Schultz Swears Allegiance to the Veil of Silence; AKA: the SWAT-stika


Deviation: The action of departing from an established course or accepted standard.

Consistency in practice, application, and procedure is a necessary element of any police department. Appearing and actually being impartial is crucial for the regular operations of law enforcement. The stakes are high in this matter because of the very nature of what is at issue: Civil Liberty. If there’s even a scent of prejudice or bias, an entire investigation is in jeopardy and the officers, and thus the department, are burdened with civil liability. This all seems like legalese that really has little to do with anything, but consider what this all really means. The time officers spend responding to a call, the safety of any victims, the costs of litigation, time officers have to spend in court and related proceedings, time taken away from regular assigned duties, and interference with home/family schedules. In short, deviations from standards and practices result in huge wastes of manpower and resources. Policing doesn’t happen magically, it requires first and foremost the labor of officers and detectives. If the results of their efforts are routinely cast aside because of failures to follow SOPs and protocols, have they not by definition failed (committed misfeasance) in their duties?

Recently a call came into 911 where a citizen reported a person was kicking over trashcans and throwing rocks at passing cars. When confronted by the caller, the subject flashed a gun at them. Maybe the subject pointed a gun at the caller, maybe he didn’t, but as officers responded to the location where the incident occurred, any reasonable person could suspect that some type of crime(s) had occurred and the offender was armed with a handgun. As it turns out, when officers arrived the subject fled into a house. As officers secured their presence around the house, the subject fired bullets at an officer who understandably, and reasonably, returned fire at the subject. The officer missed hitting the subject but struck the house. Unless the suspect was firing from within a school bus full of children, most would accept the officer’s actions as reasonable and consistent with standards and training. Considering the chain of events, the call immediately became a SWAT call-out. With an armed barricaded offender who had just committed an aggravated battery (possible an attempted murder), upon a peace officer; the offender defiantly hiding in a house, APD’s SOP clearly dictates a response by the SWAT unit. From what officers have told the Eye, Chief Schultz immediately made calls to the incident commander whereby orders were given disallowing (revoking) the use of deadly force under any circumstances and stated, the call-out will last as long as is needed. Operations then commenced over the next fifteen-plus hours where a seemingly endless amount of CS gas was fired into the house. Officers told us even as the suspect fired more rounds at officers and at the bomb squad’s robot (resulting in its destruction) officers, including department snipers, remained unresponsive because of Chief Schultz’s orders. One has to wonder where the subject’s bullets went and at what risk did he expose the community to when he continued to fire bullets into the neighborhood? Was a trained APD sniper in a position to stop the threat but denied the ability to do so because of Chief Schultz’s media grand standing orders? What if an officer or citizen had been hit and injured or killed by the subjects’ actions?

Almost a day after the event started, APD reported the subject took his own life by shooting himself. APD officers then went into the house to confirm the subject was dead after pumping more gas into the building and not detecting any more movement. It’s interesting to note that CS gas displaces the regular atmosphere in a contained structure like a house. It is likely that while Chief Schultz stated no deadly force be used to resolve the situation, displacing the oxygen from the house would surely have resulted in the subject’s death had he not taken his own life. Will the family of the deceased now file a civil lawsuit for wrongful death with mitigating circumstances of cruel and unusual punishment? After the incident SWAT cleared the house by virtually destroying it and the scene was then processed by APD’s FI personnel.

In one of the more extreme and sensational SWAT call outs in many months, APD officers were required to deviate from standard practices and training at the direction of Chief Schultz. Because the department is still under the rainfall of constant public and federal scrutiny, officers are now being placed in positions where their lives and the public’s lives are in jeopardy because of a miserable failed police chief’s willingness to do anything to remain in power. Ironically, it is these very actions that have enraged the community and brought the department’s credibility into question. Instead of relying on standards and accepted practices, Chief Schultz, Mayor Berry, and the rest of the self-anointed leaders (few have gained the rank of commander and above by virtue of merit) routinely deviate from normal operations. One has to wonder if Chief Schultz will require officers to deviate from the “norms” and expected responding personnel to be shot at. What isn’t he willing to deviate from to obscure the truth??? The local media raised alarming questions when the press released details of the event and knowingly and willingly omitted the fact there was an officer involved shooting as part of the call out. An officer’s (and the public’s) life is threatened by an armed offender firing bullets at him (and the public in general) and Chief Schultz deems it not newsworthy that this element be disclosed? Yet on the same day, APD’s public information officer released a feel good story entitled (misspelling by her): “APD takes in US Poilce and Fire Rowing Championships.”

