Double Dippin' and Poltical Pay-Offs

Last week Double Dippin' Gate exploded through the city's blogs and airwaves. We've been watching the controversy with a fair amount of interest because the stories and debate have all mixed legitimate return to work and what we believe to be simple fraud.

The first story from KRQE's Larry Barker targeted what we would call fraud. Powerful government officials from different agencies using their position to orchestrate return to work deals
for favored employees - a.k.a. cronies.

The problem here is not that city employees retire and then come back. The problem is that they either come back to the same job that they supposedly retired from thereby receiving both their salaries and the pension, or they receive cush jobs unavailable to those around them. The practice depends solely on the willingness of a well placed supervisor or elected official and requires absolute loyalty to the patron dolling out the benefit.

In the cases of Vickie d Herrera and Felicia Giron, that patron was none other that the Almighty Alcalde himself.
KRQE-TV reported on Friday that City Hall had been rehiring retirees — in some cases through a "temporary agency," apparently an attempt to skirt the 90-day rule. In other cases, employees worked as volunteers during the 90-day period.
As you can see it benefits you to become one of Marty's Minions. If you can't afford to take off the required 90 days, they simply shift your position to a temporary agency where you permanently take the position.

There are a lot of problems with this system. Most importantly, the mayor and other public officials use the PERA retirement program as a political patronage program. If you are eligible for retirement and would like to almost double your pay, you better be a card carrying member of Marty's Minions. Otherwise, you'll end up like former Officer Dennis Patrick or former Lieutenant Steve Tate... denied.

Of course if you're one of Marty's buddies (Nick Bakas) or Chief Schultz' running pal (Rob Debuck), you'll find yourself with a job making more money that you ever have in your life regardless of whether or not you are qualified to hold the position.

Our Eyes tell us that the 5th Floor is concerned that it will come to light that over 10% of the current force is made up of rehires. That means that some 80 to 100 officers are "double-dippin."

Look... we don't have a problem with someone earning their retirement, retiring, and then going back to work - private sector executives and workers do it all the time. That is of course, providing that the person in question acutally retires. Our problem is the system of using taxpayer money to pay-off political cronies. It's certainly in the long tradition of New Mexico corruption and pay-to-play governance, but it's certainly not in the best interests of the taxpayers and those governed.

I don't know about most city departments but cultural services is overflowing with "temporary workers". The library staffs so many that people hoping to get hired on in a permanent city job cannot.
Get rid of them, once and for all. If the city does not get rid of them, Paul Livingston will.

In Arab countries the penalty for stealing is that you loose one or both hands.However, typically one so you can eat and wipe your butt with the same hand.
Given the fact that in the old days when riding around on your camel, only sand was available for one of these tasks, it was a very good deterrant. Having no deterrant,penalty,accountability, or consequences, the life time mayor has no intentions in changing his unscrupulous ways.
Since no outside law enforcement agency is willing to look into the corruption here, they in turn will continue to look the other way.

There are over 105 rehires for APD. More if you count Walsh. Only 37 will be bidding for field patrol positions!!!!! Where are the other 60 plus that were supposed to be hired to take calls for service. Eye you need to check into this.

APD needs a total cleansing of its top management, the chief of police,and assistant chiefs. We the voters of this fine city demand it! We need a mayor that will put an end to this police dept that covers up the truth and does not take action on serial killers when they were told one was taking young lives. APD may have not cared about those young girls because of their life styles, but they were someone's daughter/mother.

How would they feel if it were their child????? APD's top management knew and did nothing.

Mr Mayor, I hope you take action on this matter! If they were college girls, APD would have pulled out all the stops and a massive hunt would have been on for this killer. However, police officials did not care about these missing girls and the killing went on for years and now the Chief of police down plays it.

Shame on APD's top Management!!!! We the voters demand change at APD.

The double dipping! Slow down before you support the bill, seriously.

HB573 has moved on to the senate finance committee. If you read the bill you’d be totally lost, 65 pages, give or take, of flim-flam. On the news tonight the finance committee stated it would probably pass it through to the senate.

There’s too much under the umbrella of one bill. Including retirement extended to 25 years for public safety with no grandfather clause. Those who can retire, at 20, in a year or 2 will have to wait another 5 years to get their 70%. Those who paid big bucks into PERA up until a couple of years ago! Everyone who supported PERA and allowed them to make billions $ will now have the rug pulled out from under them no matter what their agencies initial hiring practices promised. Plus an increase in contributions!

There’s also a lot of verbiage about retirees insurance, which makes absolutely no sence. I can’t even preface for you. The media, politicians and most involved with supporting this bill want all to believe it’s about employees retiring and coming back in a day to the same position.

