Barking Up the Wrong...

Threats, guns, the law, even incarceration don't intimidate determined criminals. However, a police dog and his handler strike fear into the most hardened criminal.

APD has a well-trained K-9 unit. It's police dogs and the officers that handle them work on a daily basis to clear buildings and capture suspects. Police dogs are dedicated, unstoppable, and generally non-lethal. More importantly, police dogs keep officers from having to go into dangerous situations to apprehend dangerous criminals. In short, police dogs save police officers' lives.

Unfortunately, whenever force is employed there is the potential for collateral damage. If an officer must fire his weapon to protect his life and the lives of civilians there's the potential that some innocent bystander will be injured or even killed. When a police dog is used to find and apprehend a suspect, there's a possibility that the suspect, a bystander, or even another officer will be hurt.

The case of Officer George Gabaldon is one such example. Officer Gabaldon was injured by an APD police dog while apprehending a suspect.
In November 2006, Albuquerque police officer George Gabaldon and a fellow officer pulled over a truck on Candelaria that had careered around a corner in the wrong lane, nearly hitting Gabaldon's police cruiser head-on.

The truck was riding on its rims, and it turned out to be stolen.

Although Gabaldon called for backup to make the arrest of the two men he had seen inside the truck, he told a judge Wednesday that he didn't expect an APD canine unit to show up.

And Gabaldon certainly didn't expect that he would be the one that "Doc" sank his teeth into, sending him to the hospital with a severe bite wound and keeping him off the job for weeks.
It's important to understand that Officer Gabaldon was injured in the line of duty. The City of Albuquerque has an obligation to make him whole. However, Gabaldon is suing the city not just for his injuries but for an order that requires the city to muzzle its police dogs.

Muzzling police dogs will not only endanger the dogs by removing their only defense, but will endanger officers who will have to engage criminals without effective backup from their K-9 partners.

Ultimately, were all in greater danger if police dogs and police officers are muzzled. Officer Gabaldon deserves compensation. However, by attempting to muzzle his K-9 counterparts he's endangering his fellow officers, himself, and the citizens that he's sworn to protect. In other words he's barking up the wrong... tree.

I personally know George and I respect him; however, I feel he is dead wrong in this case. The K-9 is a tool that the police have just as a gun is. So what are you saying that if an accident occurs and you have a blue on blue shooting that we should limit our firearms. Yes there have been blue on blue shootings where an officer was killed and that is unfortunate but they did not take guns away because these are the necessary tools that we have. This is the same essentially the same premise. The work of a police officer is dangerous and he knew that we he took this job. K-9's are essential to the safety of our officers, this is a ridiculous lawsuit. He was injured and the city does need to make him whole. However, I really do not understand how this ever got this far, except George wanted compensation for his injuries.

My question is this, did the police department discipline the K9 officer? He admitted to issuing the dog and incorrect order and it was his dog who bit Gabaldon. The dog is the K9 officers responsibility, just like if he shot his gun. If the police department did not discipline the K9 officer, then look for changes mandated by the court. This is because it would appear APD will not critique themselves. If the police department disciplined the K9 officer then I think this lawsuit is dead on arrival.

But who cares I what think anyway?

As co-counsel for Officer Gabaldon, our request to muzzle dogs is only for situations when dogs are used to search for persons or things when there is no imminent threat of harm by actively resisting suspects. A muzzle does not prevent successful searches, but protects the officers. When there is no such imminent threat by actively resisting suspects, an unmuzzled dog actually deteriorates officer safety. And it did in this case. K-9 was unleashed to run through a scene and bit a fellow officer, after both suspects were in custody, to search and empty truck with a bite order. The handler then ran out in front of the line of fire from weapons drawn on the empty truck. The officers conducting the felony stop were distracted. They eventually cleared the truck without the K-9. A muzzle for searches when there is no active imminent threat by anyone, increases officer safety. An unmuzzled dog with orders to bite is not needed by well trained law enforcement doing their regular jobs. That is the tree we are barking up: increasing officer safety. The K-9 officer was not disciplined.

Only situations where there is no imminent threat. That is crazy !!!! Building searches??? You do not know what is in there so you would rather send in an officer than a dog? I would like to see you go in before the dog. Would you feel safer? I think not!!!! I don't have an issue with George suing the city but I do have an issue with personally naming the K-9 officer in the suit. Was he truly negligent, he made a mistake but reckless negligence, seriously? So what is next when our tasers, batons and finally our guns. This my friend is the slippery slope that we do not need. So I don't have an issue with the lawsuit for compensatory, pain and suffering. In fact, attorneys like yourself need to get paid right? However, to ask the courts to change a police and muzzle our dogs is ridiculous. So for that I pray you they courts have common sense and the city prevails!!!!!

