Problem? What Problem?

As many current and former officers have noted, under Chief Schultz, APD seems to think that evidence is something that is best used for press conferences. Chief Schulz and Mayor Berry routinely expedite the presentation of material favorable (or so they think) to them while denying, hiding, or destroying evidence that is unfavorable. They also seem to think their department is also their own personal promotional device. As the summer of 2012 closes, we can’t think of a better time to reflect upon this mess as the fall election season goes into overdrive and how they've harmed all those that depend on APD:

•While APD couldn’t get video footage of APD Sgt. Peck’s shooting before the media fast enough, Chief Schultz and company did all they could to conceal the video footage of Officers Shad Solis, Ron Surran, and Connor Rice. Schultz even lied about state law giving him protections to keep the video from the media.

•APD continues to release guns held in evidence for safekeeping or tagged as found to persons by doing the bare minimum in a background check: a local warrant check. And such policy is confirmed to be outside of the federal gun control regulations.

•APD’s lawyer Kathy Levy professes her ignorance of the federal gun law regulations and confirms that “saving time and resources” are substantial reasons for fast tracking the release of firearms. But she continues her track record of waiting until the last possible minute to satisfy court orders rather than stepping up and getting ahead of them. Why save the city money when you can cost taxpayers thousands in sanctions because you don't want to comply with court orders?

•APD’s deputy chief Paul Feist orders the unlawful release of ballistic evidence and then claims there’s a court order directing him to do so even though there are standing federal and state laws requiring police departments to retain such evidence.
•Spontaneous statements to supervisors by P1/C’s are being used against officers in support of termination level investigations.

•NOTE TO BERRY, your mismanagement of the city is bringing the state’s entire economy down! As best said by UNM’s Bureau of Business and Economic Research director:
“Albuquerque’s performance “is shocking,” she said. Other cities in the West “had a much deeper fall in the recession than did Albuquerque, and they’re bouncing back. Albuquerque really is the laggard. It’s striking. When your major metropolitan area is still in the doldrums it’s hard for the state as a whole to really start moving forward.” (ABQ Journal, Sept 24, 2012)

•As we at the EYE reported months ago, APD and the city contracted with consulting group to assess the overall efficiency of APD. The stunning conclusion is that dayshift officers need about 30 more cops working the streets. HMMMM…there are 3 dayshift squads for each of the 6 area commands, making 18 squads to await the 30 officers. Barely 1 extra officer per squad (1.67 for those picky readers). And that extra 1 and a half officer is supposed to free up all the other officers to have upwards of 45% on-duty discretionary time.......really?

•AFD’s response times are falling into unacceptable levels of delay. We’re wondering when the local media will review APD’s response times which of course have fallen into the times they were when APD’s spin-master and defendant, TJ Wilham, reported times were too slow.

•Officers are telling us the next Field Service Bid will be held in January because of the rapid drain of personnel as they elect to retire. This would be four months early. We are also being told Schultz is looking at downscaling specialized units by reverse seniority in order to backfill the huge vacancy in the field. We can't wait to see who gets preferential treatment.

•APD is hemorrhaging experienced and skilled officers who choose to retire rather than face the uphill battle of being discriminated against or subject to a hostile work environment. Such vacancies are glossed over by a spirit best expressed by Cmdr. Kevin Rowe as a feeling of “Love and Excellence” when in fact what exists is “HATE and FAILURE.”

•The current roster of officers assigned to patrol is as low as it was in the 90’s…nearly twenty years ago.

But hey, APD gets an “A” by its leaders, while the economic, political, and forces of reality converge upon the city and the department. Perhaps, just perhaps, the problems facing the city and APD aren’t the fault of the rank and file who are out there working their butt off every day. Perhaps, just perhaps, citizens, businesses, and institutions have lost their confidence and their optimism in the Duke City and that there is general fatigue of this chief and his mayor.



Perhaps it’s the…LEADERS…who have caused this mess. Could it be???

Matrix reported that day shift officers are overworked...
Matrix reported that many AFD units have call volumes that are beyond effective range
GIS reported that many fire districts within the city/county are beyond response capabilities of assigned units/staffing
Bureau of Justice reported
that county lacks .5 sheriffs for every 1000 residents compared to national averages

Lots of new and usable data on public safety. At least county is trying to address the shortfall. What will the city do?

