Schultz Away; Village Idiot Speaks

Haven’t you ever heard, “think before you speak?” Berry Bad Mistake and Mr. PSD White Lies obviously haven’t.

First; with all due respect our condolences to the Torres family for their recent loss.

By state law police officers of the Albuquerque Police Department are required to take 40 hours of Officer Safety Training, this training includes; safe pursuit procedures, domestic abuse, DWI stops, high-risk felony procedures, firearms proficiency along with many other specialty training. Police officers are also required to re-certify year with their firearms and attend mandatory training in order to keep their law enforcement certification.

The Albuquerque Police Department’s Academy provides the best training to its cadets, along with advanced training to its law enforcement officers. Departments around the nation request the Albuquerque Police Academy staff for training their personnel and police officers in their departments. The APD’s Academy is ranked amongst the highest in the nation.

An article written by Jeff Proctor called, “Mayor Wants Changes in Training at APD,” came out in the Albuquerque Journal today(see here). The article states that Mayor Berry wants to make changes in the department and City officials are requesting APD officers to take an additional eight hours of training. According to city officials this training would include, "re-educate officers on the policy and procedures and case law regarding the proper use of deadly force, de-escalation techniques and decisional training," according to a draft copy of the proposal.

Berry Bad Mistake’s Public Safety Director, Darren White, said, "This training centers more on when to shoot versus how to shoot," and "When you look at the high number of deadly force situations we've been faced with, we felt that it was important to make sure our officers had all the necessary training." And according to this article, the training also would include such skills as assessing deadly force situations, proper use of cover, how to request and wait for backup, creating distance between officers and suspects and when to retreat. White described the proposed training as a “refresher” of classes officers take in the police academy.(See here)

WHAT? This training is already taught and required and police officers already take refreshers to keep up with their Law Enforcement Certification. To say otherwise, you would be lying Mr. White Lies.

If an officer observes an offender beating another officer (which is a felony) and that offender points a loaded gun at an officers’ head, and you know that the warrant being served is for the offender assaulting a lady and attempting to drag her out of her car violently; is there any doubt that the correct decision is to stop the offender who is in commission of a violent felony and is attempting to kill another officer?

In addition, APD is considering using virtual technology that simulates real-life situations in which officers are faced with the choice of whether to use deadly force. The technology would cost about $10,000 a month, White said.(See here)

WHAT? Mr. White Lies has no business purchasing more equipment. Mr. White Lies has a history of purchasing equipment and placing it in storage just to grow cob webs. The Eye wonders if TruTouch owns the “virtual technology” company. Remember TruTouch? Besides where is the Chief of Police? Oh, that’s right; Schultz is out of the Country on City Business. Great place to be Schultz, when your department is in crisis.

The Eye is in favor of Officer Safety Training but Berry Bad Mistake, Mr. White Lies and City Officials have just cost the citizens of Albuquerque potentially hundreds of thousands of dollars by alluding that the APD’s Officers were at fault for the bad decisions made by Mr. Torres. The APD officers do not need more training, APD officers and the citizens of Albuquerque need, “Better Leadership.”

The situation involving Torres on Tuesday, April 12, 2011, Detectives Brown and Hilger were violently and brutally attacked and battered by Mr. Torres. Detective Hilger was disarmed by Mr. Torres during the attack. Detective Hilger currently looks like he crashed into a concrete wall at 100 miles per hour, without a seatbelt; all the result of bad decisions and actions of Mr. Torres.

It has been reported that Mr. Torres has schizophrenia and a long case history of violent offenses against 23 different victims of Albuquerque. Mr. Torres did not comply with Detectives Brown and Hilgers’ simple instructions to “Turn around place your hands behind your back!” The family being knowledgeable and schooled in law knew the appropriate actions they should have taken to help control and protect Mr. Torres.