In terms of policy and use of force, obviously the police are not supposed to send a dangerous weapon into a search op with orders to bite. to clear an area does not require the use of force, obviously there should be a policy against that. of course a dog with a muzzle and search a truck or building. it would be a step toward law enforcement being consistent with the constitution.

I had one of the officers in my squad bitten by a police dog. It is an injury he carries to this day as the damage was permenant. Gabaldon is doing nothing wrong. The dogs are a good tool, but just like your firearm you have to be in control. So many times the K9 guys just don't control their dogs.

If you are going to muzzle the dogs you need to eliminate their use. What a disadvantage to the poor dog. Citizens for the ethical treatment of animals I'm sure would defend the dogs rights. As for the cop who was bit - give him what he deserves, because that's what is fair. He did sustain an injury that is most likely permanent. On the other hand, the dog handler (cop) was negligent and should be punished. NOT THE DOG! Who you really need to muzzle is that idiot Darren White and the other idiot Ray Schultz. I would go for that. Their bite is far worse than any dog. As for the cop above who says George should point a gun at himself. You are the cops that worry the citizens of Albuquerque. You sound like you are right on the line of being a criminal yourself. Go away!!!

Cops who receive permanant injuries get compensated. George wants to nullify the Workmans Comp law to his own benefit. As I said earlier he needs to check out the functioning of his barrel riflings. I am an APD cop hater; it is a lowlife thug force composed of criminal cops. I have had three run ins with these lowlifes during my three and half years of living in ABQ yet I have never been arrested and each time it was the APD who initiated contact. Utter scum but that's what you get with low hiring standards. I would never call these guys for assistance nor will I ever assist them in any form or fashion. I blame Chief Schultz who protects his lowlife cops and refuses to take action to raise hiring standards. I surmise the low hiring standards are the result of racist groups like La Raza that push for increased Hispanic presence in a city where only half graduate from high school. Of course La Raza refuses to blame the Hispanic culture that breeds this, instead focusing on teachers as the cause. Study the education accomplishments of Koreans, the Japanese and Chinese and why they excel; in a word: expectations. I do wish to go away and take my above average income along with it. I am a New Mexican who returned home after living many years in other states and countries but after experiencing the lowlife police force of ABQ I'm now pressuring my wife to move in a few years to another state. I'm one of those taxpayers who pays more in taxes than is received so my exit is a net loss for the city and state. I had put faith in Mayor Berry to get rid of Schultz but instead he created an ole boys network by bring Darren White over. APD suffers from poor leadership, poor hiring standards and even poorer oversight. Crime is rife in this city - Why - and its gotten worse. The APD is not part of the solution so they must be part of the problem. And George is an example of this cry baby force of whimps.

The article states "Officer Gabaldon called for backup" and "the last thing he expected was to have the K-9 Unit show up". Why was that the last thing he would have expected? Wasn't Officer Gabaldon trying to apprehend a suspect? So, he should collect workers comp. but let's not make this a blue vs. blue issue. Why should the lawsuit insist that the k-9s be muzzled? Why can't he sue for his lost wages and just go on his merry way and leave naming the officer and muzzling the K-9s out???

As a 34 I agree that George should get some cash. We all know that APD does not take care of their own. Not sure how much he is asking for but I hope he gets every dime!! HOWEVER... George.. what the F is up with you? You know that those dogs protect our lives. Are you willing to endanger countless other lives of fellow officers just to get some cash?

If they win that suit I suggest that George be put on call and he can go into the situations and "search for persons or things when there is no imminent threat of harm by actively resisting suspects." George is willing to endanger all of our lives... so let him be the one to take over for the dog if he truly in his heart and conscious believes that those dogs don't do a great job and should NEVER BE MUZZLED

The easiest and most non-controversial thing that can be corrected is the city's response. If the "leaders" of APD and the city would have treated George like the good officer he is and shown a little compassion, that would have gone a long way. The "too bad, so sad" routine is a BS way to treat any employee. Especially one who puts his life on the line. Getting supervisors at APD who are truly concerned about their officers' welfare would improve morale greatly. Luckily I won't hold my breath for that one.

PS to the guy whining about APD stopping you 3 times. You make me want to go through an academy again so I can stop you too!

