The start of the End; APD’s Chief Schultz Heads for Implosion, Lies and Conspiracies Exposed

A year ago, the Albuquerque Journal proclaimed “Schultz Right for Job” in an editorial where they addressed whether APD needed a new chief or not (“APD Needs One Chief; Schultz Right for Job.” Albuquerque Journal, 09/01/11). In their article, represented as the paper’s opinion, the authors identified a list of issues Chief Schultz acted upon when confronted with them. For instance, the paper stated that when Hyde murdered two APD officers in 2005 Schultz created a group of “civilian APD employees to work with other agencies to help deal with mental health issues.” (Remember COAST?) When confronted with comments made by officers on their Facebook pages, Chief Schultz developed and implemented a social media policy. (Remember the Chief’s Twitter posting?) When PERF investigated the increase in officer involved shootings, Chief Schultz implemented 39 of 40 alleged recommendations.(Remember he was on the board of PERF?) The article closed with noble ideal that “APD officers are held to a higher standard, that they must walk their law-abiding talk…”

Here we are a year later, and given the record of Chief Schultz in the years leading up to the Albuquerque Journal’s editorial we would’ve expected to see an improvement in APD’s standing in the community, the quality of its officers, and its performance as a department. But we have not. In fact by any measure APD is crashing as an institution. The department continues to lose trust in the community as it hides and conceals misconduct by officers, experienced and veteran officers retire as soon as eligible (with over 60 scheduled to retire this year), and property and violent crime statistics continue to climb. Because of endless mismanagement and gross misconduct by Chief Schultz and his Deputy Chiefs, the department remains under constant scrutiny. Patrolmen, sergeants, and lieutenants remain without a contract, litigation by employees against the department has exploded, and still Ray Schultz remains as Mayor Berry’s police chief.

Now our Eyes tell us almost the unthinkable is unfolding. For quite a while people have wondered why it seems the Albuquerque Journal is so aggressive in criticizing the hard working rank and file APD officers while giving endless cover to a chief that has cost the city tens of millions of dollars, ruined careers and lives, and all but destroyed once proud and highly respected department. Last week we found out….

On August 20, 2012, APD’s “Special Projects Coordinator” and Chief Schultz’s personal assistant, TJ Wilham, was named as a primary defendant in a defamation lawsuit. In the case the allegations assert Wilham illegally obtained timesheet information pertaining to APD employee and fully sworn reserve officer David Young. Wilham then moved forward with stories in the Albuquerque Journal with titles such as “Wanna Be Cop…” and “APD Warned Civilian Not to Play Cop” ignoring the fact that Mr. Young had been issued a law enforcement commission card signed by Chief Schultz, issued a detectives badge, been praised by department executives, and had helped provide cover for officers in APD special investigation division. While it seems people were feeding the reporter information, Mr. Wilham never once contacted Mr. Young for an interview. Nor did he review whether or not Mr. Young’s actions were in violation of any SOP never mind state statute.

This is where the lines between the private media and a public law enforcement organization blur. In response to this front page story, the complaint states that Chief Schultz and APD lawyer Kathy Levy discussed the story and plotted a response before even ascertaining whether any wrongdoing had occurred. In emails Levy tells Chief Schultz, “...take the highroad that we are acting on the side of caution.” Levy also told Chief Schultz, “...make sure we’ve got good access to tj for the right comments…” Then days later on September 15, 2009, in an engorged article by Mr. Wilham, Chief Schultz is quoted as saying, “We have decided to take the high road and error on the side of caution. We think this is the best course of action…” Clearly, the relationships between Levy, Chief Schultz, and Mr. Wilham blurred as the APD and the Albuquerque Journal plotted together how to address this story and resolve it a manner where once again Chief Schultz was afforded cover.

