Shake Ups and Break Ups Oh My!!

This has been an interesting week in Albuquerque and we don't really know where to begin. First we had the bizarre story of APD's kinda-of-investigation-but-not-really of District Attorney Brandenburg.  Our Eyes are telling us things inside APD, that is the high command, are scrambling to explain how exactly a detective on his own refers a case to the Attorney General's office without there being any statement by APD brass nevermind the detective's sergeant? Are we really to believe this Detective took it upon himself to send the case across the street on his own? Like her or not, Ms. Brandbenburg is the top cop in the county and this whole matter smells much like the Judge Murdoch affair. Except this time instead of sex we've got guns and money in play. Weird.

Then we saw this little article:

No sooner is David Tourek out the door then are the replacements lining up. One name however jumped out at us: Erica Anderson. You see, Ms. Anderson has been busy defending Perry/Berry/Schultz in the lawsuit brought against them by the family of the "departed" civil rights attorney Mary Han. (It's been a while since we reported on that case but you do remember that one right? You know, the suspicious death scene where virtually all of APD and City's brass arrived at a crime scene and said "nothing suspicious" and left possibly with diamond rings, computers, cellphones, pictures, and files.)  Funny, Ms. Anderson has been very busy over the past year outside of her representing the squad of crime scene contamination experts:

First she tried to run for a judgeship last summer:

And when she failed at that (it seems that even though she has been carrying water for the Republicans, she is in fact a Democrat, and we know Martinez doesn't like such creatures) she started her own law firm:

But what's even weirder is that apparently she's also working for Tourek's brother in law, attorney Stephen French still:

So we're not sure what's going on there but, either way it stinks.

Looks folks, it seems doing business at the speed of Albuquerque means..."kinda." Get in or get out. If you're gonna charge the DA with a crime then step up with department leaders leading the way, not some poor detective that is going to get left holding the bag to explain why the department fully complied with a IPRA request (when it rarely does) and did so when there was a clear exemption to the request (how often have we heard APD use the "on-going investigation" excuse?)

Add to that a clear scheme where an attorney who appears to have the inside track for the city's top legal position is working for the the retiring city's attorney's brother-in-law but also has her own practice on the side? And really, chasing after the Han family for legal fees. How 'bout you produce the cell phones and articles that were taken from the scene first? And Ms. Anderson, don't think for a minute we aren't aware of your interaction with Ms. Han....

We don't like the look of things to come and the year is all but over yet this mess keeps moving forward....

When was this position advertised? The Mayor cost us $30,000 with that charade hunt for a Chief.
The Chief is important but with everything coming to the legal department, both from APD and all the personnel who are suing from across the City, it is worth it to properly advertise. Then we can get a city attorney who knows how to actually follow not just the letter of the law but the intent as well.
Someone ask the unions how many cases they all have in court and how many grievances are at their final stages?

Steve French supposedly was interested in being appointed head of State Risk Managemet by Martinez when Ned Fuller resigned and was appointed District Judge by Martinez back in July. French wants to close his practice and Erica Anderson works for French and she is in desperate need of a job. Anderson wanted to run for District Judge against Ned Fuller, but lost her bid at the Democratic State Central Committee in August. Erica is a big opportunist and has always helped Republicans, even though she was a Democratic Party State Central Committee member. She is not to be trusted.

Ned Fuller has the inside track on becoming the next City Attorney. He was appointed Director of Workers Compensation by Martinez, then appointed head of State Risk Management by Martinez. Fuller then was appointed District Judge by Martinez. Fuller was a strong supporter of Berry when Berry ran the first time and was always down at City Hall. Fuller has always been a big Republican political operative. He was a Workers Compensation Judge appointed by Gary Johnson and then fired by Bill Richardson. Fuller sued the state when Rischardson fired him as a judge and Fuller walked away with a $300,000 cash settlement. Berry will take care of Fuller before he would ever take care of Eric Anderson.

Does anyone know anything about the rumor that PERA is NOT going to figure the rentention bonus into our retirement calculations? Stephanie is this true? Will someone tell APD officers soon? We have to decide if we are retiring this year and if it is not going to add to my pension I am leaving. Can someone post something?

Thursday January 1st 7pm the governor will hold her swearing in ball not in Santa Fe but at the Albuquerque Convention Center.
Tickets can be purchased on the new mexico true website.
The website does not say how much they are.
It does not say where the money from ticket sales will be going. It does not disclose if the governor is paying fair market prices to use the convention center. It does not say how many officers will now be on overtime to cover her political cronies.
If you ever cared about this city show up ready to protest and equipped with cameras. Lets photograph every single car and person going to this event. Tickets or not you can only keep it private if you do not hold it at a public building.
We need cameras at the parking garage entrances on MLK, the entrance trucks use on first street, all sides of the hyatt, the galleria, city hall, the plaza garage,the police station, the courthouse, the old jail, and any other building downtown with an underground tunnel.

You can go celebrate your buying a politician but we have every right to photograph every person walking in and out. Eye, we will send you the pics and you tell us what odd bed fellows show up when Mayor Berrys wife hosts the governors hooray for us grand ball while the homeless five blocks away go hungry.

i wonder when the tent city between the two will be secretly demolished so the party goers dont risk seeing it.