I will say it again, George is a whimp, a spineless whimp who should rely on the system to provide for his injuries as it does for others injured on the job. George thinks he "special" that he is now one of Jerry's Kids, but the truth is George wants MONEY. This is all about MONEY and the rest is smoke and mirrors. George, please do the city taxpayers a favor, perform a functional check on the riflings of your service revolver. Make sure you keep an eye on the bullet to insure its spinning properly.

APD officers do not have the balls to take me on. I live in Willow Wood. I'm the guy who always greets any passing officer with my middle finger extended. I would never, ever call APD to my house as they would either plant evidence and/or steal from me in additional the normal lying in police reports which they do daily. My wife knows that should we ever call 911, to ask for State Police or Bernalillo county sheriff presence if protocol calls for an officer to be dispatched. Crime in ABQ is already high and we don't need APD thugs and criminals victimizing us like they do to the citizens of our city.

Get real! Muzzle an attack dog? Okay cop, hang up your service revolver before going on patrol.

I seriously doubt that George wishes to permantly muzzle K-9s, and is just hoping to bring attention to the fact that they need to re-look at their policies. Good luck to you George.

Got to love the APD, the lowlife force of America. Yeah, I sit on the sidelines but no, I never have nor will I ever call you pukes. That's a guarantee. Besides by the time you guys arrive there's nothing left but the pieces anyway. I can take care of myself. And no I have never been arrested but have had contact with the morons of the APD on three occassions. The good thing is I did learn a lot and the bad thing is I have complete and utter hate for the APD. Since living in ABQ I have assisted the APD (prior to start of problems with them) twice. Now I wouldn't call 911 if I saw one lying in the street screaming for help. I would watch though and of course give a one finger wave. Keep in mind, there are over 1000 APD thugs in the city thus using simple probability, the odds are far greater that you guys need my assistance far more than I do yours. My home is safe and secure because I'm proactive in keeping it that way not because of the APD.

Hey APD, explain to readers about the $500 and up payments that are brokered through certain lawyers to arresting officers NOT to SHOW for court. Like I said, APD is a corrupt, thug force many of which have criminal backgrounds.

I read this blog for the humor and I must say it is actually pretty funny. There is this disgruntled citizen who is uneducated and illiterate that can only vent his frustration over a few police officers behind the secrecy of his computer. It would expect us to believe that the entire Albuquerque Police Department is corrupt. While I undoubtedly say there are a few bad apples the good far outnumber the bad. Then you have disgruntled officers slandering other officers. This is pretty ridiculous, especially at a time when the new mayor has a union busting agenda. So to the “Willow Wood” resident I say get to know the police officers in your area and you will have a new found respect for them and vice versa. For the police officers quit slandering each other, this is a time when you need each other more than ever. If there are bad cops there are ways of dealing with them such as Internal Affairs or the Independent Review Officer. These are put into place to deal with these situations so I say to you “Either put up or Shut up”. People are always their worst enemy.

Ever been to Willow Wood - it's a neighborhood of homes in the $220K to $350K price range. Not the place you find the uneducated and illiterate. Most residents work at Sandia and include many engineers and scientists.

You make yourself look silly by attacking me as "uneducated and illiterate and hiding behind my computer" all the while using "anonymous" to spout your insults. I'm very vocal with my insults of the APD, learned first hand from the "fine" officers of the Foothills Division. My bias is reinforced by the daily reading of the Albuquerque Journal, the "EYE" and others who also report on APD corruption, abuse of power and wrongdoings. If your not a regular reader of the "EYE" I suggest you scan through 2009 where you will find plenty of APD related reports. ABQ has a crime problem and the APD is not part of the solution - they are the problem along with the city leadership that enables them. You may note that I have pointed out that APD hires felons and has officers who are paid (by criminals) not to show up for court. Notice that no one denied this because its true.

My solution will be to move away from here taking my above average income and tax dollars with me. But until then I will continue to vocally criticize the APD and city leadership. Willow Wood

Got to love the APD, the worst police force in America. Expressing an opinion is "American" and I see the APD can't handle criticism. APD does hire felons, that is a fact and was even brought to light last year because of pressure by Mayor Marty for the APD to hire the thugs. They also accept bribes brokered through certain ABQ lawyers, to ensure arresting officer won't show up for court thus causing any charges to be thrown out. Talk to anyone who has spent some time at MDC.

You know I would join the APD but I graduated from high school and have a clean background thus I'm unqualified.

