When Newspapers Fail

The Eye received the following as a guest posting in response to the Albuquerque Journal's unprecedented THREE story feature yesterday in support of the failed mayor of Albuquerque. We couldn't agree more with this writer:



In case there are any misunderstandings whether or not the Albuquerque journal (urinal)
editorial board, and those running that (for lack of a better description), perverse, yellow rag are
in cahoots with Mayor (for lack of another better word) Richard J. Berry, I am going to show that they are. We will show the disparity in reporting both sides of what is going on in Albuquerque, disregard for balance in reporting, intentional omissions of information, and facts that adversely affects their connections, and dealings with their close friends, aka Mayor Berry, in city government. I will outline the facts that show that a popular Albuquerque newspaper aligns itself time and time again with poor choices for political reasons, monetary reasons, vindictive reasons, and unethical reasons. Sometimes you are as good as thecompany you keep. Lets look at the Journal, and their company, those inside their company, and the ones who thought Albuquerque was a crowd when things started getting hot, and fled.

For the same reasons we do not like to give credence to perverts in the media, we will not post links to the Urinal articles, but we will reference their content, and illustrate how these articles manipulate public opinion for the benefit of Berry, by painting his critics as being disgruntled, or suffering from the effects of sour grapes, when they point out the undeniable facts of Berry's failure, while they praise Berry as he lies directly to your faces. Three articles were written on 1/17/16 about Mayor Berry, and the Albuquerque police department. One laid out a timeline, and the other two provided cover for the liar and accountability dodger, while painting him as the "better man" in a media perceived war over what he has done, and overseen being done to employees, and citizens during his malfeasant term in office. Make no mistake about it. The mayor and police chief have both stated publicly that Albuquerque is a mayor strong city. This means the mayor calls the shots, up until, of course, the time he needs to be distanced from the blunders, (Boyd shooting, Tasergate, Eden caught lying at personnel hearings, IPRA violation issues, APD manpower misrepresentations, FBI UCR crime stat manipulations, contract violations) then he sends in waves of information officers who bend information, and lie to the media and public. (Tanner Tixier: no such files exist, and Celina Espinosa when she said the elder gentleman can be seen reaching for something in a recent video where a K9 was released on him) Conveniently, Berry gets deniability through layers of cannon fodder between himself and the mistakes he has purveyed over until you, the public, get the truth, as in when back in March of 2014 during the Boyd protest down town, Eden attempted to make command decisions, and was told to sit down, and shut the F$&@ up by the mayor, and that the mayor was running things. The mayor knows of everything that has been done, and is complicit. The
difference is that YOU, the tax payer will fund the legion city attorneys to shield him from
accountability, and or pay to settle any case to keep him from exposure in any way. The Urinal
lauds this Mayor as "the better man" when he vetoed the DOJ resolution request to have the
DOJ enter the picture. Drug dealers on the corner would probably like to have the option to veto
police presence too. Lets not forget the e-mail sent out to supervisors, threatening employees not to talk to the DOJ by Gordon Eden.

The disgust meter goes up with the printing of article number two in our January 17th hat trick of
crap. This article discusses the rebuilding of the Albuquerque police department after former chief Raymond D. Schultz, Deputy Chief Paul Feist, Deputy then Chief Allen Banks, Deputy Chief Beth Paiz, former city attorney Kathryn Levy, resigned public safety director Darren White, CAO Robert Perry, and Mayor Berry destroyed the place by illegally breaching contracts, playing shell games with money, lying to the media, public and courts, bullied citizens employees and media executives, tampered with investigations, cases and witnesses, retaliated against citizens and employees, stole money earmarked as retention incentives to use as hush monies to keep the current command staff pacified, attacked families who were plaintiffs in wrongful death cases, ran smear campaigns against high value adversarial targets in the media in order to deflect attention away from themselves, politically preemptively, and maliciously attacked the District Attorney of Bernalillo county in order to take control of her office, and thwart prosecution of officers involved in the Boyd shooting, at a crucial time when they did not want the negative publicity while the DoJ was here. Lets not forget how they went after a popular district court judge, ruining his career, to deflect attention from their misconduct again, at a very key time in 2011, while Tasergate was developing on the drawing board, and the DoJ was looming. A fool could not see that these officials knew what they were doing, were actively conspiring to complete their initiative, and were doing anything they had to do in order to make sure they went undiscovered. The Albuquerque Urinal, and their perverted editorial board would have you believe Mayor Berry is absolutely clueless. We think not. I am sure no other officers
want to get shot by their Lieutenant, then get blamed by their command staff, and the city for getting shot. Maybe that has something to do with not wanting to work for APD?

