For Mayor-Elect Berry the news was an embarrassment because candidate Berry ran on a platform of fixing the crime problem created by the Chavez administration and presumably Marty's Chief Minion, Ray Schultz. In point of fact, the selection of Schultz itself made Berry look rather less than honest and both the media and the public can easily spot hypocrisy and/or political expedience.
[Sidebar]Late Wednesday afternoon things got even worse for the new chief (same as the old chief). For the past two weeks a lightly covered law suit was going forward in U.S. District court in Santa Fe. In it former Officer Sam Costales was suing APD and Chief Raymond Schultz for retaliating against Costales for giving testimony for the defense in the case of State of New Mexico vs. Unser.
A new mayor has not only the power but the duty to surround himself with "his" people. Chief Schultz was but one of the early missteps made by an inexperienced but ultimately honest politician.
Berry's mistake? Listening to his soon-to-be Public Safety Director. Darren White has been working with Schultz for more than just the past 5 years, but since he was a new APD patrolman and young Darren's first sergeant. Our Eyes tell us that White promised his first boss that he'd be staying on within hours of the election.
In his naiveté, Berry failed to realize the very real political implications of the Schultz choice - implications that should have been readily apparent to both White and Berry's other top appointment, David Campbell. It appears that both White and Campbell are busy following their own agendas.
[End Sidebar]
Costales claimed that Schultz and the department created an atmosphere where he feared for his life and was ultimately forced to leave the department. Wednesday afternoon the jury found for the plaintiff and Costales was awarded $662,000.
The jury found that Chief Ray Schultz personally violated Costales' civil rights as did the Albuquerque Police Department. In addition, the jury found that there is a "blue wall of silence" and that the actions of Chief Schultz were retaliatory.
The lawsuit also named Sheriff Darren White and police union official James Badway, but claims against them have been settled. The jury finding makes it look like the entire department acts in unison to close ranks and protect their own even if the "offender" is one of their own. The reality is a little more subtle than that and a hell of a lot more dangerous.
Our observation is that while rank and file officers are regularly drawn and quartered publicly, while the favored few - the good ol' boys - are regularly protected from the consequences of their own screw-ups and misdeeds. Our Eyes even tell us that some of Ray's Favored have even been protected from allegations of criminal conduct.
It's no surprise that when Sheriff Darren White called Schultz to complain about Costales' testimony in the Unser case, Chief Schultz sprang into action to punish the officer who had the temerity to testify against the Sheriff's deputies. It's not a "blue wall of silence" as much as a blue barrier of fear where the mighty Favored Few are protected at all costs and the rank and file never know when they might be sacrificed to "prove" that the department is capable of policing itself.
All of which brings us to another of Berry's campaign promises... transparency. How can APD operate transparently when officers fear retribution? Transparency requires honesty and honesty is the first casualty of fear. Officers shouldn't face retribution for telling the truth, speaking their minds, or doing what's right. They should be rewarded not retaliated against.
[Sidebar]Until December 1st, Chief Schultz, his cronies and his cover-ups belong to the little vindictive outgoing mayor. Before Mayor-Elect Berry has even taken office, Chief Schultz has become an embarrassment to his administration. That's two strikes in as many days. After December 1st, the mess that is the APD 5th Floor will be owned by Berry.
It's telling that there was only one currently serving officer courageous enough to testify for the plaintiff. Our Eyes tell us that Sergeant Paul Heh testified yesterday much to the chagrin of Chief Schultz. Part of his testimony was that he feared 5th Floor retribution simply because he was called to testify.
If you're on the street and run into Sergeant Heh, tell him thank you and watch his back. You can bet that Schultz and crew will be looking for some payback.
[End Sidebar]
The only questions remaining are how many strikes will Berry allow Schultz, how much more political capital is Darren White willing to burn on his favored friend, and how long will it take for the new mayor to figure out his mistake?

EMBARRASSING!!!! Give me a break. Get rid of this guy now...and send White packing with him.....and don't forget TJ...all 3 of these goofs have been covering for each other for a few years now.
I would like to know some details of the "settlements" with White and Badway. I suppose they came out of taxpayers' pockets too.
UNBELIEVABLE!!!!!
Thank you Officer Sam Costales for having the guts to stand up to ray Schultz and apd. I hope more cops will have the same integrity when called upon.
Let's have a vote of confidence for integrity.
Great article by the eye.
Schultz must be removed NOW. Do it before you take office next week.
Albuquerque is 8th in the nation in crime and danger. Now Schultz has cost us another million dollars (after attorney fees). In the private sector this guy would be toast already.
Maybe Schultz should go work at UNM with Krebs and Locksley. He seems to fit in there.
I am starting to think that Paul Heh writes this blog...
Thin blue line? Ha! I have done enough I.A. cases to know there is no such thing!!!!! People need to know that the majority of complaints come from other Officer's, not the public
Mayor-elect Berry has gotten himself into a tight spot. Problem #1 was the premature hiring of Darren White who was not properly vetted. Problem #2 was the retention of Ray Schultz as the Chief. Problem #3 was the promotion of junior Commanders to the DC slots who have a total lack of experience. Berry must find a way to correct problems #1 and 2 in the next few months or there is the possibility that both White and Schultz may cost the City many more hundres of thousands of dollars if not millions. If Berry thinks that hiring and keeping both White and Schultz is the right thing to do he is sadly mistaken. It is your administration Mr. Berry, do yourself and the community the right thing give us a professional, non corrupt police department, one that we do not have to pay for their flagrant wrong doings.
I hope there is still integrity left in the Albuquerque Police department after the jury found an error Shultz's thinking. Anyone with any sense didn't need a court verdict to see that law enforcement leadership has not shown a proper example to follow. Those who have followed the mishaps of Ray & Darren don't question the outcome of officer Sam Costale's lawsuit. They know that the awards for standing up, sacrificing, and winning are a large benefit to many in Albuquerque's future. The obvious is too often understated by those who prefer to deceive. Some are gullible to believe Shultz or White's words and might never know the difference of a city that could be kept safe by individuals who are better qualified.
If White settled and Schultz was found responsible for the hugh payoff to Sam Costales what are they doing serving in their current/future capacities with the City of Albuquerque. Richard Berry this is not what you promised us.