If APD’s Chief Schultz is willing to omit information about life threatening violent actions against his own officers, will issue orders denying officers the ability to defend themselves (and the public) when shot at, and will hamstring operations of a critical SWAT incident all in the name of keeping another shooting from appearing in the news…..what is he willing to hide and conceal when matters are less visible??? What has he already destroyed and hidden from you (Mr. and Miss Tax Payer)?

I'm going to make a comparison to two police departments here. The more I read about the bad "political" decisions made by Albuquerque's police chief, mayor, CAO, city council, I am immediatley reminded of the Boulder Police department, and the city of Boulder. I thought Boulder was the only place where bumbling idiots ran the city and police department. Boulder has met it's match in Albuquerque.

Outstanding article. The Eye should be nominated for the Pulitzer Prize for outstanding journalism. It seems that the Eye is the only place in Albuquerque that tells it like it is about the corrupt administration of APD. People have known for a long time that the cheif has spun things in order to keep his status quo for so long. NOW the lies have spun out of control and have enveloped an entire city in HIS mess. From this omission to the lies that were exposed in the Sunday paper last week that are coming out about those officers that were framed. This chief has played games with the media and news, spreading disinformation when it helps his cause, omitting any information that hurts his cause, and downright lying in desperation when his cause is in it's final stages of self destruction.

We have seen this self proclaimed ring master over justify police justified police shootings, clam up on the bad ones, withhold information that was crucial, and that under any normal circumstances would have been released with earnest in order to opportunistically sacrifice officers for the sake of getting himself out from under a Federal probe. He has disappeared when things have become sticky to the point that it is beyond obvious that he was hiding and insulating himself from the media. (A new federal building opens up, and he sends his two liars to represent the departmenti instead of showing up himself) Was it a coincidence that this guy submarined in light of the recent investigations and arrest involving the former APOA president? A true leader steps up and owns everything under his watch. NOT THIS GUY. He sends in his deputies when things are too hot for him. Just recently his main go to deputy put his foot in his mouth again when he denied something that a former officer had audio tape of, then they retaliate against another officer when they get mud on their face over it in Federal court. Providing false information to federal investigators is as bad as lying and I am sure the FBI has their tune down by now. It is time for a federal probe into this administration, and the acts behind the scene, namely the advisment coming from the city attorney's office in how to conduct this type of business and get away with it. The city attorney's office has been present behind the scenes (so they think) of too many scandals the last couple years, from the untimely death of Mary Han and the lack of dignity provided to her at her home that day, to Police and IA investigations to operations being carried out by APD in the streets.
One would ask, when you are governed by a set of rules and standard operating proceedures, why would you have to consult an attorney with every move you make? UNLESS you know that you are doing SOMETHING wrong. Officers make decisions on the street every day that could cost them their lives WITHOUT this luxury. Why can't the chief and his deputies make the decisions that they think they are qualified to make without the hand holding afforded to them by the city attorney? After all they are superior aren't they? It's pathetic when a group of self serving liars in a position of leadership use their officers and put them in positions without support, they themselves would NEVER accept as an officer. That is because these individuals never were officers in the true sense of the classification. They wore uniforms but if you ask their peers in their cohorts, you would recieve a description of individuals who were lazy and negligent of their duties (playing video games and sleeping at home while on graves, time sheet falsifications, lack of initiative) while in the field, however short that was. God bless the true officers out there every day fighting the fight, with only their brother officer behind them. They need it! Keep your heads up! The side of right is behind each and every one of you! That's all that matters. Rectification will come.

After reading today's Journal I am calling my city councilor to demand an INDEPENDENT investigation into how Mary Han's death was handled. If even small parts of the Journal article are true a complete investigation by an outside agency is needed. That investigation should recommend discipline, if necessary, and should recommend if her death should be reopened and a new investigation done.