Reading the aforementioned article, you can see Mayor Berry using the false reason, and excuse that employees retiring, and not returning is the reason for the high attrition. Employees retire to not work anymore. This is one reason why employees retire. We here at the Eye know for a fact that officers are retiring for other reasons. They are retiring, or RESIGNING, because the work atmosphere at the Albuquerque Police Department is atrocious, treacherous, and rife with retaliation, vindictive and criminal behavior, and childish attitudes, exhibited by high ranking police officials. The media knows this too, but they will not air it. They know that they will be thrown under the bus for mere workplace disagreements, or speaking out, just as former use of force instructor John Corvino was when he discovered that the department forged his name on a letter to the State Police Academy, and he spoke out about it. They are buying time to retire, and moving away. Berry wants to blame money, when he knows the reason is himself, the lunacy he enables, and the out of control, parasitic, lunatics running rampant on APD's 5th floor. No other reason. He also knows that he will not be held to task on his representation that money is the reason for declining APD manpower because he will be gone. Mayor Berry was the one who said Ray Schultz was the right man for the job, but he holds no responsibility for this mess because he is the "better man." I bet he is glad he said that. It is amusing how Berry
acknowledges the benign mistakes, like imposing college requirements on APD hires, but dodges reporters on the mistake of retaining Ray Schultz, and Kathryn Levy, who are now embroiled in Tasergate. As quick as the article praises Berry for being "the better man" and appearing to look past disagreements with critics within the police department, in the same breath, it shows how little he thinks of officers dedication, by blaming all of this on officer's greed. Berry's statements amount to pointing the finger at employee greed. That greed comes right back on him with what Schultz pulled, and the next article to be addressed. Berry says all of this because he knows that his term will be up before it is proven that money had nothing to do with any of this. Berry is only buying time, and making fools out of anyone stupid enough to fall for his lies. The manpower situation will not improve, because APD is notorious, and Berry owns that. Mike Gomez says “He’s like an ostrich in the sand. … He’s the master of deflection, that guy,” about Mayor Berry, and no truer words can be spoken. Misrepresentation, lying and claiming" being taken out of context" are Berry's greatest tools. It is amusing how Berry claims that Police reforms “did not start when the DOJ walked in the door." No they started when Berry heard they were about to kick down the door. Berry never wanted the light shined on Schultz's criminal enterprise, if not only just because it would sully his bid for the governor's office, and his actions proved it, starting when he vetoed city council's request. To top it all off, the comment of "The mayor “faced the investigation and the findings head-on, and has worked hard to pull together the funding and support to implement the improvements outlined in the consent decree,” "spewed by the CEO of the Greater Albuquerque Chamber of Commerce Terry Cole, Takes the cake for propaganda of the year award. Is there anyone not willing to whore themselves out in order to benefit politically in some way around here? This mayor has dodged every single hard topic, hid during every crisis, and continues to lie to the public daily, when he does poke his head out to take responsibility for any positive publicity that comes along. After all, a true leader
takes credit for everyone else's work. The Psychopaths at the Albuquerque Urinal couldn't have
picked a better picture to portray the Mayor in this article. Place two U.S. Marshals on either side of him, and everyone he's turned his back on behind him, and there you have it. 