Mr. Torres continued to escalate the situation by brutally beating and trying to kill Detective Hilger; Detective Brown did not have a split second to think; he acted based on his police training. Berry Bad Mistake and White Lies haven’t you ever heard of “Motor Memory Skills?” Berry Bad mistake, you might not, but White Lies should, and he should educate you on the definition of what it means. But in case he doesn’t the Eye will give you this lesson for free…

Motor Memory Skills, also known as motor learning, is a form of procedural memory that involves consolidating a specific motor task into memory through repetition. When a movement is repeated over time, a long-term muscle memory is created for that task, eventually allowing it to be performed without conscious effort. This process decreases the need for attention and creates maximum efficiency within the motor and memory systems.(See here)

The decision that Detective Brown made, no law enforcement officer ever wants to be faced with. The lack of police officers on the streets because top city officials are loading their pockets, is creating a hostile environment for the city’s police officers and citizens.

It is not a lack of training; it is a lack of “Good Leadership.” With all due respect to the Albuquerque Journal, according to the APOA (Albuquerque Police Officers’ Association) the Journal’s headline should have read, “Sixteen people have assaulted police Officers since January 2010 while possessing deadly weapons.” The APOA also stated, “This trend is in line with Local and National statistics. Nationwide assaults on Officers have increased at an alarming rate. A responsibility of the press is to educate the public. What you have done here is victimize the true victims; Detectives Brown and Hilger.” The Eye agrees with this statement. (APOA press release)

Any good leader knows when a grieving family vents publicly and makes inflammatory statements such as; APD is a “1000 percent negligent.” Let’s analyze this statement. Here we have the brother of a deceased man who is an educated attorney. It is common knowledge that the maximum of any given situation is 100 percent, not 110 percent and not 1000 percent. This was an inflammatory statement by a grieving family member. Any good leader knows the statement made by a grieving family member regarding hiring four detectives to look into Mr. Torres’ death, is only a statement of, a grieving family. Any attorney know that public statements like the ones made by the family in this case will allow or open the door for a change of venue. This could greatly hurt the family’s case. Once again, this is a grieving family publicly venting.

Any good leader knows that once there is a threat of civil litigation or actual litigation, the City should not make any statements pending the litigation. The reason that no statements are made are due to the fact that these statements will be used against the City during the court proceedings. The Eye assumes that the City Attorney, Rob Perry, was not contacted because he would have strongly advised both Berry and White to keep their mouths shut.

When Chief Schultz left town, he placed Elizabeth Paiz as Acting Chief. Acting Chief Paiz was guarded and cautious when she spoke to the media, thus protecting all concerned. Why would Berry Bad Mistake and White Lies think they know more or were more seasoned than Paiz, who was the PIO for APD for years and currently holds the rank of a legitimate Deputy Chief of Police.

If any liability derives from this case it will lie firmly on Darren White and Richard Berry. What took place with Mr. Torres was unfortunate; what came out of the mouth of White and Berry is shameful.

Beautifully written; Give em' hell, Eye! This is the wake-up call people need! Anyone who believes these officers could have done something different, are just as stupid as JC Darren (Jesus Christ) and Mayor Dingle-Berry!

Thank you Detectives Brown and Hilger for doing the job no one wants to have to do - God be with you in your time of turmoil. The administration may be leaving you out to dry, but never forget that you have a "family" of supporters on your side.

Are you kidding me????Perry is the Chief Administrative Officer and part of the Berry White inner circle. There is no doubt Perry reviewed and approved the new policy. Perry was hired by the City based on Darrens recommnedation. Perry is a defense attorney and likes to run his mouth off to the media almost as much as Darren.

Once again, 'White Lies' will throw these two officers under the bus when push comes to shove, as in the case of Brad Ahrensfield. Yes, they did what they had to do, however, had they been properly informed before attempting to apprehend Mr. Torres, the out- come would surely have been different.
Hilger, Brown; This is very unfortunate, but watch your back. Daren White will not take responsibility for your not being informed enough, before sending you out on this mission.
Darren White is truly a mercenary, and will use you guys to fulfill his Rambo fantasies.
He's definitely the guy we want on the Judicial Review Board. What an incompetent joke.

In reality he is using our tax dollars to seek employment in some foreign capacity or some company's security position. Darren went to India, possibly to do the same.