The chief selected PIO always puts out feel good info & ignores fact. Every time she speaks on TV she reminds me of the youtube video of "burque girl" that's who we have as the voice of our decrepit city?

The citywide email she put out wasn't even a little bit correct congratulating Commander Geir of the SW area command. Last I saw he RAN the SE command? Is she so far removed from reality that she doesn't even know who commands where? Oh wait of course she doesn't need to know that information she's scared to work the streets, and runs from her own shadow. Two years on and she is assigned to the chief. Fascinating!

Chief bring back a PIO like John Walsh who at least worked the streets and spoke English when he addressed the media or do it yourself chief. Then maybe the media will take us serious again. When you have a child as our Public Information Officer who barely speaks English, No ONE takes us serious. "basically, basically, ummmmmm well basically,,,,,,

Why do we even have 9 PIO's? Is it to confuse the media? Bring back Chief Stover or Hansen they told the media how it really was in the world by showing the public dead criminal bodies and the weapons used daily against us.

The media is now running APD and i'm afraid its only going to get worse out there. I feel sorry for those of you working the streets, I really do. I hope you all use your cameras constantly that way the administration has videos to feed the medias lust.

No matter what order is given to you and by whom, remember your most important job is to go home safe at the end of your watch. NO ONE EVERY WANTS TO TAKE A LIFE ! SOMETIMES THAT BECOMES NECESSARY TO PROTRCT YOURSELF AND OUR CITIZENS.! Always be ready to do the unthinkable,because if you think about it at the time you already lost. You always try to use every option at hand to avoid taking a life. Sometimes there is no other option. Don't let anyone paint you as a bunch of killers. I know you and you are not ! Eye, you missed the fact that Kathy Levy was also at the scene with DC Warfield and was making the decisions as to how the SWAT team would handle the situation. They were told under no circumstances would they use deadly force against an individual who had already shot at a Swat officer but who continued to shoot at officer's throughout the night. Not only was he a danger to the community but also to all of the people who lived within a mile of that house. Schultz doesn't care about the safety of his officers, only that we dont post number 25 in the Journal's headlines. It is time for the union to file unsafe/hostile work environment suits against Schultz and his idiot commander and Lt in the tactical division before they get an officer killed and it may not be a SWAT officer. You are all in danger working under those conditions. Ray, you used to be a good Sergeant. You have your new retirement locked up. You have no respect or integrity among your troops. Why dont you stand up to Berry and the 100 loud mouths that show up at the council to complain about their poor baby getting killed. The vast majority of the public supports APD but they need to see support from you instead of groveling before the council and the 100 loudmouths. Regain a small amount of respect and tell the journal and the council and all of the good citizens of Albuquerque that you will not have your officers shot at or assaulted and maybe you can leave with your head up instead of slinking out the back door.

Interesting article today in the Abq journal...6,000 guns and 1,000 cops. Where are the details of the audit? From what the Journal is implying, maybe not all 6,000 guns have been accounted for in this recent audit. How about that Mary Han case? No dignity for someone's loss, how pathetic can you get APD? No common human courtesy for a fellow professional who past, no matter the circumstances? Remember APD, respect is earned not given. The city attorney is an idiot. If that is the way that swat call out went down, Levy should be fired. She should be fired anyway. Why is it that this administration is blatantly contradicting officer safety policies set forth in police training across the country in regards to deadly and non deadly force issues in some sort of desperate attempt to hide something? You can't tell an officer what level or kind of force can be used. It is obvious that the administration is terrified of a DOJ investigation because they know that the DOJ will open a Pandora's Box that will end the culture of corruption within APD and this city administration, then possibly put a few high ranking officials behind bars where they belong.
Things have been out of control for so long now they want to hide things, prevent officers from protecting themselves and scapegoat officers for doing their jobs to deflect attention away from themselves. All this at the cost of the tax payer. The citizens are suffering from these actions because these cretins don't want to be discovered by the DOJ. Officers lives were risked and residents behind flimsey wood and stucco walled homes could have been hit by stray rounds. They have just proven that they think their political and financial hides are worth more than human lives. They conceal the truth but everyone knows it. You folks really shit the bed now.