And last, but not least is a gem in this trifecta of bull manure. It is written by the man of the hour himself, RJ Berry, and for the Urinal none the less. See if your opinion gets published in the Urinal. In this article is where the utter discredit will come for Mayor Berry. Berry made the fatal mistake of using one of the department's biggest failures in his hypocritical pining for his plan to try to have the Return to Work reinstated, in order to have rehires eligible to return to APD as officers again. Mayor Berry decided to use the now retired Lieutenant Les Brown as his poster boy for what as he says "By all accounts, APD Commander Les Brown is a good cop; so good in fact that he was just selected to be the Chief of Police in Wickenberg." The Eye would like to know by who's account? Who is the "all" here? Would it be Greg Brachle, who worked under Lieutenant Les Brown at APD SID? Would Brachle say such a thing after he emptied a magazine into a car containing two APD UC officers, striking both, and almost killing one, injuring him so bad that his life will never be the same. Would it be officer Jacob Grant, who was shot multiple times by Lieutenant Brachle? Would Jacob be saying this because Les was such a great cop, that he stood up for Detective Grant, instead of letting the city cover for Brachle? Les was such a great cop, because he was there for his officer? No. Because he wasn't. Les Brown was in charge of the biggest out of control portion of APD, SID; a unit rife with out of control individuals. One of these individuals was indicted for the shooting of homeless camper James Boyd. This same detective, Sandy was previously Giglioed in federal court. He was also the
detective involved in indicting judge Murdoch; a case we all know was tossed. This great cop stood by, and did nothing. What most do not know is that Les Brown was such a great cop that he was not promoted to commander, and had to sue for his rank. As a matter of fact, Les is such a stand up guy, that he entered a class action civil suit against the city, then caved in, and sold out a third party in the case when the city offered to promote him to make the lawsuit go away. Les looks out for number one. Seems he is a great guy too. Berry says Wickenberg, AZ is lucky to have Les, as would be any department in New Mexico, but this has been the trend of former high ranking members of APD when they retire, to move to another state because no department here will take them, unless you are former Commander Mike Grier who is one of the good guys, who is now the Chief of Rio Rancho PD, which, by the way, is right next to Albuquerque, and not having recruitment or crime issues. Lets look into this. You spend your whole life here, then retire with a hefty pension, and you have to leave the state to get another job. It seems like these "great prospects" are "running" instead of "leaving." They are going to places where nobody knows about them or APD. Schultz, Banks, Sailor, Archibeque, and the list goes on. There is nothing fortunate about allowing a cancer to spread. Nothing! The fortunate thing is that communities in this state know better than to hire one of these malfeasants. The current system is not driving these employees away. The fear of getting caught is. While Berry talks about the system forcing out experienced officers he just allowed one of the most
experienced officers, who was also a rehire, to be fired for doing his job, and running video on every contact, including oversight interviews, as he was ordered to do, just because former IRO Robin Hammer doesn't like him. Robin Hammer is friends with Robert Perry. Perry would like to see his friend Robin appointed to the Inspector General position. He would surely be able to call in owed favors then, and "soften" up a whole bunch of stuff for his buddies. 

There is one more thing the world needs to know about Berry's poster boy for great seeds of leadership being littered all over the Southwest. Jennifer Vega Brown was divorced coincidentally from Les Brown as Brown was going through a Bankruptcy, and just before getting her settlement for roughly $340,000 from a lawsuit she settled against BCSO, coincidentally protecting this money from any bankruptcy filings but they still live together. Berry is a liar. His return to work is just another pacifier to make the uneducated think he is doing something. When it fails, he will blame the next administration, like he blames the previous. I think at this point Berry's tenure with the city of Albuquerque can be summed up as burning down the barn while trying to close the doors, after the horses have long run out. He is a failure, and coward who only looks to blame everyone else, while dodging and delaying accountability, as he runs interference for the criminals who brought the city to the meltdown it is now in. Berry has operated alongside his minions, and underlings from a position of cover, while stacking the deck like nobody's business, yet they go silent, and hide as soon as they get called out. Maybe he can write an article here when one of his success stories lands a job as a chief in a city of the first class and he is taken seriously in Washington. 

