The Blue Barrier of Fear

It's been a very bad couple of days for Chavez' old chief now Berry's new chief. Tuesday, Sergeant... uh, Chief Schultz received the bad news that his five years of serving as Albuquerque's top has earned him the dubious distinction of overseeing the metro area's rise to number eight on the list of the nation's most dangerous cities (read it here).

For Mayor-Elect Berry the news was an embarrassment because candidate Berry ran on a platform of fixing the crime problem created by the Chavez administration and presumably Marty's Chief Minion, Ray Schultz. In point of fact, the selection of Schultz itself made Berry look rather less than honest and both the media and the public can easily spot hypocrisy and/or political expedience.

A new mayor has not only the power but the duty to surround himself with "his" people. Chief Schultz was but one of the early missteps made by an inexperienced but ultimately honest politician.

Berry's mistake? Listening to his soon-to-be Public Safety Director. Darren White has been working with Schultz for more than just the past 5 years, but since he was a new APD patrolman and young Darren's first sergeant. Our Eyes tell us that White promised his first boss that he'd be staying on within hours of the election.

In his naiveté, Berry failed to realize the very real political implications of the Schultz choice - implications that should have been readily apparent to both White and Berry's other top appointment, David Campbell. It appears that both White and Campbell are busy following their own agendas.

Late Wednesday afternoon things got even worse for the new chief (same as the old chief). For the past two weeks a lightly covered law suit was going forward in U.S. District court in Santa Fe. In it former Officer Sam Costales was suing APD and Chief Raymond Schultz for retaliating against Costales for giving testimony for the defense in the case of State of New Mexico vs. Unser.

Costales claimed that Schultz and the department created an atmosphere where he feared for his life and was ultimately forced to leave the department. Wednesday afternoon the jury found for the plaintiff and Costales was awarded $662,000.

The jury found that Chief Ray Schultz personally violated Costales' civil rights as did the Albuquerque Police Department. In addition, the jury found that there is a "blue wall of silence" and that the actions of Chief Schultz were retaliatory.
The lawsuit also named Sheriff Darren White and police union official James Badway, but claims against them have been settled.
The jury finding makes it look like the entire department acts in unison to close ranks and protect their own even if the "offender" is one of their own. The reality is a little more subtle than that and a hell of a lot more dangerous.

Our observation is that while rank and file officers are regularly drawn and quartered publicly, while the favored few - the good ol' boys - are regularly protected from the consequences of their own screw-ups and misdeeds. Our Eyes even tell us that some of Ray's Favored have even been protected from allegations of criminal conduct.

It's no surprise that when Sheriff Darren White called Schultz to complain about Costales' testimony in the Unser case, Chief Schultz sprang into action to punish the officer who had the temerity to testify against the Sheriff's deputies. It's not a "blue wall of silence" as much as a blue barrier of fear where the mighty Favored Few are protected at all costs and the rank and file never know when they might be sacrificed to "prove" that the department is capable of policing itself.

All of which brings us to another of Berry's campaign promises... transparency. How can APD operate transparently when officers fear retribution? Transparency requires honesty and honesty is the first casualty of fear. Officers shouldn't face retribution for telling the truth, speaking their minds, or doing what's right. They should be rewarded not retaliated against.

It's telling that there was only one currently serving officer courageous enough to testify for the plaintiff. Our Eyes tell us that Sergeant Paul Heh testified yesterday much to the chagrin of Chief Schultz. Part of his testimony was that he feared 5th Floor retribution simply because he was called to testify.

If you're on the street and run into Sergeant Heh, tell him thank you and watch his back. You can bet that Schultz and crew will be looking for some payback.

Until December 1st, Chief Schultz, his cronies and his cover-ups belong to the little vindictive outgoing mayor. Before Mayor-Elect Berry has even taken office, Chief Schultz has become an embarrassment to his administration. That's two strikes in as many days. After December 1st, the mess that is the APD 5th Floor will be owned by Berry.

The only questions remaining are how many strikes will Berry allow Schultz, how much more political capital is Darren White willing to burn on his favored friend, and how long will it take for the new mayor to figure out his mistake?

