Crossing the Line

Little Brother Blocking and Listening

Information is power; every dictator in history has recognized the truth of that statement. The Soviets controlled all of their media outlets in order to control the flow of information and ideas. The Nazis burned books and produced propaganda films like "Triumph Des Willins" (Triumph of the Will). The Communist Chinese restrict access to the Internet in order to "protect" their populations from subversive ideas.

On Monday we started receiving emails that indicated that eyeonalbuquerque.com was no longer available on city owned computers. At first we thought it was probably a snafu and that there was some temporary problem that would be cleared up shortly or would work itself out as these things often inexplicably do when the Internet is involved.

In order to be thorough, we decided to run it by our Eyes. Lo and behold our Eyes confirmed that the emails and posts we received seemed to be accurate. City employees using city gateways and computers were no longer able to reach The Eye at eyeonalbuquerque.com.

This clicked with some other rumors that we had been hearing about the wiretapping of city phones. Our Eyes have been hearing that in addition to blocking out the ever-lovable Eye, city officials (our guess would be with the Almighty Marty's approval) are listening in on conversations of city employees on city phones.

According to our Eyes, both Councilor Sally Mayer and APD Captain Conrad Candelaria have confronted CAO, Bruce Pearlman (of ABQ PAC fame) with these allegations. Of course Mr. Pearlman denied any such activity - which we would expect even if the allegations were true.

Look, the city has absolutely no obligation to provide access to Eye On Albuquerque. Since they own the gateways and have administrative authority over every city employee, there's nothing illegal about blocking access to a website. However if the rumors are true, the city could be looking at criminal charges for anyone involved with listening in to conversations without first obtaining a warrant to do so.
"The Federal Wiretap Act, sometimes referred to as Title III, was adopted in 1968 and expanded in 1986. It sets procedures for court authorization of real-time surveillance of all kinds of electronic communications, including voice, e-mail, fax, and Internet, in criminal investigations. It normally requires, before a wiretap can commence, a court order issued by a judge who must conclude, based on an affidavit submitted by the government, that there is probable cause to believe that a crime has been, is being, or is about to be committed. Terrorist bombings, hijackings and other violent activities are crimes for which wiretaps can be ordered. (The PATRIOT Act expanded the list of criminal statutes for which wiretaps can be ordered.) This authority is used to prevent as well as punish crimes: government can wiretap in advance of a crime being carried out, where the wiretap is used to identify planning and conspiratorial activities. Judges almost never deny government requests for wiretap orders."
It concerns us that the city may be attempting to control or monitor information; some of which is protected by law. If true, those involved are engaging in activities that are not only illegal but most feared by our founding fathers.

Tyranny, repression, subjugation, absence of liberty, are all kept at bay by the free flow of information and the ability to communicate confidentially. If it's happening here at city hall, we'd suspect that the Almighty Mayor knows about it. Even if he doesn't, it may be happening on his watch. Is this really the type Senator that New Mexico can afford to have?

Is violating our rights something new to this city? No. Will anybody do anything about it? No.

Maybe Marty running for senate is a blessing in disguise. If he spends all of his time and effort on the senate race maybe somebody else can take over the mayor's seat whether or not Marty wins. Let's all pray that he doesn't win. I'd love nothing more than to see his political career over very soon.

As an aside in the vein of this article let me tell you this. The guy from the city I.T. dept who would not allow detectives uncontrolled access to the internet to investigate certain sex crimes was himself recently arrested for seting up an escort date at lunchtime -- ostensibly from a city computer. He was an absolute stone wall about it for months, at the time I though he was just obtuse but now .....

hehheheh... gotta watch out for those I.T. guys! They can basically do whatever they want and nobody knows about it... then when someone else notices something funny- I.T. guy can blame a "computer glitch", fix it AND be the hero that solved the problem!!! ;)

If you remember a few years back, part of this administration was tapping Capt Leeper's phone line while he was the commander, assigned to the NE sub. Some of those players are still here.

At the time, Capt Leeper was very politically connected with the wrong group and the administration was doing everything they could to find out who he was communicating with.

Capt Leeper was very powerful
in the NE and was well liked, so the administration did everything in their power to bring him down. When that did not work, Chief Schultz moved only a few Capt's indicating he was going to move them all. He however only moved four, one of which was Capt Leeper. He took Leeper completely out of the lime light. Shortly thereafter Schultz forced him out.

He never moved any on the capts that were his friends.

They also tried to go after him for criminal charges. Of course, all of this was highly illegal, but no one stopped them. However, when it became public, they backed off!

Looks like they are at it again!

Remember, you don't have any rights with this administration. They do what they want.

How does the Mayor and the Cheif deal with being despised instead of admired by the troops. Even Marty's cabinet members(appointees) don't respect him. He has loyalty only because of employment. Neither have any real friends. The one's they THINK they have are doing so only out of fear. What a way to live.
They will eventually turn on one another and sell out their own mothers to save their hides.
What a despicable cesspool they wallow in.