And what do we say about kent walz, joe kirby, karen moses, don friedman, sharon hendrix, dan herrera, D'Val Westphal, and the rest of the yet to be named responsible parties over at the Urinal, that have been lying to the public for years? Use their rag for your chicken coops, and puppy or parrot cages. That is all it is good for. Because, when you have a bunch of immature brats in the positions these people occupy, the best thing to do is take their audience away when they insult your intelligence. Read the Albuquerque Free Press instead. 

Life is too short for sociopathic journalists, with personal agendas, who take out their frustrations on citizens and those that criticize them, and engage in retaliatory, vindictive reporting, while colluding with city government, and contributing to the decay of ethical and honorable values in society.

Glad to see that Geier is still playing his con game with most of APD. There's a reason he was promoted but keeping thinking he is great, he lies as much as they all do. Brown just ran SID into the ground as usual and Garcia let him. All of the 5th floor need to retire if the LOVE APD and let new blood get in there. UNM is coming down thanks to Kevin no one likes him didn't take him long to bring down a good small department.

I have to admit, I'm not a political person, so when I've read past articles about Berry and the journal, I just read though it and moved on. But this latest series has shed light on what I have read. I've never seen a more one sided series as the ones written. It is so obvious now that Berry has had a voice in what was written in that article. What a crock. So many lies. And as for the les brown reference.....if that is the best example the mayor could come up with, then it shows how screwed up The APD culture really is.

6:26..... I agree the 5th floor needs to go. But who are the "new blood" that you are referring too. All of the commanders were hand selected by the mayor. All feel a loyalty and refuse to stand up when things are wrong. As for out LTs, who are you going to promote that doesn't have baggage? Aragon, Jordan, Campbell, Garcia, st onge..on and on.............there's numerous people wearing gold bars that belong in a brothel not in a position of leadership. Young or old. You can go to the main/Fac and watch a bunch of rehires sitting around reading the paper all day or pass by the NW sub in the early morning and watch 7 officers in the gym sleeping. The negative culture goes too far down the ranks. The only way to change is to completely swap out everyone commander and above with outsiders. And I don't mean outsiders like Tyler, I mean people out of state with no political connections. But with the union and politics, it will never happen. So be prepared to struggle with APDs issues for the next 20 years if not longer.

The failures at APD will attack anyone who accomplishes something on their own merit unlike them. What a bunch of pukes. The frat mentality true colors come out as soon as the duscussion leads to somebody doing something positive on their own merit because everybody here knows merit has nothing to do with getting anywhere in APD. If it did, Gonterman, Brown, Garcia, Brachle, Peck, Sanchez, Roseman and Stephenson would not even be officers. APD, where the filth rises to the top. Lying, brutalizing intoxicated homeless people, bullying subordinates, halitosis, defrauding money lenders, fucking in city office buildings on duty, shooting your fellow officer 8 times, spying on citizens, perjury, photographing subordinates breasts and sharing the photos with everyone, ass kissing, and domestic disputes get you everywhere here! APD is a great place to work isn't it, Berry, People are too smart to come here to work for a bunch of lowlife criminals and perverts who will destroy their careers the minute they get their felings hurt. Your command staff are filth and everyone knows it. Albuquerque Police department recruiting can't even cover up what is getting out with the snowjobs they are trying to pull on people to get them here. Everyone knows. #APDNotorious

Eye- Your assumption that Geier walks on water is refuted by the officers in Rio Rancho who have quickly learned that he in fact does not walk on water and simply wants to turn Rio Rancho PD into a mini APD. He inherited a great department that he now has turned inside out with internal hate and discontent, low moral and the hurry up and retire attitude found with most of the men and women of the Albuquerque Police Department.

Rumor is,,,,,Eden just promoted a guy to Commander that doesn't have a degree. If this is true, how do you explain to the hundreds of great people who wanted to serve their community but didn't have the required college, that they aren't good enough but if your one of the good old boys you are. I don't know if having a degree is a requirement for promotion to area commander but if not then why did the mayor allow the ranks to dwindle while he preached the importance of an education. If the people the mayor promotes do not need an education to make $120,000 + a year then neither should his officers.