A lot was snuck into this bill without any public employee knowledge. I personally hate most of the double dippers, Marty and Bill paybacks, but look at this bill completely before you support it. And the Guv is saying he’ll sign it if it comes across his desk.

Attempt to educate yourself on this grossly written bill and contact your representative to let them know it is being pushed through without thought. The issues need to be separated.

I thought the law allowed them to be rehired back. Why all the cry baby postings? If you dont like the law, you should of voiced your opinion in Santa Fe. I haven't heard any of the posters saying they were in Santa Fe over the last few years protesting this hire back law. It amazing how the media runs this town. You all walk around like lost sheep till your feed something from the media. Why dont the people here get involved and change things on their own.

With unemployment at almost 6% in New Mexico it is time to open up government jobs and send the double dippers packing. The law does allow for double dipping, but too many government agencies have worked to find loopholes in the law and at a time when good workers are unemployed the public doesn't see the need for it. HB 616 is coming out of the Senate Finance Committee today (18th) and will be voted on the Senate floor. Richardson said he will sign it. Good bye double dippers, the only whining I hear is yours.

HB 573 will not make it this time around. You can thank the double dippers that it was even brought up. It would have changed the number of years worked before you can retire to 25 for public safety and 30 (plus age 55) for everyone else. The reason for this is because of all the double dippers coming back. The legislature figures why have them double dip, just make them work longer to begin with. I suspect this will be brought up again if the economy doesn't turn around. The stuff in this bill for Retiree Healthcare isn't rocket science. Retiree Healthcare has been underfunded since it's beginning and a number of bills are trying to fix this.

Ive never seen officers acting like the rookies we have where they just dont care about anything. At least the old timers still do care and know when you took the Oath of Office you really ment every word.

Speaking of rehires, how about the fifth floor sweeping things under the carpet for thier rehire buddies, like former deputy chief ed saur who retired because a rape charge was comming up on him, well now he is rehired on at the apd range he has been caught sleeping with another rehires wife ( joanna hammon) then he asked capt. candelaria to sent officers to stand by while joanna removed her items from her and her husbands house. next john walsh son has been drinking with teenagers and after ia sent the investigation to the chief it also went away whats up with that

Schultz and Marty will have an interesting problem on their hands now that the double dipping law was approved with the amendment for public safety. APD will be over their allotted strength by about 20 officers come May 2009. By July 2010 if they want to continue to keep the retired rehires they will have to ask the City Council for a resolution stating Police is a critical need position and can't be filled. Well it is being filled and with two or three more Academy classes due to graduate before July 2010 APD will be a hundred or more over their allotted strength.

So what will Ray and Marty do? If they ask the Council for the resolution, then they don't need anymore academy classes. If they want Academy classes they will be a hundred or more officers over their authorized strength and therefore the retired double dippers won't be given the resoulution and they will be forced out by state law in July 2010.

Being that APD could never even get close to 1100 officers for years, this is a good problem to have. I would figure the double dippers will be shown the door in 2010 as it tis more important to bring in new people than to keep old ones. The next year should be interesting.

Did someone forget there are about 200 + officers to retire befor 2010 and lets not forget those who choose other jobs and thoes who are kicked to the curb for something they did wrong, think that brings us back to keeping the rehires. For every new hire there is one that retires, resigns or is asked to leave.

The comments reference the officer not wanting the re-hires. This is an example of how APD has changed there once was a time when being a police officer menat belonging to a family. We took care of each other, We welcomed the new and taught them. We bonded togather and remembered those who retired. I am disappointed in the comments of the obviously new and self serving police officer. one day you will be retired (that is if you dont piss off the adminstrations that will come and go throughout your career). You will want respect for all of the hard work and dedicated service you will feel you provided your city. you will encounter and learn that the city you serve, the adminstration wou work for and the citizens you serve and protect wont give a shit for you. and if by chance you do something good or (god forbid) get killed all your efforts might be worth a small segmant on the news. however your brothers and sisters, both new and old will be the only ones who will truly how you feel because they will probably have gone through the same trials and trebulations as you will have. Unless they become ass kissing supervisors. With that said Never forget where you came from Never forget there are veteran cops around the country and this city who just might have experienced more or the same as you will. If you are an "old Timer" then you learned nothing of the "brotherhood". The only reason you are back is to pad your own pocket. Almost all of you OLD Timers are riding desk duty, and you did that your entire first career. Real brave, maybe you will get a blister on your ass, while those of us who have spent almost 20 years (yes I am not a rookie and when I retire in two years I will not beg to come back) in the field do the real work of police officers. You guys make all of us sick. No one speaks out anymore because you guys cry to Schultz so much that we don't want the problems with IA on our backs.

