You Do NOT have the right to remain SILENT

As a community we are all grieving the loss of Rio Rancho Police Officer Gregg Benner.  The cause of death was an unprovoked, premeditated and malice act of a known murderer. This is now murder number two for this offender.  The current, District Court Judge Christina J. Jaramillo who allowed this murderer to wonder our streets freely has stated she does not comment on cases. Our thoughts here at the Eye are; Judge Jaramillo DOES NOT HAVE THE RIGHT TO REMAIN SILENT.

Here is the difference.  The average person did not pursue a “public” life which affords them certain rights such as the right to remain silent.  When a person such as Judge Jaramillo decides to pursue a political public life; their life becomes an open book and they lose certain rights that the rest of the private public are afforded.

Christina J. Jaramillo started out as a very liberal Public Defender employed by the New Mexico’s Public Defender’s Office.  After several years as a liberal attorney who fought avidly to allow the criminals to slither in our streets she was appointed by a liberal Governor, Big Billy Richardson.  Is the picture starting to come together?

Jaramillo has any defendant’s full history at her finger tips literally.  She could have easily pulled it up on her State of New Mexico issued computer that sits on-top of her bench.  Or she could have instructed her courtroom clerk to pull it.  Knowing the severity of the charges why didn’t Jaramillo order a PSA (Pre-Sentence Report)?  This is a common practice among competent judges.

Remember when President Clinton stated it was none of anybody’s business when he had an affair while in office?  He sought election and the public elected him; at that point he no longer had a “right to remain silent.”  The same is applicable to Jaramillo; she sought the appointment to a judgeship, and ran for election thereafter to which the public voted her into office.  At that point she no longer had a “right to remain silent.”

The action of Judge Christina J. Jaramillo is nothing short of calculated. Our Eyes tell us Jaramillo, as a matter of common practice, continued cases all the times because she did not want to go to trial.  Why?  Because it was too late in the day or she had to get home.  Was it this blunder which caused Officer Benner’s life? Was this a result of a lazy judge who was trying to avoid a trail?

Perhaps we the people need to start changing the laws and make the judges accountable. Did you know coppers, firefighters and ambulance/medical personnel must take random drug tests? Judges don't. If a public servant J walks; they are disciplined.  Judges don't. If there is anything questionable a public servant does they are subject to disciplinary action up to and including termination as well as criminal and civil prosecution.  Judges are completely unaccountable for any of their action.

What would happen if a judge had to do the same amount of time as an offender because the judge released a criminal without conducting due diligence and who goes back out and commits another crime?  We are thinking the judges, such as, Jaramillo would start doing due diligence. Otherwise judges like Jaramillo would be facing the death penalty or life in prison.

Just because you are paid by taxpayers does not mean you lose any of your CONSTITUTIONAL RIGHTS! Remember that from the sworn oath to uphold and protect when you took the job of a policeman? This punk that killed Officer Benner held all responsibility for his heinous act. Trying to put blame on one person in a system that is not perfect and filled with checks and balances reaks of possible feelings of guilt from your inaction as being a part of this system. Another example of cops mantra of " us against the world" mentality. Sad......

Okay eye, while I agree whole heartedly with not letting these idiots out to hurt people, especially those of you who ARE great officers and do their job with integity and honor, MUCH RESPECT!!!

However, is this REALLY the failings of ONE D.A. and ONE Judge???

Was he ever in front of any other judges? Proabably! Was he ever at a drug treatment program where professionals are employed to evaluate the risk their "clients" pose to themselves and other?? PROBABLY!!

When he was in 1st-5th grade, did anyone notice that he was missing school more than attending school?? Did anyone care that he was showing up with bruises from being ANOTHER OMAREE!!!?!?
PROBABLY NOT!!!!!

NONE of this justifies him killing an officer, but my point is;
this guy was long gone WAY before he decided to take a life!!
What we are experiencing is the RESULT of the failings of our Mental Health and Child Welfare Systems.

