get it! In addition, they are in charge of Student Affairs and Academic Diversity? Rita Martinez Persons, is a racist, she is prejudice in her words and actions yet this racist is in charge of UNM academic diversity. Then accuses me of racism that doesn’t pass the common sense test. I refuse to call it reverse-racism since that seems to make it okay… RACISM in any form IS NOT OKAY! In addition, when university administration is obviously racist there is a HUGE problem.

Look at her “diversity plan” it is obviously bias in favor of the majority of students. It even speaks of the majority, then outlines how to assist them! Yes, it favors the majority not the minority, is that the meaning of diversity? On the other hand, isn’t this the definition of prejudice?

Why is there a separate Raza graduation at UNM? I do not care how you try to spin that, it fails the common sense test. Either, it is wrong to make others feel excluded, or it is wrong to teach children they are different and extraordinary if they get a degree. Either way it is wrong and is in direct contradiction to what Dr. Martin Luther King has taught America.

Furthermore, went I spoke with Rita Martinez Persons last September about the co-authored letter. She told me that the only reason she could not prosecute me further was that did it on US constitution day. Obviously, she felt I do not have a right to due process; wonder if my name was Pedro and not Peter she would allow me that right.

The crime I feel the American people deserve justice for is outlined in the UNITED STATES CODE; TITLE 36; CHAPTER 10; §174. titled Time and occasions for display. Para D: titled Particular days of display
The flag should be displayed on all days, especially in September; Constitution Day, September 17.
In addition, Para E: titled Display on or near administration building of public institutions.
The flag should be displayed daily on or near the main administration building of every public institution.
