Official Complainant Steps Forward against Improprieties in the APOA

Below is an open letter from (Ret.) Senior Sergeant Paul Heh. Chief Schultz had boasted there was no complainant in the alleged improprieties at the police union (APOA). Now the Chief has an official complainant. What will the City's Police Chief do now?

April 28, 2012

Raymond D. Schultz
Chief of Police
Albuquerque Police Department
400 Roma NW
Albuquerque, NM 87102

RE: Suspicion of embezzlement of APOA police union dues
monies paid.

Dear Chief Schultz,

Please accept this letter as formal notice of my complaint
regarding the suspected embezzlement of personally paid
dues and funds to the Albuquerque Police Officer’s
Association.

Recently a publicized email sent by lawyer Fred Mowrer to
the executive board of the Albuquerque Police Officer’s
Association (APOA) raised issues concerning accounting of
member paid dues monies. Specifically Mr. Mowrer stated
that “steps need to be taken immediately to address
financial matters I raised.” Mr. Mowrer made this
assertion in the context of the expenditure of over
$250,000 of union member paid monies for salaries to then
APOA President Joey Sigala, Vice-President Felipe Garcia,
and Mr. Ron Olivas.

I found this revelation shocking as I am unaware of any
occasion where executive leaders of the APOA collected
additional forms of compensation drawn from union member
paid dues in addition to what they are paid by the city.
From 1987 and on through to my retirement in September
2011, I was a full member of the APOA. In addition to my
bi-weekly dues payment of $17.00, there was an
undetermined period where members, like myself, paid an
additional bi-weekly payment of $10.00. Like myself, most
members did not provide any consent for our funds to be
used to pay any additional salaries for Mr. Sigala, Mr.
Garcia, or Mr. Olivas. Nor did we ever grant those
individuals permission to spend our money on personal
items, dining, or other unapproved expenses.

Mr. Mowrer’s assertion is not entirely surprising as
unexplained expenditures of APOA funds were also addressed
in the Spring of 2008. In April of 2008, APOA credit card
statements were publicized and it appeared a significant
amount of funds were being spent on dining and convenience
items. Over a four-month period almost $10,000.00 was
spent on dining alone. I raised objections to the
expenditures and found my questions persistently delayed
or unanswered. Executive board members have a fiduciary
duty to account for and protect the funds they are
entrusted with. Under the current circumstances it seems
a significant amount of funds were neither protected nor
accounted for.

As I was a dues paying member during the time much of the
questioned funds were spent and because I still maintain a
claim of benefit should the APOA succeed in its pending
litigation I undeniably have standing in this matter.
Under New Mexico state law, NMSA 30-16-8, embezzlement is
defined as the conversion to a person's own use anything
of value, with which the person has been entrusted, with
fraudulent intent to deprive the owner thereof. As an
experienced and veteran law enforcement officer, I am
troubled by these many revelations and want to ensure all
members of standing, like myself, have not been
victimized. I demand the commencement of a full
investigation into Mr. Sigala, Mr. Garcia, and Mr. Olivas’
unauthorized personal spending of APOA funds. Because the
APOA received public monies from the city in addition to
private contributions it seems that this is a matter best
addressed by the Office of the State Auditor of New
Mexico.

The Albuquerque Police Department and the Albuquerque
Police Officer’s Association are both facing unprecedented
challenges of confidence by the public. Confidence lost
is only restored by taking responsibility of our own
actions and in this matter it begins with an honest
examination of the hundreds of thousands of dollars paid,
and seemingly unaccounted for, to the APOA. While I make
no accusations towards anybody or any persons in
particular, an independent and objective investigation
into the APOA’s management of funds appears fully
warranted.

I would be happy to discuss this matter further and can be
reached at 505-xxx-xxxx.

Sincerely,

Paul Heh
Sergeant (ret.)

Now what joey boy flipper and olivia? Now what you three back stabbing cowards. It seems like there HAS to be an investigation NOW. We'll see who's smirking at the substation now! Embezzlement carries heavy prison sentences. Everyone will be talking soon.
Beter retire soon bigman, so you can save that fat pension you got on the backs of all your officers.

Good job Heh. Continue to not only be a thorn in these scum bags sides, but be their total demise. They all need to go to prison!

Alright Shultz-it looks like you got your complaint like you asked for! Now, are you gonna step up or are you gonna publically say you didnt know anything about your agreement to start an investigation after a public complaint has been lodged-like you normally do!! While your at it, maybe one could be started against you for corruption, intimidation, conspiracy, and accessory after the fact. Good riddance you POS!

This link takes you to Gov TV for the City of Albuquerque. Scroll down and play the City Council Committee of the Whole Meeting for April 26, 2012. At 1:33:00 Councilor Dan Lewis starts his questioning of Chief Schultz regarding the APOA missing money.

