Getting Plucked

By now you're all probably tired of the seemingly endless Thanksgiving references. Sorry, but we just couldn't help ourselves because we've never seen a bigger turkey than Marty's scam-era program. We've talked extensively about the faults of the red light toll system, but what we haven't spent much time on is the speed vans (scam-vans) that are also a part of the Safe Traffic Operations Program.

In our opinion these vans are the least offensive of the STOP components. Unlike their fixed intersection counterparts, the vans have a police officer present who performs calibration at the beginning of the operation, at the end, run the internal radar check. At best the intersection scam-eras run only an internal check and as far as we know are never independently calibrated.

Before you think that The Eye has gone over the edge, the equipment calibration and the presence of a sworn police officer are the only two things we don't object to.

Like the scam-eras, the scam-vans issue a citation by mail complete with photographic "evidence" that your vehicle has become an evil-doer. There is no indication of who the driver is and no direct evidence that your vehicle has indeed violated the law and become a public nuisance.

The Village of Los Lunas is suing the City of Albuquerque in District Court because the scam-eras give no indication of who is actually driving the vehicle. Apparently, the Chief of the Los Lunas Police Department (or more specifically his scofflaw vehicle) received a scam-era citation and the village doesn't want to pay unless the City of Albuquerque proves who was driving the village vehicle. (KOB-TV read it here.)

Remember people don't run red lights - vehicles do! We can't be expected to know what our vehicles are up to when we're not driving them!

When you receive a speed van citation (on behalf of your dastardly vehicle) you have the option of paying or challenging the citation in Marty-roo court; run by the same "hearing officers" that run the rest of the scam-era program and who are hired (and potentially fired) by the Almighty Alcalde.

We received information and supporting documentation about one of these speed van incidents just today. In this case, the owner of the unruly vehicle decided to challenge the citation and took the time to obtain the Speed Van Deployment Log of speed van number 1.

The log clearly shows the date, speed limit, start time, end time, and location of the speed van. It also contains the notes of the attending police officer. What's interesting is that the officer's notes include a list of license plates followed by statements like "(no violation) other vehicle trip camera" which indicates to us that this particular officer was paying attention to the operation of the equipment.

On this day back in June - June 19th to be exact - the mobile revenue generator... uh, scam-van started rolling in the dough at 0907 and stopped filling city coffers at 1213. In that 3 hour and 6 minute period, 5278 vehicles were assessed of which 1306 were tagged for violating the speed limit - that's 25% of all of the vehicles passing scam-van 1.

We know that the Albuquerque isn't exactly known for driving too slow, but 25% of all vehicles in a three hour period were exceeding the speed limit by 10 MPH or greater?! Come on!

Here's the problem... and what ultimately led to the dismissal of this scam-van citation. The van was parked and operating in an "improperly marked" zone. You see the scam-van was sitting in a 65 MPH zone and handing out citations as if it were a 55 MPH zone. Ooops!

The hearing officer down at Marty-roo court knew about the mistake and promptly dismissed the citation marking the Findings of Fact Decision and Order sheet as being dismissed by the APD officer. The "judge" went on to tell this particular defendant and his attorney that ALL of the citations from June 19th were being dismissed. (Go ahead and check your citations... we'll wait.)

When we heard this story it clicked with some other information that we've had for some time. Our Eyes told us a few months ago that an APD scam-van officer had reported to their supervisor that there was a problem with one of the vans that made all of the citations issued that day suspect. According to our Eyes the officer was told to send the citations anyway. Let's say that again... the officer was told to issue suspect citations despite his belief that they were inaccurate.

We don't know whether or not these two stories are actually the same story from two different sides. However, if the owner of the dastardly Dodge, Ford, Chevy, Toyota, Nissan, Honda, Mercedes, BMW, etc. had simply paid the citation (which you are nearly threatened with your life to do in the citation letter) they would have never known about the scam-van problem June 19th and the city would have happily dumped their money into the general fund.

This is the problem when PROFIT gets involved in law enforcement. If only half (we'd bet it's more like 70% to 80%) of the citation recipients decided to simply pay, the city would have hauled in almost $100,000. And if the numbers from the recent audit are any indication $54,000 would have been considered "excess money" a.k.a. PROFIT. Not bad for 3 hours and 6 minutes on the freeway.

There can be little doubt that the Red Flex scam-era system is flawed, but we believe that knowingly allowing 1306 individuals to receive questionable citations could be considered fraud. If a city official, ranking officer, or hearing officer knew of the problem and did nothing to make sure that people who were slapped with fines in error received their money back, then we'd say that constitutes a conspiracy to defraud. We're no attorney here but doesn't that constitute a violation of the Racketeer Influenced and corrupt Organizations (RICO) Act? We're quite sure that it could become the basis for a class action lawsuit since we understand that there's one (yes another one) in the works.