10:25. The idea that Geier inherited a great department in RIo Rancho is crap. I retired from rio and can tell you from experience that they are lucky the media has it's hands full with APD. Rio has been jacked from the get go, in fact don't you still have some officers that APD fired.specifically one who was firing their gun while drunk. So to 10:25, stop,jumping on the band wagon of anti-APD idiots and worry about your self. In a dept as small as RRPD if you have hate and discontent, then it has to come from the ranks, not the chief.

I understand that if all the journal did was report the negative things about APD, they could do a full papers worth 365 days a year. But they want to stay neutral and report the facts, then they have been doing a piss poor job. Interviewing Berry and having him give the same old crap excuses is lame. Berry using Leslie Brown as an example of "great" APD leadership is disgusting, and Berry continuing to blame the shrinking ranks on PERA is getting old real quick. The journal editors need to start doing their jobs and look into the facts of what they are reporting. Do a quick background on Brown and you'll see he was garbage. Look into SID under his leadership and you'll see all the lives destroyed......the only fact seen with APD hiring Tyler and Arizona hiring Brown is that no one does backgrounds anymore.

The Albuquerque Journal needs to start printing on yellow paper.

Did you hear what a citizen did at the Personnel Board last week? Holy Shit!!!! Where is Fred Mower, the APOA, the urinal, KOB, KOAT or KRQE?

On 1-13-16 this citizen verbally addressed, on camera, the Personnel Board with this statement...

On September 5th 2012, in an effort to secure the independence of the Personnel Hearing Officers - tasked with adjudicating personnel hearings—, from any perception of political influence by the Executive or Legislative branches of City government, the City Council replaced the Independent Office of Hearings Ordinance with ordinance O-2012-024 - cited as — the ‘IHO Ordinance’. (IHO = Independent Hearing Officer/Personnel Hearing Officer) I’ve marked a copy of the IHO Ordinance, for your convenience, as Exhibit #1.

As you can see, in section 5 of the ordinance titled “Selection," starting on page 2 line 29 thru page 3 line 7, and I paraphrase here, it explains that the Mayor will select the hearing officers that adjudicate personnel hearings and that these officers will not be classified as city employees, but as contractors. It also explains that the Mayor may only retain — or contract with — these individuals after obtaining the approval of the City Council. Evidence of this requirement can be seen, in what I have marked here as Exhibit #2, that shows an Executive Communication (EC-12-258, dated October 25th, 2012) from the Mayor to the City Council President - Trudy Jones at that time — and approved by the City Council, after a majority vote, on November 19th, 2102. With this approval, contractors Patrick Bingham, Willard Davis, Jr., Barbara Albin and Rita Siegel where retained for 2 year terms with a stipulation that the contracts may not be extended.

It is my understanding that the process for the approval of an Executive Communication (EC) from the Mayor to the Council begins with the EC being publicly posted in the Council President’s Minutes where it will be notated as to which Council subcommittee, such as the Finance & Government Operations Committee, it will be assigned before it is presented to the City Council as a whole for discussion, where the public may comment, before it is voted upon.

On September 1st 2015, the Mayor entered into new contracts with Patrick Bingham, Willard Davis, Jr., Barbara Albin, Rita Siegel and Judith Durzo, I’ve marked these as Exhibit #3, where these individuals where retained for 1 year terms. You will note, I’ve marked as Exhibit #4, that these contracts, or agreements, all carry the stipulation that approval is required and “shall not become effective or binding until approved by the highest approval authority of the City required under this agreement and all required signatures are obtained”.

