Misleading and Mischaracterized Statements: Yermal Style

Recently the above memo was distributed out to Albuquerque city employees. In it Berry/Perry & Company's very own Human Resources director, Vinnie Yermal,  reacted to a public comment by a labor union president representing the local AFSCME chapter. Yermal you see was upset about some comments made by the president that revealed publicly what has been the city's method of working with labor unions: Don't Work With Them. And here, Yermal went on the attack.

Since Berry took office, he and Perry have not backed down from their efforts to remove all city paid compensation to city employees who get paid to work for their unions. This is an ideological argument that neo-conservatives can't seem to get over. Nevermind the fact that at most we're talking about a handful of employees and that in reality they bring a positive savings that out weighs their earnings. But by the city's actions of not negotiation on this issue, they have brought an impasse to union contracts with the police, fire, and AFSCME covered city employees. And from those impasse's there are lawsuits and decreased productivity. Not bright executive management style at all if you ask us. Out of protest of a few employees, Berry/Perry have harmed thousands of other employees.

While Berry/Perry's lead contract negotiator has collected hundreds of thousands of dollars in his efforts to make sure all the main unions do not get new contracts, the affected employees have also seen their pay go down while their expenses go up. Now with the AFSCME president bringing attention to this matter, Yermal goes on the offensive in actually blames her for the impasse.

Oddly Yermal makes the statement that had the unions folded on this issue all employees would have seen a 1% raise each year for each of the last three years. Funny, affected city employees have seen a reduction in income and had this increase occurred it would have been a pay restoration and not a raise. Silly Yermal.

Yermal then closes the memo by saying, after his lies, that he hopes the "memo clears up and confusion and misunderstanding regarding the City's position." Right, because only in the land of Berry/Perry is it called leadership where you punish the vast majority of your employees while you give your impulse control impaired CAO a $33,000/year raise.

We at the Eye have to state the obvious, Yermal sounds way too upset for a guy that according to the city's transgression, oops we me transparency, site makes $45.94/hour.

But then again, since Yermal only gave $500 to Berry's campaign (reported on August 20th), unlike the $2500 Perry gave Berry, I guess we shouldn't be surprised he's been tasked to push back against the city's workers.

Given how APOA Vice President Willoughby can't support APD interim chief Allen Banks enough praise (even though Banks is even more anti-union than Schultz) we don't expect much from the city's finest to fight for their wages. AFD shows promise but the cards are still out.

Who knows, maybe it will be the clerical workers, the solid waster drivers, or perhaps those fiesty librarians that finally pull the plug on Berry/Perry & Company's war on their employees. We do know that they just got a huge ally with the election of Diane Gibson to city council.....we see.....

Did the HR Director violate this over 6000 times to city employees?
AFD has been the only ones to not crack. AFD will bring them down.

If it had been only the clerical union I might have said try harder union. But it is almost all unions. That smells of union busting. Perhaps, all the unions need to come together for some brain storming instead of each union for themselves. Just a thought .

Great post Eye!AFD isn't the only one that didn't crack. Deb Rainaldi stood her ground a few years ago when Berry and his personal ball buster..oops I mean union buster tried to give her clericals a jacked-up contract to sign She said NO and took a lot of heat for it,including from myself (Xena). She sat me down and 'splained the reality of it. Yeah, we gave up 1%…but the cost would of been much greater.in the future.The Dog and Pony show(Perry& Berry) are purposely letting Yermil hang himself on this one. HE'S NOT SUPPOSED TO TALK ABOUT CONTRACT NEGOTIATIONS BUT HE OPENED THE DOOR FOR DEB TO PUT HER OPINION ON THE RECORD. Stupid Yermil...yer being played...derp!

I read that memo too. It seems like what the City is trying to do is justify their efforts of trying to crush the Unions by eleminating Union time. And as far as their 1% raise, what would Perry have said to a 1% raise? Perhaps he would have found it insulting. Well so do we.

Officers retire at the end of the year for PERA purposes. No one leaving since Banks came in at the end of August means nothing. Tell me what you think when the 50 officers slated to retire December 31 do so. APD goes below 900 in staffing and the only idea Berry/Perry/Banks/Schultz can come up with is to make the entire state fix their problems by begging the legislature for a DROP Plan.

APD problems belong to APD. They don't belong to PERA. They don't belong to the legislature. They don't belong to anyone else.

Berry should put on his big boy pants and admit that doing away with the veteran incentive in 2009 was the wrong move. He should reinstate it right now. He should also admit that excluding applicants who don't have college or military has ruined us for recruiting (look at BCSO). Berry should remove the college requirement or at minimum allow applicants with no college or military but who are 25 years old to apply.

Berry / Schultz / Banks / Perry own the entire mess at APD. Hold them accountable and don't let them bankrupt PERA with a DROP plan. PERA Retirees this is for you. You want to see your COLA go down to ZERO! Let Schultz and Berry spin the DROP plan and get it approved and I can promise you the legislature will drop our COLA to pay for it. Speak up or lose your COLA. NO DROP PLAN!

