If it is determined by the internal affairs investigation that officers involved did not respond in accordance with proper procedures, swift action will be taken to hold those individuals accountable.”
Huh, maybe Perry would be better served having the city's Inspector General investigate this mess since we know Perry is in the middle of it? Are we really to believe that these people, who cite statistics to the tenth-percent are now suddenly ignorant of their own department's failures? What happened with no decrease in service, decreased demand for officers, and decreased incidents of crime?
Oh right, now that it involves something that is damaging, it's all about what we don't know.
Please. We at the Eye have some very serious questions. Questions that will shed light on whether the city's failure to provide public safety services for this little boy was because of incompetence or coverup.
1. When did Banks / Perry / Berry first know about the June 22 2013 event? Omaree died on December 27 2013. Did it really take 40 days for someone who isn't the Chief of Police to order an IA investigation? And really, we are to believe they didn't run calls for service at the house on Commanche NE?
2. Why wasn't this investigation ordered back in December 2013 when the investigation into Omaree's death exposed it?
3. When did Banks / Perry / Berry know about the June 22 call and if KOAT had not exposed the June 22 2013 incident, would there have been an Internal Affairs investigation?
4. Banks is the Chief, so why is it that Perry / Berry are publicly saying "upon consultation" they ordered the Internal Affairs Investigation now, February 4, 2014. It seems Perry / Berry are trying to find political cover by saying they are now stepping in and doing Banks job. Why didn't Banks order the investigation back in December 2013? Why did Banks stonewall KOAT?
5. Is this the reason Banks stonewalled KOAT, for over a month, when they asked him for comments on Omaree Varela? Was Banks hoping this would not come out until after he left for Round Rock? Will Round Rock reconsider their choice?
6. Will Berry finally hold someone high up at APD accountable for the debacle APD has become and dismiss Banks? Will Berry hold Perry accountable and dismiss him? Perry appears on TV for everything and seems to run the city. Does Berry believe the buck stops with Perry and Banks and fire them? This stinks of cover up and no accountability. Berry refused to fire Schultz all through the Costales $1,000,000 lawsuit, the Ellis $8,000,000 lawsuit, the DoJ investigation, the Nature at Play department, the antics of Banks / Perry / Wilham / White at the Mary Han crime scene etc. Will Berry finally decide to take control as mayor and fire the guys at the top, thereby showing us he can hold people accountable?
7. Will Berry come out of his bunker and see his shadow (his political career disappearing) and hide? Or will Berry finally step forward and take control of this city and police department, hold Banks and Perry accountable?
8. Perry lambasted these officers for better having a "damn good" reason for not filing a report at the June 22 call, is Perry going to hold Banks to that same standard for high profile incidents where Banks tampered with crime scenes and/or failed to write reports?
At the same time KOAT was reporting more on Omaree at 10 pm, KRQE was coming with this Larry Barker story. A pretty good story about APD employees violating the law, knowingly approved by the brass at APD.
At 6:30 minutes into this video Banks takes responsibility for the DUI Seizure Unit not following the law. Gee thanks, (sarcasm). Does Banks feel the same way about Omaree? Does Banks feel the same way about how APD has handled all calls related to Omaree? Better yet, does Richard Berry, that invisible mayor of Albuquerque feel that Banks / Perry are responsible? Will Berry come out publicly and hold Banks / Perry responsible for how poorly they have run the city and police department? Perry recently tossed Schultz under the bus, and that might be the easy thing for Berry to do now that Schultz is gone. Schultz was running the place (although out of town) during at least two Omaree incidents. But Banks / Perry were the ones here when Omaree died. They were here when it came that murder investigation exposed June 22 2013 incident. Yet no IA investigation until February 4, 2014!
Watch what happens tomorrow. All we will hear from Banks / Berry / Perry will be silence. They will not have further comments. They will be in church praying this goes away.

What is sad is that an entire city has lost faith in it's police force due to a police chief who thinks the oath he took was a joke and a police chief who polluted this place from the top down with his cult attitude of retaliation, cover ups lies, preferential treatment, theft, selfishness, malfeasance, and cowardice.
What is even harder to accept is the fact that on June 22nd of 2013 an innocent child had believed the police were the good guys. He believed the police were his protectors. This child picked up the phone as he was obviously in a desperate situation this child called those he believed in for help and nothing was done. Way to go fella. APD has finally done it. A child, really.
This makes me sick.
Perry, Banks and the mayor are all the lowest forms of cowards and scum. Now we are seeing it. Perry is stepping his fat ass out of the shadows because he has to now. Schultz was the front man and head liar, but make no mistake, he was directed by Perry and aided by Levy. Now you all know why Schultz was kept around by this fraud of a mayor. Because if not, Perry and the rest of them would have been forced out into the light a long time ago. Banks is too stupid, and not as good a liar as Schultz and nobody is willing to be a replacement liar for this regime. This is the beginning of their end because cowards like these guys DO NOT want to be out in the open where they make contradictory statements daily and leave themselves vulnerable. The tier one layer of liars has been peeled. We are now down to the next layer. The only layer buffering shit from the mayor.
Within the last year the entire top end of APD has cut and run. Let's hope they get drug back here for federal indictments and to answer for filling their pockets with BLOOD money that they stole the running away leaving the place in shambles.