Comment above:
A-hole, Paul cannot write this good. Second he doesn't have the time. You are either Ray or Darren or one who has no morals. This is not theory but fact. RJ Berry has been duped big time by a slippery lawyer, Campbell, (our new Mayor in fact) Darren and Ray.
This is a huge 500 pound bag of shit.
Good luck on your first and most likely last term as mayor with these choices thus far.
Will Berry open up an IA investigation on Schultz? I mean a federal jury has found Schultz guilty of violating Costales civil rights and his management practices has just cost the city around $900,000. I am sure there is something in the SOP about this.
Oh I forgot, the SOP doesn't apply to command staff.
Mayor Berry please get rid of this guy and get a good Chief.
There are alot of cases like this one at APD. Most never try to sue, if they did the city would be broke. I think this will pave the way for others who where hammered for trying to come forward and tell the truth, but have been too scared of the Chief.
This in response to Nov. 26 / 11:34 am "Thin Blue Line?". One question; have YOU done any IA investigation on APD "Dog Catcher" Levi Chavez? The insiders say no.
DO YOUR DAMN JOB AND SHUT THE HELL UP!
For years Ray has said "just sue me and I'll be on a beach sipping drinks by the time it goes to court." He also doesn't care because the money won't come out of his pocket! I too have worked in Internal Affairs and have witnessed 1st hand how this chief uses I.A. to control those that don't agree with his every word! He acts like a boy scout but is a vindictive ass!!! If you like Ray its because you have never disagreed with him. He only likes officers tat kiss his ass. He has always said that it might take a few years but he will get you and you won't know where it is coming from.
I concur with the last post. Costales whined in the end but it does however show that Ray Ray and White steppedover bounds. Ray needs to move on.
As far as Abq being 7th in Crime. The crime stats listed by the FBI last week show Abq 72nd in the Nation out of the top 400 Cities. Not real sure where your getting your stats. Las Cruces was 125th and and Rio Rancho was listed at 222nd on the list. I am assuming the last post was a misprint.
I can see what a great job Schultz and White have done. Let's see, we are ranked 8th in the nation for crime and the top brass protects a bunch of thug police officers. Yes, most police officers who are honest and good. However, I doubt they will have the guts to tell on another officer based on how they saw Sam Costales treated. Heaven help Albuquerque with the likes of them running the show. APD be careful citizens are armed with cameras on their phones.
Happy Thanksgiving !!
This is sure some foul bird to feast on.
James Badway? what a POS! is he still bangin Hamby? Loser!!!!!!!
Please JOEY STOP THE SPIN!!!!
The truth comes out! It always does. Schultz has done this to officers for a long time. Berry WAKE UP! Darren is not helping you.
Ray Schutz calls himself a cop. He is nothing but a big piece of crap with no integrity. As far as IA goes they know what goes on in this department. They don't have the balls to tell the truth either. Half of those guys and gals in IA couldn't investigate them self out of a wet paper bag. I find it funny that new sgt go to IA when most of them have no investigative experience.
I say we get some officer who has the integrity and balls to do a no confidence on cheif schultz and dc calloway. i can name a few, they have to have the balls to do so:
paul heh
mark garcia
matt fisher- he did it once and was intimdated by ray. ask him. ray followed him to calls, etc.

This is Paul J. Heh. to the anonymous poster that said I am a conspiracy theory fool. You hide behind anonymous. You dont have the courage to put your name to your commet.I suggest you ask anyone who has ever worked for me before you open your big mouth. You are the kind of person that will stand silent and watch an officer be wronged. I will not. I will always stand up for the rights of officers and I will always do what is right. My standing up however has cost my officers. For that I am sorry. My officers are denied training, awards and so on just because thay work for me. MY officers have been told by command staff, if they ever want to get ahead they need to stop working for me. AND HERE IS THE NEWS FOR YOU ANONYMOUS, THEY CONTINUE TO BID FOR ME, AND I AM HONORED THEY DO !!!! As long as I here I will not stand by silent and let an officer be abused by anyone. DO YOU UNDERSTAND THAT ANONYMOUS, NOT BY ANYONE !!!! two things I will say in closeing. No I do not write this Blog. Yes Beth Paiz is a good choice, she is a cops cop that will have your back. For thoes of you that are planning to come after me for having ETHICS AND INTEGRITY I AM NOT SCARED AND I DO NOT RUN. SO LET THE GAMES BEGIN. PAUL J. HEH
How much did White and Badway have to pay Officer Cosatles?
This is not the first time or last time this will happen. Top APD brass has been doing this for the last 5 years under the Chavez administration. The city will lose more upcomming suits! Evidence Room cover up, SID Fraud case cover up, Violent Crimes, Lt Montoya scamming of O.T thats been covered for years. The list goes on. All this will soon blow up and be exposed.
CAN ANYONE SAY PERJURY. YES THAT'S RIGHT, RAY PERJURED HIMSELF.
WILL SOMEONE IN GOVERNMENT START LOOKING INTO THE DEEDS OF RAY & DARREN? MR. BERRY HAS NO CLUE WHO HE'S DEALING WITH.
ALSO, HOW WELL DOES HE KNOW DAVID CAMPBELL?
SUPPOSEDLY A REPUBLICAN,CONSERVATIVE WON THIS RACE FOR MAYOR. TO APPOINT CAMPBELL, A BUSH HATING, OBAMA LOVING SECOND AMMENDMENT KILLER, IS TOTALLY COUNTER TO THOSE WHO ELECTED YOU. AS FOR RAY & DARREN; YOU RUSHED TO APPOINT THEM AS WELL.
YOU JUST PLACED THREE WOLVES IN THE HEN HOUSE. THE REPUBLICANS AND ITS PARTY ARE NOT HAPPY.
paul Heh was the only one who believed in this guy from the get go. Everyone else didn't give Berry a chance against Marty. He assured his fellow officers that a vote for Berry was "THE RIGHT THING TO DO". If this happened to Wilfred Brimley, he would have a box of 'Quaker oats' shoved up his ass. Oh,I forgot, Paul already has.