Great job Paul Heh! Nice to see we still have officers who will stand up and demand public accountability of our police.

And to Schultz's comments about not being able to act on stuff you read in the newspaper or blogs????? What the heck is he talking about? Many times we investigate crimes based upon comments made on Facebook etc. Hell Schultz orders investigations of his own officers based upon Facebook and Twitter comments. Just last week APD did a search warrant and started an investigation based upon media reports of crimes committed by the City Hearing officer. Had it not been for a media report Jerome Block Jr would still be on the NM PRC.

So Schultz should just save us all the lies and just resign already. He is trying to protect Joey et al and now Paul Heh has forced him into a corner. I hope the media jumps all over this story. This investigation should have begun back in February when Mower exposed everything. Now the main targets have had three months to destroy the evidence. And Schultz did nothing.

You know, you can't say Hey doesn't do what he says and says what he does. While I can already hear those whining snivveling lurkers getting ready to go "oh but he supported Berry" to them I say Get Over it. Good for you Paul and hopefully good for all of us.

How was this letter sent? By mail? Hand delivery? Who's to say Schultz received this?

I'm certainly no supporter of Schultz but just because you post a letter up here doesn't mean he received it. Where's the proof?

Give proof and facts to back up your stories. They will certainly hold a lot more weight with people if you do. You are on the right track, but your stories need to be more solid than just so and so said this.

Credibility is the key word.

Well, Whooooops A Daisey!!!!!!
Seems that every time the chief opens his fat flappy flabby mouth, he sticks his foot in it. Everyone heard the city council meeting. We all know what was said. Paul Heh along with every single member of the APOA is a complainani or possoble complainant. You don't have to know that you are a victim at the time a crime is committed to be a victim. That union president Sigala asked for an increas in dues for the legal battle concerning the police labor contract and many other illegal labor practices, And that little punk spends that kind of money on meals?!?! Are you kidding me? One thing the letter did not mention was the disproportionate amount of money paid to that coward of an ex union president's wife for the short amount on non work performed.
The pool table, and all teh other crap these assholes did with the BLOOD money they took. These arogant little punks want to go around saying they resigned because of that bullshit bounty allegation?!?!? Yea Right! Everyone knows why these two miscreants resigned.

All of this kind of makes you wonder if this was a conspiracy to defraud from the beginning. Did all the individuals in this conspire from the beginning to increase the dues to fatten their pot?

Then, all of the sudden there is two company men at the head of trhe union and teh vote for an investigation gets shelved. I don't think so. If one of these creeps even so much as bought a twinkie with a penny of my contributions, they are going to jail.

If the media doesn't run with this, we now know not only are these creeps and the administration aka pseudo quasi leadership corrupt, but the producers and journalists are just as rotten.

They are all trying to protect eachother because when the first one falls that will be the one cutting the deal to put the rest of these malfeasants behind bars. Obstructing, tampering, lying, perjury, and conspiracy.

Something tells me everyone is scattering for a reason. You can retire but you can't run from a subpoena and when you are retired, you aren't getting paid to have your worthless ass in federal court as a defendant.

I'm gonna go out on a limb and say that Ray's next move will be to state that he (the department) needs an actual 'victim' and a 'criminal complaint' to proceed with an investigation. I'm gonna bet that he handles Paul's 'letter of complaint' the same way he would handle the 'complaint' about a barking dog. What a douche.

I dont answer anonymous comments, however just this one time to where is the proof. I mailed the letter to Chief Schultz at 1126hrs. certified return at the Post Office. This is just my first step in helping the great officers at A.P.D. ,who derserve much better. My hope is an investigation will show nothing was done wrong and this dark cloud will be lifted from The A.P.O.A.. On the other hand if an investigation shows criminal wrong doing then thoes responsible must be held responsible for their actions. I continue to say I do not accuse anyone of any wrong doing, let an investigation show the proof one way or the other. It is most important to me that the great Officers at A.P.D have the public confidence restored in them, and that thoes Officers have confidence restored in themselves. I will always be one of you. I know you and I know your quality as the highest of any police department in the world. I can not sit back and watch you be beat up any longer. Someone must act. That someone will be me.

I love that after all the years of being a burr under Ray Ray's saddle, Paul Heh retires and continues to be a burr! Way to go! But don't hold your breath, Ray Ray will drag his feet as long as he can before he rides off to collect his multiple retirements and leave the next chief holding the bag for all of his poor oversight.

The city attorney, the administration of APD, The CAO and teh Mayor are all conspirators against justice. What a snake pit Albuquerque has become.

Anonymous said...