What we wonder is how ironic is that while Chief Schultz is being hailed as a leader and the man right for the job he never is in front of challenges facing APD or its personnel. As the first Journal article confirmed, all Chief Schultz has done is follow events. He has not once been in front of them. And to make matters worse, those event she’s followed and “acted upon” as soon as they leave the public eye, he lets them go. Additionally, Mr. Wilham now works as Chief Schultz’s personal assistant and as we’ve seen in recent stories, Mr. Wilham and Chief Schultz remain in personal contact with the Journal’s current police reporter Jeff Proctor via personal non-department cell phones. Today Mr. Proctor reported on a story involving a charge of discrimination by several veteran APD lieutenants. Mr. Proctor learned of this information not from the lieutenants, not from their attorney, not from the state’s Department of Workforce Solutions, not from the US Department of Justice….but from none other than the 5th Floor.

A week after the Albuquerque Journal’s article praising Chief Ray Schultz, another article appeared authored by retired APD lieutenant Steve Tate. In “Schultz Has Had Ample Time To Cleanup APD.” (Albuquerque Journal, September 8, 2011) Lieutenant Tate asserts from first hand observations occasions where Chief Schultz could’ve done the right thing but failed to do so. When exceptions were being made to accepted police officer hiring standards, Chief Schultz did nothing. When certain officers’ misconduct was brought to Chief Schultz’s attention for termination, Chief Schultz did nothing. When it was clear there was significant increase in officer involved shootings, Chief Schultz did nothing. But from the dialogue detailed in the lawsuit against Mr. Wilham, we can be sure Chief Schultz was in constant contact with then reporter TJ Wilham in their plot as to how best spin the stories. Through Mr. Wilham’s help, Chief Schultz has evaded responsibility for the mess that now weighs over APD….

Everyone of you are going to lose your shirts and your jobs. Smart phone recorders are a bitch and talking to a witness, especially trying to influence them is a crime. Good luck. Remember, lying while under oath is a crime. Don't worry about the civil end of things, that's a given. The city will indemnify your lying rights violating sorry ass. Worry about the crime of intimidation of a witness and tampering with a witness because when you lie that recording becomes your demise and you go to jail. It is better to come clean and tell the truth then tell on the criminal who gave you those orders than it is to get indicted, fired and lose everything for a bunch of self serving scum who would roll on you in a minute.

You can tell these sneaks are being advised and spoon fed prior to their actions. If this is the case someone needs to look into a disbarment proceedings. Great story EYE. I never thought David Young did anything inappropriate. It will be interesting to see if the Journal comes to the financial aide of one TJ Wilhelm. Chief Schultz should be ashamed of his actions regarding this mess. He is a failed leader, all of his deputy chiefs have failed and so have most of his commanders failed.
It is past time for a change at APD and that would rule out all of his current and past command personnel to include the retired female deputy chief who spends so much time with Mayor Berry. We should also not forget all the males who kissed the chief's tail instead of doing their job for the city.

To David Young, I hope you stick it so far up TJ that he can never sit down again. By the way TJ you might look over your shoulder, good authority said Proctor would love to have your do nothing job.

An accredited lab does not EVER release a fired cartridge case to an involved party after it is entered into the NATIONAL INTEGRATED BALLISTIC INFORMATION NETWORK (NIBIN) system. A shell casing is not stored with personal belongings either. Feist is talking out of his ass. You want to make these clowns look like the assholes they are, just give the the Association of Firearms and Tool Mark Examiners a ring a ding and run what Feist and crew did by them for a laugh. You want to further jam it up their lying asses, Call the AMERICAN SOCIETY OF CRIME LABORATORY DIRECTORS LABORATORY ACCREDITATION BOARD UP and tell those guys what happened and see them come after their accreditation. As a matter of fact, gather evidence of all of their evidence blunders, and send it to them for review and consideration of the revocation of their accreditation.

As for the Lt's sueing, Callihan seems to be a smart guy, but many of those old Lt's finished dead last or at the bottom of their Lt's lists. Just look at where all the complainers finished on their Lt's list and that will tell you if they're Commander material. Not to mentioned there are all hiding inside.