Ok look: ref Mary Han - I never had any dealings with her but it's no secret that she wasn't a fan of the police department. Having said that here are a couple of things to consider. 1 > to say that Ms. Han, or ANYONE, would 'never commit suicide because they were happy' is pretty silly. Certainly to outward appearances you may think that your friends and family are happy, but since you can't be in their minds, even for a moment, you just don't know what someone is thinking. I'd be willing to be that there isn't a single person reading this post that at some point didn't, just for a second, consider harming themselves. Think about it, and be honest - maybe we aren't really serious about it, but it's always a possibility. 2 > think back to the tragic death of an APD Lt when a shot gun went off accidentally, killing him. The OMI originally ruled that death a suicide as well, mostly because it really didn't fit into any other category. It was later changed to undetermined or some other silly title.

My point is this: outwardly Ms. Han may have appeared happy and content, but no one knows for sure what emotions she may have been feeling. And suicide or accidental death I'm confident that APD's investigation was thorough. I do, however, agree that all of those extra people should not have been there and those people need to answer for the lack of respect shown.

Ref 744, a thorough investigation was tossed aside as soon as the scene was contaminated. I hear family members pointed out that things in the house were rifled through and expensive jewelry missing. What makes you confident Apd did a thorough investigation when they made so many errors intentionally or otherwise? The cops did nothing more than what you'd expect cops to do in the early 1900s....nothing.

Regarding Parkins.....Reicherd was the OMI pathologist there. And despite eyewitnesses to that accidental shooting Reicherd still called it suicide. That guy has some major issues....accident, natural, homicide, suicide and undetermined are the five manners of death and each has to be proven in a solid investigative fashion. To just say something is just because it looks like it is lazy and unprofessional...

How about the wire tapping, breaking in houses (Al Walck), (shop owner/Ahrensfield case) contaminating a crime scene (Tera Chavez). Sure their finest, no - their most corrupt. There isn't a lot of integrity left at APD. I feel sorry for the cops who really have honor and became a cop to protect and serve. That's out the window. I would find another profession. They will eventually destroy themselves. I wish it would be sooner than later.

When investigators are instructed to do the wishes of a corrupt higher ranking chain of command that has no respect for the rights of anyone, and who have proven time and time again that they will do ANYTHING to suffice their appetite for vengeance, that investigator is worthless as far as being objective. APD has conducted investigations directed by the top goons that have predetermined outcomes. They have proven that they fit their investigations to what they want it to be, to benefit themselves, and hurt those they want to hurt. It is now catching up with them. The things they have done to hide the other things they have done or have failed to do is being exposed.

How bout being objective: Han's death was unattended and all unattended deaths are treated suspicious deaths especially when the agency responding is named as a defendant in dozens of lawsuits and therefore has serious conflicts of interest. Right from the get go its bad. Seal the scene, call in NMSP. Who was the field sergeant there that day?

Here is a fact. Officers are terrified to do their jobs. They know that anything that looks the slightest bit bad, even if it's
1oo% on the up and up, will be used to sacrifice them for the benefit of the ones trying to pull their own asses out of the fire. They have seen officers rights violated, and laws broken in reference to just this. Officers are all about self preservation at this point. They know they will be used, the union will not back them, and in fact may help facilitate it by their blatant lack of representation. Officers are being framed, and thrown under the bus for doing their jobs by people who violated their oath, never were cops, and are in trouble for being malfeasant and negligent of their duties. What we now have is again the citizens of the city of Albuquerque victimized. They have no aggressive proactive protection by the police, and they have to foot the bill for all the lawsuits against these malfeasant rights violators. The biggest slap in the face to the citizens of Albuquerque is that the head culprit gets to retire, move out of state, and leave everyone behind to hold his bag and mop up the mess he has made the last few years. Nothing but an insult and piss in the face of everyone here. I guess we are not good enough to live with as a civilian. You have to have power over everyone then leave with the money you made on everyone's back. Despicable!