So please, just continue hiding and telling yourself how big and brave you are that you are back running the Museum or working on computers or sitting in IA or working in Inspections or recruiting or backgrounds, or hit and run or sitting at a school, etc etc etc. Those of us that have worked as cops our entire careers do not want to belong to your lazy, self serving brotherhood.

Wow I am a rehire and I work in the FSB and I am one of the top producers in the FSB. If you feel like telling the other rehires off why just not name them, oh but then I guess you did say where they work. I for one did not beg to come back, but I do enjoy being back and about being back to pad our own pockets, YOU ARE CRAZY. Lets hope your wife/husband doesn't takes half of your retirement. If they haven't yet, they probably will, then see how great you do with the petty cash you are going to get, and anyway the retirement only covers cost of living. You are going to have a big awakening when you do leave. So may God bless you, and make you a better person. I will pray for you.

This is for the officer with almost 20 years on, I am sorry you feel that way. You are probably in the field because you want to be there. There is always a job opening in different areas of the department, no one is stopping you from applying for it.

I am a rehire and I am working in the field, I do agree that all the rehires should be out in the field but you need to take that up with the brass and the APOA and not put the rehires down. Don't think that because we are rehires we make the deals. The deals are made with golden children and yes all the rehires should be taking calls for service. You also need to know this isn't anything new golden children have always worked for APD. Anyway there are old timers on now and they have been on since the 90's working part time where were you back then, I didn't hear anyone complaining that they were working the schools or cold cases what is up with the complaining now. Maybe it just that there are alot of rehires that have inside jobs. But again complain to the Chief, DCOP's, ect and the great APOA they are falling asleep on the job too. The APOA and it's members need to stand up for what the contract states and for what the rehire program was intended for. If they place all rehires back to the field then great, those that want to stay can stay and work the field and those who don't want to work the field can leave. I do believe in the brotherhood! You do wear blue don't you! I believe the 5th floor and the 11th floor are haveing a good time seeing us fight ourselves. All of us need to stand together! We are all blue!

Let me clear up one thing, the rehires that are in the field are GREAT! My apologies for not making that clear in my above posts. You guys in FSB are really something and are appreciated! We owe you guys a big thank you for coming back and being willing to be a cop and help us out.

It is the rehires who are afraid to be in the field. Who do everything they can to get a desk job anywhere. Who brag how they don't do anything all day and still get paid, those are the rehires I have a problem with. I have a problem with Schultz letting them get away with it.

Yep it sounds like I have a lot of problems, but the rehires who are back doing real police work, they are the hero's. God Bless all of them, we all can learn from them.

To the above poster, WE ARE THE APOA. If we can't hold ourselves to a higher standard why make the APOA or chief do it? This is a personal responsibility issue. If as a rehire you can look yourself in the mirror and know you are hiding behind a desk and afraid to work FSB, I just don't know what to tell you. I expect more from myself. I would think you would too.

So don't put all the blame on the APOA and Schultz, at some point in time you have to ask yourself if you are proud of who you are. Just because they give you the opportuninty to get police pay without doing real police work doesn't mean you have to take it.

I am proud of who I am and I do real police work like I said I am in the FSB taking calls, you need to take a little more time when you read the blogs so you will understand what is being said. You need to address your Chief as Chief Schultz or just Chief don't be disrespectfull unless again you are his friend and that's why you are defending the APOA and the Chief. Just for your information it is real police work no matter where you work desk or FSB that is why the positions are filled! I am just saying if the rehire program was intended to assist FSB then that is where we (REHIRES) should be working.

Have any of you worked with a rehire? I currently do. Let me tell you she is not only bossy but a know it all too! I am sorry but I think they need to go. Why let them earn double pay? We need young officers not old one who are afraid that they are going to break a limb. New officers are go getters not lets sit here and do nothing! The rehires are old and frail. I feel with the young ones coming aboard they are more agile, able to keep up and more savy on crimes and how to handle situations better. The "ole timers" are set in there ways. Always a know it all. Give me a break!

If you were there you probably would be in IA 99% of your time because you don't know how to communicate. I do think a little education would help you and a lot more training. GET A LIFE!!!! In reading all the BS the obvious so called young officers are typing, makes me glad I retired and never went back to apd. I was in a restaurant last week and was sitting near to a group of on duty apd young officers. Their conversation was loud and troubling. They were bragging and compairing stories regarding how many tickets they had written fellow officers. They then talked about how backwards the people in this town are and made jokes about the hispanic culture. These were obviously officers who never grew up here. They continued talking and laughing talking about how there are way too many mexicans in apd, sometines refering to them as "wet backs". These are your fellow officers good luck, with your racist brothers. I am glad I was with apd when we stood up for each other and the only bad guys were the crooks.