If we (and I do mean WE, ALBUQUERQUE!!) hold parents accountable for the basics in life, you know like school attendance, not abusing their kids (as Omaree's P.O.S. mother is suing) and nutrition, they simply would not turn out like this. Ask yourself what type of father Omaree was going to make?? May he R.I.P. but his life was over before it began, do we really convince ourselves this abused lost soul would have been a productive member of society?? Or would he have been left to APD to deal with in the streets?? THAT is why good officers are getting a bad rap.

Balderas investigates the Brandenberg case exposing political corruption, and now KOB who has been recently carrying some major APD water, digs and reaches to try to sully Balderas. Keller exposes Schultz, and then the republican party retaliates by IPRA requesting his phone, text and email messages. Is it a coincidence that KOB now has such access to things they never had and is now getting first crack at scoops on stories? No it isn't. When they agree to go light on the department in exchange for these types of favors it is collusion.
This is the same thing that the Journal did for Schultz. It is also the same thing that KOAT did for Schultz.
I bet if the DOJ wire tapped Jay McCleskey, they would find the root of all of this. There is no doubt that Martinez has aspirations of going to washington and who do you thing she and the republican party have in mind to fill her spot when she leaves? Mayor Berry. They are shielding and protecting him from everything coming down the pike to get him in that office. This was planned from way back. This is why he said he was only seeking 2 terms. He knows what is going on and what he is doing. What all of you people who are fooled by smoke and mirrors do not know about politics is that it is all methodical and calculated. These people in any other realm are considered sociopaths. There are paid people who orchestrate all of this. Martinez's camp is as dirty as the day is long. She could give a shit about anything here. She is looking forward to much bigger things, and those behind here are the ones pulling strings. The sad thing is that she betrayed everyone along the way to get what she wanted. She went republican disregarding the values of those she should be representing in order to be the republican minority and female "in" for them in this state. It is a symbiotic relationship of two parasites and non-thinkers can not see this. Open your eyes people. Mayor Berry made some big mistakes by opening his mouth too, just like Eden, and the administration has been doing some heavy calling in of favors to back fill for him. One of those mistakes was Schultz. If Schultz goes down, it will take everyone down with him, including Berry, so if you think the Republican party isn't doing everything it can illegally behind the scenes to make sure Schultz does not face the music for his crimes, you are foolish. This is politics. It is not fair, just or ethical. This is why these criminals do what they do. It is all about greed. Get your heads out of your asses, and start calling Washington. Push for congressional hearings into the widespread corruption into this state. The entire state is permeated with it.
This is just the beginning people. These criminals have no problem tarnishing good people for doing their jobs in order to cover for what they are doing, and to keep their positions. They do not deserve the air they breathe.

This looks like a clear attempt at retaliation, extortion, and intimidation.

This is behavior exhibited over and over again by the guilty. When caught, call your friends, have them circle the wagons, point the finger hypocritically, and call foul on everyone. Those who have been bullying everyone are now crying victim. This has been culture within APD and Albuquerque city government.

If you want confirmation of complicity, just read the governor's response, and see how she provides cover for Schultz yet again. It is clear from just one email; "greased" that the actions surrounding Schultz and Taser were illegal.

The signs are in behavior and deviation from standard behavior. Read Martinez's comment at the bottom of the article. Make up your own mind and ask yourself this. Why is a former police chief who took off as soon as the DOJ started their investigation given so much cover after being responsible for making such a mess out of this city? What else of value has Schultz done for these people? What does he know?

Martinez's advisor McCleskey is BFFs with, White who is buddies with Schultz. Berry has taken care of both of them. White stepped down to avoid causing problems for Berry, and Martinez has taken care of him. If Schultz takes a hit on this Taser deal, the party is over for Berry, and the republican party. This is how deep it is here. This is why there is no fairness or justice. These people are doing what ever they have to do to make sure that the balance of their power is not upset. There is a lot of money behind this.