Kudos to the district court judge who saw through the city's unwarranted attack on a fair, well respected arbitrator, and labor relations mediator today. Justice and belief in the TRUTH was served. Today proved that the city's corrupt reach does not extend past it's own sphere of control. Once the playing field is leveled, such as in cases reaching DISTRICT COURT and FEDERAL COURT with false allegations, THE BUCK STOPS! Congrats Mr. Reeves on proving your integrity. It is a shame that you even had to (we all know better), when you were attacked by so many beneath you, who couldn't hold a candle to your accomplishments, or level of integrity. In fact, your attackers have none! God Bless you Sir!
I am sorry you have to deal with this nonsense. Onward and upward!

Pack your bags rats. City council is right. The leadership is corroded. Another win in dist. court today. That arbitrator should run for Mayor. He has more credentials than the city attorney, mayor,CAO,chief and all of their support personnel combined. The city attorney makes the criminals look like strait shooting saints. What have we when we have the enemy within? How is a department or city supposed to function with people in place who stoop to low life tactics, attack reputations, and try to destroy someone just to support their purposes? It is a disgrace. The mayor is asleep at the helm and he needs to take his cabinet of crooks with him when he gets booted out of office!

If the scarecrow from the Wizzard of Ozz had a son, he would look like the Mayor.

If Cindy Lauper and Lou Albano had a son he would look like the City Attorney.

If Uncle Fester and IT had a son, he would look like the CAO.

If Newt Gingrich had a son, he would look like the chief.

If a smurf, dust mop and a three headed snake had a son, it would look like the three DCOPS.

I hear Ringling Brothers

He can never deal with issues with the strait up truth. But...fact is the chief stated to city council that he would place the accused on admin. and serve a warrant on the APOA seizing the books. Well, I guess we will see just how much crap he was talking because that letter sure sounds like a formal complaint.

Ray Shultz is the most passive and vindictive police chief ever of APD. No leading from the front, just hiding behind and whispering venomous thoughts. He was always a wuss when he was, briefly, a street cop and was always took the non-confrontational route. He will do everything he can to avoid confrontation with Paul Heh, who has more backbone and more guts even in retirement than Schultz ever had.

Anonymous said...

This goes to show you how the public and the police department don't trust Schultz. He did nothing when Fred Mower reported this. Thereby leaving evidence in the hands of possible suspects. Why? After months of doing nothing and the APOA blocking all attempts to have a formal audit done, Schultz goofs and makes a stupid statement to the city council. Apparently news reports about Jerome Block were enough for the AG to open an investigation, but not enough for Ray. No wonder the public and the officers don't trust the upper command at APD. Coverup. So now Ray you have a formal complaint, will you do what you promised the city council? Will you immediately request an outside agency to investigate? Will you ask this agency to secure all evidence immediately? Or will you try to back pedal and not do anything, thereby making sure that you are remembered as the chief who destroyed APD.

Nothing came out of your ignorant complaints then and nothing will come out of them now! How manny of you were professionally represented by Ron over the past 16-17 years of his Union involvement? Though most of you have short memories, where are you now?
Think for yourselves... Don't jump on this negative unconfirmed crusade. Ask questions and bring them to the right people!

The crooked city wrongfully terminates a well respected arbitrator after they lose two hearings against him so that they can stack the cards in their favor in further hearings. These corrupt officials are going to start a legal war at the expense of the tax paying citizens. Every citizen should know that vindictive city officials are using tax payers money to fund illegal vendettas that they will have to settle out further down the line with millions of tax dollars. They are doing this to attempt to preserve their hides till they are out of office and long gone. This city will be paying for the actions of these criminals for decades after they are long gone with their pockets full. Every citizen in this city should march on city council for the next meeting to call for the firing of the city attorney and the chief administrating officer.

The city aka Perry just fired Arbitrator Reeves. They lost two hearings, and arrogantly, blatantly and wrongfully terminated that man because he called them on their violations of officers and employees rights. These city administrators and lawyers think they are above the law. They think they can do whatever they want.
THIS IS WHAT CORRUPT INDIVIDUALS DO! They sabotage everyone around them that calls them out. They RETALIATE HARRASS AND VIOLATE RIGHTS. Perry has the audacity to say that he wants fairness and does not want to stack the deck, YET a Deputy Chief LIES under oath at the same arbitration that is the point of this controversy and nothing is done about THAT!!!!!!!!
What the hell is going on here. Is this the philosophy of teh Albuquerque Police Department and the City Attorney's office???? It is ok to lie against people to get the result you want! It seems Perry condones Any means to get the predetermined ends.

Do these liars keep track of what comes out of their mouths?
They are all corrupt. You can't fabricate evidence that isn't there, so you will still lose every dirty case you have framed on people.

I don't know what that clown is talking about, waiting four years to become a complainant. This information has just come out. Maybe the union should stop being a bunch of coverup pantywastes, and do the damn audit. It seems to everyone when you delay, put off, dodge and make excuses for something, you are afraid of the outcome. If those guys are so great, why did they resign when all of this is going on? In my eyes that is cowardice. You don't resign unless something is wrong.
If there is nothing to hide, hand the books, credit card and bank statements and payroll records over. Pretty easy, isn't it? I will promise you that Paul will not be the only person coming forward.