My suggestion to the APD is they shut their mouths and do their jobs. They are paid decently and they get to retire after only 20 years of work. Yet they whine over a dog, about getting lunch, about being criticized by the public they are paid to serve. Sounds to me like many need to find some other work that's more satisfying but then I understand, the other places have higher hiring standards so you're stuck. I suggest a few years in the Army to make you appreciate how good you got it but then their hiring standards too are higher than APDs so maybe your stuck, huh. Soldiers endure much tougher circumstances: they endure long separations from family, they don't get paid for overtime, they often eat meals out of a bag and go without, they don't get a personal car to drive around in and of course there can be "hazards".

Please APD do the citizens a favor, enforce the law, do your job and by all means come to south Juan Tabo where traffic enforcement is always welcome unless your a resident of Volterra.

I also know that certain officers are paid to skip court and the biggest payor is attorney Tom Clear, he has a group of buddies onthe DWI Unit that he pays off and the one that was notorious for taking the payments when he was on DWI was AC Rodriguez. Clear pays for Vegas trips for these guys and who knows what else. There are more good cops than bad and the bad need to go!

I didn't realize we were making comparisons about our homes but ... Yeah, they (APD) live better because they are on the take. I never said I was intelligent and no I didn't use my name but then I note neither did you. At least I use a tag so idiots like you can easily address your messages whereas you leave nothing but messages filled with jealousy and anger.

I know the name of another attorney so the count is at least two on the number of attorneys who are brokering bribes for officers not to show up.

Why I don't like the APD: Ample negative news reports, a network of long time ABQ residents who have biased my view of them and then personal experience. I will reiterate - I have a clean background - no arrests. But I was cited once by a dumb APD cop who issued me a citation for cussing him out. The citation - a criminal misdemeanor by the way never made it to court because the DA refused to proceed because the issuing officer had no basis since no infraction had taken place. Harassment then started after it was thrown out resulting in two more contacts with APD thugs and two other side incidents related to leaving notes on my car. In all cases the APD came to me. APD blue wall was used to harass a law abiding citizen thus turning him to the dark side. This in a city that rates number 74 in the country for crime - far worse than our neighbor city to the south (El Paso). Thank you APD.

You say 40%, but from what I hear that's the percent who are openly gay. Not that there's anything wrong with that.

I too have spent my time as a soldier. Jealous of what? Not being part of a thug force who enjoy intimidating citizens. No thanks, I would rather shoot APD cops than harass the innocent.

To the APD - do your jobs and do them honestly. Quit taking bribes and quit harassing those who obey the law, then maybe you will garner some respect. Break the blue code of silence and rid your force of the thugs, criminals and other bad apples. Until I see a turn around I will only show disdain for those who wear the APD uniform which is a lose-lose for all residents of the city.

They do not complain, bitch or whine, but rather do their jobs so uninformed people like yourself can sit back in your 200-300 thousand dollar house and armchair quarterback the moves of every organization that you have never been a part of. They, along with all of the APD would just like a bit of thanks from you and your wife. You take for granted the life you have, the relative calm of willow wood, try being the one who runs into the building where shots are being fired while everyone else is running out, try watching a crime scene where two of your fellow officers were gunned down, we do not do this job for the money, we do it because we are willing to lay our lives down if necessary for the safety and protection of this city and our families. We do this job because pussies like you will not or cannot do what we do. Step up to the plate and go on a ride along for a week, perhaps during the holidays and see firsthand the missed birthdays, holidays, divorces and all the other items that go along with being a beat cop. For such a paradise, I'm surprised APD needs to visit so often. It goes to show that money or education doesn't mean you ain't still dumb as a post. I'd rather have a bucket full o' fresh turds than neighbors like you, Carl Kettle. Yes, I'm anonymous. No, you can't do anything about it. Got to love the APD - they do their jobs because they feel the need to "lay down their lives" to keep us safe. What a crock. There might be a few nut cases that believe that but the vast majority are there for the pay check and twenty year retirement. Every job has hazards, that's why cops get to retire after only 20 years.

Soldiers are not deployed for my freedom. We could bring them all home now and there would be no threats to my freedoms. Our "threat" is nothing more than some muslim lunatics who can do little more than conduct small ops on an infrequent basis. By the way, I did my time in uniform and am well aware of the threats and hazards. I have been a war zone (Iraq) too - whoopie. The police are a greater threat and are frequent violators of Constitutional freedoms. And for the cop who talked about the pitfalls of the job: missed holidays, divorce, etc. Try being a soldier then you will never complain about those little things again.

By the way - none of my contacts with the APD thugs occured in Willow Wood. Its rare to ever see one here except for a couple who are residents. I can recall only flipping off cops in Willow Wood on four occasions and that's over the course of a few years.

