FAST AND FURIOUS: APD Style

“…and weird” is how retired APD Lieutenant Jay Gilhooly described the current state of affairs in an interview that opened up this week. If there was any confirmation of how weird things are with Mayor Berry’s police department and his police chief, Ray Schultz, one only has to look at Chief Schultz’s press conference yesterday as he released the now infamous SE Bike Cop videos. Whatever one’s take is on the officer’s actions in the video, we at the Eye are troubled by the threatening behavior and intimidating actions asserted by Chief Schultz in yesterday’s press conference. As Chief Schultz is in violation of the state’s Inspection of Public Records Act, Chief Schultz is the last person of any standing to reprimand the media for wanting to break a story before alerting law enforcement to possible criminal violations by officers. As he has an endless history of chronic abuse of his authority, information manipulation and deception, and a “leadership” style despotic in nature, Chief Schultz should keep the finger waiving to his own defects. Yet, Chief Schultz tries to deflect his by stating reporters had inside information and were trying to play a game of “gotch ya.” There are no requirements in IPRA which compel a justification for desired records. There are however requirements within APD’s SOPs that mandate APD personnel to investigation wrongdoing committed by personnel. Our Eyes tell us the officers involved in the video were subject to an IA investigation but the investigation was tied down, if not sat on, by none other than DCOP Banks.

Chief Schultz clearly needs a reminder that it is NOT the media’s job to do his job. If Chief Schultz was doing his job the media clearly would have little to report. And in the midst of this mess where is Mayor Berry? While APD once again makes negative national news, Mayor Berry is at the city zoo discussing an increase of tickets by over 30%. Apparently not satisfied with his destruction of the annual balloon fiesta, Berry seeks to destroy one of the few remaining city run attributes as well.

However, just when we thought things could not get any weirder with APD, they continue to do so. While Chief Schultz was falsely reprimanding the media for doing their job—holding him responsible for suppressing public records and violating state law—several of our eyes alerted us to a very troubling matter concerning firearm shed by APD. On any given week, guns are tagged into evidence by APD personnel. Not all of these guns are related to crimes but are often stored for “safekeeping” or “found.” As such, owners/responsible parties may retrieve the weapons from APD. However, APD is bound by federal and state regulations that require a background check to ensure compliance with laws before releasing the weapons to citizens. For instance, it would be unlawful for APD to transfer a gun to a person who is a convicted felon, has a diagnosed mental illness, is an unlawful user of controlled substances, is not an illegal alien, has not had a dishonorable discharge from the military, that precludes them from possessing a firearm.

Our Eyes alerted us to the pictured emails coming from none other than APD’s lawyer, Kathy Levy. In these emails Ms. Levy states that APD need only “…limit the check to the parameters of the Brady requirements.” Prior to then, APD had completed what is called a Triple I check which reviewed a citizen’s criminal history on a national scale and not just limited to local matters. Ms. Levy adds that “I had an opportunity to speak with the Chief and he, too, was unaware of the depth of the investigations we have been conducting…This new approach should free up a lot of resources.” Per the Brady statute, a transferor is required by law to ensure that the person seeking the gun does not fall into any of the above listed categories. However, our Eyes tell us Ms. Levy and Chief Schultz have ordered APD evidence to perform a local background check ONLY ensuring that the citizen simply has no outstanding warrants. Why would Ms. Levy want to be so quick to release guns to citizens we wondered? Our Eyes tell us that once again inventory in evidence is being mismanaged and they are running out of storage space for guns. And that Triple I checks cost money.

So in an effort to save space and reduce costs, Ms. Levy and Chief Schultz are allowing more firearms to be released without conducting a full investigation to see if a citizen satisfies the Brady law. As all officers know, a limited local check is extremely narrow and does not include a review of all of the criminal records which may exist on a given citizen. Only a Triple I does this. Once again, Chief Schultz and Ms. Levy either are ignorant of the very laws they are subject to OR they are intentionally trying to circumvent them. Given the recent active shooter tragedies around the country, we at the Eye demand that APD go back to full Triple I background investigations before any guns are released and transferred to citizens. This is an unsafe and an unethical practice that frankly, defies belief given recent events in Colorado and all the police shooting that APD has been involved in.

Chief Schultz stated he wanted to be briefed before the release of any story involving possible misconduct. Well, in the United States of American we are free to brief public officials in PUBLIC and in a manner supported by the Constitution. And that is exactly what we are doing here. And we know where Mayor Berry will be while this mess gets worse….

Now That hack lawyer Levy is a FFL dealer?!?!? On the back of every 4473 it is stated what the requirements are by law. Again these arrogant, uneducated blatantly defiant, malfeasants act like they care in the faces of the citizens of this city, yet they are giving guns out without a records check. Checking for active open warrants shows nothing about a criminal history. This is disgraceful. All agencies and businesses are bound by the Brady law. Face to face sales by private individuals is another matter. I don't think APD qualifies as a private entity. This atrocity has been going on, and Chief Schultz has the hypocratic guts to put out one of his youtube propaganda videos telling everyone how he is protecting them after that Colorado shooting? How is giving out guns protecting the public? How many faces does the chief and city attorney have? How many of these weapons have been used again in crimes? ATF needs to come in and audit the evidence room. Schultz will probably try to blame those under him AGAIN like a coward.
HOW MANY LAWS DOES IT TAKE FOR THEM TO BREAK? HOW MANY LIES DO THESE SCUM GET TO TELL BEFORE SOMEONE STEPS IN ON THEM?