Anonymous said...

HMMMMMMMM Schultz agrees to open an investigation, but instead of doing what he promised the city council, he announces that APD officers will do the preliminary investigation into possible wrongdoing at the APOA. HUH?

Since when do we investigate ourselves? WE DON'T! Why isn't Schultz giving this to the BCSO and letting them figure it all out? This makes no sense. APD members are at minimum fair share members of the APOA. So by having APD detectives investigate you are tainting the entire investigation. These detectives may be suspects or they may be offenders, this is why you have an outside agency investigate.

So why is Schultz doing this? I can't figure this out. This is about Trust, Truth and Transparency. Right now APD is lacking all three at the Chief level.

If you don't like your Union...why don't you follow the NLRB process of decertifying them? How is it the city administration's fault? You think they like the union? They would be perfectly happy if you voted APOA out. It's in your hands as members...use your rights. Public sector unions are a sham and this only proves that out. Get rid of the union!

Anonymous said...

There's a reason all the cops are being REQUIRED to wear body cameras and to record all citizen contacts.....it's because there's very little trust in APD anymore. Even the chief doesnt' trust us.

Regarding Weber's statement about Olivas...while I guess it might be true that as an employee of the APOA (still trying to figure that out) he may not have been entrusted with anything of value, he was entrusted with all of our money when he was president. Don't think this isnt going to go back to when he was president then.

Jerome Block's issues began with a friggn snack bought at a gas station...don't think we don't know where this is going. And given that NOTHING has been done since Mower's Feb 21 letter, don't think there's not gonna be enough to go around with tampering with evidence charges.....

Todays artcle says Olivas will help with the audit....huh?

What a joke this place is! A person who leaked information on an FBI investigation is trusted?!?!? HE's going to help with an investigation?!?!
I guess everyone but the prosecutor will know the facts of the case before the investigation is over. Heard the Chief assigned his boys to the investigation too. This place gets more and more unbelievably twisted every day. Is this administration tripping on acid? I am sorry, but a federal government agency needs to step in now and crush these criminals. It's about time their ability to cover up investigations, and direct those investigations into a direction they desire is taken away. This blatant criminal behavior is out of control.

Albuquerque Journal March 21, 2012,

"The Journal has confirmed that APOA members voted last week to hire an outside firm (as of May this has still not happened) to audit union's finances for the past two years ..... The moves followed revelations at Thursday's APOA meeting from Union President Joey Sigala tha the and Vice President Felipe Garcia have paid themselves more in salary from union dues than they previously acknowledged publicly, and that Sigala's wife was paid about $6,000 for working special projects and filling in as a temporary administrative secretary."

"Andolina confirmed that Sigala and Garcia said during the meeting that they had paid themselves about $36,000 and $28,000, respectively, in dues funded salaries last year. Sigala last month told the Journal he receives about $26,000 annually for union work- on top of his $52,374 APD salary - and Garcia makes $19,500 a year plus his city salary, which is the same as Sigala's."

Go read this at the Journal for yourself, but it appears to me that Sigala all but confessed to embezzling around $10,000 of our dollars and the same for Garcia. Why it has taken Councilor Dan Lewis to put Schultz on the spot, months after this was all reported in the media, I can't figure out.

Why is Schultz still dancing around by having his own detectives start the investigation? And what about the rumors of missing money from when Pete Dywer was APOA president? He also had to step down and Schultz gave him a inside position, until Pete's mouth got out of hand. If there are criminal charges to be filed will anyone address why Schultz has dragged his feet on all of this?

Trust,Truth, and Transparency sorely missing at APD right now.

In reference to May 2,10:54PM.

It is not fear, it is terrorism that officers face for doing what is right. Whether it is blowing the whistle on harrassment or exposing corruption, the Albuquerque Police Department is a unique organization. It has survived an era where most departments changed, and became more transparent by creating the illusion of said change but never facilitating it from the level of Deputy Chief to the Chief himself. In fact, these failed leaders use their officers as public sacrificial dissection displays to draw attention from their wrong doings and misdeeds.