One thing is sure - like Thursday's turkey we're all getting plucked. The only question is whether or not some city officials (mayor, chief, etc.) end up with their gooses cooked.

No one of the 1300 + people were notified of this. Every one of those speed trap tickets were dismissed, but no one knows. They were sent out anyway and probably most sent in a payment. How many were refunded? I'm guessing NONE.

1306 citations X $150.00 is a lot of moola. If even 75% of those sent in the fines, that's $146,925.

Too many people are reading this blog now. Something big will happen soon. This City and ultimately the taxpayers will pay for this administration's cavalier attitude. Afterall, it's not their money. Maybe it's about time we have honorable people in place that actually care where our money is spent, not down the drain with legal settlements that are sure to hit real soon. With that said, I hope there are other penalties besides financial. Like jail time for the corrupt that run this city.

Okay, we're getting off topic here. This particular blog is about how the City is charging and fining people in a speed trap that was illegal. So, back to where we were.
1300 + people or vehicles were illegally sited and the City issued tickets and probably 80% sent the $ in. The City did nothing to notice those about the mistake. We'll not say anything and hope it all goes away. Meanwhile we just collected about $156,000.00 we should'nt have.
But guess what? It will be returned. The attorneys are lining up for this battle. A battle that the citizens will win.

This stuff about the walking beat is ridiculous. There are two distinct issues: Their position and their performance as officers.

They were allowed to “be on duty” and collect overtime (that’s 1 ½ times the pay rate) on a discretionary basis that’s reflective of poor policy and poor management. When they are on duty they cater to downtown merchants and rarely respond to calls. Do they save the “field” calls while on duty? Of course they do but saying that their mere presence contributed to cleaning up downtown “speaks volumes” where they didn’t have to take any calls is flat out uninformed if not simply stupid.

Since much of the general public was not at work yesterday there was nobody to cater to and shame on them for not stepping up and doing anything. Oh but wait, downtown was full of transients after the lunch feeding got out but where was the walking beat???? At home, probably where they were all day. Let’s be real, they were clear all day because they chose to do nothing.

As far as them being rehires, they are. Unfortunately they give rehires a bad name because there are many rehires that are worth more in weight than a current active duty.

Back to the point, all anyone has to do is send Larry Barker or any other "investigative reporter" an email telling them about the 6/19 illegal citations. All these media types just love it when anyone from city government screws up, real or imagined. They can't wait to plaster it all over TV. I recall back in the day at APD when Barker and his cronies would show up just sniffing around for dirt anywhere they could find it.

I know an officer who was involved in an extremely high profile case and was feeding Barker info until his BUDDY (who was in a high ranking federal position) asked him to not run the story. He dropped my friend and his partner like a hot potato. Somebody should ask Barker about little cruise to Alaska..with his boyfriend....He's not near as tough as he would want people to THINK he is...

The rehire program is a scam to keep numbers, the dept would now be under 900 without them. everyone knows that only a few guys like gene and bruce are dedicated to the team. the rest are making 90000 dollars a year to hide inside, the csa's too. I think my dues should be going to get rid of that program, but like always, the leadership is protecting these guys

Without the rehire program APD's numbers would be in the high 700s. There are about 75 rehires on the dept, although the majority are in inside positions.

The big risk isn't that the rehire program harms younger officers (although it certainly does, younger officers would have received a much better raise in the past had it not been for rehires returning). Younger officers are also kept out of inside positions because they are given to rehires.

The bigger risk is that over time our pension is going to change because of it. Either the legislature will realize that cops don't need to retire after 20 years and they will change the program to have us work longer before retirement. This would be cheaper for city's and for the pension fund. Add to this that the City of Albuquerque has lobbied every year to NOT pay PERA contributions for retired rehires and you can see the funding issue. If Albuquerque ever got this passed our pensions would be in serious trouble.

The rehire program is a Pandora's Box that never should have been opened.

See today's Journal, Marty admitted that APD only has 998 officers. Now we know he counts the part time CSA's so when you remove them APD is below 950! They graduate 9 officers right before Christmas and are expecting almost 70 retirements by Jan 1, 2007! This city's police department is in crisis with it's staffing. They are not growing they are shrinking.

There is only one way to solve this staffing crisis.......convert our PERA plan back to a 25 year 80%program. Once you do that, you can take a stab at creating a 5 year Drop Program to retain the officers that wish to stay longer....

i wish i had a segway instead of a $60k car, id never take calls and eat alot. if they sent me a call id find my car attach it to the trunk and drive to the call. total time to get to an emergency call is now two hours. my family would sure feel safe with those numbers. good thing i have secret parking underground next to the mayors car, no traffic to deal with.