Schultz must be removed NOW. Do it before you take office next week.

Albuquerque is 8th in the nation in crime and danger. Now Schultz has cost us another million dollars (after attorney fees). In the private sector this guy would be toast already.

Maybe Schultz should go work at UNM with Krebs and Locksley. He seems to fit in there.

Mayor-elect Berry has gotten himself into a tight spot. Problem #1 was the premature hiring of Darren White who was not properly vetted. Problem #2 was the retention of Ray Schultz as the Chief. Problem #3 was the promotion of junior Commanders to the DC slots who have a total lack of experience. Berry must find a way to correct problems #1 and 2 in the next few months or there is the possibility that both White and Schultz may cost the City many more hundres of thousands of dollars if not millions. If Berry thinks that hiring and keeping both White and Schultz is the right thing to do he is sadly mistaken. It is your administration Mr. Berry, do yourself and the community the right thing give us a professional, non corrupt police department, one that we do not have to pay for their flagrant wrong doings.

I hope there is still integrity left in the Albuquerque Police department after the jury found an error Shultz's thinking. Anyone with any sense didn't need a court verdict to see that law enforcement leadership has not shown a proper example to follow. Those who have followed the mishaps of Ray & Darren don't question the outcome of officer Sam Costale's lawsuit. They know that the awards for standing up, sacrificing, and winning are a large benefit to many in Albuquerque's future. The obvious is too often understated by those who prefer to deceive. Some are gullible to believe Shultz or White's words and might never know the difference of a city that could be kept safe by individuals who are better qualified.

Will Berry open up an IA investigation on Schultz? I mean a federal jury has found Schultz guilty of violating Costales civil rights and his management practices has just cost the city around $900,000. I am sure there is something in the SOP about this.

Oh I forgot, the SOP doesn't apply to command staff.

There are alot of cases like this one at APD. Most never try to sue, if they did the city would be broke. I think this will pave the way for others who where hammered for trying to come forward and tell the truth, but have been too scared of the Chief.

For years Ray has said "just sue me and I'll be on a beach sipping drinks by the time it goes to court." He also doesn't care because the money won't come out of his pocket! I too have worked in Internal Affairs and have witnessed 1st hand how this chief uses I.A. to control those that don't agree with his every word! He acts like a boy scout but is a vindictive ass!!! If you like Ray its because you have never disagreed with him. He only likes officers tat kiss his ass. He has always said that it might take a few years but he will get you and you won't know where it is coming from.

I concur with the last post. Costales whined in the end but it does however show that Ray Ray and White steppedover bounds. Ray needs to move on.

As far as Abq being 7th in Crime. The crime stats listed by the FBI last week show Abq 72nd in the Nation out of the top 400 Cities. Not real sure where your getting your stats. Las Cruces was 125th and and Rio Rancho was listed at 222nd on the list. I am assuming the last post was a misprint.

I can see what a great job Schultz and White have done. Let's see, we are ranked 8th in the nation for crime and the top brass protects a bunch of thug police officers. Yes, most police officers who are honest and good. However, I doubt they will have the guts to tell on another officer based on how they saw Sam Costales treated. Heaven help Albuquerque with the likes of them running the show. APD be careful citizens are armed with cameras on their phones.

I think Paul is attempting to put himself into a situation where he will be retaliated against so that he can sue the city. Sam did the same thing. It's kind of a fat retirement bonus for those old guys who know how to work the system. Sam's "forced to leave the department" claim would have been a lot more believable if he had not just topped out his retirement. All I can say is; watch your back if Paul Heh shows up on one of your calls. He is going to be looking for an officer to testify against so that he can get in on the "forced to leave" retaliation money.

I love being a cop but I find it harder and harder to work for a police department where the so called leadership has no Honesty or Integrity. When the chain of command constantly lies and the department is run by Intimidation and Retaliation I think it’s time to look for another job. I have witnessed first hand the lies and the deception that goes on. A police officer that is not honest or has no integrity is no better then the people we arrest. Please don’t get me wrong, I think there are a lot of good honest cops out there but the double standards and the favoritism that goes on within this department is crazy. How do they sleep at night? I will be making a very difficult decision on whether I should look for another job or not because my integrity defines me as a man, father, a husband, neighbor and of course a cop.