Republicans are looking like Democrats, Dems are looking like Repubs.Things are topsy turvey lately. Maybe it's a politican thing. Who know's. All I know is alot of votes were waisted on the same 'ole bull sh@t. The soon to be mayor and chief looked dumb when that reporter was questioning them . Studdering and uncomfortable.I guess we should get used to that...
what about the over $600,000 that is due to the graveyard officers? That could have been settled a long time ago. That was one hundred percent ray and calloway. Berry, please get rid now, or you are going to be made the laughing stock of ABQ
I think Paul is attempting to put himself into a situation where he will be retaliated against so that he can sue the city. Sam did the same thing. It's kind of a fat retirement bonus for those old guys who know how to work the system. Sam's "forced to leave the department" claim would have been a lot more believable if he had not just topped out his retirement. All I can say is; watch your back if Paul Heh shows up on one of your calls. He is going to be looking for an officer to testify against so that he can get in on the "forced to leave" retaliation money.
Castro has lots of money to throw around.( he married it) just ask Darren. Bought the rank twice , now he'll buy his way back after retirement by getting some plum job from Darren while Berry's not looking.( which seems to be a daily occurance) The money trail won't show up the next go around, it will be in the form a plain brown envelope. Ray the busboy will get a gratuity as well.
Way to go Mike. Great ethics.
I love being a cop but I find it harder and harder to work for a police department where the so called leadership has no Honesty or Integrity. When the chain of command constantly lies and the department is run by Intimidation and Retaliation I think it’s time to look for another job. I have witnessed first hand the lies and the deception that goes on. A police officer that is not honest or has no integrity is no better then the people we arrest. Please don’t get me wrong, I think there are a lot of good honest cops out there but the double standards and the favoritism that goes on within this department is crazy. How do they sleep at night? I will be making a very difficult decision on whether I should look for another job or not because my integrity defines me as a man, father, a husband, neighbor and of course a cop.
Hen House;
How the hell does a Republican, at this stage of the game appoint such a liberal, lefty like Campbell? You'd think, that with all that these liberal socialist, Obama types have done to us so far, the last person you'd want running the city would be an Obama Democrat. His lord and god called upon him to serve in spreading the socialist word in his foriegn service, but instead punked out, some how convinced Berry to run the city. These elitist liberals heep all their social shit upon us, but when it comes to walking the walk, their not available.
Sorry Obama, I'm afraid of going over seas. Instead you'll be proud to know that i've imbeaded myself in a republican mayor's office.
Sgt heh is a good guy who stands behind his people and does not let the 5th floor push him around.
No I don't work for him, I just know him somewhat. Keep the 5th floor in line Paul.

How dare you! You clearly have no idea of who Paul is, and what he does for his 34's, and yet you sit there on what I assume is your fat, sorry ass and bash him. The sad thing is, when you're neck deep in the shit, Paul will likely come to your defense, in spite of what you just wrote. Turn in your badge, scumbag...you don't deserve to wear it.
Come on Ray do the right thing!!! Get OUT!
Pathetic, why is the APOA always so silent on this??? Oh I forgot, there's nothing that they can do?
Anybody seen Ray Atencio lately and who he's working for????
The SO is damn glad you got Darren and we are rid of him!!! Sal should go next.
The city goes after anyone who stands up for the right thing. It's that way in most of the city departments. I was counting on CHANGE I think I wasted my Vote!!! The tax payers should be outraged.
Why wasnt matt fisher called to testify? after he voted a no confidence, chief was intimidating him like crazy. matt said cheif would follow him to calls and made him very uncomfortable with threats, and such
LETS ME ADDRESS SEVERAL THINGS, YOU GO PAUL HEY. ALSO CASTRO DID NOT MARRY MONEY HIS WIFE IS A STEP DAUGHTER NO GUARNTEE $$ AND WAY TO GO BETH, WE ARE ALL HONORED. WE ALL KNOW THAT VIOLENT CRIMES WORKS OT THE DAY OR NIGHT BEFORE THEN IS OFF THE FOLLOWING DAY, CLAIMS IT AS WORK AND CLAIMS THE TIME BEFORE AS OT. AND OL CARLOS WHATS UP WITH YOU AND YOUR WIFE AND THOSE EMBEZELLEMENT CHARGES. YOU CAN RUN TO IRAQ OR WHERE EVER YOU ARE GOING BUT YOU CANT HIDE.
To the idiot who said Sam did this because he had just topped out his retirement - WRONG! Sam was a rehire and didn't get extra retirement. In addition, I don't think one can plan for a bunch of thug deputies to jump on an old man and rough him up so he can be a witness and get a lawsuit out of it. Ray Schultz put that part into action and I'm pretty sure Sam didn't expect to be retaliated against by Management and of course his brothers in blue. To the person who has done IA and claims, there are more cops telling on cops than citizens - Wrong again! If APD has nothing to hide open them up for public scrutiny. To the person who said Sam worked in Radio with Mark Mabry - Wrong again! You all need to get your facts straight. I now see why APD and the Sheriffs office can't get their stories straight. It's hard when you don't know the facts, you're a liar, or you are just too ignorant. Anyone, who stepped forward to tell the truth should be commended. If there is no wrong doing and you are not abusing citizens then you shouldn't worry about who you are working with.
I bet Officer Costales is glad that Marty had that do not settle policy on lawsuits. Marty was such a bright leader. For the taxpayers, it may be the only money that is well spent since it enlightens everyone to what goes on at the PD.
It beats Marty giving away money to his chosen few in pay raises (pay backs).
I just wonder what the real numbers are going to be for the budget short fall once the facts come out. Marty has spent and spent. He has filled high paying positions and left service positions unfilled. His Directors,Associate Directors and HR know what they've done. Lets see who will have their heads hanging high once Marty is gone. I believe the public is going to be surprised the city is out of money and in trouble. GET READY!
WHO WILL GET LAID OFF FIRST?
What pisses me off the most is that every cop has sworn an oath but yet we turn our heads and are afraid to speak up for what is right. Nothing will change until we hold our chain of command accountable. You can bet your ass if you screw up they will be all over you. Look at the people that are running this department.
If you break the rules you pay the penalty. Justice is blind and no one is above it.
Justice “I deem one of the essential principles of our government… equal and exact justice to all men of whatever state or persuasion, religious or political.” Thomas Jefferson
Not many of you young guys remember Sam being the head of a pyramid scheme in the mid-90's. He almost lost his job back then too. But he was able to make about $20,000 before he was found out. Ask around, it was no secret. So I guess this "Honest" cop is not so honest, now is he?