So the APD never complains, only the guy in Willow Wood. Really! On this thread alone I saw cops dissing cops. I guess your union is a waste of time since they are generally focused on resolving complaints and protecting the wrongdoings of cops. The only way to fix things is to identify the problem and air them otherwise the assumption is, all is well.

To Burp - the lawyer I know was brokering "APD no show" payments several years ago. I'm reluctant to post his name due to potential liability issues that could result. Same goes for the APD thugs - I know their names in most cases yet I don't call them out specifically.

APD: You are of no use to me and I could care less if you take a bullet. As I have previously stated, one thing you can count on is my never dialing 911 and asking for a cop. Fire or ambulance yes, cop NO. Nor would I ever allow you in my home. I would rather not report (theft/burglary) than call you guys. And I sleep soundly at night because I have taken precautions to discourage lawbreakers and should one ignore those then I can take care of the issue myself. APD is not needed nor wanted. You are uninformed and unintelligent. State law does not allow felons to be certified as peace officers. So yes my friend, I will still refer to you as a friend and will be there when you need help, get your facts straight before you post false claims. In addition, a misdemeanor charge would be an officer prosecution case that does not involve the assistace of a District Attorney, unless it is a domestic violence or a DWI. So again you are a liar and lay false claims. Just to refresh your memory, you said that the DA refused to prosecute you for your criminal misdemeanor. NOT!!!!!! But again this is comedy!!!! So yes your are an uninformed idiot!!!! Move away please, I will even buy you a one way ticket to China. You did say something about China in an early post right. I would like too see you do a one finger wave at Chinese police or Japanese police. I would have to say you probably would not have it anymore.

For a cop you are ignorant. APD was involved in a scandal some time ago where an officer they hired had a felony conviction. You're right a felony conviction is supposed to disqualify a candidate but then how many felony charges are dropped to misdemeanors during the plea process and how many of those individuals have ended up in the ranks of the APD. I'm sure there are many. Cops should have squeeky clean backgrounds with no misdemeanor convictions period. These guys have power which is easily abused.


You are way off about the DA's involvement. After receiving the citation I received a criminal summons in the mail to appear before the court. Knowing that all info concerning a case is available online I followed my case there. The case notes showed clearly that the DA refused to prosecute and noted officer error. The case was dismissed. Having cussed out the dumbass cop for not knowing the law I would think prosecuting me would be a priority. Unless of course no law had been violated which was the case. Harassment followed which was done by APD's finest.

And it is fact that APD officers are being paid not to show up for court. This I know first hand.

You make it sound as if APD officers are saints. Like I said earlier, browse the EYE for 2009 and look at all the scandals. And these are just the ones that got out - I'm sure far more remained quiet.

China? Don't recall ever mentioning that nor Japan. I have lived in Asia though. The finger would have no impact as they use a different gesture. But in AMERICA where we are talking about waving the finger (at cops) is LEGAL although there are situations where its not. Cops have to take it according to case law. According to today's Albuquerque Journal, APD Officer George Gabaldon cannot seek damages for his injuries. It found that George was bound by the limits of the Workers Compensation Act (as it should be). When George was injured his medical costs were paid by the city and he received seven weeks of paid medical leave (as he should). But no, George wanted more. Of course I'm sure an appeal is in progress.

There is little doubt the APD has a leadership problem. Not only are there indications of this in the comments for this post but far more so in the November 2009 post link above. Schultz should have been removed but for whatever reason Berry elected to keep him. Mr Mayor, APD needs a new chief.

The saddest part of this is the only time you cops support each other is when one dies in the line of duty and I believe it's only because you want to ride in the procession and pretend to the public you are united. What a crock! Poor George - now he can't sue and YOU his brothers in blue are happy about it. You all wanted Sam to lose too, but he got the last laugh. You cops are pathetic and if I were George I would appeal and hopefully the higher court will see there was negligence on the part of the city since the dog handler was there employee. This wasn't a normal Worker's Comp issue ! Don't worry one of you will have something bad happen and none of you so called brothers will be there for you either!!!!

I too have heard - straight from the big house on the west mesa that attorney Tom Clear has many "contacts" within the APD, especially on the DUI unit. Why does APD tolerate "bad" cops? Does the "blue wall" protect these potential killers (allowing drunks to walk and not be punished sets up potential for a tragedy)? Any corruption or improper actions taint the force. APD you are tainted and the citizens of Albuquerque need to know it. Of course many of us already know it.

George was/is kind of reckless; known to run into situations. Not that this was the case here, but I have questions about the whole incident.