I just read Joe Monaghan's blog where retired APD Sergeant Dan Klein wrote about how the liars Piaz, Banks, and a few others all just recently and coincidentally receiving new cell phones within the last few months. Wasn't that hack lying lawyer levy delaying things so much the last few months so much that she faced sanctions? Wasn't she so grosely and blatantly far over the time lines for producing that evidence that she faced sanctions? Is it true that this unethical, bitter, seedy, quasi-counsel for the collapsing city has delayed without cause these proceedings for some reason? Could that reason have been to get rid of the evidence or facilitate it's oops.... Loss?

Well, 30-22-5 of the New Mexico Criminal Law Manual states that:

A. Tampering with evidence consists of destroying, changing, hiding, placing or fabricating any physical evidence with intent to prevent the apprehension, prosecution or conviction of any person or to throw suspicion of the comission of a crime upon another.

B. Whoever commits tampering with evidence shall be punished as follows:

(1) if the highest crime for which tampering with evidence is committed is a CAPITAL or first degree felony or a second degree felony, the person committing tampering with evidence is gilty of a third degree felony;

Since there was multiple people involved in this, and we all know they weren't sending pictures and video of their little spawn's soccer games that day.....

If you let your fingers do a little walking a few more subsections down the NM state statute book, to the little old word these cretins are surely fond of with these secret phones of theirs to a number known as 30-28-2

The chief has a personal cell phone that a journalist at the Journal has access to? Everyone involved in the Mary Han case denies taking photos? But they don't want to give up their phones? Something smells to the high heavens here! Is this transparency? The only transparency involving this bunch and their administration, is when it can be used for their benefit and that comes with drawstrings too. They will only let out as much as will help them, concealing anything that does not fit their cause. Proof of that IS coming very shortly.

30-24-3 Bribery or intimidation of a witness; retaliation against a witness.

A. Bribery or intimidation of a witness consists of any person knowingly:

(2)intimidating or threatening any witnesses or person likely to become a witness in any judicial administrative legislative or other official cause or proceeding for the purpose of preventing such individual from testifying to any fact, to abstain from testifying or to testify falsly.

B. Retaliation: Working for APD, you all know what this is.

C.
Whoever commits bribery or intimidation of a witness is guilty of a third degree felony.

D. Whoever commits retaliation against a witness is guilty of a second degree felony.

The familiarity here is when an officer doesn't say what the 5th floor and their henchmen want them to say after being threatened numerous times, then the 5th floor retaliates. You pissed up the wrong tree clowns. Your sergeant is going to prison.

Hey eye, how about a story about a loose cannon Lt. that has assaulted officers both verbally and physically on more than one occasion and if you can believe it, the officers are transferred for standing up to him. Tim Lopez is without a doubt the worst Lt I have ever seen and Commander Harold Medina (geez how it pains me to call him that) knew of two of the incidents and did nothing. Now Lopez assaults an officer and King Schultz being the standup guy that he is, screws the 34's. Medina and Lopez both should be busted back to P1/C's and given a walking beat.

All the closets within the APD need a good cleaning.. There are WAY TOO many officers with inside jobs that should be out in the field shagging calls. APD is said to have over 1000 officers but the bid list is only showing close to 400 bidding that is disgusting.. There is no need to have all those officers in Recruiting, IT Unit, Accreditation, Inspections, we could go on and on with the BS units the APD has. And now we hear that Sgt Jennifer Garcia is going to be heading the PEACE & LOVE UNIVERSITY??? Why doesn't she just quit and run a DAY CARE CENTER....

Brad Ahrensfield's appeal was held in Denver before the 10th circuit of the US Court of Appeals. No change of venue, that's where the court is. A decision by the judges hopefully by Christmas.