Deborah Peacock is the wife of Kauffman's West owner Nate Korn. Nate Korn has had several no bid sole source contracts shuffled his way by Raymond Schultz over the years. (ballistic vests, jackets, patrol rifle optics) Most APD cadets are directed by staff to go directly to Kauffman's for all of their gear without consideration being given to the two other police equipment suppliers; Neve's and TLC. Nate Korn has not been shy about his friendship with Schultz, nor has he been modest about the fact that he feels that whatever Schultz says is gold. He considers Ray's opinion as good as gold. Read the minutes and observe how it was whitewashed and pushed through. No other case is ever pushed through like this without looking at the facts of the case. The board took the word of someone saying nothing happened without hearing the facts of the investigation or even having Sanders present. This is total deviation from standard practice and it was done to keep Sanders' certification intact and to keep from coming to light the allegations that brought this investigation to the board. Every employee who has had scrutiny leveled on them and action taken on them should be outraged at how this was handled. Notice mister Korn's stance on media relations, and how he thinks it is important that employees should be vindicated in the media also. Has mister Korn ever stated this in an ordinary officer misconduct case? Since when is hearsay ok in a LEA board meeting to answer for charges. Someone told Jack Jones, and Jack Jones relays this to the board, and that is okay? What charges did stick from the city of Hobbs against Sanders to make him resign?

This is just the beginning of the information that is coming on these people.

One thing I've heard cops complain about 1000 times, is that no one takes responsibility for their own actions anymore. And here we go again. No one made that douche bag pull the trigger. I have seen officers agree to cheesy plea deals thousands of times, never once thinking that the offender would get out and kill someone. Stop blaming everyone else and start placing blame where it belongs. All you have to do is watch the news. ISIS has put out a hit on all uniformed police officers, and the majority of these idiots have never stepped foot in an american court room.

The minutes of those meetings show the disparity in the way cases were handled while Korn was there carrying all the water he could for Ray Schultz who was sending business his way. Sanders faced no scrutiny in that case, while most every officer who went in front of that board had to explain themselves, or field questions into why they were there, OR have THEIR LAWYER do it for them, but not Sanders. Everything was tainted while Schultz was there, and anything he had his hand in should be audited. They praised Schultz for his volunteer work on that board. Schultz never does something for nothing. Schultz sat on that board for power and control and the ability to have influence in political matters and issues that he wanted handled his way, or to push in certain directions for other chiefs or friends. The patterns are all there now. Get a hold of Sanders case #12-089 along with the investigation from the HOBBS City government to see just what was covered. You will not believe it. Do not stop there, interview the former Hobbs officer and detective in that case to find out what happened. This was whitewashed so that Sanders could get that Texas gig and hire Schultz eventually. They even state that he was in Texas for that interview in the minutes. 12-089 is public record along with the LEA 90 that was filed against Sanders. Sanders resigned from the Hobbs PD because of this and faced discipline, yet the board says nothing happened, move along, there is nothing here to see. What police chief up and resigns without having another job lined up, and goes unemployed? One who was given the option to resign because something DID happen.

So Brachle is still employed and unscathed, the ROP team is still 10-8, the Chief and Mayor are non existent, APD Officers are retiring/leaving at a breakneck pace, the Academy can't function, lawsuits are coming in droves, the dumbest of the dumb are being promoted, the Union has caved and gone with the Admin, DOJ is saying that moving vehicles are no longer a threat (see recent news articles about moving vehicles), Field Officers are taking more calls than ever because Management can't manage, Albuquerque is getting more violent, Mayor Berry is still non existent, the D.A.'s office can no longer work with APD because of a stupid little quarrel, A.G's office no longer trusts APD and Mayor Berry is still no where to be found, Susanna signs a bill that pretty much stops Departments from receiving funds from asset forfeiture (SID was funded mostly by Fed seizures), Mayor Berry still not seen, so many specialized units manned by so many Detectives who do nothing while calls are holding. Is it just me or does it seem like the City is a free for all?? Does anyone give a fuck about ABQ anymore??