To the idiot who said Sam did this because he had just topped out his retirement - WRONG! Sam was a rehire and didn't get extra retirement. In addition, I don't think one can plan for a bunch of thug deputies to jump on an old man and rough him up so he can be a witness and get a lawsuit out of it. Ray Schultz put that part into action and I'm pretty sure Sam didn't expect to be retaliated against by Management and of course his brothers in blue. To the person who has done IA and claims, there are more cops telling on cops than citizens - Wrong again! If APD has nothing to hide open them up for public scrutiny. To the person who said Sam worked in Radio with Mark Mabry - Wrong again! You all need to get your facts straight. I now see why APD and the Sheriffs office can't get their stories straight. It's hard when you don't know the facts, you're a liar, or you are just too ignorant. Anyone, who stepped forward to tell the truth should be commended. If there is no wrong doing and you are not abusing citizens then you shouldn't worry about who you are working with.

I bet Officer Costales is glad that Marty had that do not settle policy on lawsuits. Marty was such a bright leader. For the taxpayers, it may be the only money that is well spent since it enlightens everyone to what goes on at the PD.
It beats Marty giving away money to his chosen few in pay raises (pay backs).
I just wonder what the real numbers are going to be for the budget short fall once the facts come out. Marty has spent and spent. He has filled high paying positions and left service positions unfilled. His Directors,Associate Directors and HR know what they've done. Lets see who will have their heads hanging high once Marty is gone. I believe the public is going to be surprised the city is out of money and in trouble. GET READY!

Nothing will change until we hold our chain of command accountable. You can bet your ass if you screw up they will be all over you. Look at the people that are running this department.

Not many of you young guys remember Sam being the head of a pyramid scheme in the mid-90's. He almost lost his job back then too. But he was able to make about $20,000 before he was found out. Ask around, it was no secret. So I guess this "Honest" cop is not so honest, now is he?

If you're a cop and feel this administration is corrupt - ban together and go to the city council, mayor, news media, (shoot contact Oprah) etc. They can't go after all of you and maybe you could be instrumental in tearing down the "Blue Wall of Silence". I'm pretty sure the majority of cops don't participate in what the bad cops do, but you wouldn't want somone to turn a blind eye if it were their child, dad, sister, etc. being abused. You are in an honorable profession so, don't let the bad apples ruin it. Unfortunately, the top cops are a major part of the problems at APD. Get rid of them!!!

This is Paul J. Heh. To anonymous that said I was attempting to set myself up for a lawsuit because I will claim they forced me out. LET ME MAKE THIS VERY CLEAR. I DONT RUN !!!! Now let me address anonymous about the court overtime. Myself, Dawne Roberto, and Matthew McElroy have been been involved in this from the beginning. We have argued with the A.P.O.A. over how this issue should be settled, we tried to offer an olive brance early on to just put the department back on four tens to settle the issue, we have gathered names of officers effected,we appeared at the labor board hearing where Fred Maurer Approched us and told us we can settle this thing if we will agree that an officer will get paid 2hrs. overtime if they worked the night before and their court starts by 10am.EXAMPLE work the night before get off at 0600hrs. court overtime starts at 630am and continues until your court is finished for that morning. NO break continues straight through such as a jury trail into afternoon your overtime continues. we agreed with Fred to get this settled and to avoid a lawsuit against the city ( which I believe we would win ) to get the officers their money, and not wait 3 years for a lawsuit. Fred went in to the meeting to announce the agreement. Waiting outside A.P.O.A president, vice president, and Loren Torres approched us and stated the argeement is court must start by 8:30 am. I went into the meeting pulled Fred out and had him explain to all concerned that the start time for court is by 10am not 8:30 AM.I know most metro court starts between 8:30am and 9am. Fred stated in front of all concerned the start time is by 10am.Now the contract states if you are a graveyard officer and you work the night before your court overtime starts 1/2 hour after you get off shift. SO by the letter of the contract if court started at 2pm your overtime would start at 6:30 am. Like I have said you have to give some for a settlement without a lawsuit that would take 3 years. Much more has transpired since that agreement IF you want to hear the entire play by play get ahold of me, Dawne, or MAC. Bottom line. There is finally a person working in D.A.L. His name is Norman. His job is to pull time sheets of thoes effected and to see how much is owed to each. You can stop by D.A.L. to make sure you are on the list and how much owed. If anyone finds anything funny going on please let me know. I think we must try to avoid a lawsuit. BUT A LAWSUIT IS ALWAYS AN OPTION NO MATTER WHAT ARGEEMENTS HAVE BEEN MADE AND BY WHO. Make no mistake this is the only reason graveyard was put back on four tens. PAUL J. HEH