Now, what company would not promote it's best people. Most Lt's that passed the process by the skin of their teeth should never be a commanders. No company in the world would go to the bottom of the list, you take the top smart one, the cream of the crop!!!! No one should be a commander just because they have a lot of time on!

My eyes tell me that TJ went on a couple trips earlier this year on the city's dollar as some type of special projects manager for Schultz along with two supervisors. On good authority TJ spent all his time in the strip clubs and Schultz did nothing about it and was aware of it.
He does this and then goes after you, win big Mr. Young

For all of you jumping for joy just remember this. It is the Albuquerque taxpayer who will lose. Do you know that we would not need a Paseo bond issue had Schultz not lost over $30,000,000 in lawsuits in the last five years? That money could have started the rebuild of Paseo and Jefferson, but instead it was just flushed away.

So don't get to happy. Not one mayor Ray has worked for has held him accountable for the taxpayers money. Marty didn't when Ray lost us $1,000,000 for the Costales civil rights violations and Berry hasn't for all the millions lost since then.

Will someone please hold Schultz accountable and fire him for not being a good steward of our money?

I personally think it is better late than never that these ex-commanders are stepping up to the plate, and calling out this corrupt administration. Would you have them risk their jobs by speaking out against a regime who would frame them, lie on them, and terminate them for being outspoken and criticizing the malcontents running things? Who in their right mind wouldn't wait until they were untouchable before they took action against a Chief who lies against his officers, and who's Deputy Chief's swear to it?
I have way more respect for these Commanders than I do the self serving administration they are exposing, and twice as much respect than I do the agents/minions here trying to discredit them like school children with comments like "I'm smarter".

You know where the problem lies? It lies with those who think that studying pointed information, and selling out your personal beliefs in regards to morals and ethics is paramount to doing the job you took as a cop, putting your time in, upholding the oath you took, working the street to know what it is to be a cop, having the courage to take the road less traveled, bleeding, caring for your fellow officer instead of your own personal agenda above all else, not taking the first opportunity to hide inside like a nutless coward, being the first one through THAT door just once in your pathetic career, telling the truth, and having the fortitude to let the chips fall where they may with disregard to HOW YOU MAY LOOK, and being a human being. In all my years, I have never seen a thicker blue wall of silence than when it comes to the top brass. No other aspect of law enforcement is treated with a blatant turning of a blind eye and complete double standard when they are guilty of multiple confirmed actions that they themselves would terminate their subordinates over.

Yes, the problem lies with those who have conditioned themselves to survive on the lives of those they step on on the way to the top. The cancer here is also the universal cancer in law enforcement. Total fratracide, and universal lack of a code in which one operates by. Something even criminals have.
Those guilty of it show the same symptoms across the board. Lack of life experience to the point that they have never seen the other side of the fence. THEY consider themselves better than everyone else. Yep. Upbringing. Their dysfunctional behavior is that deep rooted.

I suppose you would settle for a disgusting self serving commander who is so self righteous callous, selfish, and lacking in human compassion, that when their coworker was diagnosed with terminal cancer, and he was deservedly assigned to an administrative position so that he could be with his family and have some convenience in his last days, SHE complained that she should have had this position. I guess you would want a commander who would make life hard for someone like that. A man, who though dealing with such a devestating situation, chose to still come to work like a true warrior, while the individual criticizing his being assigned this position would have never even thought of coming to work had she been dealt such a hand, and would have no doubt been at home curled up, feeling sorry for herself, blaming the world for HER situation. This kind of person makes me sick. A person being friends with this kind of person makes me sick. THIS is the problem. This is not being smarter than ANYONE. This is the people we have in positions that require leadership. People who never knew the feeling of personal sacrifice, or devotion to duty. This is why they all have to go. They are a virus that replicates with every new generation. It is time to get back to the basics of right and wrong, and the courage to do the right thing. The frauds need to leave.