Eye, we don't know what happened with the incident regarding Torres. There is no "other" side to talk to given he's dead nor are there any third parties. The word of APD officers is not credible. APD officers are trained liars and given the level of the "blue code of silence" not to be trusted. I'm not condoning Torres' actions. I do believe he attacked one officer but I fail to understand how TWO officers couldn't handle an unarmed civilian without resorting to deadly force. Something just doesn't jive.

I do blame the Torres family for not taking action to control their family member. This guy was a threat to citizens which was clear to anyone, a history going back over five years. He was a clear and present danger. According to the Journal he was provided a Mustang GT to zoom around the city in racking up dangerous incidents along the way. So where was the family? Please respond Torres family.

HIPPA laws restrict a lot of information given to officers. Officers deal with hundreds of people a day collectively. Traffic stops, warrant round ups, etc. Torres had no red flag except that he was on his way to becoming John Hyde... we just got the upper hand!

Whenever faced with a hypothetical question (What if?), I sure wish the "leaders" of our police department would learn to tell the media, "we do not work in what ifs, we will only discuss what happened".

APD had no leadership. I would recommend a new chief, but there is no telling who Berry / White would appoint.

These two officers should sue the Torres family for the pain and suffering they are now having to deal with. The Torres family did not work to help their mentally ill family member, the opposite is quite true. Giving him a mustang, working hard to defend him in court, instead of working hard to institutioalize him.

The APOA needs to step in and pay for attorneys for both officers to counter sue the family. It is time to stop blaming the police and to start placing blame where it belongs.

First, I thank God that the two officers are safe and that they went home that night. Mr. Torres certainly controlled the outcome of this incident.

I have a question that doesn't seem to be asked by anyone or addressed. Were there additional officers there at the house at the time of the shooting other than the two officers mentioned?

The officers are not at fault its the system in general. Nothing was learned from the hyde incident. There needs to be better tools to protect officers and let them do their jobs. But now since the person that died in this tragic incident has a family with stroke, something will be done to better protect all sides. But it always happens like that, when someone important or their family comes from prestige then its time to fix the issue.

What about the latest group that came into town to evaluate the previous officer assaults that ended in a shooting. Last I heard was that APD was congratulated on the training they provide. Where is that report?

Its not uncommon for 2 officers to go to a scene and pick up a wanted person. We can't second judge anything they did. Remember FSB sends two officers to everything even to get a wanted subject.

The officers were given no choice once Torres armed himself, unfortunately gun retention is not a science but I am sure the officer did what he could to keep control of his firearm.

WE as a very weak society live in a blame world. This man had a few scews loose, I think thats evident. His family right off the bat is blaming APD for killing there son. The fact of the matter is that after he attacked a patron in a garcias, he attacked a WOMAN at a light and his final straw he atttacked a COP. The family knew he had a mental issue and should have helped him.
The leadership of our police department is political. Thats you guys problem, you have politicians going into public arenas and getting votes.
Sad situation all the way around but if you attack a officer you should expect lethal force. No winners in this issue and that idiot White has done what he does and stuck his nose into a situation and made it worse.

How come Darren didn't ask for extra training when his deputies beat up on Al Unser (who is hardly a threat) and instead attacked Officer Costales. What did Ray do, order an internal affairs investigation on the officer. Now, when an officer shows up to a dangerous situation where the officer could have been killed, he again, attacks the officer. Just depends on whose a** Darren is kissing how he reacts. What a loser. To the person who thinks he and his low class wife are wonderful people - read this blog more and find out for yourself what a creep he is!