People watch, certain people are present at public events and they see and hear things....they are not politicians, they are unrecognizable...they attend events where police are present, but they don't know who is who..but these invisible people, have something in common..a lot of them come away from these events shaking their heads asking themselves or each other..."who is that guy with the big mouth hitting on all the young women??? It's embarrassing..." Now this could apply to most men...of a certain age, let's say, who fancy themselves to be irresistible! Must be the combination of a high salary and too much viagra. You have no clue what you are talking about. The DROP means they are drawing their pension out fo PERA during that time. This is a negative for PERA and needs to be stopped now. Let Albuquerque fix their own mess, Berry should grow some balls and not pass the buck to PERA.

That memo is one sided. The memo states that the city offered a one percent raise this year and over the last three years for clerical. Funny how the memo doesn't mention that approximately four years ago the city took three percent away from clerical pay. If that one percent was accepted over the years than it would have just made up for the lose they had four years ago. Also, the memo states that one percent was offered, however it DOESN'T state that they want to take away longevity, seniority, etc. Clerical would have lost a LOT more if they accepted that lousy one percent. Deb knows what she's doing. She's not allowing the city to continue to screw over their own employees. Clerical employees work hard and they're shitted on and under appreciated every day. Deb, keep up the good fight! Clerical deserves more than what they're getting.

Montgomery and Pitzer sent this guy to the hospital and didn't even explain why in their reports. Broke his jaw and cost the city $60,000. Yet they are still working. Montgomery cost the city $400,000 for his shooting and Pitzer now has 3 under his belt. Yet they are still employed.

I believe the Constitution guarantees equal treatment and Doyle and Woolever certainly have not received equal treatment from APD and the city.

Kudos to Deb for not backing down. This attempt to smear her name and discredit her hard work is disheartening but it will not work. Clerical employees watched officers give up their Longevity and other benefits for a big raise. Officers, with their longevity gone they did not get their promised raises. Deb refused to allow this same thing happen to Clerical. Clerical DID get offered a 1% raise, however in exchange they would have had to give up their longevity. Clerical employees would have had to give up 2%. Clerical employees would have been making 3% less total after their big raise. Remeber management, clerical employees are the ones typing your reports, ordering your supplies, making sure you get paid, making your phone calls and making life easier all around. To those clerical employees that think maybe they aren't getting the representation they deserve or their voice isn't being heard anywhere other than this blog, consider attending some union meetings. This "Open letter" is union busting at its finest. Berry/Perrys attempt to disenchant unions memebers so that the entire union can be busted. Their attempt at making things easier for them to take the benefits you now have away. Your union has fought for you, Deb has faught for you but unions are NOT one woman rodeos GET INVOLVED!

I for one appreciate that our clerical union president turned down the PITTANCE admin was throwing at us like a freaking scrap of mouldy meat. On the other hand, I feel sorry for APD and the illegal sketchy shenanigans of their current union, and the union presidents and Reps. that they've had in the past. Something stinks there and an investigation is called for. Deb Rainaldi has the guts, has the stomach to look Administration in the eye, and say HELL NO!!! We don't want your stinking 1% raise. We are the lowest paid city employees. Some of us are the sole support of our families, and yet we drop our kids off at daycare, day in day out, we work weekend shifts, no problem, we are not the entitled, some of us rely on food banks to feed our families, but we won't back down. We want our longevity pay, we deserve it for our commitment, dedication, and pride. I am actually proud to be a City of Albuquerque employee- I just want to be respected and rewarded for a job well done, as a very hard worker, and enthusiastic positive representative of the City!

You're an idiot. Clerical employees are NOT ungrateful. Clerical employees are grateful that they have a job, however they have not had a decent raise for 4-5 years. The offer has been one percent. THAT'S LESS THAN .25 CENTS. With medical insurance rates going up, the economy in the towlet and prices going up on gasoline, food, clothing, etc. it is VERY hard to "make ends meat". Also, how fair is it that clerical's duties have doubled if not tripled without an any compensation?
And by the way, clerical employees do have talents. As stated above, "clerical employees are the ones typing your reports, ordering your supplies, making sure you get paid, making your phone calls and making life easier all around". Basically, clerical does a lot of work if not all of the work for management, higher ups, etc.
Clerical has very good reason to complain and they ARE grateful that Deb Renaldi is standing up for their rights and livelyhood.

Something even bigger than the investigation into APD is going to come down. The DOJ, Office of the Inspector General will be looking into Union/City Admins. Illegal activities as it pertains to Union misuse of pubic funds, threatening and harassing union members. Remember Perry standing on the corner yelling at peacefully protesting union members? SAVE THAT VIDEO AFSCME...it is evidence and may rise to the level of RICO violations if union dues were diverted to Perry, Berry , etc. To buy or bribe no contract or impasse on attempted negotiations.