If you're a cop and feel this administration is corrupt - ban together and go to the city council, mayor, news media, (shoot contact Oprah) etc. They can't go after all of you and maybe you could be instrumental in tearing down the "Blue Wall of Silence". I'm pretty sure the majority of cops don't participate in what the bad cops do, but you wouldn't want somone to turn a blind eye if it were their child, dad, sister, etc. being abused. You are in an honorable profession so, don't let the bad apples ruin it. Unfortunately, the top cops are a major part of the problems at APD. Get rid of them!!!
This is Paul J. Heh. To anonymous that said I was attempting to set myself up for a lawsuit because I will claim they forced me out. LET ME MAKE THIS VERY CLEAR. I DONT RUN !!!! Now let me address anonymous about the court overtime. Myself, Dawne Roberto, and Matthew McElroy have been been involved in this from the beginning. We have argued with the A.P.O.A. over how this issue should be settled, we tried to offer an olive brance early on to just put the department back on four tens to settle the issue, we have gathered names of officers effected,we appeared at the labor board hearing where Fred Maurer Approched us and told us we can settle this thing if we will agree that an officer will get paid 2hrs. overtime if they worked the night before and their court starts by 10am.EXAMPLE work the night before get off at 0600hrs. court overtime starts at 630am and continues until your court is finished for that morning. NO break continues straight through such as a jury trail into afternoon your overtime continues. we agreed with Fred to get this settled and to avoid a lawsuit against the city ( which I believe we would win ) to get the officers their money, and not wait 3 years for a lawsuit. Fred went in to the meeting to announce the agreement. Waiting outside A.P.O.A president, vice president, and Loren Torres approched us and stated the argeement is court must start by 8:30 am. I went into the meeting pulled Fred out and had him explain to all concerned that the start time for court is by 10am not 8:30 AM.I know most metro court starts between 8:30am and 9am. Fred stated in front of all concerned the start time is by 10am.Now the contract states if you are a graveyard officer and you work the night before your court overtime starts 1/2 hour after you get off shift. SO by the letter of the contract if court started at 2pm your overtime would start at 6:30 am. Like I have said you have to give some for a settlement without a lawsuit that would take 3 years. Much more has transpired since that agreement IF you want to hear the entire play by play get ahold of me, Dawne, or MAC. Bottom line. There is finally a person working in D.A.L. His name is Norman. His job is to pull time sheets of thoes effected and to see how much is owed to each. You can stop by D.A.L. to make sure you are on the list and how much owed. If anyone finds anything funny going on please let me know. I think we must try to avoid a lawsuit. BUT A LAWSUIT IS ALWAYS AN OPTION NO MATTER WHAT ARGEEMENTS HAVE BEEN MADE AND BY WHO. Make no mistake this is the only reason graveyard was put back on four tens. PAUL J. HEH
I'll second that on the Undersheriff Sal, we would love to see him leave next! He has done nothing to support the deputies in the field and is pretty much worthless!
Sounds like you have intimate knowledge of that pyramid scheme. How much did you make? OR why didn't you report it? Like I said before, quit beating on your chest if you can't do the right thing and turn in your fellow officers for misconduct. The truth seems to be coming out more and more about officer misconduct. I sure would like to see the IA files on a bunch of you. Citizens speak out and ask for those files to be made public. I bet we would start to see a pattern develop. Citizen claim - DENIED! What happens when you see citizen complaints against the same officer over and over. Hmmm there's that pattern and it is called a cover up!
I think I'll go for a boat ride with Bill & Brian and have some cookies & tea. Once we dock we'll enjoy dinner and consider what to do about corruption in government.
A fairy tale is still a fairy tale. I hope we can fix this mess without losing our way.
Contact Randi McGinn at 505-843-6161 if you have been threatened by Ray Boy or any of his lackeys. Some 34s have already stepped forward, next round Ray and some captains!!
Give out ia files? Your right. We should also publish photos and charges in the papers of citizens. What's fair for one is fair for all right? I bet the citizens don't want that, it violates their privacy. Let's also publish employment records so we can see who can't hold a steady job. Sounds like fairness.
Sort of a good example of how juries and courts see things that are not part of their everyday lives.
For instance the great "police conspiracy" belief requires one to have never had to experience first hand that two cops can't even agree on where to eat lunch --- but apparently entire divisions are willfully keeping quiet over career threatening issues to protect guys they don't even like.
Those same civilians would be amazed at the amount of phone calls IA gets from cops turning in in other cops for things as henious as double parking or taking an extra 10 minutes on their lunch hour. But again, these same guys are keeping quiet over the big stuff like arresting a rich guy who tried to drive through a closed perimeter.
Another thing that may be hard to believe is that some folks are just dicks, granted any citizen may be a jerk, but when one is rich famous old and driving on a street that the city named after them, they may be a bit belligerent and talk themselves into jail aout of what amounts to stupidity and entitlement.
So one officer there sees things differently and ends up a few years later $600,000.00 richer. HMMMMMM -- let's see here, families of people who get killed
often get lower settlements... so in this case someone believed that Sam was worth that much even though he had one retirement coming in, and was ready to stay home and retire anyway.
Perhaps it was due to the fact that he was such a "ball of fire" as a worker, volunteering fro hazardous duty or working in dangerous assingments -- nope he was on dayshift for 20 years...
Puzzling what was found that we don't know, or if this was just a vote against an administration rather than for one officer.
On the other hand, it could just go to show true the old analogy of a judge or a jury being on par with a box of rocks.
Just read the blog about publishing things on citizens. I think you do that on Saturday (DWI's). If I had the authority a cop does, I would have no problem publishing my IA records. In fact, turn on your belt tapes. Isn't that what they are for. Seems to me they get erased when it's not favorable. Of course, they forgot to turn it on. According to the paper the deputies (all three of them) didn't have their belt tapes on. Imagine that. I think you should have to wear cameras that would eliminate the I thought he had something in his hand and now it's a justified shooting. News flash we all answer to God in the end.
"News flash we all answer to God in the end"
I am an atheist, guess it just goes dark for me.
I bet Ray Boy is really happy he hired Sam back as a rehire!
Both Ray and Sam are tools. The bad thing is us citizens are the ones paying for this.
Get your facts straight. Read the transcripts of the trial. The jury based their award on facts!! Ray is a vindictive ass and was finally called on it!
APD now is well known through out the United States. Just like our honest governor.
Rocking Chair - On another blog I heard Sam jumped in a raging arroyo to save someone and received a Metal. Do you have one?