The people of Albuquerque need to know that the so called leadership, their attorneys and their cohorts in city hall will stop at nothing to protect their interests. They will spend any amount of tax payer dollars to do it too. Time and time again they make short sighted decisions to wrongfully act in order to facilitate results in their direction. Case in point, the firing of arbitrator Reeves. The city lost miserably two hearings that they initiated against Mr. Reeves, using slanderous and unbased allegations. That arbitrator sides with the city on a majority of his heard cases, but not the one the city wanted him to side with them on. The city knows that he set the bar on wrongfully terminated police employee cases, and that their reasons for firing officers will not hold up. They think they will prevent any further reinstatements by stacking the deck in their favor. They are wrong. They wanted to remove him. They were told no by judges and they did what they always did. They disobeyed court decisions, violated rights and did what they wanted to anyway. They know that they violated a contract and they will lose. What will they do? They will just pay out the contract to make the lawsuit for breach of it go away. This should infuriate taxpayers because THEY will now pay for work that was not performed because of the city attorney's Chief's and CAO's personal political interests. They do what they want and pay their way out of it with YOUR MONEY!
They do the same with officers.

Brad Ahrensfield's situation started out with him doing the right thing; telling the objective truth of how an incident could occur during a homicide trial. A fair investigator and prosecutor should want to know all possibilities of an incident, whether exonerating or damning. No details or avenues should be hidden or omitted. Not a case that Schultz wants prosecuted though. BRAD WAS RETALIATED AGAINST FOR THAT. FOR BEING FAIR AND DOING THE RIGHT THING. That's where Brads trouble began. Just ask a recently retired DCOP. Would you want to be in Brad's shoes? Camacho was retaliated against by the charges alone, because he spoke out about wrongdoing. Here you have a retaliation within a retaliation. Compounded retaliation involving one constant key factor. The chief of police.

This is why officers are afraid to stand up for anything at APD. They will hang a whistleblower, yet the ones who perpetuate that terrorism act like they are doing the right thing, cleaning up the department, backing the officers, being fair. That is the furthest thing from the truth.

So you tell me, who wants to be framed for murder, fired for doing the right thing, have your career dead ended because you spoke out, lied on for arresting a wanted murder suspect at a time when these corrupt failures need scapegoats for their misdeeds, and have your family exposed to losing everything and facing violence and humiliation at the hands of a bought and paid for media outlet?
Or all the above.

In a perfect world where there are checks and balances people would be able to safely speak out. This is why the Feds need to be invited in. Outsiders need to be brought in to enact change. This "here's the new boss, same as the old boss", crap has to go.

God bless everyone taking action against and fighting these cheating lying betrayers of the oath they took. Keep fighting and exposing them. The effort is not going unnoticed.

Anonymous said...

Now with Dodi and Rowe as Commanders all of APD's problems are answered hahahahahhaha WTF????

Anonymous said...

Lets not jump to conclsions. What will happen is the APD will do their own tained investigation the APOA has agreed that we the members are paying for an audit. We can make a motion that the audit results be sent to an outside agency for criminal charges.

We all know what Schultz will do.

If you are involved in any way as a witness do not speak to APD Detectives pretty simple.

Union business is not the 5th floor business.

A Concerned Citizen said...

There is some real irony here.
The Mayor and Perry say they want fairness concerning the hearing officers. Are they looking for their version of fairness like when THEY don't get their way on EVERY SINGLE DECISION no matter how much they botched their case? They drudge up dirt and slander against a hearing officer and then when they (the city) lose Fire them anyway. NO, the citizens as you say do not want that type of NAZI tactic. That is not fair. That is extortion. Perry stated that he is not trying to stack the deck in the city's favor. Then why was a hearing officer removed after two hearings where the city lost their argument? Why is it when teh regular joe loses it's ok but when these idiots lose out of their own negligence, teh mayor and administrative officer see fit to bankrupt the city to fight to make somenthing right that was wrong from the onset?

Notice how the manipulators are always stating that they think this is what the citizens of Albuquerque need. Nice psychological manipulation technique to atempt to win the hearts and minds of a population who already know you don't care a lick about them. The citizens of Albuquerque had no beef with teh reinstatements of violated employees. In fact, juries are siding with the plaintiffs against teh city at every turn. There was no outrage over reinstatements. It is the Mayor, Chief of Police and City Attorney's office who are making all the noise over THEIR LOSSES. The tax payer funded propaganda and vendettas are what the citizens of albuquerque do not need anymore.

What the citizens and employees of Albuquerque need is a new mayor and chief administrative officer, along with a new city atorney and police chief who do not use intimidation and extortion to threaten and intimidate hearing officers to do their bidding. They need a fair system where the influence on decisions concerning is left out of the media. They need a governing administration who does not play games and use the media to influence teh outcome of hearings against the city by using fear of retaliation. They want to control these lawyer's ability to work other jobs when arbitrating is not done every day, yet they think these officers feel safe rendering a decision against teh city when they know the minute they do they will face a wrongful termination. You tell me how fair and independent that is? The Mayor and his gang are liars. This is going to cost the city millions. Every case will be considered bias due to the recent trumped up allegations against the recently wrongfully terminated hearing officer, and every case will be apealed to federal court where it belongs. Is this what the citizens of Albuquerque want? I guess they want their tax dollars tied up in litigation resulting in millions in bavck pay, punitive and damages awards.