I, as Ms. Apodaca can attest to, have been attempting to obtain a copy of the Mayor’s, approved by the Council, Executive Communication for these new contracts. I have contacted the City Clerk’s office several times, without any luck, and Ms. Apodaca, eventually, referred me to a Ms. Ortiz at the Mayor’s office. Ms. Ortiz, nor anyone else at the Mayor’s office, where able to produce the Mayor’s EC and I was finally directed to a Ms. Bradley, who is an Assistant City Attorney assigned to the City’s Purchasing Division, and she admits in our email correspondence, I’ve marked here as Exhibit #5, on December 18th 2015, that no such Executive Communication exists and “we are currently in the process of securing approval from the Council”. To date, this EC has not appeared in the Council President’s Minutes, meaning the approval process is not “in process” as Attorney Bradley proclaimed it was.

Furthermore, the above mentioned, five Independent Hearing Officers are conducting hearings under these, yet to be approved, contracts as evidenced by what I have marked here as Exhibit #6.

In summary, and I’m not a lawyer, but I believe, based on these facts, this board should halt all recent and current personnel hearings and investigate their legitimacy. And being that all five of the aforementioned individuals are licensed New Mexico Attorneys, and should be fully aware of their requirements to abide by all Federal, State and Local Laws - which a City Ordinance is - I believe they should be barred, forever, from any involvement with the City’s Personnel Board.

Update 1-16-16
No Request For Proposal (RFP) for contractor proposals or Executive Communication (EC) for the Council’s required approval where produced by the Mayor to establish the lawful due process operations of the aforementioned four (2012) contractors between the dates of Oct 25th 2014 and August 31st 2015. (It was during this time several controversial - News Cameras Barred from Public Hearings - hearings where held. Including the overturning of Independent Hearing Officer Patrick Bingham’s recommendation that APD Officer, Jeremey Dear, be terminated.)

The Council President’s Minutes for introduction on 1-20-16 show an Executive Communication EC 16-28 (Notated to be sent to the Finance & Government Operations Committee ) asking for Council approval of the aforementioned five (2015) contractees, but inexplicably it calls for two year, and not a one year, contract terms, reverses the ‘no extension clause’ and makes misrepresentations by omission by not mentioning that the 2015 contracts are already operational without the lawfully required (employee’s due process) Council’s approval.

Update 1-17-16
It has come to my attention that the Mayor, CAO, City Clerk, Office of Administrative Hearings, City Council, City Finance/Purchasing Department and the Personnel Board itself appear to be in violation of stipulations laid out in a 2005 2nd Judicial Court Order/Settlement Agreement (CV 2003-2115) since Oct 2014. Those stipulations include, but are not limited to, the disallowance of the hearing officers to be “retained” in excess of two years without being subjected to a new selection process and being subject to all applicable ordinances, rules and policies.

It seems that the so-called "independent personnel hearing officers" are not so independent, eh?! What do you expect in a corrupt cesspool like Albuquerque? If you mention Albuquerque in conversation to anyone outside the state of New Mexico, the reaction is ALWAYS the same, people shake their heads, say something to the effect of how awful it is and how bad crime is there. Great reputation, Albuquerque, you all should feel very proud that your city is seen as a crime-ridden hell hole by plain old folks around the nation! This is a little off subject, but did you notice what Hillary Clinton said during Saturday's debate? She stated "something must be done about the systemic racism in our nation's criminal justice system." How does that make all you cops, prosecutors, and judges feel? Every personnel board hearing for the last 5 years has been illegal.
There are numerous contractual and intentional illegalities that are going to be coming out really soon with the class action lawsuit being launched against the board and Berry personally in a few months. 20 employees will be seeking relief from actions that will trigger indictments when this one lands. You want to talk about the disparity in how employees are treated at APD?
Former Sgt. Tommy Henderson cut a deal at his hearing yesterday with the city, after he was fired for timesheet fraud. The entire thing was kept hush hush because Tommy was Ray's snitch inside the union, and Henderson was allowed to resign with no prosecution, and no action sent to the NMLEA board to take his certification. How does that feel fellas? You have cops getting jackpotted, and shit on where the department commits felonies to bury them for doing their jobs, and this slug skates, and gets covered for so he can be a termite in some other department. This clown should have been prosecuted for embezzlement. The entire country knows that the Albuquerque Police Department is the department where you can be a lying, thieving, rat bastard, and you can even shoot your fellow officer, but they will ruin the cop out there doing their job, rather than punish the filth. All the accusations of back room deals concerning Fred Mowrer are 100% spot on. People are getting stabbed in the backs to get contracts through, and to protect others while others get paid.