Meanwhile the mayor works harder and harder on construction deals for his buddies. All this CLOWN cares about is CONSTRUCTION. The convention center, I 25, now the zoo. Can anyone see what is going one here?!?!? This idiot is only concerned about the gift that keeps on giving. When he's out of office he will be raking in the favors owed. This is his retirement....ON THE BACKS OF EVERYONE IN ALBUQUERQUE!!!!!!!!!!!!!

OK, the chief may leve in december, time for a replacement pick. Anyone coming from the current deputies or commanders would have been tainted by the chief, so they are a no go. Beth Pias retired to spend more time with the kiddies so why is she spending so much time with the mayor who has a hard time paying attention to business with her around, so I am told. Is she playing the Ray card by leaving and then coming back as the outsider? She has her baggage to. Where is Matt Dillon or Wyatt Earp when you need them?

Each time I read something about Kathy Levy, I cannot help but roll my eyes in disgust. Why is she allowed to continue making up rules for the police deptartment - yes that is what she is doing. Six years ago in my Personnel Board hearing, she told the board that APD did NOT have to abide by the City of Albuquerque's Personnal Rules and Regulations. Stunned, the board looked at her, looked at eachother and then called her out on her stupidity. Sadly, she still continues obviously to think that way. When will it end???

So let's talk about that elite APD academy in the 90's. Solis and Surran, Class of 99. Rice can be considered a newbie, I'll give you that. More importantly, all that work and it reaped no results. According to the Abq Journal, all charges against those tasered potheads were dropped. In fact, APD never even found dope on two of the suspects. So now the taxpayers will be on the dime for the payout for the civil rights violations, and in the end, lousy work product from APD. APD gets a continued vote of no confidence.

The full video is posted on police one. After watching the video, the only disturbing thing about it is that I hear the officer say "I was not aware that catching a bad guy gets you in trouble, but apparently it does, so watch your back" This was said at the 21:46 minute mark. That sole comment alone sums up the problem with what is going on in APD. The officers are out there alone with no backing because the cowards on the 5th floor will use them, and they know it. One has to wonder, and only the officers on the scene will know this but, were any of the officers involved in this threatened by agents of Schultz who were conducting this investigation to incriminate Connor or else they would face charges? If any of the officers interviewed in this case faced the slightest insinuation of or directing of what they they should or better say to save themselves, they need to get a lawyer and go after the 5th floor for intimidation of witness and tampering. It doesn't seem that the video shows any use of force. One has to wonder if chief ASSume sent in his goons in his usual round about way to influence this investigation with lies about what the video showed to coerce false statements. Seems like something stinks in little Albuquerque

Gilholly was in charge of CNAU when they ran rampant and later the city paid for the lawsuits. He was also in charge of the reserve program when the infamous Young incident occurred. Sounds like a disgruntled employee who was no longer promotable due to his own actions, yet allowed to retire. Then he casts stones at others but never calls to attention his own FUBARS.

Did every one catch in the Saturday Journal what Berry said regarding the May tasing: "the video shows entirely unacceptable behavior. I believe the incident needs to be investigated by law enforcement, the DA and potentially the US attorney's office. There is zero tolerance for this type of behavior within the department" Talk about second guessing a first responders actions and presuming a crime. Worse yet the double standard he has by continuing to back the actions of Schultz who has been found to violate peoples rights by jurrors.

And you must believe everything you read in the Journal because the only one saying the Reserve program was wrong was TJ Wilham. So by Schultz's own statements, property crime here in the city should be 49.79% of what it was in 2009. In other words, property crime rate is less than HALF of what it was in 2009. I don't even have to look at the FBI numbers to know this is utter bullshit.

But since when do lieutenants or sergeants (that's who are assigned to IA) investigate commanders? That would be against SOP. YOU HAVE TO HAVE A DCOP OR SCHULTZ DO THE INVESTIGATION....but since none of those guys know how to do it.....now what.....?

No one cares that the next Chief is a woman as long as she does the job. As for bagging on these guys serving in the military Reserve or otherwise....they spend time away from thier families...do duties overseas and otherwise and don't ask for so much as a thank you. To those touting Beth Paiz as the next chief. You have a chief now that has no integrity and neither does Paiz. Those who were within ear shot of her statement at a substation public event not long ago can provide testament to her statement regarding Officers Doyle and Woolever. She said, in essence, that the officers did nothing wrong in the Blume case and that she had their back. Well, when pressure came she caved into Herr Schultz and toed the party line to crucify those officers. Even today, retired, she will not come forward to tell the truth. It takes a special person and someone who serves in uniform in both law enforcement and the military is nothing short of amazing. A thank you to those in law enforcement your service is appreciated. There is no doubt that the military is part of what make this country great and we all must be thankful and respect those who serve in the military and defend this great country. Also, we must be just as thankful and respect those who are cops and who risk their lives everyday to serve and protect our community. What I do not understand are those individuals who serve and risk their lives in the military to defend our great county and our constitutional rights but then return to serve as cops and proceed to ignore or allow the violation of people's constitutional rights and civil rights when they know better. The words "playing soldier" were not meant to disrespect the military and should not have been used to make the point that Gilhooly knew what was going on with CNAU and did nothing to stop it.

There were a few more FI's out there recently but they were SRO's on break from the schools that had a little bit of FI training thats all. The SRO's are now back at the schools so the FI numbers have now changed. And the comment made that FSB 34's aren't sent to burglaries is CRAP..