This system will never work, things like this @ APD have been tried b4. Citizens already wait far 2 long for a response as it is, by designating a call lower than a P3 1 of 2 things will happen as the lower calls will also likely be delayed 42 calls. Either 34's will play dodge-call by 54ing or milking or citizens will complain (rightfully so) and Dispatch will upgrade the call from a lower designation so that it is immediately dispatched on (this happens ALL the time, the squeaky wheel is the one that gets oiled and everyone knows it).As it is, when a call is sent to TRU the vast majority of times the caller will demand that a 34 respond and the call gets kicked back. If you call for a cop, you get a cop. Back in the 90's an attempt was made to have people involved in all 44's in which the vehicles were drivable and there was no issue of DWI. That plan lasted about a week from the initial media broadcast before 34's were required to respond again. Why? Because people complained. Heck, and this was back when the traffic unit was fully staffed, had three squads, and worked multiple over-lapping shifts. Oh and by the way, this was also when the cty's population was about 200K lower, APD had ~900 34's and only 4 area commands (yet somehow there were still at least 360 guys bidding for field spots).

As for my comment about field guys playing dodge-call or milking, I do not blame them one bit as the field is so grossly under-staffed and the guys are being run ragged.

Over the years numerous attempts have been made to alleviate calls for service, cut down response times, etc. But as usual, the political climate sways how APD is run and it inevitably reverts to its' failing ways. When the push to "grow" the department came all it did was allow for mediocracy. And as that mediocracy was retained by changing leadership at APD/CABQ it allowed for movement up through the ranks where it became overall ineptitude. From Chavez to Berry and from Polisar to Schultz, they all allowed for APD to become the joke that it has finally become today.

The city's population has grown immensely from the early 90's and calls for service, set aside actual emergency calls, are rediculously high. Thie field has always suffered from this as more and more resources are inserted to SID/CIB with the creation of new and unwarranted specialized units and the bolstering of existing ones. As much of an absolute idiot we all thought Galvin was, the decentralization of APD during his stay was the one thing I can remember that actually worked. What a novel idea, put additional expertise and resources at the area command level working various shifts to enhance communication, share intelligence, and provide cops with immediate access to resources. This concept also provided for less bureaucracy within the department as there was no need for all the additional Sergeants, Lieutenants, and Commanders. It was a "win-win" for us as a department, but especially for the citizens that we serve.

Now with the looming crisis of as many as 150 34's retiring by years end due to the PERA changes, this is Schultz's/Berry's solution, to re-categorize calls for service??? And what if there are further, very plausible, changes that are made, either by way of PERA or if Mr "Businessman" Berry reorts to the initial stance on "double-dippers" within CABQ. Well over 10%(maybey closer to 15%) of sworn personell at APD are the very "double-dippers" that Berry despises. And with that, we all know that APD having ~1100 34's is a FARCE !!! The number is more accurately right at 1K, with some of those still being carried over from retirements earlier this year. So with these upcoming retirements that puts us at 850 or so 34's, and if for arguements sake we subtract the ~130 "double-dippers," we are now in the 700's.

This is the REAL CRISIS that our administration has allowed for... and oh my, have they failed us all.

Sexcapades in evidence, on video,in stairwells, and in offices by employees and high ranking personnel, the entire top administrative branch of a police department that are confirmed liars under oath, evidence being concealed, lawyers outright misleading and lying during proceedings, A chief who frames his officers, a mayor who wears blinders. Officers who are terrified to stand up against all of this corruption because they know they will be next on this groups hitlist. It must really suck to work somewhere where you are sworn to uphold justice, yet see examples of the corruption so blatant and obvious and not do anything about it because you will be retaliated against by people who will stop at nothing to cover their tracks by attacking their accusers through their families, attacking them, setting them up, lying on them, fabricating cases against them and using political influence to get it all done. Every one of you will be caught. Are these people so stupid that they think that nobody sees through their schemes? Schultz fires his officers without cause and loses every appeal because he is a liar and violates their rights with a preconstitutional theory that he thinks he can just fire employees? Since his personal promotional crusade has backfired in his crooked face, he now trys to get the LEA board to drink his Kool Aide. Now this clown wants the LEA board to be his dopes and suspend officers certs based on his lies. When will this coward stand up and do his own dirty work? Pathetic punk. This is only yet another way for him to retaliate attack and violate the rights of those he does not like or whom he wishes to use to advance his political gain. You see, it's not just a suspension of a cert. It's a way for baby ray to get his way and fire someone he wants to fire anyway. An investigation does not matter with this guy. He makes up his mind that officers are fired before an investigation even begins. He just tries to find ways to justify it. So with this cert issue, baby ray can just say... Oh well... their cert has been suspended, They can't be cops, I guess we have to fire them. Since ray has been illegally terminating officers, this is just another slimy attempt at circumventing due process. Contriving such schemes takes real piece of work. Scumbags.