The fact is, Schultz and Perry do what they want when they want without following their own SOPs or standards. I've got a degree in history. It all started out small. It always does. The criminal does what they can get away with. So nobody has been tortured. It doesn't mean that they don't wish they could do it. And torture is really relative when you think about it. I would hate to think what that guy would be doing if he was in 1942 Germany. It would probably pale in comparison to Hitler when correlating the actions of him and his pals to today's standards as compared to then, if you know what I mean. I am not going to bicker with you on this. The conduct of this man is outrageous in regards to labor practices, proceedure, criminal and civil law and I can't believe it has been tolerated in this day and age. It's a disgrace.

I would like to extend my condolences to the family of Mary Han. Her untimely passing was a tragedy. She was a great lawyer. Those that treated her negatively, or have bad things to say are only angry because they were outed and exposed, then lost their battles with her. They are sore sorry losers. I hope that everyone who violated proceedure and disrespected Mary and her family at such a hard time, are brought to light for their disrespectful unprofessional and illegal behavior, and be made to pay for it so that it ends. Their acts have truly shown they are without honor. For a true worthy opponent would never disrespect their adversary , no matter how many losses they suffered at their hands. There would be respect for that person, their abilities and accomplishments. This shows the lowly and hate filled mentality of those high ranking children within APD. They have never learned.

I can truly say I have never had anything bad to say about Mary until I saw her in District Court with Paul Kennedy. It was probably 2004-2005 I went to get an arrest warrant signed and sat in the back of the courtroom. The Honorable Judge Romero saw that I was sitting there and asked me what I needed, and I answered "arrest warrant." He asked for a recess and told me to step into his chambers. Mary Hahn threw a hissy fit and started slamming her files on the table and just glared at me. Go figure, a Judge who has respect for a detective to take a recess and a lawyer who acted like an infant. Thats my memory of Ms. Hahn. Sorry people, "The golden rule" treat others as you'd like to be treated. Obviously this in not what hahn did and every LEO remembers that.

Rob Perry, Darren White and TJ Wilham have never given an explanation why they felt it was necessary to go see Mary Han's body at the scene, which was her home. Paul Kenndy,the big shot trial attorney and defense attoney, has never explained what he meant by the term he used "apparent accidental suicide". He found Han's body so what evidence did he rely on to make such a statement?

Mary's spirit lives on, and you will see it in the lawyers coming after you all. You might think you can knock one down but ten more will be there as a replacement to carry on.

A technicality is a screwup. Don't screw up, and you won't lose your case. Now we have a sore loser that makes excuses, and blames others for their foul ups. Add that to the list of qualities coming out here and we have the problem with the administration of APD and this city.

Maybe you should reevaluate yourself, considering your outlook on payment for work done. Based on your outlook, YOU probably owe the city alot of money back for the cases YOU lost. Maybe YOU shouldn't have gotten paid for your court appearances when all you did was drag your lazy ass to court, and lose because you screwed your case up. In that case, you shouldn't have gotten paid for the time you spent on the failed arrest that led to the failed charges in court, that led to the lawsuit for civil rights violations, that cost the city millions. Now who's the drain on society? All you do is show up. A lawyer preps, gathers evidence, conducts interviews, files motions, conducts investigations and does paperwork that you probably don't even understand half of. Learn how to do the job right, and stand your cases up in court and you won't have to cry about a lawyer who handed you your ass.

You better put your seatbelt on because no matter how you cut it, your buddies are in for a boatload of legal problems and their hack of a fraud city attorney isn't put together enough to handle a fraction of what lies ahead. As a matter of fact she might want to consider resignation.

Technicalities like arresting a district court judge on a defective criminal complaint and sworn to by a cop that has been found to have NO CREDIBILITY IN COURT. APD has become one of the saddest police departments in the country because we can't police ourselves. Our union prez and vice prez resign in disgrace and are the target of numerous criminal investigations and the Feds are about to kick in the door of the chief's office because of his endorsement of endless civil rights violations. Seems to me Mary Han kept a lot of this shit in check and it's not too hard to identify persons who had MEANS MOTIVE and OPPORTUNITY to 27-1 her. Dumbest thing they could've done was to take her out, now we all go down.

Oh yes, also it was not a hit on a DNA, it was an affadavit to obtain DNA on warrant. Do you even know how to type a warrant or conduct an investigation?