Captain Leeper WAS admired by all.
By his troops, neighborhood leaders and politicians alike.
Politicians; the ones that knew right from wrong and held themselves to a higher standard. Ray and Marty were jealous of that fact and couldn't succeed in bringing down the Hammer and Sickle on the officers and civic leaders under his command.
There will be a day of reckoning for all of this as these creatons will be exposed for who they are.
It's coming sooner than later.

Unlawful use of a Title III wiretap is a serious violation of Federal Law. If this is going on, and I hope it is, that's serious jail time.
Make room for some big fish at the West Side Country Club.

It's sad to see the sworn officers of APD go through all this. Citizens can find it hard to imagine how bad the officers have it but also try and imagine how bad it is for the civilian employees. Upper management is in all the DC's pockets. At APD you are either Sworn or sworn at!!

With Captain Leeper as Chief, you would never have to worry about getting screwed or blindsided. He is fair,honest,moral,just and would not sell his soul or back down from a fight like the slithering snakes on the fifth floor. Those who occupy it now and those who did a year ago. The morale would be high and the public would have definitely been better served.

Wilson, Chavez, or Pearce? Pearce wins Dominici's seat.

White, Heinrich, or Madrid? White wins Wilson's seat.

So guess where that leaves Marty...back as Mayor. Ugghhh!!!!!

I agree this place needs a major "cleansing" but its only gonna happen if the heat is kept on Chavez. Every public event needs to have a heckler and somebody to throw a counterpunch!!!

Read the city charter, he can't run again. The charter only allows for two consecutive terms. Now if he challenged this it probably would not stand up in court, but by the time the senate election is over it will be too late for him to challenge the city charter.

Gee, I thought I was the only person in ABQ that thought Marty was scum. Seems like everytime I listen to local talk radio, all the call-ins say that Marty has done wonderful things for the City. I always disagree (sometimes at the top of my lungs) but if Marty is as despised as these posts would indicate.....it should have been easy for S. Pyke to get the 22,000 signatures it would have taken to recall Marty. Heck, at least 900 would have come from the APD rank-and-file. Add wives and miscellaneous other family and you've got around 3-4 thousand. And that's just outta the cop-shop.

Alas, Marty has everybody (but me) hoodwinked into thinking his sh!t doesn't stink and so he'll be either our next US Senator or our next Guv. If the latter, imagine how effed-up this state will then become!

Capt Leeper may be our next Chief when Mayor Marty is out of the picture. Watch all those lying rats run for cover, as he'll fire every last one of those lying weasels. He'll start with the entire 5th floor and work his way down!

They all came after him once, because he was not supporting the right party. He stood up to Mayor Marty and Chief Schultz, not letting them go after his troops in the NE, and they made his life a living hell!

Capt leeper did not go along with those liers and respected the troops and the troops all respected him. The 5th floor could not have the community and the troops having more faith in the Capt, so they attempted to bring him down.

They even tried to blackball the new company he formed after he retired. The 5th floor called Santa Fe in an attempt to tarnish his good name, but again, they failed.

If the Mayor leaves in a year, Brad Winter or Cadigan may become mayor. If so, hasta la vista Schultz and his puppets.

I'll bet the 5th floor will not be sleeping that well in the months to follow.

A CITY IS NOT SAFE BECAUSE THE POLICE CHIEF FEELS SAFE. THE CITY IS SAFE WHEN THE AVERAGE CITIZEN FEELS SAFE. Every COP knows John ,he has had our backs for years. Now its our turn to have his. APOA Union Ron Olivas, I am a local attorney and if I understand what I've read correctly. It appears that the APD Chief called you into his office and chewed you out for placing your 900 ad.

If this is in fact true, you have a valid lawsuit against him and the city for violating your right to free speech.

Secondly, your union can move forwrd with charges against him for union busting. What the chief is attempting to do by the use of harassment and intimidation is highly illegal activity with regards to union activity.

Clearly, just from reading this blogg, this chief does not understand employment law and appears to violate the law concerning the rights of his employees on a regular basis.

I can only judge from what appears to be on the surface, but there are some very serious issues here, if the information is factual.

Your union should really consider taking legal action.

I am not an employment attorney, but there are several great ones in town.

Hon, if you’re looking for sympathy because you can’t blog and surf on your employer’s time and equipment, you won’t find any here. My own workplace is pretty locked down, but then I work in the private sector where they seem to have more exacting standards about actually doing the work you’re being paid to do.

By coincidence, my pastor this morning preached on the seventh commandment: thou shalt not steal. One of the examples he gave was the workplace. He quoted a study that said workers admit to goofing off about 20% of their work day – and, as he said, that’s only what they admit to! That comes out to a day a week. His point: those workers are stealing a day a week from their employer.

I realize this is out of synch with the current culture, but I’d find it interesting if not even a cop blogger gets this connection.