The last comment sounds like an iro member. hummmmm
Are there no honest command officers in the Dept. past or present that could fill Ray's shoes? We saw what happened when we got an outsider like Galvin.
RE: november 28,2009 1:26:00 pm mst
Either you are a citizen that has never had to do an officer's job or your name is Ray! Officers and deputies have broad authority because they have to make split second decisions that will be debated for years by attorneys that have the luxury of time on their side. When an officer's decision is debated, even the attorneys can't agree on the outcome. I am a citizen and don't pretend to know their job, however, I'm intelligent enough to know that we need to support the street officers and deputies. I have a different opinion of their administration. I have met their leaders and know that some promotions are based on popularity not capabilities. When government is treated like a business real changes will take place!
$662,000 and some. The cost of doing business with cover up scam artists. Ray and Darren are just frat boys from 'Animal House'.
Professionalism, forget it.
Then there's the other snake in the grass, Paul Chavez with his lawsuits pending, which will drag Ray in the middle of that fray as well. So who held the gun to the whore's head on the fifth floor?
Oh gee it was Paul and Ray watched.
Transit will be rolling in with some more mega lawsuits as well, with a gaggle of hoes that will be coming forth testifying about Greg Payne's behavior as well. That ought to be worth about $250,000 -$300,000 alone. Let's see by the time the new mayor takes office the total for these will be about
2 Million; and these are just the ones we know of.
By the way. Darren's got some thing that's also about to come flying out of the back bedroom that will bite everyone in the ass as well. Next time you shouldn't use a dart board when selecting people.
I think all citizens support the honest APD officers and the honest BCSO deputies. Most citizens are heartbroken when an officer dies in the line of duty. This isn't about the honest cops, but the ones who think they are above the law and can bully the public. I think most cops start with the right intentions, but you live what you learn and if your leaders are corrupt heaven help you. Most cops are stuck between a rock and hard place.
By the way the IRO answers to - guess - Schultz! Somehow as a citizen, I don't see the logic in that.
Well, to the atheist..... What about the Mayan culture and their belief that the world will end in two years? See the movie at the Theatre? Well, your in luck... I went to Guatamala 14 years ago and did my little dance on a stone in Tikal.... so, I guess the world won't end afterall! (even if Darren White and Schultz remain or don't remain in Office).
The past karma over the past 14 years, has been "emotional," but the world will keep going on and the Mayan prediction won't occur!
Do you think that cute, upscale store in ABQ Uptown will do a movie set design featuring
a Mayan stone with a female saying, "Oh, my gosh... Fashion diaster.... the idea for me of the world ending.... would be a Mayan faux paux in the fashion world."

It's spelled "Medal" - metal is what in in the aluminum foil you wrap around your head when you write on blogs.
And yes, I did get one, for a similar type of life threatening incident however mine involved a bit of a gunfight.
I worked for the same dept. for 23 years, and managed to settle my problems like a big boy, not by trying to win the ghetto lottery.
People will say that the only way a bureaucracy can learn in to lose a lawsuit. In fact that may be true but I still reserve the right to think it smells for Sam to get that much for getting his little feelings hurt.
The chief ain't blameless in this deal, dont get me wrong, they treated it all wrong in how they looked like they targeted him witht hat silly discipline over how he appeared in court. However, at the same time bringing up a one time occurrance when Sam jumped into the water doesnt really give a fair assesment of well over 20 years of being a P.I.A. and languishing on dayshift or running his side businesses.
In fact waving the bloody flag about one incident of bravery reminds me of what my momma always said - "even a blind hog finds the food trough once in awhile".
I'm just sayin' (using that analogy) that Sam really stumbled right into the food trough.
Sadly, although Ill be accused otherwise, I dont even dislike the guy -- Im just saying he aint worth over $600K for this crap -- it's straight up silly.
Sam Costales worked in the radio room with David Archunde (I think that is how his last name is spelled) for a few years as rehire officers, all they did was take reports over the telephone. Then came Leonard Rodriguez and Frank Olivas they took the job in the radio room and forced Sam and David out. David quit because he did not want to be in FSB. If you didn't know Sam was not a certifed officer when he returned as a rehire, he did not get certified as an officer until March 2006. So did the incident with the Unsers occur before March 2006? If so then Sam could of possibly said he was a full time officer but he was not certified as an officer by the state and possibly should of never been out on the street and for sure should not testif that he was an officer because he was not certified. Maybe you should look into this.
In fact the city had several rehires (over 10) working as officers and they were not certified by the state until March 2006.
The only thing that surprises me is how we can be led like lemmings into believing silly things.
That doesn't just go for religon, but for politics as well.
Maybe someday we will stand up, take responsibility and demand change. Not just in government, but in our life.
Ok that is about as serious as I can get. It's Sunday, so time to get drunk on the blood of you know who.
To the Atheist/Agnostic
I'm not writing to judge anyone for their beliefs. I think you are entitled to your freedom of religion. I think that's how civil rights go. My point is, Mr. Costales should not have been crucified by Schultz and APD for exercising his freedom of speech right. I do, however, feel sad that you only have yourself to turn to in good times and in bad times, but that is your right!
Rocking chair - excuse me for the misspelling of metal and MEDAL. I was in a hurry and didn't proofread. I am quite aware of what they both mean. In fact, I am college educated and probably make twice what you make. Can you elaborate on your heroic gunfight - MEDAL. What did the suspect have in his hand a cell phone. I am not saying anything against a police officer who has had to make a split second life and death decision. Again, I am in no way trashing those that did what they had to do in that situation. However, there are some and if the shoe fits where it! Sounds like you are just jealous of Mr. Costales and I seriously doubt Mr. Costales cares what you think. The jury has spoken. Go back to where you came from - blinds hogs - troughs? You might want to look at your sentence "People will say......" . Hmmmmm!!!
Vindictive! marty's gone but he wasn't the only one. The village isn't saved. Now we have all the village idiots back. They're all vindictive. KY up everyone, Berry just opened the gates to all the boofoo-ers. Business as usual only worse.
Just because I decided to work as a cop does not mean I am willing to give up my rights. Ray Schultz and this department can kiss my ass. I am glad Sam sued and won. Ray Schultz and half the chain of command have no Integrity anyway and that’s a said thing to say.