Thanks to Detectives Hilger and Brown, as well as the rest of rank and file at APD that put their lives on the line when they go to work. The officers' actions were dictated by the suspects, as per the Use of Force Continuum. Plain and simple. You punch an officer, the officer steps up the force. You seize his gun, you risk a deadly force response. In this case it came.
The media needs to realize that the reason there were 16 shootings recently were because officers' lives were placed in jeopardy 16 times. That officers killed 11 of those people indicates that they are trained well to react appropriately and accurately. If they had not, we may have had more police funerals.
The public, including the current administration needs to realize that APD would reduce officer involved shootings simply by not going out looking for offenders. But at what cost to the citizens? I'm glad Torres if off the streets so he will not be able to attack my wife at an intersection. I am sorry he died as a result of his actions, and I feel sympathy for his family. However the police must put themselves in harms way to keep order. To suggest otherwise is to say police should be prohibited from self-induced jeopardy. In other words they would not be able to take any action that may result in harm to themselves. This is the argument they always use in many officer involved shootings.
To suggest that officers do things "as safe as possible" is another ludicrous suggestion. I suppose if we had a full squad of detectives doing nothing but gathering background and intel and performing surveillance, we may reduce injuries. But at what cost. Raising the force to 3,000? City councilors were just spouting off about how unhappy they are with overtime, mostly from DWI cases. So what about when they get the bill for detectives working 40 hours to pick up a single felony warrant.
The bottom line is personal responsibility. If you do something like take an officer's gun and threaten deadly force, you alone are responsible for the outcome.

Youre right. White was never a real Cop. It does us no good to bash BCSO. They didnt like him anymore than we do. The post about sending two officers to a call is right on. No difference than sending two detectives. The homeless on the streets panhandeling exhibit more signs of mental illness than Torres did. Can you imagine how it would impact response times if we started sending 3 officers to a call involving contact with another person. 8 hours of extra training is a joke. And they have been talking about buying that simulator for months now. It was ordered prior to this incident. Somebody is running off just to get in front of a camera....so whats new or suprising? Nothing will change...just stop stressing. We survived Baca/Galvin...we will survive Berry/White.

I could not disagree more. Every officer involved shooting should require a thorough review of the officers tactics that lead up to the shooting. You may have an "in policy" use of deadly force but the tactics that lead up to the shooting may need to be addressed. That's how we as an institution get better.

If the subject of the arrest warrant has a past criminal history of VIOLENT and ERRATIC behavior and is currently wanted for numerous crimes involving VIOLENT and ERRATIC behavior, possibly having additional officers present to effect the arrest may have been an option that was not considered. Would it seem possible, even likely that this type of knucklehead may "go off?" on us when we show up at his house to arrest him - considering his past criminal history?

It is not my intention to appear overly critical of the officers who used deadly force against Mr. Torres. I make this point only to reinforce my strong belief that if we do not self examine these incidents, we do not get better. If we do not get better, the bad guys win more often and eventually an officer pays with his life.

Albuquerque is a violent City. Law Enforcement is entitled to protect themselves and go home at the end of the night. You dont hear the Feds or State or BCSO getting in shootings or incidents very often because there is very little crime in those communities that they patrol. 50% of the States pupulation lives in the Metro Area. I pray for the safety of these Cops that they go hom safely to thir families.

The writers above assume all APD shootings are justified. I doubt that. This is the same police force that allows its officers to trample crime scenes under the guise of "grief" counseling. This is the same police force that has a veteran officer tail-ending a citizen, providing false information and leaving the scene, this is the same police force that has been the subject of lawsuits because of officer incompetence. This is the same police force that allowed OFFICERS to loot its evidence room and hold no one accountable, and the list goes on and on. And yet the citizens of ABQ are supposed to believe what they say happened.

Please answer for me, why was SWAT called to Mr Torres killing AFTER the fact? Why the bomb squad AFTER the fact? Sound like another "grief" counseling session to me.

He is anti-cop, anti-union, anti-city employees. Perry is another bullet that Berry has put in his revolver to use against his own work force! Whoops, never mind reference APD Officer Angelo Lovato. I was looking under traffic and found it (I think) under it under criminal. Location is the big I and it seems someone was injured. The news report made no mention of that but I'm sure a "sudden" or "delayed" case of whiplash arose (after an ambulance chaser contacted her) thus an "injury". Case No. CR716911.

What is the definition of a cop hater. Is that anyone who speaks ill of law enforcement officers? Is that anyone who comments on the actions of law enforcement officers?

Since Darren and Ray are cops then a whole lot of cops (including the union) are cop haters.

Law enforcement needs to live under a microscope. You carry a badge and a weapon so scrutiny is a must as is integrity and accountability.