Anyone remember the door kicking incident involving several officers, and Daniel Burge?
This was another investigation that was initiated by Schultz, then scrapped when it was found out how far wide and deep it would lead concerning the use of steroids within APD. Word was there were more than 60 officers using steroids. Some of these steroids have metabolites that remain in your system for up to 18 months after discontinued use. If you remember, a few of these officers resigned and some laid low until they flushed their systems. The administration knew that by conducting a mandatory test of all officers it would result in a catastrophic scandal, and loss of over 60 officers. With everything going on, this could not be risked, so they let that investigation fade away by bringing up other issues and constructing and devising further distractions. They knew that people tied up in this knew things and would talk if they were outed by the department. Many of the users were in special units and or connected well within the department. A lot of them hung out at knockouts. Under this new agreement, those in charge will continue to manipulate the shell game to make sure their friends are not targeted for random testing. Nothing will change until there are hearings where those who know what has been done are brought in under federal subpoena, and questioned knowing the ramifications of lying in a federal investigation.

They DA's office decides on the plea deals, not the police officers! It is no wonder that New Mexico is the cesspool of the southwest...it appears that most folks in Albuquerque have the IQ of turds! The bottom line is this, Albuquerque is the epitome of corruption, a corruption that runs deep and wide and it appears nothing is going to change. The LEA board is a farce. They rubber stamped whatever Schultz wanted thanks to his buddy Nate Korn. You know what's funny? Cops bitch about the no bid contracts Korn gets, but I still see dozens of cop cars in his parking lot every day...hey you stupid cops! you can get your equipment elsewhere. There are two other supply stores in town that will let you buy and pay out of your checks! Hey, there is also the internet, you can buy there. So if you're gonna complain about how evil things are, quite spending money with one of the purveyors of the evil! But you know you won't because none of you have a backbone, if you did, you'd find jobs elsewhere! APD=Cowardly Wimps!

Perry should be recusing himself, and have no further contact with committee members on the OIG investigation either through third parties, the use of his private secret emails or burn phones, because he is directly involved in the Taser scandal and previously in a biased manner stated Schultz did nothing wrong. But no, this arrogant punk will continue to keep his thumb on the scale until the Department of Justice chops it off along with his legs and head because when they do get him he will assume they are as stupid as everyone else and he will lie. I bet what Perry is pulling is not only a federal crime, but an ethical violation according to the NM BAR that could strip his license.

The fundamental problem of our city and most other cities is US the people. We have become lazy, corrupt, drug users, drunks, lovers of pleasure rather than lovers of God. We are suffering the consequences of our liberal educators and baby boom dope heads who have the reigns of power now. And I see things getting worse, much worse with the next generations. Perhaps we are living in the end times predicted in Bible prophecy and if we are we haven't seen anything yet! People will die by the billions-there will be weeping and gnashing of teeth.
Keep an eye on the middle east and Israel. Plus watch Obama and his actions or lack thereof. He's an evil man elected by racist fools because of his race and not his qualifications.
At least we have an opportunity in Albuquerque and America to turn things around; we have to fundamentally change who we are and what we are about. But throughout history the only way to change mens hearts is with great suffering. And I am not a preacher; I am in the gutter with the rest of you. First point: Who in their right minds would want to be a cop in today's political atmosphere with the ACLU, NAACP, corrupt city administrators all throwing police officers under the bus. What is going on is not "accountability" but rather a political witch hunt that will back fire with the public losing protection.

Second point: The corrupt cesspool that is Albuquerque. I know there are a lot of people who think this is a wonderful city; however, your wonderful little town has a mayor who is out to enrich himself and his cronies; you have a CAO that is his cohort in these crimes; you have a police chief that is even more inept that the crooked fool he replaced; you have the DOJ doing as little as possible to clean up the mess; you have a city council that is inept and has turned a blind eye to the wrong doings of the mayor, the police administration, and the city attorney's office; you have attorneys that sit in judgment on administrative panels who owe their very livelihood to the city they are sitting in judgment on; you have a police union that will march to the tune whistled by former chief Schultz and is now working to defend the officers that shot Boyd to death on video yet; and you have district court judges that wouldn't understand case law if it hit them in the face.

Third point: Albuquerque, you deserve every negative comment made about you; you deserve and have earned the extremely poor reputation that you have across the nation; and I see nothing being done to change it. Any other chief worth his manhood would have told Perry to go ahead into the city council chambers and that they would be in after speaking with the media, but not this coward. I know chiefs that would have grabbed Perry by his neck, and put his fucking head through the drywall for talking to them like that, but not this fairy. It is clearly evident that Perry is calling the shots behind everything, and he is the one who should take the hit when the corruption here gets investigated. It would be nice to see Perry getting slapped around in prison Gpop having his pants pulled down, his meals taken and spunk stains all over his back just like he does to the city of Albuquerque.