The Mayans believed in blood letting like taking a knotted rope and cutting a hole in the tongue and dragging the knotted rope to and from the tongue, sorta like the blue wall of silence except the
blue wall is often used as a form of punishment, an invisable force where as the knotted bloody rope can readily be seen to the naked eye. Unlike the blue wall of silence, the Mayans belief of blood letting was not given out as a punishment, but was administered to the highest priests and princessess and believed to be an act of piety to worship "blood" and sustain their god and themselves. In the Mayan world, bloodletting is also deeply associated with political power.
APD Officers experiencing "the blue wall," would help to keep in mind that once an Officer goes against the grain that other Officers don't want to get involved with that Officer.
The case awarding Costales over half a million dollars is in defiance and shows us that we do have a civilization worthy of another billion and more years to come.
Civilization has come a long way since blood letting.
What if? During the Mayan civilization, a "gay" fashion designer and the Mayan Princess whom the tailor designed Mayan outfits for were both disgusted and flabberghasted that all the tailored work to design a dress had been ruined in no time from the Princess undergoing blood letting. The "Gay" Fashion Designer gets drunk with the Mayan Princess and the two devise a plot to whisper into the ears of Mayan leaders a false prophecy offering up a year that the world will end just to keep the leaders busy with another project making bloodletting less likely to occur and ruining his tailor made outfits? Ok, just another theory.
Though the blue wall of silence doesn't involve a disgusting ritual such as, blood letting ruining outfits etc.... the blue wall can be a "force" that although often invisible is viewed by the court system as unethical.
I said said it before & say it again -- Heh stands up for what is right & fair, regardless of the retaliation. Those at the top got there by kissing ass and compromising their belief systems. Heh's not about that.
Sam may find that food trough, but afterwards, he'd just throw it all up.
“Power leads to corruption” Right Ray Schultz, Marty Chavez, Pete Dinelli, Darren White ...
Honorable Mayor-elect Berry,
We placed you in office for a reason Sir. Do the job we; the public hired you to do!
Mr. White and Mr. Schultz should be in hand cuffs.
Here is your challenge; put the trash out at the curb. get rid of the trash (White and Schultz.)
Sir, please keep your promise to the public. If you violate this trust; we will not give you another opportunity and you will be looking for another job.
ABQ's Voting Public
There seems to be enough hate to go around for everybody at APD. I wonder if other police agencies have the same attitude. Did not realize how disfunctional APD was.
Its simple Ray Boy has been doing this for years!! It finally caught up to him!! Time to fire him and Darren!!!!!!
I think it was after March 2006.
Rocking Chair - Excuse me for the error - guess I didn't proofread. I do know the difference in the two words. You should proofread your own blog. Lets see - Look at your first sentence, etc., etc. I am college educated and probably make twice what you make, so please....... I don't need your help. I would, however, like to hear more about your heroic gun battle. Did the suspect have a cell phone in his hand? I am in no way insinuating that most officers have to make a life and death decision in seconds and things happen, but there are some of you out there that just can't wait to do someone in. Further, I am pretty sure Mr. Costales could care less what you think. The jury has spoken, so get over it!
So, the ancient Mayan civilization had people as leaders that were little sociopaths, but not all were... It makes sense that perhaps a Mayan Princess and her "gay" fashion designer duped the little sociopaths into being fixated on a date when the world would end just to reduce the amount of blood letting taking place.
In comparing and contrasing, Bloodletting with the Blue Wall of Silence, what kind of topics could the Officer get the APD Leadership
preoccupied with to avoid the unethical behavior of the Blue Wall of Silence?
Any suggestions? I know Costales could have arranged for Darren's wife to go on the show, "Cheaters," exposing Darren with his (unsecret) affair! I saw the show last night and there was a guy that looked kinda like Darren wearing a Star shirt and I thought is that a Sheriff? Any ideas for Schultz? What could get Schultz preoccupied with a concept other than arranging for Officers that go against the grain to be ignored by their fellow Officers?
Well, I guess the courts stepped in and duping political leaders into being preoccupied with projects, concepts and ideas is unnecessary now.
You all are funny. Now get to work!
Why is it that we arrest a criminal and make sure he/she has an attorney. But when an officer is accused of wrong doing and hires an attorney he/she is obviously guilty? I can't understand why this administration believes that 34s don't have rights. I would hire an attorney if ever accused (not a union attorney a real lawyer)so that my civil rights are protected! We don't become 2nd class citizens because we wear a badge or star! Don't let these guys intimidate you, exercise your rights and protect yourself. Randi McGinn, Mary Hahn, Paul Kennedy, Rob Perry are just a few who don't back down from Roy Boy and company. Do your job to the best of your ability make your family proud of you and hire a good lawyer if Ray Boy pushes you around!!
BERRY WILL NEVER GET MY VOTE AGAIN!!
THE ABOVE POST ABOUT HAVING ATTORNEY YOURE SO RIGHT. YOU HAVE NAMED THE BEST ATTORNEYS IN ALB AND WEIRD HOW CHAVEZ CAN SUE FOR HIS BACK INJURY AND NO ONE BLINKS EYE OVER THAT STUFF BUT IF OFFICER DOES IT OR STANDS UP FOR HIMSELF EVERYONE BACK STABS HIM.
Ray Atencio retired! good for him. No more rehires but I have a feeling the department found him a nice computer position somewhere. Ray boy took care of him i'm pretty sure.
I'm GUMBY Damnit!
Ray Atencio works for Tiberon....so much for ethics from that jesus freak.
Yup. People on here bash the chief, admin, etc. and when someone stood up to them and won, they bash him. I hope it's just a few idiot cop's posting. Hate to think there are more.
When political leaders in power are doing the unthinkable, for example bloodletting, the blue wall of silence, etc... then what can a person do in response of that kind of corrupt, unethical abuse of power?
In just a theory, for the Mayan Princess with a tremendous fear of blood and her "happy" companion, a cute fashion designer that she accepted was in love with somebody else, she had to get creative to find a creative resolution to reduce and to help prevent blood letting from taking place.