By the way how many APD cops do you think Albuquerque has? How many of those are currently under investigation? How many of those are part timers? How many will be retiring January 1, 2007. I would bet by that date APD is closer to 900 than to 1100. Marty and Ray can't deliver on this promise because of their mismanagement of APD. They own this. I can't wait to hear their spin.

And you are concerned with a program that reaches around 100,000 voters everyday, if you're not you're a fool.

In today's society we are getting more and more young folks with degrees plus military service (in a war zone). These kids may want to go into public service but they sure have checked the internet and run the numbers. They know what cities pay the best as well as which ones have better living conditions and crime rates. So if you want a mediocre salary in a high crime mid-sized city you end up here. When I retired a few years ago more than half my troops had at least a BS/BA from somewhere plus loads of other training on their resumes. These same guys are eligible for any Federal L.E. job out there, from park ranger to Border patrol to the FBI... and they all start in a GS level far above 20 bucks an hour. This leaves us with folks who are tied to the city already (family ties) or a few who cant get on at a bigger agency because they have been turned down already. Think this department hasnt come down in the applicants estimation? Well in the early 80s we were getting over 700 applicants for a class of 40 to 50 cadets... now they are getting enough to shake out what, 9 worthy ones? We now have a self fulfilling prohecy of bad media from crappy selections (Maes, Chavez et.al.) at the very time in history that we need voters to step up and help the dept. pay more money. This is exactly the scenario that Detroit, New Orleans and Camden went through and they are all places none of you would like to work or to live except behind walls. Add to that the "sanctuary city" and other unpopular ideas (Red light cams.) and the average joe in this town is about as unlikely as ever to pony up more dough for cops. Best thing for all right now is stop the infighting and work like Santa's elves on getting a bunch of good press real quick!

Remember when it comes to counting the numbers, by city budget standard, the only officers that are allowed to be counted toward the 1100 are full time, sworn officers.

Part timers don't count toward the 1100.

I would bet that by January 1, 2007 APD is down to 900 full time sworn officers.

two posts up, review the city budget, as approved by the council, for the police department and you will see the language 1100 full time sworn officers. Part time officers are in the budget but paid from a different fund. The reason the budget states 1100 full tome sworn is because full time officers get all benefits, that means the city has to set aside money for health insurance, PERA, etc. Part timers get no benefits so they are paid out of another fund.

It is all online if you want to look it up. Go to www.cabq.gov and research city budget. I linked through the council to get to it.

yes but they are not full time as per city budget. That is why the only number that is being talked about is the 1100 full time officers.

Think of it this way, how many part time officers drive in police cars and take calls for service as uniformed patrol. ZERO That is why you can't count part timers in the numbers.

If any of the part time rehires would like to work the field ( I believe there are about 70 of them, then by all means, tomorrow when you go to work show up in uniform and notify your chain you will be answering calls. You and I both know that isn't going to happen. Instead of trying to fix the manning crisis with a band aide approach, the management of this city needs to find a way to hire full time officers like they are supposed too. Not all police departments are having a manning problem. Albuquerque needs leaders who can honestly address the problem, put aside special interests lobbist (retired folks), pay a high wage a for entry officers, give officers at 20 years a substantial hourly increase so it would benefit them not to retire and start working on a solution instead of stop gap measures.

The dumbest thing APD has done with hiring is to count on retired rehires. APD has no control over this program, the legislature could kill it every year. Who would allow a large part of their staffing to be governed outside of their control? This is just plan dumb. What happens if January 2008 the legislature and governor sign a measure to immediately kill the rehire program July 1? What would Ray and Marty do then? Because all the rehires are going to walk and APD will be in even more crisis. Nope you don't hedge your bets on things you don't control and the rehire program is just that.

It never ceases to amaze me how the retired rehires act when they are brought up. I am not slamming the rehires, I am saying that APD and the City have no control over this program. The legislature controls it and can stop it any given year. That is not a good way to manage your manpower. I could care less about rehires themselves. If they want to believe they are saving the city so be it. The program itself is not under Ray and Marty's control and that is bad management.

The city would have been forced to give us a big pay raise, but instead you retired guys showed us no support. You came back for $21.07 while new officers are stuck at $19. Then on top of that most of you came back to closet desk jobs. I have no sympathy for you. I owe you nothing and I expect nothing from you. You are not in line with your brother officers, you are only in line with your own greed.

As for solidarity, don't blame the younger guys or this website for your problems. No one forced you to come back and you all knew the that we have not gotten across the board raises in 8 years.