You should go to IA and complain about their racist comments this in no way should be tolerated. They are not officers they are punks and need to leave the force. This is what happens when the standars are lowered and the city is desperate they will hire just about anyone. I keep hearing that recruiting goes to UNM and tells the students they no longer need to graduate from college, they will get hired. This is bad because if these students really wnated to be officers they would of choosen the path and not gone after the hiring bonus $7000 to sign on, sounds good to anyone.

Your pension is not run by the FOP or APOA, it is run by PERA and the governor and legislature. See that is exactly what I meant, you think it all revolves around retired cops and you don't even have a clue who actually runs your pension.

How about you go to the PERA meetings? Join Retired Public Employees of New Mexico? Sit in on some of the legislative hearings regarding your pension. The FOP and APOA don't have anything to do with these issues. Did you go to the PERA meeting this weekend here in Albuquerque? I did, along with about 100 others. That is where you get the correct information.

(By the way, PERA was down to $7,5 billion on March 9, 2009, but in the last 45 days we have made one billion and now the fund is up to $8,5 billion. We still lost some money, but at least it looks like it is slowing coming back) Of course you wouldn't know this because you weren't at the PERA meeting. Such a foolish person to trust the words of others instead of trusting themselves.

Like I said, the sun doesn't rise and fall on retired rehire cops.

And all the slamming on younger officers. Just who the hell do you idiots think you are? Like the retired rehires are such a great group? Most rehires are retired supervisors including the Chief. I bet you would be the disrespectful peices of s*** that do not respect his/her supervisor, doesn't follow orders, and you think you know more than they do. Wow, I am a chairman of a local church group of citizens who actually support APD. We have always supported the police officers of APD both young and old officers. we are saddened to read the posts from the new officers in this website. You say you are tired of the "old-timers" as you so sarcastically put it. Well let me tell you younger guys, yes you might have more of a college education, but you dont have the education these old-timer do. they protected this city before you were probably born or when you were young teenagers causing trouble as teenagers do. I have recently had coffee with one of these "newer" officers, who APD recruited from another state. This Officer spoke kindly about where he had been raised, and took this job because there was no work for him back home. He said this was the case with all of his current friends now with APD. He was angry because he said the Mexicans back home were taking all of the jobs, and he was angry with them. I told him it was ironic to have taken a police job here with a heavy hispanic popluation. he smiled and told me "but now he can get payback". That disappointed me because I remember the "old-timers" were not that way they were cops because the loved the job, the city and the people they served. The substations and training academy are named after "old-timers". It appears college education has not done you new guys any good. I feel safer with one of the rehires then with a new officer.

You know nothing about PERA. You go to one meeting and you are now an expert LOL you are a disgrace to the APD and about the name calling it is only for you asses on this blog not the other 98% of good officers. I wonder who recruited you and then went to the chiefs selection begging to hire you. But then again for several years recruiting has said they are scraping the bottom of a barrel to get people into the academy.
I guess their investigation did not go beyond the telephone, they should of checked your entire neighborhood and not just the friends you thought would talk good of you, because then again they are just like you. Just leave don't let the door hit you in the ass we wouldn't want any of the city's property damaged. You are probably a piece of shit officer that just sits on their ass doing nothing all day but type on this blog go home! go home! go home! take you kiddy nap and suck on you thumb.
If you had any common sence I would type a lot more but we are dealing with the ones at the bottom of the barrel. You just wanted a job so put up and shut up. This is a career for most officers and nothing but complaints from punks like you thank god there are not many of you on the force.

Rehires don't work at Walmart they come back as a rehire for APD or they work for DOE or Sandia Labs or Sandia Police or Bosque Farms Police or VCSO or BCSO or APS or LLPS or the DA'S offices or the Banks, there is so muc LE work out there for us. So the job at Walmart, it is yours, you rookie. LOL, Oh by the way you only have to pass one drug test so your ok good luck. LOL

Well the APD rehires should start getting nervous. Schultz announced last week he will hire no more rehires. All new hiring will be new officers. That is the first step. Next thing he will do is announce at the next bid that all rehired inside positions will be deleted and if a rehire wants to stay working that rehire will be assigned swing or grave with bad days off. That will remove almost all of the rehires because the majority will refuse to work the field.

The legislature just might kill the whole thing come the special session. If I were a rehire I would be finding other work. The writing is on the wall, their days with APD are numbered.

By the way I agree that there is a lot of law enforcement work out there, that is why retired officers should go to somewhere new and not their old agency. Good point old timer.

The inside rehires will be the ones who will be impacted as their positions will be gone (the chief is allowed to do this by contract). I don't think the FSB guys have anything to worry about except heart disease from to much free food haaa.