EXACTLY correct on retirement, it would be absolutely foolish not to.

I like to believe that we all chose this path because we wanted to "help those who could not help themselves," and for for the most part that is true. But I also believe that for a greater percentage of those who dawn the badge this path has chosen you. I've had the pleasure of serving my community and working with some very special 34's who make my claim true. It is evident in how regardless of the disgruntled talk we all share and how we damn our administration, we still run to the sound of gun-fire while others flee, and we still put in the extra work and hours at the expense of our loved ones to take evil-doers off the streets, and we take the time to ensure that victims know they are safe. All this is stored internally and is only shared with those affected, and we do this without reward. In contrast to our enlightened view of police work, our very actions that are intended to stop mayhem and "keep the peace" are distorted by the media and exploited politically by our supposed leaders.

We know that all of our training is intended to keep us safe from violent criminals on the street. We all trained to become consciously competent and prepared to keep the community safe and take us home in one piece at the end of the night. But over the years we learn that it's not the knife in the suspect's pocket that gets us, it's the knife that is put in your back by those who would would step on you for rank and self-promotion, those that would sacrifice safety to save time and money, and those who would inundate you with gadgets and policies that inhibit you from immediate action to protect for the sake of civil litigation.

Please retire if you can, don't tempt fate, and look back with pride in your work well done. In the end WE have to ensure our own safety and wellbeing and can't rely on a corrupt pulse-less organization to do it for us.

If he had it posted online he could have just as easily or probably even more easily downloaded the Matrix report as a PDF file, and e-mailed it to everyone in city council. HE wanted them to find out last for a reason. There are dirty reasons for all deeds done by these mutants. When the excuse sounds stupid, it is because it is stupid. Look a little further into it and you fill find the real reason. With politics it is usually timing. These magicians need help with their illusions and timing is everything. Lies help too. Why doesnt anyone (i.e. News Media, APOA, City Legal, etc.) ever "Follow-up" in reference to these "Big" stories in the news? What ever happened to the "Retention Bonus" fiasco?!! Wasn't there an audit showing officers were either Overpaid, Underpaid, or Not Paid at all? What was ever done to correct this matter? It's is my understanding this concerns over a MILLION DOLLARS, yet, although there was allegedly, "No accounting record" as to HOW these bonuses were issued. Makes me wonder who got "paid" at the expense of the city and those officers who were not part of the Ivory Tower or part of the "Good ol' boys Club." I can understand why officers are in such a hurry to leave! Who wants to work for a city that refuses to follow contacts, refuses to do the right thing and steal from its officers and the tax payers.

No wonder Albuquerque and New Mexico are in the toilet. Blatant missapproriation of funds and the media and the powers that be don't care.

this dept is so low on the morale dept is it even repairable? and yet another sgt is accused of having an affair with his subordinates. is there going to be a homicide in homicide? playing with fire! seems to me that one or both need to transfer ASAP

Why does Organized Crime "Need" anyone to "let" them go after anyone? An officer is sworn to uphold the law. That means that an officer is sworn to take action when they see a law violated. That is unless you work for APD where Schultz does not believe in that oath or the constitution of the United States. Right Ray? You little fucking pussy. You have better luck expecting ice cream sandwiches in the Sahara than you do an APD cop standing up against the administration. And why blame them. The minute they do, the APOA sides with the corrupt administration because they are in their pockets snuggled right up against their empty balless sacks. Then the administration starts the retaliation wheels moving. The only thing that will make a difference here is when these corrupt lying criminals are held accountable, charged and imprisoned. They are cowards. The first time one of them takes a hit like that, they will all piss shit and vomit on themselves, then give up everyone and their mothers. All the shit and lies they pull on people needs to be unleashed on them.

And Perry, get this, You and your meeting with the chief, mayor and White back in June is all coming out. The orders given, and what was done is being spilled like beans. You thought you dodged a DOJ investigation. Those people don't like to be duped and fed bullshit. Your attorney doesn't have what it takes to defend what's coming down the pike.
