On this coming Wednesday, on October 31, the final day of the John Doyle v. Ray Schultz labor hearing will (unless APD lawyer Kathy Levy gains ANOTHER continuance) conclude. If you recall, former APD Officer, and retired highly decorated Philadelphia Police Department officer, John Doyle was terminated by Chief Schultz almost a year ago stemming from the circumstances surrounding the arrest of wanted violent felon Nicholas Blume.
Since several months have passed since the last hearing many stunning revelations have unfolded that not only cast doubt on Chief Schultz's stated reasons for Officer Doyle and Officer Woolever's terminations, but seem to indicate their termination was unlawful and based on fiction. We wish this could be a case of "trick or treat" but it isn't. Chief Schultz initially stated the officers were terminated for their use of force in subduing a combative felon via the least intrusive means--but then it was revealed that kicks to the torsoe and shoulder are taught at APD's academy. Then Chief Schultz said it was for lying, but then it was revealed that it was Officer Doyle himself who obtained a copy of the very video tape that APD sensationalized at Officer Doyle's expense. Chief Schultz then did all he could to invite a federal indictment against the Officers under 18 USC 242 only to find the officers fully cooperative in their criminal investigation and to see that the actions of the officers were well within the confines of trained and practiced activities DESPITE how the video looks to uniformed citizens or book-trained instructors at the NM DPS academy.
We wish Officer Doyle the best in his effort to regain his job and to pursue all available means of relief to restore all that he has lost. For those interested in attending and supporting officer Doyle, the hearing starts at 9am and is at the old-SID building on Randolph just west of Yale SE. We would remind all those arm chair critics who attacked and continue to denounce Officer Doyle's actions that you are talking about the efforts of a season front line first responder with over twenty years of experience working the meanest streets in the country. As such we find it of little irony that not one person who was called to testify against Officer Doyle even remotely has his skills, training, or experience in street level law enforcement. We would also remind critics to take a hard look at Graham v. Connor one more time.....

Very nice article Eye. If ever there were two officers who cared about their fellow officers, it was those two. Good cops. Every cop who worked with them knows they were wronged. I hope they win and this case shows how dirty they were done. They did their job and could have been killed that night. They went home alive and a bad guy who would have killed went to jail alive.
There should be a sea of blue at this hearing standing up for Doyle. But they are all intimidated away. If you can't stand up for yourselves, how can you be expected to stand up for others?

The ones that testified are the ones that take the easy way when doing anything. Get hired, work the field for six months, go inside to a closet, and then attend ALL KINDS of schools to beef up their resume and then use what they SO CALLED learned in those schools against officers that were ONLY DOING their job... Doyle & Woolever deserve to get their jobs back... Schultz ONLY went after them to make the DOJ think he was doing his job... And he continues to do the same thing.. May God be with Doyla and Woolever during this time...
We dident show up because the highers will retaliate. I have a family to feed and can't chance it. Doyle was a good 34 not much good to say about Woolever, he cared more about his muscles then work. Officers are leaving and the manning levels are pathetic. Hope all you haters are happy.
Thank you Eye for this insightful, truthful, and caring statement. This has been a long, tiring, and bleak journey at times that Officer Doyle has had to take since relocating to New Mexico. However, we know it is far from over. We are very aware of all that has occurred over the last 17 months.
To watch a career and the work he has done his whole adult life destroyed is very upsetting.
We would like to thank those that did support John over the last 17 months. When you go thru something like this and away from home it is harder to deal with unless you have true friends to support you. We know who was there for him.
We also thank Rob (Officer Woolever) who stood along side John through this ordeal, which partners don't always do. Rob is a very honorable officer in his own right whose career has been taken away by APD as well
Our hopes are that the Arbitration Board will see the truth and what was wrongly done to Officers Doyle and Woolever and act accordingly.
We believe things happen for a reason. We have to believe that there will be positive things that can come from this life experience.
We have always been proud of the work John has done and believe that on that February night in 2011 he and Rob did what they needed to do to apprehend this felon who previously eluded APD on several occasions. No matter what the outcome is of this, we will always be proud of the job he was sworn to do with honor and integrity.

I don't know any details of this case, and am not interested to be honest. I cant seen these problems from my house...
But I will say this, most people who comment on here act like APD is the only organization in the world where the worker bees get treated unfairly by management. Most workers will tell you horror story after horror story of how unfair their boss is and how unfair their workplace is. Pretty much anyone with a job in New mexico is employed "at will", meaning they can fire you for any reason they want to. Some organizations felt this practice was unfair and they formed unions to protect their workers rights. You have a police union, let them do their job or stop paying dues, or find another line of work.
It's not nearly as bad as you make it out to be. I've known people who lost their jobs for a lot less.

Go ask any retired APD employee, and you'll find out just how bad it is. Comments like that crack me up. It's fine, and not as bad as you think until it's YOU that is the one wronged. Officers aren't baking cookies, sweeping floors or mowing lawns. They are risking their lives every day to protect us. When they get used as political pawns by a chief with a more than checkered past for doing their jobs, and apprehending a violent felon, it is a disgrace. And when the order takers don't have the guts to do what is right, and instead form fit an investigation, hiding evidence, intimidating witnesses, and lying it is worse. When you are wrong, you are wrong. The investigator's job is to put forth a fair case, not one that has to win by all means. When you are wrong, you don't change your story and make up another false reason for termination. This is where APD is getting out of control. They move forward until they reach their desired conclusion. You think it's not that bad? Imagine investigators dealing with the public that are taking orders to get people one way or another. When someone is cleared one way, ramp up and come at them at another angle until you can find something that looks like you can get them with, then when that doesn't happen, just fire them anyway. The shame about it is that it happens, and that should never happen.
When an IA investigator tells an officer what to say in an IA investigation in a "recorded off the record" conversation after getting up and closing the door something is wrong. Now hopefully all involved will see what the right thing is all about.

He is attempting to say it is because of the proposed PERA reform, but that has been addressed and the 7 year waiting period for retirees to get their COLA's has been put off until 2016. Of course Ray Ray isn't going to disclose that, nope, he is crying that all these APD officers are leaving because of PERA. Ray has never taken responsibility so he will never admit it is his fault. Just look at the number of command staff officers who have left while Ray has been chief. 2. The chief sets the wheels of this bullshit cert revocation nonsense in motion with the LEA board.
3. A recommendation comes back to fire said officer.
4. The chief really wants to, but strategizes to use the situation as a propaganda opportunity to make it look like he is not hanging every cop he can. When the recommendation comes down for termination the chief gets to act like the good guy which is all bullshit.
5. CAO and Mayor want termination and the chief knows that a letter is getting sent to the LEA board for consideration of action to be taken against said officer's cert.
6. Board recommends legnthy suspension or revocation, and the chief says OH MY....I have no choice but to fire you because you have not kept up your cert as per sop.
The chief has tried to have quite a few other people do his dirty work for him like this but they all saw what was up.
Every officer that gets hit twice like this needs to fight the LEA board to the highest courts until their antics are ruled on, and case law is set like it is in every other civilized city in this country with a police union that has balls and a police chief that has morals. This happens nowhere else. It is illegal and against every labor law there is. But hey, cops are judged on "what it looks like" when everyone else in the United States is entitled to due process and what it really is.