Certainly, this lesson in history though just a theory, could serve well to help end the wars in Iraq and Afganistan.
working for Tiburon? WTF??? how conveeeeeiiiinent! (:
Be careful mocking Atencio. FYI, he does serve the living God whom you will also answer to. Think before you type you moron
To ALL the hard working, honest and oath abiding officers: I am not in law enforcement, just a regular citizen who fortunately hasn't needed many of your services but rests comfortably at night knowing you are out there if I do.I read these posting and can't answer what is true or false-Im not there. I do know that I rarely if EVER see the APOA/Police Union (not sure if there's a difference) in papers, on the news at rallies. I also know that any city government/department can't be trusted to do the right thing by public safety unless their feet are held to the fire. According to most reports there are about 1000 officers in APD...that is HUGE! If you were to organize and strengthen your union you would be unstoppable! You would have the respect, attention of City hall and desire of APOAs endorsement. Chiefs, deputies etc. would be apporved (at least discussed) with union officials prior to placement. Good 'ol boy-ism would reduce, mistreatment would lessen because Admin. would KNOW you wont stand for it. Its alway easy to complain about problems...support your union officials, go to meetings, if the current ones aren't good-vote new ones in.GET INVOLVED! Things can't change overnight but I promise you they will change with persistence. I have noticed other unions, namely, the Fire Local/union go from never being heard of to seemingly be a considerable power in local politics. Their recent DWI policy is a perfect example. You may not agree with it but you got to give the fire union credit for working hard enough to make a relationship strong enough to get policy like that signed. There are of course some bad cops (pure statistics prevail)but the vast majority seem to be honest BUT standing on the sidelines indifferent (or discouraged), waiting for that 20 year mark to come around to retire. You guys are better than that. Become part of FOP or combine with Fire for a public safety union, but DO SOMETHING to change this. YOU GUYS DESERVE IT!!
Looks like people have to much time on their hands. Need to change the retirement to 30yrs.
I don't see Atencio wearing a cross or a robe, he is working for Tiburon because he applied for the job when it opened. The department didn't give him the job! It was nice that he was overseeing Tiburon when he did work for the department. Anyway why should you care where he works. He can work where ever he wants as long as they hire him. His salary is not comming out of your pocket he's not a public employee anymore! So move on you moron!
What if we are athest and do not believe in your living God. Then do we worry?
To the jesus freak defending atencio: thank you for proving my point. He violated city ethics by taking a job with them but of course you'll omit that little fact. Tiberon is a piece of shit program that has cost this department millions in dollars and time. If you're ok with that then it is you who is the moron. Your mythology would support this AND if you were really a believer you wouldn't be so concerned with my beliefs.
APD HAS UNION? RAY ATENCIO STOP POSTING
New Mexico Coalition of Public Safety Officers. If you are looking for a new direction, new leadership, or tired of the same old-same old, contact them.
See NMCPSO (NMCOPS) at www.ncpso.com and also on Facebook.
Their goal is to unify all of public safety statewide and nationwide. They are a true public safety organization representing true public safety interests. They are the fastest growing public safety organization statewide and nationwide.
It is spelled "Tiburon" moron and I did not say I liked the program I said why should you care where Atencio works, no one else does oh I think only his family does you moron! And you reall need to check policy before you open your pea brain and post on this blog. He did noting that violated city ethics moron!
FYI I really don't care about Atencio either but the truth is the truth moron!
To Dec 1 - 9:29 - If you cops are so concerned about being the best and have morals and values then why are half of you against Sam Costales. Seems to me, he stood up for the right thing and his department turned against him. I guess I don't get why looking professional is such a big deal when you act like a thug. Perhaps, you are right and they are hiring just anyone (namely Ray & of course Darren). You have to start with law abiding leadership and we can see that is not apparent when he violates an employee/officer's civil rights. Sounds like the department is a mess!!!
New Mexico Coalition of Public Safety Officers
What a joke! They know the APOA has the best contract in the state. Bitch all you want but check out the other contracts (even the ones for surrounding states).
Talk about your bottom feeders...trying to hijack a blog and get people to go with them.
Go back to whence you once came. All though it's not perfect I'll stick with the APOA and it's contract.
I love it when the spelling police come out and fuck up their own postings:
"He did noting that violated city ethics moron!"
Let's ask the taxpayers how they feel about a public employee saddling the city with a POS software system that has cost hundred'$ of grand, endless hours of wasted time from each employee, and is less efficient and THEN going to work for the same software company.
How's that sound folks, is that OK with you for your "servants" to feather their own nests on your dime????
I'll stick with the APOA and it's contract.
December 3, 2009 7:05:00 AM MST
The contract had nothing to do with APOA but was possible because of what surrounding jurisdictions were getting in their contracts and Marty's pledge of 1000 strong to the public...
The issue is not the contract it is with APOA or better yet with the board.. We would like to see change to where board members do not get sweet gigs like SID or the Mayor's detail.
We are tired of the APOA board making endorsements against the wishes of the majority of officers they represent. A meeting of a qurom does not represent the majority.
Eye, do a Poll for the officers if they have confidence with APOA or if change needs to happen.
Members should never pay for board members to smoke cigars or have coffee and meals on a daily basis just because they want to.
See where your last endorsement got you board members! And hopefully no more free rides to SID or the Mayor's security detail...
No one attends the APOA meetings because they are disgusted and fed up with all the BS that has occured over the last 8 years.
I like the contract but I do not like the APOA's direction...
It's "Too" genius.
"The contract had nothing to do with APOA"
Okay Genius, then please tell me who sat across the table with the city and negotiated it?
Once again the "Heh Consortium" is spewing shit from their mouths.
Move on folks, you are nothing but arm chair quarterbacks who lack the intestinal fortitude for real action.
Dawne Roberto for president APOA she did what the president should have done a very long time ago!
Well it looks like Sam won't have to worry about a pay raise.
Who cares about the spelling and grammar. Stick to the issues.
He shouldn't. He had the balls to go against the Dept and won. You sound jealous...
I work with Dawne and tried to talk to her about running for president, I dont think shes going to go for it. Im not publishing my name cuz im at work and im on a city computer
Who the hell cares good for him stick to the issue. JUST FOR YOUR INFORMATION SEVERAL OFFICERS HAVE GONE AGAINST THE DEPARTMENT AND WON ONLY HIS WAS JUST RECENT GET OVER IT!!! We have all moved on!!! I went against the department, I filed in federal court, only it was settled out of court and like I said who cares!!!!! I wish it would of hit the news on the settlement but it only hit the news when it was issued a cause number in court. Oh well whatever, I won too and im moving on with it!
I can't believe you cops are sooooo........ afraid to stand up to that loser Chief. Is Dawne female? I can't believe you can only depend on a few people to do the dirty work and the rest of you do nothing. If that's the case you deserve to work there!!!