Sounds like you have intimate knowledge of that pyramid scheme. How much did you make? OR why didn't you report it? Like I said before, quit beating on your chest if you can't do the right thing and turn in your fellow officers for misconduct. The truth seems to be coming out more and more about officer misconduct. I sure would like to see the IA files on a bunch of you. Citizens speak out and ask for those files to be made public. I bet we would start to see a pattern develop. Citizen claim - DENIED! What happens when you see citizen complaints against the same officer over and over. Hmmm there's that pattern and it is called a cover up!

For instance the great "police conspiracy" belief requires one to have never had to experience first hand that two cops can't even agree on where to eat lunch --- but apparently entire divisions are willfully keeping quiet over career threatening issues to protect guys they don't even like.

Those same civilians would be amazed at the amount of phone calls IA gets from cops turning in in other cops for things as henious as double parking or taking an extra 10 minutes on their lunch hour. But again, these same guys are keeping quiet over the big stuff like arresting a rich guy who tried to drive through a closed perimeter.

Another thing that may be hard to believe is that some folks are just dicks, granted any citizen may be a jerk, but when one is rich famous old and driving on a street that the city named after them, they may be a bit belligerent and talk themselves into jail aout of what amounts to stupidity and entitlement.
So one officer there sees things differently and ends up a few years later $600,000.00 richer. HMMMMMM -- let's see here, families of people who get killed
often get lower settlements... so in this case someone believed that Sam was worth that much even though he had one retirement coming in, and was ready to stay home and retire anyway.

Perhaps it was due to the fact that he was such a "ball of fire" as a worker, volunteering fro hazardous duty or working in dangerous assingments -- nope he was on dayshift for 20 years...

Puzzling what was found that we don't know, or if this was just a vote against an administration rather than for one officer.

On the other hand, it could just go to show true the old analogy of a judge or a jury being on par with a box of rocks.

Just read the blog about publishing things on citizens. I think you do that on Saturday (DWI's). If I had the authority a cop does, I would have no problem publishing my IA records. In fact, turn on your belt tapes. Isn't that what they are for. Seems to me they get erased when it's not favorable. Of course, they forgot to turn it on. According to the paper the deputies (all three of them) didn't have their belt tapes on. Imagine that. I think you should have to wear cameras that would eliminate the I thought he had something in his hand and now it's a justified shooting. News flash we all answer to God in the end.

Officers and deputies have broad authority because they have to make split second decisions that will be debated for years by attorneys that have the luxury of time on their side. I think all citizens support the honest APD officers and the honest BCSO deputies. Most citizens are heartbroken when an officer dies in the line of duty. This isn't about the honest cops, but the ones who think they are above the law and can bully the public. I think most cops start with the right intentions, but you live what you learn and if your leaders are corrupt heaven help you. Most cops are stuck between a rock and hard place.
By the way the IRO answers to - guess - Schultz! Somehow as a citizen, I don't see the logic in that.

And yes, I did get one, for a similar type of life threatening incident however mine involved a bit of a gunfight.

I worked for the same dept. for 23 years, and managed to settle my problems like a big boy, not by trying to win the ghetto lottery.

People will say that the only way a bureaucracy can learn in to lose a lawsuit. In fact that may be true but I still reserve the right to think it smells for Sam to get that much for getting his little feelings hurt.