These corrupt officials are going to see just what the citizens of Albuquerque need come election time.

Why do an audit before doing a criminal investigation? It's really simple, did Sigala, Garcia, Olivas buy shit for themselves? It seems they did from clothing to food to pool tables to Mac computers to bonuse funds. If that's the case then they broke the law. Under Ray's regime if you get booked you get fired right??? Let's see what happens....

I notice the Apoa's new leaders haven't posted any statements showing all is in order. Nor have they said an audit is being done. So keep ur head in the sand boys you'll pay for that also.

"I notice the Apoa's new leaders haven't posted any statements showing all is in order. Nor have they said an audit is being done."

Didn't we expect such things when the highest ranking position @ the APOA also happens to be part of the administration and also happens to be endorsed by the 11th floor. No surprise to me. As for what I know/heard, the Mac computers & I phones which were purchased for APOA business were either returned immediately when Joey & Flip left or they were on the verge of doing so. As for the pool table it stayed @ the APOA office (as did the "special" cue sticks). Things such as suits??? If they were purchased as is claimed then the transactions will be located within the "books." And of course, there will be some sort of justification included. As for meals/trips/etc they too should carry some level of documented justification if done within reason. Anything more and there is A LOT of explaining to do. With the new VP there comes an opportunity to set things straight. VP, you often voice your strongly held opinions and you have a voice that you use quite often, don't let that be muffled. You were not among the accused and were not within that "inner circle" that is being scrutinized. Come clean with the books on behalf of the entire membership to silence the crowd and hopefully exonerorate the accused. But most importantly, do it to keep schultz away and to squash any plans for a criminal investigation.

This has gone beyond embarrassing already.

May 4 2012 Albuquerque Journal,

Chief Schutlz announces that the NMSP will take over the case after several people remind him of the conflict of interest between his office and BCSO.

Just why has it taken Schultz, the smartest cop that ever lived (just ask him), three months to get this investigation going? Could it be because Councilor Dan Lewis forced him to finally do his job and to quit covering up crminal activity at APD/APOA?

I certainly hope the NMSP goes all the way back to when Pete Dwyer and Lawrence Torres were APOA presidents. There is still a lot of spectulation that Dwyer cut a deal with Schultz to resign as president of the APOA, or face an investigation into missing APOA funds back then.

The APOA scandal is another reason we need the DOJ and we need a new Chief. Schultz can not be trusted.

Peace be unto you, my brethren. And fear ye not, for verily it is written upon the restroom walls . . . SOMETHING cometh!! And when SOMETHING arriveth, it will smite the unworthy ones and cause SOMETHING to happen!! And all city employees will be uplifted with indescribable joy and form conga lines dancing throughout the city and making bonfires with their underwear. So it is forecast and so it shall be.

The APOA needs to ask the FOP to step in and help. The National FOP is a proffesionally run organazation and will bring credibility back to the table. ThATS THE MOTION THAT IS NEEDED PEOPLLE.

You're just spewing hatred and you appear to be pretty ignorant.

Nadine does not scare anyone.

If you want to the FOP to come in and take over come to the meeting and make the motion.

If the Christmas bonus rumors are true, could we be looking at 10 or 20 APOA/APD cops being put on admin duty? Could we be looking at 10 or 20 officers being charged and fired? Great job Ray Ray, you could have looked into this back in February but as always you turn a blind eye and know nothing.

I bet the NMSP phones are ringing off the hook with APOA/APD members cutting deals. Isn't that how it works when officers are accused of wrongdoing? Just ask Olivas and Ahrensfeld.

To 7:24

The FOP is broke and would like nothing more than to use or have influence on APOA money. They broke their own bank and are extremely troubled in this state. Sorry guys this will never happen. They also bring nothing to the table.

Anonymous said...

Yea, what a bunch of cowards. If they gave up those phones and computers like they were hot potatoes, they KNEW when they did was wrong. Robbing a bank, then returning the money does not mean you did not rob the bank. It dose not make you innocent. They knew they were caught and closed the barn door after the horses were out. Their phone records and a complete forensics screen of the hard drives of those lap tops will show whether they were used for "Union Work" or not. Dicking off on the internet is not union work and why do you need a top og the like $3000.00 mac book to do "Union Work"? Seems like fat Tommy partook in the festivities also. Better tell the truth you fat little fucker. Untruthfullness is a rireable offense. No wonder why he met with the mayor and did their dog and pony show. Everyone has dirt on everyone and all it takes in this case is for just ONE of them to go down. They will take th erest down with them.