I see APDs biggest problem as leadership. It all starts at the top. In today's ABQ Journal there was a graph showing assaults against police officers by year. The spike upward began in 2004. When did Schultz take over?

Today's Albuquerque Journal editorial slammed the APOA for its stand on additional training following the C Torres shooting.

The blog, Errors of Enchantment, also hit the union on this issue. When the boss says, let's do some refresher training its not up to the union to decide if its necessary. The union is not accountable to the taxpayers of ABQ. The mayor says do it, then do it.

He took over in the Spring of 2005 and everyone thought things would improve. Took everyone at APD almost a full year to realize Ray had become Marty's puppet. He could've stood up for the department and been a real buffer from the department against the mayor and some of the politics. However, he chose not to. Everyone has seen the results of his piss poor leadership year after year as things get worse. He was OK at other ranks, but has been horrible as chief. He has no balls to do the right thing, and is extremely vindictive and childish when he's crossed. Too bad for APD....after Gallegos they deserved better and instead got worse. Way to go DeBuck....he pushed hard to get Ray the chief's job. He had a lot of stroke with Marty.

News flash: we're all taxpayers, even us city workers, all of us: whether we're cops, firefighters, animal control, solid waste, cultural services, senior affairs, on and on.....so don't go there with the "taxpayers dollar" rant. Its not about the training. We would have done that training anyway...it mandated by the State. Most officers attend way above the 40 hours of mandated training each year anyway. Well over 75% of the department have CIT training even if they dont get paid monthly for it. The problem is that the announcement of the so called need for training at that time gives the impression that the officers did something wrong. Then here comes the outcry for more restrictions and policy changes. It all but sews up the wrongful death lawsuit and makes every LE officer at APD look like a bunch of goons. White screwed up period. The Mayor backed him up and they refuse to fix the situation. The Union needs to stand up and clarify what they said. If this were a Fortune 500 company as everyone in Albuquerque wants to the City to run it like...then the board would have already sent the Mayor and White packing.

To 4:26 post, you are right on. I know everyone has lost any respect for White but it seems like we are letting Schultz off the hook. If he was out of town when all the comments were made, he has a cell phone. If you think for one minute that he was not consulted about what was being said, you are the village idiot. He approved everything. Paiz is qualified to be Chief I think everyone is just waiting for a change. Schultz runs the dept bottom line doesnt matter if he is in town or not. Schultz has had his chance he did not stand up to Chavez or so rumor has it. Thats just Schultz way out, again, of not being a Chief is to blame Chavez. Berry gets elected, same old stuff, miracle Chavez isn't here???? So Schultz has to be held accountable. Oh but, Schultz will blame White, same old routine.

In this particular case and being an APD officer, there are certain circumstances that have to be handled differently like it or not. Yes, Chavez should not have been driving drunk. That said, he should be reprimanded severely for his actions. The 5th floor's decision to not send Chavez to the ass-hole compound that night was the right one as he is an undercover detective and many peoples lives could have been at stake.
Darren's decision to interfere and have that leaked to channel 13 news is just ONE MORE example of WHAT he is and WHO he is. His mere existence on this planet centers around one thing; getting even. He is one LITTLE vindictive prick.
The Chief can't run a department with discretion and the mayor can't govern with this pill poppin pimple running things. Darren White is over his head and totally incapable in this position. This current reign of Darren will continue until his fall from grace, which is soon and the mayor and our Governor will be wearing egg on their faces. What a liability.

Ray at the City Council Meeting of the Whole last night -- some councilors asked him some questions that he stumbled over. Sanchez asked him how many officers working on the streets, does APD actually have. Schultz started counting them, and included himself! LOL He finally had to admit that APD only has about 700 or so........actually on the streets. What a bunch of crap city hall spins.....

If I were one of those cops who went south to destroy evidence I would start singing like a canary and save myself! There is no honor among thieves. You cops had the chance to get Schultz by filing a complaint once he was found guilty of a civil right violation and no one stepped up. The CIA was at that roadblock. Chavez could have been waterboarded thats why they let him go. They didnt want that getting out. Its possible...the DWI Unit is full of former military. Former DWI Officer Al Longabhardi was a former Green Beret.