The chief ain't blameless in this deal, dont get me wrong, they treated it all wrong in how they looked like they targeted him witht hat silly discipline over how he appeared in court. However, at the same time bringing up a one time occurrance when Sam jumped into the water doesnt really give a fair assesment of well over 20 years of being a P.I.A. and languishing on dayshift or running his side businesses.

In fact waving the bloody flag about one incident of bravery reminds me of what my momma always said - "even a blind hog finds the food trough once in awhile".

I'm just sayin' (using that analogy) that Sam really stumbled right into the food trough.

Sadly, although Ill be accused otherwise, I dont even dislike the guy -- Im just saying he aint worth over $600K for this crap -- it's straight up silly.

Sam Costales worked in the radio room with David Archunde (I think that is how his last name is spelled) for a few years as rehire officers, all they did was take reports over the telephone. Then came Leonard Rodriguez and Frank Olivas they took the job in the radio room and forced Sam and David out. David quit because he did not want to be in FSB. If you didn't know Sam was not a certifed officer when he returned as a rehire, he did not get certified as an officer until March 2006. So did the incident with the Unsers occur before March 2006? If so then Sam could of possibly said he was a full time officer but he was not certified as an officer by the state and possibly should of never been out on the street and for sure should not testif that he was an officer because he was not certified. Maybe you should look into this.

In fact the city had several rehires (over 10) working as officers and they were not certified by the state until March 2006.

Why is it that we arrest a criminal and make sure he/she has an attorney. But when an officer is accused of wrong doing and hires an attorney he/she is obviously guilty? I can't understand why this administration believes that 34s don't have rights. I would hire an attorney if ever accused (not a union attorney a real lawyer)so that my civil rights are protected! We don't become 2nd class citizens because we wear a badge or star! Don't let these guys intimidate you, exercise your rights and protect yourself. To ALL the hard working,honest and oath abiding officers: I am not in law enforcement, just a regular citizen who fortunately hasn't needed many of your services but rests comfortably at night knowing you are out there if I do.I read these posting and can't answer what is true or false-Im not there. I do know that I rarely if EVER see the APOA/Police Union (not sure if there's a difference) in papers, on the news at rallies. I also know that any city government/department can't be trusted to do the right thing by public safety unless their feet are held to the fire. According to most reports there are about 1000 officers in APD...that is HUGE! If you were to organize and strengthen your union you would be unstoppable! You would have the respect, attention of City hall and desire of APOAs endorsement. Chiefs, deputies etc. would be apporved (at least discussed) with union officials prior to placement. Good 'ol boy-ism would reduce,mistreatment would lessen because Admin. would KNOW you wont stand for it. Its alway easy to complain about problems...support your union officials, go to meetings, if the current ones aren't good-vote new ones in.GET INVOLVED! Things can't change overnight but I promise you they will change with persistence. I have noticed other unions, namely, the Fire Local/union go from never being heard of to seemingly be a considerable power in local politics. Their recent DWI policy is a perfect example. You may not agree with it but you got to give the fire union credit for working hard enough to make a relationship strong enough to get policy like that signed. There are of course some bad cops (pure statistics prevail)but the vast majority seem to be honest BUT standing on the sidelines indifferent (or discouraged), waiting for that 20 year mark to come around to retire. You guys are better than that. Become part of FOP or combine with Fire for a public safety union, but DO SOMETHING to change this. YOU GUYS DESERVE IT!!

The contract had nothing to do with APOA but was possible because of what surrounding jurisdictions were getting in their contracts and Marty's pledge of 1000 strong to the public...

The issue is not the contract it is with APOA or better yet with the board.. We would like to see change to where board members do not get sweet gigs like SID or the Mayor's detail.

We are tired of the APOA board making endorsements against the wishes of the majority of officers they represent. A meeting of a qurom does not represent the majority.

Eye, do a Poll for the officers if they have confidence with APOA or if change needs to happen.

Members should never pay for board members to smoke cigars or have coffee and meals on a daily basis just because they want to.

See where your last endorsement got you board members! And hopefully no more free rides to SID or the Mayor's security detail...