While I am no fan of Brandenburg, this case reminds me of when APD tried to frame Judge Murdoch for rape in order to distract from Darren White's problems. Seems like these things happen whenever APD is getting too much heat. Why is APD trying to distract the public. It looks like amateur hour the way the department conducts its business.

The retention bonus will NOT be figured into our income for retirement pension amounts. PERA and city are about to be in a huge fight and we get the shaft. Again.

I guess Roseman isn't the pension expert he told the city council he was! APD and this city are run be idiots, what was wrong with the retention bonus we had back in 2009? I know Roseman wanted to spike his pension but now he fucked all of us. And since the MOU says "retention bonus" we are going to be taxed at the highest rates, thanks Berry and Eden! Maybe next time they will ask PERA for their input before they start making changes.

The entire issue of the retention bonus is because Berry didn't put it into the regular contract that was approved this summer. Berry decided to do an MOU instead and this MOU says "bonus" with an end date of June 30 2015. That is why the law does not allow PERA to calculate it into your pension, it is called pension spiking and it ruins pensions funds and is illegal. Berry and Eden were warned and they did it anyone. What a bunch of fools. Thank God we have people protecting PERA from these idiots.

Even the United Nations is condemning the tactics of U.S. Police and demanding a nationwide review of police policies and procedures. It is apparent that the " I Can't Breathe" movement is gaining WORLD-wide momentum. I recall when excessive violence and abuse by the authorities was only subject to happening in the barrios and ghettos. Wnen you read the overwhelming majority of the comments on the Eye, you can tell most are cops or retired cops, or cop family members or wanna be's who live in their own self centered, slefish little world, with nothing more to contribute than smack on each other and no usefull information. The Eye really needs to screen the comments or not publish the comments at all. The comments are becoming more of distraction to what the Eye is trying to accomplish.

Bonuses, like retention bonuses, have never been a factor in pera. They will not count here because it is not a raise in base pay. This is the Mayor up to his old tricks again.

Retention bonus does NOT count towards pera.
Never ask the city either. They are not the final say. Do not trust your unions to know the right information. Your pension is too important to leave in the hands of someone who may be wrong. Only get your information about pera from pera.

Remember this is the Mayor who thinks the only reason you could possibly have for leaving is pera.

Good point. I didnt know. I knew the retention bonus would not factor into pera. I did not realize, since it is a bonus, it is taxed higher than my income. I think the rate is 40% but can someone advise?

Like this - the mayor collected his paycheck like normal but his staff spends most of their time not knowing where he is. Rumors are flying that someone else answers his email and send instructions via text. We can't prove it but we suspect someone else is really running the city and it is not rob perry either.

PERA sent the city formal notice last week that they will not include the retention bonus in pension calculations.

The retention bonus will be taxed at 39% federal and 8% state. It is viewed the same way as capital gains.

So if you thought you were getting an extra $1,000 each month, that figure is actually $1,000 minus 47% ($470), or $530.

That's the real story, if you stay for this you need to have you head examined.

This is being carried over from some comments on the previous eye story regarding the APOA and the lack of planning by the President and the clown Vice President. In the last two meetings they have focused most of the time worrying about Christmas and blowing a huge amount of money on a PR firm. Danny Klein is wise and a much needed voice of reason right now, he's trying to show the APOA leadership that they are walking into a trap and they're helping Berry do it. First, the mayor swapped the retention program for the take home cars. Terrible move by the APOA. So here we are with an opportunity to engage the administration yet Stephanie and Sean refuse to adopt a strategy of any kind. They have sat back and pushed the mayors agenda. Why not tell the city we will give the cars back for a substantial retention raise?? And please read between the lines, if they are going to make ridiculous offers we can counter with our own. Why wouldn't you seize the opportunity to gain some foothold?? If PERA is a bridge too far with respect to the retention bonus then take the city head on with the issue. Stephanie instead chooses to do media stories about how great her family life is and how she's such a good cop. Tsk tsk, wink wink. Nothing like having your own media handlers paid for by working cops.
More importantly, the APOA failed to act on the mayors subtle move to reinstate the RTW program to combat the dwindling staffing levels. Stephanie and Sean immediately threw support behind it, but the mayor hinted that he will decide the shape and scope of the legislation, this is not good:
1. They will be forced to work patrol
2. There will be a sunset on the program
3. The city will decide who gets in
These stipulations mean two huge issues must be addressed. How will you classify these employees and will they be unionized? If the APOA doesn't get ahead of this, the city can take either side of the issue and use it against us. The city has moved themselves into a position to create a "right to work " group of 34's. Those two will refuse to accept any responsibility as usual. They will use the " It's your union" excuse to sit back and wait. So this is really for the rest of us who need to be informed about what may be coming. There are way more serious issues pending than Christmas toys. They said it right in front of us at the meeting, they were going to focus on image issues. Meanwhile, the city is gift wrapping a turd for the APOA toy drive.

We need cops on the street. Take my dues to pay one of those east coat union thugs. Tell the city since they are used to paying over 100k for these two to ride a desk we want 80k to pay a private person like the other unions have. Some out of town staffer who answers to our board.
Then we can hire someone with zero connection to us and show this Mayor what it is like when you do a nationwide search and hire the best applicant, versus some crony.
This administration wouldn't last a day outside new mexico. Imagine what they would do if we brought the outside to them.