Cops, Cops, Cops.... You think like cops and only want blood, regardless of facts or truth! I'm disappointed in all of you bloggers, on how you have addressed this issue!!! The APOA is a non profit company completely detached from APD! There is no SOP to contend with, a violation of the bylaw is not the same as being in violation of state law. The elected President of the association has the ability to make the call where or how money from day to day is spent! It is not apparent that anything was used for personal gain! That's why they are doing an audit looking into questionable areas! If its not criminal the opption for restitution is always there on the civil side of the law! Please open your eyes! Not one member has been kept in the dark! There has not been some big coverup attempt! That being said you are making us all look bad with your bullshit comments. It's bad enough the system allows an investigation into an alleged crime reported by someone who is not a victim or a Police Officer member!!! If it was apperant a Crime had been committed the APOA would have filed there own report!
As for Christmas bonuses..., ya that was a rediculous decision made by the President who had the ability and freedom to do so without telling the board! The clothes... also a call made by the boss given to an employee as it is a requirement to dress up for his job! Employing his wife.... Again his call. Unapproved training and trips.... If it was for the association in any way that is but a violation of bylaws not a crime....The spending of union dues for lunch and meetings..... Yet again that authority was in the presidents power. If you look and I mean really look criminal activity is not apparent. That's the reason for the audit people!
PS...... In this state the FOP is a joke! Don't even bring that shit up... They need to clean there own house before they throw stones at ours!

1027....You are so misguided in your knowledge and facts. We're not laughing at you we're laughing near you. For starters go ahead and dispute the fact that Paul Heh, or anybody else who was a member of the Apoa up through at least Joey's departure has no standings. Please advise how they don't.

Anonymous said...

To the complete idiot who just commented about how it is the president of the APOA's decision to buy people suits, laptops, telephones, pool tables, breakfast lunch and dinner, $500.oo a night hotel rooms, and whatever these scum bags felt like on the backs of officers who didn't know that this was being done, you should grow a spine and pair of balls.
You are full of shit. Taking and spending money that is not yours without permission is a CRIME. The president's excuse that the members should know the bylaws is bullshit. Everyone here buys their own suits for work along with paying for their own meals, and just try getting money out of these crooks for a training trip. You won't get half as much as the small fortune these punks spend on their seminar minivacations. If nothing was done wrong then why did two COWARDS pull the rip cord rocketing out of their positions?
Why did they run like sissies in the middle of what has been happening in this department. Not that either of them did a damn thing for any of the officers recently tossed under the bus, but they left an entire union hanging while they ran away. Why don't you just keep your one sided mouth shut and tell your father / son / brother / butt buddy / BFF or whatever you are to these pathetic excuses for wastes of oxygen that they are nothing but back stabbing cowards. You are the company you keep pal, so check yourself too. From what I'm hearing, this probe is the least of their legal worries and only the beginning.

There is a criminal investigation. Are these two cabin boys on administratiuve leave yet?

City Council meeting Monday, should be interesting. I only wish wish wish NMSP or DOJ would come in and rip the sh*t out of the 5th floor -- Mayor Berry is behind all the hate now @ COA. he has picked haters like Perry to run this city into the ground. God Bless the rank & file of APD.

Paul Heh...blah blah blah. He never did anything while he was active except talk a loud game. Its a shame but the entries above are right. The money entrusted to the APOA can be used very liberally without aproval from the leadership. Once you convert it for personal gain it is not meant to be used for it becomes a crime...and no the Christmas bonuses dont count. What is scary is all you who are so zealous to get these guys in jail but the same ones who wont do a report for a car accident or try to cut offenders for "minor" incidents...yeah we know you.

Anonymous said...

I sure hope 10:10 isn't a cop because he / she has no what a white collar crime is. This is another problem with APD.

Anonymous said...

Ray Ray's still in charge. Rowe and Dodi promoted. Nadine's still not doing police work (which is actually good for the citizens). The APOA is led by one swindler after another. There is no fiction writer who could make this up! My condolences to the officers actually working so that there are those who can make all this friggin circus perform day after day. Best of all, it's free entertainment (unless you count the waste of my tax dollars that pay Ray, Dodi and on and on).

Anonymous said...

1010, Really? They can be used liberally w/o approval...to the point of abuse? Please please please use that as a defense and everything will be subject to scrutiny like you've never seen before.

Oh and thanks for representing us APOA in this lapel camera shit. Everybody is fucked now.

Anonymous said...

Funny you bag on the APOA for taking advantage of weak by-laws. Remember Sisi Miranda....probably not as 3/4 of have not been on 7 years. Read the white collar crime statutes. There is a huge difference between abuse and embezzlement. How many BS cases you do that just get dismissed in court because you stretch the statutes. And grow up...dont think for a second that the mayor would turn a head for anyone in the APOA...the only reason it was passed off to State Police is so the likes of you will not have any conspiracy theories to whine about when its dropped. Bitch about the cameras....that was your doing...all you do is complain about shit you voted in and oh well...here we are. You people make us all look like a bunch of whiney little bitches...then try to persuade everybody you are right. Whats wrong with this department are the whiners on this blog.