No one attends the APOA meetings because they are disgusted and fed up with all the BS that has occured over the last 8 years.

I like the contract but I do not like the APOA's direction...

Well Sam said he lost all this weight for being stressed out. He is always stressed out ALWAYS!! He was throwing up way before he retired for everything you could imagine. He would make up a call so he could get out of going to court because it was too stressful for him to go testify. See how many people got off on their tickets because honest Officer Sam didn't show up. Plus he lost all the weight after he quit. Not because the dept was against him. He just likes to sue and got lucky this time. Don't forget about the time he was arrested by Rio Rancho PD and then moved out of RIO because he said their PD was harrassing him. Sounds like a pattern. See what his lawsuit pattern is he has filed several. He had to go back to field and cried about it. He couldn't have his cushy job in radio. I'm sure the lawsuit was just -- but not that much of a settlement. Sam was a lawsuit waiting to happen when he was on the dept. I saw some racial lawsuits in the making against other officers. He was also the biggest prankster but would cry when somone pulled a prank on him. So there is the OTHER side to Sam.

Dec 15 9:25 - First, If Mr Costales did throw up it was probably because he had to work with some corrupt cops and that would turn just about anyones stomach. Second, from what I hear all the statistics you cops turn in stating how many tickets you write etc. are all made up numbers. I think the public should ask for an audit. They claim a certain amount of tickets were written and yet I bet if you compared that to the actual all your reports would be false. I checked out the information where you insinuated Mr. Costales sued Rio Rancho and that is FALSE. If he was arrested the charges must have been dropped because I could find no conviction. My conclusion is he was wrongfully arrested. Guess you are in to slandering and defaming people just like APD. I'm pretty sure you work there and are just jealous that you still have to work there. If you wanted that cushy job in radio why didn't you bid on it? Sounds like you are mad about being in the field as well. So I guess I just don't get what his bad side is other than he successfully proved that APD and the Sheriffs office have some really corrupt cops. Nothing but a bunch of thugs with a badge.

Tiburon is a horrible system. I did write to the Berry Transition Team hoping that the system would be replaced. I doubt anything will be done about it so I guess we will just continue to put my fellow coworkers at risk with this system. God bless you guys.

You sound like you need some anger management classes. Sorry they did away with the radio job and you can no longer bid on it. Boy, sounds like this Sam guy really screwed that up for you. Perhaps, you should think about getting a new profession. The citizens of Albuquerque do not need another abusive cop on the streets. Another suggestion would be for you to stick up to the Chief instead of letting him bully you. Oh, I forget your all a bunch of wimps with no backbone and can only pick on helpless citizens. Some of you sound like a bunch of jealous boys who didn't have the guts to go up against APD themselves. I bet Mr. Costales could careless what any of you crybabies think, after all he WON his case in a court of law. Funny, I wish I could hear his side of all these wild accusations, but if I were him I wouldn't bother either.

Well you didn't look hard enough because Costale's was arrested in Rio Rancho probably about 10 years ago. Costales is the crybaby ask anyone that knows him. And the position was eliminated because the cops are needed in the street not in radio and that's what the telephone report unit is for they could of went there to work. And I could care less about bidding for the position I am retired. But this whole site is nothing but a bunch of unhappy people who only look at one side of the story. If Albuquerque is such a bad place the freeways are open in all directions grab a u-haul and move -- we won't miss you.

I've lived in ABQ my whole life and love the place. Too bad we now have to live with a bunch of corrupt cops running the place. Never said Sam wasn't arrested I said I couldn't find a conviction. In addition, it was about his ex wife hanging out in his neighborhood. I also read the journal story written in 2006, where his ex was interviewed and she said nothing but good things about him. Guess they made their peace, so if that's the worst thing he did - give me a break - that's not very news worthy. Talk about a crybaby - you are probably one of those retired cops who can't let APD go and move on. You say your retired, but I bet you are still working for APD. You're probably sitting in a police camera van giving tickets. The radio job sounded better and you still sound jealous. Bet Sam doesn't care much what you or anyone else thinks.