Eden, if you were a man you would have sent Perry into that meeting through the wall after you shoved your resignation letter so far up his ass he choked on it. But that is asking you to have fortitude conviction, honor and two balls between your legs.

The journalists and reporters in Albuquerque are trying to do the right thing, and report the raw truth, but they are being shut down by unethical editors being directed to take out the damaging information that they know is true. Executives within the media are providing cover for Berry and his people. There are serious allegations being leveled that are constantly edited out to protect these people. Waltz over at the journal is just one of these Editors. Many are fed up at having their stories shut down or edited to protect criminal element within APD and city government. Whistleblowers are coming out of the woodwork in city government and the police department. The media is also urged to come forward to report the hiding and twisting of facts. Collusion of media and government is a crime. Report this to the NMAG's office.

LT shoots his own guy and still has a job. Officer beats his kid and still has a job. Officer provides sensitive information to one of her many "quickies" and is still on the job. Officer shoots dead guy in head with beanbag and is still on the job. Numerous officers including a major are engaged in affairs with subordinates and they continue to get promoted etc.. And it goes on and on....Officer makes a few comments on the EYE and her career is destroyed. NEWS FLASH......chiefs Schultz and Eden were called idiots because they are idiots. It's a shame that officers have to hide behind stealth or anon, but now you know why. It's better to violate rights or be the mayors bitch that to voice your opinion and try to change things.

It is a very sad day when the police chief of the Albuquerque police department along with other supervisors can get caught lying in a personnel board hearing in order to cover for that no bid crumby Taser deal where sub par cameras were bought at an over-inflated price just to protect a criminal administration, lead by liars and criminals, but an internet blog that exposes these vermin is vilified, and anyone rumored connected with it is attacked. It is a shame that malfeasants in high public office have absolutely no accountability to the point that they do whatever they want and always get away with it, but a blog is blamed for putting the department and city in disrepute. This place is totally backwards and upside down, and that is putting it lightly. Gordon Eden has a conversation with Matt Grub from KRQE and Rob Perry essentially says come on bitch, we have a meeting to go to, now shut up, and lets go. This is disgraceful. And these hypocrit liars take the moral high ground and claim transparency. What a bunch of liars. This city is filth and it permeates the entire state. So many people are behind the corruption that it is mind boggling. The media should take the gloves off and demolish these parasites and the government should step in and continue until every single one of them are prosecuted. If you think Ray Schultz is only responsibke for the $25,000 Taser overcharge and sime petty misdemeanors, you are out of your mind. He has lost the city more that $30,000,000 in civil cases and they have spent half of that defending his actions and covering for him while he was here and it continues. A handful of people are directly responsible for what has gone on here and Schultz is one of the main ones. He is still working down in Texas. Every singke other law enforcement officer under such an investigation would be on leave.

Just about every single person on the 5th floor has not followed orders in the past and look where they are. It is disgusting to hear daily about all the crap that goes on and the only ones that are held accountable are the beat cops. Why is it that SWAT officers never seem to have time to turn on their cameras? They arrive at a scene that is almost always secure and have the time to change into their stuff and get all gunned up but they can't turn on a lapel camera???? I call bullshit on that one. Jeremy Dear deserves to get his job back and everyone knows it, he is being targeted so other bad stuff isn't focused on at the present time. DISGUSTING.........

Does she really think that the magnitude of her unethical and criminal behavior is not known? Being directly involved in the Taser scam, then directly contriving schemes to cover for it. Even street corner criminals have the common sense to distance themselves from their crimes. There are how many city attorneys, but this liar has handled every single filthy case from Corvino, Doyle, Woolever, Vigil, Dear, Ellis, and countless others where she has made a mockery out of the court system. Any other lawyer who had done half of the crap this one has pulled would have been disbarred and charged with crimes. It is Government attorneys like this who have created the mistrust between citizens and city government.