@ 11:52am

Can you please enlighten us about how you, an APD officer, is "fucked" by wearing a lapel camera?

Anonymous said...

602....no there aint. Just because the by laws don't say you can't do x doesnt mean you can. that is abuse. and guess what, welcome to embezzlement because that's where you get your intent element proven.

and 754, you don't think there'll be a chilling effect upon citizens? can you video record minors? can you video record rape victims? or what about witnesses that fear retaliation? these is total knee jerk reaction that is doomed for failure because once again our beloved chief can't think beyond tomorrow's headlines.

Anonymous said...

Sisi Miranda? more than 10 years ago and you still bring this shit up? who gives a fuck. you didn't do anything then about it did you? well we're doin something about this now. this shit needs to stop and at least ten years from now, no sorry ass like you can go "but wait remember Joey..." What about Sisi??? as if that matters now you dumb twit.

It is funny how you defend the APOA for "Taking advantage"!!!!?!?
Are you kidding me? No pal, it is you and your ilk who are plaguing the city of Albuquerque with lies and disinformation. You expect to be taken seriously, while complaining about people taking issue with what you admittedly call "taking advantage of"???
I guess in your mind it's ok to take something that isn't nailed down. That case was not passed off to the State Police. It was taken by the State Police because there is merit behind the accusations and an Agency with integrity is needed to investigate it.
Since you know so much, why did your pals cut and run like cowards at a time when the whole department is in turmoil? Why did the union shelf the issue? Tell us Mr. Know It All! Tell us all about your heroes. Tell us about how they stuck it out, and fought for the officers. People just don't resign for no reason at all. Your role models took the easy way out and quit. They ran away. They gave up. Resignation is almost an admission of guilt. Noce try, but you are blowing hot air.

Anonymous said...

I think what that poster was saying about the lapel camera is that every single encounter such, as saying hi to a resident in your beat can be possibly counted as an encounter, and therefore used aghainst you should you fail to use your camera, and if the vindictive, retaliatory agency needs a violation to hang you on. Every encounter is excessive and the way things are going, I could see them using it as a negative tool. THATS WHAT THEY DO!
Other than that, it is beneficial when it comes to showing what happened during a critical incident. Also, again the chief places the blame on his officers in an indirect way by insinuating that it is THEY who can't be trusted and therefor made to have their cameras on for every encounter with the public.

Reference 8:57....Great post, and totally on the money. The citizens know who the crooks are. They all know. That's the truth. If you have to think twice about it like something just isn't right, then it probably isn't. Doesn't take much. WE all were brought up knowing right from wrong. At least those that don't buy suits, pool tables, breakfasts, rooms at the Ritz Carlton, and spend the rest of officer dues liek the money is free know right from wrong.

Anonymous said...

The citizens of Albuquerque back our officers. We want the chief to go away. Just go away, and things will get better with APD. Why won't this person just resign to the fact that he is a failure. The leadership of APD has failed it's officers and the citizens of Albuquerque. The lies are out of control. You would have to be stupid to believe anything that comes out of any of their mouth's. They fired two cops for arresting an armed murderer and lied on those officers. They slandered their officers when they did nothing wrong. They used them to take the scrutiny off of themselves. That is a shame. These officers have to worry about the criminals trying to kill them along with the administration trying to bury them. This insanity needs to end. This mayor will not be elected because of the chief. The chief is a dictator. Fire this guy!

Anonymous said...

Since when does APD need a complaint to start an investigation or bring charges for that matter. We do it every day when we pull over people for speeding or what ever other myriad of traffic or even DV laws are out there without any complaint being filed or even a victim. WE DON"T NEED ANY STINKING COMPLAINTS!!!!

Anonymous said...

6:26....

Oh my poor young little guy.... DV is one of the only crimes you are required to determine a primary aggressor and make an arrest! Traffic violations are misdemeanor crimes that occurred in the presence of a police officer! The fact of the matter regarding the APOA is did money get spent for personal use????? That is the question and an underlining element in embezzlment..if the guys committed a crime they will pay!!! Until then SHUT THE HELL UP.....those of you talking shit about Ron are misinformed! He did nothing but assist in the effort to save the Union from this bullshit. As for the guy that keeps using the word "pal" get a life!!!! This blog is just another bathroom wall!!! 90 comments woohoo...... At least it's more than attend the APOA meeting...... (pal).......Move on people.... You say those that are shining the light on someone that worked a deal with law enforcement to get out of a crime of integrity that they initiated in the first place are wrong. Well then.... School us on how great your PAL is! Give everyone some facts on things here Einstein. "We don't even think about this bullshit" hahahahahaha... Yea, that's obvious by just how BUTT HURT You are.