Rio Rancho cops are worthless, self-serving pieces of shit in which their sole purpose is to harass the public instead of actual policing. They must be APD rejects. The superblitz motorcycle traffic units are out of fucking control on 528 and on Unser with radar and speed vans at every block. Now you see an influx of speeders and road rage on every other damn street that are trying to dodge Ponch and John. DWI Units stake out patrons leaving Fat Squirrel, O'Hares and other alcohol establishments which we all know is illegal, causing a backlog of probable cause issues at metro and district court. Every RR cop I come across has a shithole personality and a holy'er than thou attitude that really tarnishes the PD and the rest of us officers. RRPD is on the fast track to join the APD hatred club. Criminals are flocking to RR as bad as Albuquerque, they aren't the least bit scared to tango with cops and all know the city attorney/metropolitan court is a fucking joke. Obviously RRPD doesn't have their shit together either, since cops are getting shot, cases are tossed, politics rule the day, and crime is on the rise. Rio Rancho can also thank Berry for enabling the spread of crime to the surrounding communities. When Albuquerque goes to shit, so do the other metro areas. Rio Rancho leadership will eventually learn that their shithead cops and political bullshit will place themselves in the same turmoil as Albuquerque.

It's becoming clear that President Hernandez and Sean Willowby orchestrated a move to put officers in administrative danger by blowing up protections that have been in place for years. I'd like to know how they legally tied in the settlement with the contract, this was a grave error and the membership should have known. Can someone tell us if we have a class action lawsuit against willowby or the Apoa? The Sgts. and the Lt's need to start a new group. The supreme court is preparing to get rid of forced dues to non-members, this should give us an opportunity to make a move. Just because I was promoted after 8 years doesn't mean I have to send my whole career being screwed by willowby and mowrer.

In looking at those who are dues payers versus fair share it appears that the majority of the bargaining unit shows there clearly is not amajority support and a petition should be filed to the mayor asking them to review the majority status required. See below as per the labor ordinance:

(H) The decertification of any employee organization which has been recognized as the exclusive bargaining representative of employees in an appropriate bargaining unit may be affected by the filing of a written request for decertification supported by either a showing that 30% of the employees in the bargaining unit seek to have a decertification election, or a statement by the city government that it harbors a good-faith doubt that the exclusive bargaining representative has the support of the majority of the employees in the bargaining unit. If, in the opinion of the Board, the showing of interest in support of
such a petition is sufficient, or in the case of a petition filed by the city government, there is objective evidence to support a good-faith doubt as to the majority status of the exclusive bargaining agent, the Board shall call and hold a decertification election within 45 days from the date of the receipt of the request. If a majority of the city employees in
the bargaining unit vote in favor of decertification of an employee organization, the Mayor shall decertify that employee organization as the exclusive bargaining representative for the bargaining unit.

If my memory serves me correctly, APD was served by the FOP in the past and same things that are occurring happened back then as far as alleged corruption in that union. That's when it was changed to an Association. Same problem then as now as far as apathy from rank and file. You all moan and groan about the union but only after things have gotten out of hand. Again YOU are the Union not just the leadership. Attend meetings regularly not just at contract voting ! You have a voice, use it at meetings or shut up and sit down. A national union has its merits but not if you sit on the sidelines and let someone else do everything. You will end up with the same results as now. Learn from the past.....

The APOA has NOT stood behind the GRANT family. Just read the lawsuit. If the APOA had done its job then the GRANT family would not have sued the CITY who is fighting the lawsuit. The CITY also PAYS for BRACHLE's lawyer to fight the lawsuit.