Gomez got his promotion because Shultz knew he screwed up in believing Bonnie Montoya's accusations. Gomez won a decision and Schultz knew he needed to do something before he got sued. As far as Gomez, he was a lazy worthless officer that got his two degrees while on duty time and at the expense of those working around him. Having the degrees makes you no better and in many cases a worse candiate for promotion. No experience just a piece of paper

I retired 4 years ago and worked the AIBF for about 5 years. Its easy to work for the first 2 days. By day 3 you are on very little sleep and pretty much miserable. 6:07 post must have never worked it as they are talking out of the can.

As far as organizing the balloon fiesta, McCutchen probably did the best job in the last 20 years.

Wasn't wilHAM dual-employed with the CABQ and the journal at the time that he illegally acquired Young's timesheets and made these slanderous reports? Obviously the information was leaked to wilHAM by someone on the 5th floor who encouraged him to do the negative write-ups knowing darn well that Young's case would suffer in terms of public opinion and support as a result. So if the 5th floor did this, and wilHAM was in fact acting on behalf of his employer (APD)for his other employer (journal), why isn't the CABQ, mayor berry, chief schultz et al also named as co-defendants in Young's lawsuit? Maybe wilHAM was too slow to spill the beans on the administration that already left humpty dumpty to fall... just a thought?

The fact that he possessed them may not quite be the issue, but the fact that he possessed them and used them so maliciously that he caused the department such disrepute as a result is very much an issue. Then Banks gets on camera and says if you have any further questions to call him or the Chief. I say they need a lot of calls by citizens to ask them who the hell they are promoting to be APD's leaders. What a disgrace to a once proud department. Calihan has to be laughing his ass off as Rowe could not have made a bigger ass of himself. Rowe a lateral with a month of classroom time, no PT, straight into the polygraph unit, a clueless Sgt. in White Collar, sued to get promoted to Lt. and would sing in briefing and preach to his troops about god and infedelity. This would be funny if it was not so pathetic. Mayor Berry, what the hell does it take for you to act like a leader for the first time in your term and put an end to this embarrassment. Your citizens deserve more from their Chief and APD.

What happened to the days where you could trust your local police officer because you knew they were honest and ethical and would do the right thing? And what about sergeants, lieutenants, captains, and chiefs....weren't they supposed to be the polished of the polished???

Now if we want to talk to a officer, we have the entire session video and audio recorded. What is wrong with this picture!?!?! Why didn't the commander want to hear what the citizen have to say? Why did he have to be so rude and hide over a microphone, a stage, and a podium? How bout get off your fucken high horse and be real for a second?!?! Be honest and quit lying for crissakes.

Four citizens show up for the SO CALLED town hall meeting?? That would have been the perfect time for Rowe or whoever was representing APD to get off the stage and sit down with them and actually talk to them not at them... But it appears that Rowe HAD and HAS NO idea what he is doing.. It is a disgrace what has been happening over the past few years with regard to promotions.. The people qualified for them get stepped over and the worthless ones continue to get them. There are several worthless Commanders & Lt's(and you all know who you are) hanging around just to see who will be the next mayor and chief so they can get promoted.. The ones that are RIGHT for the promotions are leaving this THREE RINGED CIRCUS.. It's a REAL shame APD is in real danger and the citizens will all suffer... God4 help us all.....

Having worked with Rowe, I can say he is not what he claims to be. Hugging and coping a feel is not very chrisitan in my book..he still gives me the creeps.

If working for APD were so wonderful, employees with 20+ years of experience would not be leaving by the dozen and that cut throat lawyer wouldn't be so busy and Schultz woudln't be so afraid of her.

But, like a tick infestation, Schultz sticks to APD. Mayor Berry must think Schultz is worth the $150K in retirement that he is going to get every year.