Sam is not the only officer that has gone against the department. There have been several officers, I for one settled out of court and several others have to. He is not the only one that had the balls as you put it, it doesn't take balls to go after the department! Don't know why they did not want to settle with him out of court but oh well good for him and good for the rest of us!
ROTFLMAO, Is Dawne Female-- she is, but I think her balls are bigger than ours!
Good for Dawne!!! Go get em Dawne. We need many more strong women. I know, I have fought for others against Management, even to my own detriment. However, in the end I prevailed and hopefully made a difference. To the good cops - God Bless You and keep you safe. To the bad cops - I hope the good cops put an end to the corruption. Put the pressure on the Mayor. You have many venues, just use them!!!
Well if she wants to run then run but this blog is not about her so shut the!!!!!! she will prob screw it up like the last female did, but hope not. oh well who cares most of us don't!!!
dawne sucks. look at her facebook page. she's a cop but she is standing behind a sign that basically says keep out. that sums it up, another cop thinking that she can jump over the law. and she is proud of it. how anyone could trust or like her is beyond me.
To the post above, you sound like a gorilla talking smack about the females! You puss, the women that have made a difference make you feel inferior huh? Grow a set or shut up! Dawne would make an excellent President and the last women got us a 14% pay raise you ignorant whimp! Look at what we have now, no respect! Go Dawne!!
Ok some cops hate Dawn and others love her. I heard she talked shit about Sam and yet she doesn't like Schultz. My question is what or who is she for? Sounds like she is not such a great choice after all.
i love females, don't like dawne.
doesn't matter about the gender, what matters is who you are ethically. she flaunts that she can do what she wants when she wants, i feel the same about male cops who are like that. it's about cops thinking they are above the law. some of us know about the things that are happening out there with you guys and gals and it's not a good thing. cops are covering for each other, getting away with stuff they shouldn't and she is one of them. she wouldn't make an excellent president. someone who is honest would. where o where is that person?
Well Sam said he lost all this weight for being stressed out. He is always stressed out ALWAYS!! He was throwing up way before he retired for everything you could imagine. He would make up a call so he could get out of going to court because it was too stressful for him to go testify. See how many people got off on their tickets because honest Officer Sam didn't show up. Plus he lost all the weight after he quit. Not because the dept was against him. He just likes to sue and got lucky this time. Don't forget about the time he was arrested by Rio Rancho PD and then moved out of RIO because he said their PD was harrassing him. Sounds like a pattern. See what his lawsuit pattern is he has filed several. He had to go back to field and cried about it. He couldn't have his cushy job in radio. I'm sure the lawsuit was just -- but not that much of a settlement. Sam was a lawsuit waiting to happen when he was on the dept. I saw some racial lawsuits in the making against other officers. He was also the biggest prankster but would cry when somone pulled a prank on him. So there is the OTHER side to Sam.
Dec 15 9:25 - First, If Mr Costales did throw up it was probably because he had to work with some corrupt cops and that would turn just about anyones stomach. Second, from what I hear all the statistics you cops turn in stating how many tickets you write etc. are all made up numbers. I think the public should ask for an audit. They claim a certain amount of tickets were written and yet I bet if you compared that to the actual all your reports would be false. I checked out the information where you insinuated Mr. Costales sued Rio Rancho and that is FALSE. If he was arrested the charges must have been dropped because I could find no conviction. My conclusion is he was wrongfully arrested. Guess you are in to slandering and defaming people just like APD. I'm pretty sure you work there and are just jealous that you still have to work there. If you wanted that cushy job in radio why didn't you bid on it? Sounds like you are mad about being in the field as well. So I guess I just don't get what his bad side is other than he successfully proved that APD and the Sheriffs office have some really corrupt cops. Nothing but a bunch of thugs with a badge.
Tiburon is a horrible system. I did write to the Berry Transition Team hoping that the system would be replaced. I doubt anything will be done about it so I guess we will just continue to put my fellow coworkers at risk with this system. God bless you guys.
December 15, 2009 9:25:00 PM MST
So are you for or aginst the Chief? Or are you just a jealous busybody hating on anyone who got their name on here? Which is it?
Oh let me guess, you will respond with angered, cussword filled, tyrade that makes no sence...
or maybe you are the chief..
I know you are but what am I?
Great posts you guys or gals, way to show everyone that APD has a requirement that you attended 3rd grade, not passed.
Stop embarrassing your fellow officers.
See what I mean? Angered, idiotic response. haha
Dec 20 @3:21
You sound like you need some anger management classes. Sorry they did away with the radio job and you can no longer bid on it. Boy, sounds like this Sam guy really screwed that up for you. Perhaps, you should think about getting a new profession. The citizens of Albuquerque do not need another abusive cop on the streets. Another suggestion would be for you to stick up to the Chief instead of letting him bully you. Oh, I forget your all a bunch of wimps with no backbone and can only pick on helpless citizens. Some of you sound like a bunch of jealous boys who didn't have the guts to go up against APD themselves. I bet Mr. Costales could careless what any of you crybabies think, after all he WON his case in a court of law. Funny, I wish I could hear his side of all these wild accusations, but if I were him I wouldn't bother either.
Well you didn't look hard enough because Costale's was arrested in Rio Rancho probably about 10 years ago. Costales is the crybaby ask anyone that knows him. And the position was eliminated because the cops are needed in the street not in radio and that's what the telephone report unit is for they could of went there to work. And I could care less about bidding for the position I am retired. But this whole site is nothing but a bunch of unhappy people who only look at one side of the story. If Albuquerque is such a bad place the freeways are open in all directions grab a u-haul and move -- we won't miss you.
I've lived in ABQ my whole life and love the place. Too bad we now have to live with a bunch of corrupt cops running the place. Never said Sam wasn't arrested I said I couldn't find a conviction. In addition, it was about his ex wife hanging out in his neighborhood. I also read the journal story written in 2006, where his ex was interviewed and she said nothing but good things about him. Guess they made their peace, so if that's the worst thing he did - give me a break - that's not very news worthy. Talk about a crybaby - you are probably one of those retired cops who can't let APD go and move on. You say your retired, but I bet you are still working for APD. You're probably sitting in a police camera van giving tickets. The radio job sounded better and you still sound jealous. Bet Sam doesn't care much what you or anyone else thinks.