After seeing channel 13's report, I am ashamed and outraged at APD, the officers who responded to this call, Berry, Perry and the state of this city. Regardless of the shitty academy training you responding officers probably received, it doesn't take any more than common sense to realize you should've put forth more effort and basic police work to protect this child. Milking the shit out of this call is pretty pathetic, also. Citizens of Abq, you better wake the hell up and attend the next City Council meeting and raise some hell. God bless you, Omaree. I'm so fucken sick of hearing those comments. The plain truth is that NO ONE IS DOING NOTHING ABOUT NOBODY! Not even the DOJ.
Not only has a beautiful wife and mother (Tara Chavez) been murdered, a intelligent and noble women (Mary Han) been murdered, countless good and innocent men have been murdered, but now a beautiful innocent CHILD has been murdered.
Who or what is it REALLY going to take to gut the City of ABQ and the ABQ Police Department out? How many more lies must be told? How many more cover ups do there need to be? How many more lives must be destroyed? How many more people must die?
And all of this is being done for the sake of having power and money. Power and money NEVER last,

Before I retired Karen Fischer's girl was giving us a report on repeat cfs on 15s and runaways to look for stuff like Omaree but Joanna took down the server and never put it back up. Same computer that Feist would tell everyone had the West Mesa reports and looked out for any new missing 23ers years after we stopped having them.

I'm not trying to make light of this tragedy, but really what happened here at 4909 Commanche NE is APD in a nutshell. Afraid to do real police work and more interested in fast-food style law enforcement.
If that scumbag mother and boyfriend were panhandling, they would've been checked for warrants and cited.
If they were having a loud party, they would've been visited by party patrol and cited for MIP and DIP
If they had a half-built truck in the front yard, CNAU would've come by and red tagged the property.
If they were suspected of dealing drugs, there would've been a knock n talk.
If there was a car with 22" rims, Gangs would've come by for a knock n talk.
If they had any unpaid tickets, they would've been picked up on a warrant sweep.

THE PLEAS OF OMAREE (Joe Monahan February 6 2014)
The APD officers who responded to a 911 call placed by 9 year old Omaree Varela reported they spent two hours on the case, as we blogged Wednesday, but now media reports surface saying they were actually only on the scene for 15 minutes. The officer took no action and did not write a report. They have been placed on paid leave.
The boy died from physical abuse six months after placing this second 911 call pleading for help. His mother is charged. The second call was taped by 911 and its release has shocked the state. It goes on for 21 minutes with the mother and her husband verbally abusing the boy so caustically many of our readers have told us they can't listen to the entire tape.
Interim ABQ Police Chief Allen Banks, who is leaving APD to become chief of police in Round Rock, TX, tells KOAT-TV he was not aware of Omaree's second 911 call on June 22, 2013 until the station aired it this week.
If Banks is being truthful, then a Chief of Police admitting that a reporter knows more about your department than you do is just plain embarrassing. What if Banks is not being truthful? That he did know of the second Omaree cry for help via 911 but was stonewalling KOAT for 40 days over records of the Omaree investigation and now hopes he can head off to Round Rock unscathed?
Since he says he didn't know of this horrific phone call and the 9 year old boy's cry for help went unheeded by APD, shouldn't there be an internal affairs investigation into why Chief Banks didn't know? Will Mayor Berry or CAO Perry get the ball rolling?
And just why did Banks stonewall the TV station's records requests over Omaree for 40 days? Was it becuase he knew of this devasrtating phone call? Someone knew something and called the TV station. Why tell the station and not Chief Banks? Was it because the whistle blower was fed uup over the stonewalling of APD?
Does Berry think Banks was a good interim chief? What does Berry think about all things Omaree and APD? No comment isn't much of a legacy.
Omaree did not die in vain. He is now the symbol of the apathy that plagues the state and has made us 50th in America in child well-being. His death could serve as the wake-up call we need--if we let it.
Berry's interviews on Channel 13 and Channel 4 on Omaree Varela's death and his no solutions was as pathetic and disappointing as it gets. Berry could not even pronounce the child's name correctly during one interview. No real emotion shown by Berry at all over the killing of a child. Berry expressed he was "disturbed" by the differences between what he heard on the 911 tape and what was recorded on the police lapel camera tape. Berry showed no emotion, no anger, no outrage over a very preventable killing had responsible agencies done their jobs. But Berry did announce creating a "task force" and spending $25,000 to bring experts in to tell APD what it already should know what to do to fix the problem. Berry also intends to ask the new chief he appoints what can be done to keep this from happening again. No real hard questions from the media on how this could even have happened and if he intends to hold any one responsible for what happened. No media questions on how long did he or his Chief knew about the 911 call or the lapel camera tape. No substantive advocacy by Berry on policy nor criticism of CYFD, only a task force. But again criticism of CYFD may offend the Governor and Berry's campaign manager Jay McClusky.

Berry's leadership is the carrot and stick approach. The carrot is, "I throw you bones such as the use of siezed cars and gas and you keep quiet about what's really going on." The stick is, "If you speak, I'll retaliate and you won't have a job." The city employees are just the pawns in Berry's game. Berry, Perry and the other corrupt leaders seriously need to be psychologically evaluated to diagnose their obvious psychological disorders.
Berry uses machiavellian tactics, "the art of manipulation in which others are socially manipulated in a way that benefits the user, whether it is to the detriment of the people being used. The user would feel little to no remorse or empathy when their actions harm others." Your bible is Machiavelli's, "The Prince." We see you for who you are.
Berry, re: asking the question what you can do differently? Here's something you could start with: be honest, truthful and competent, putting the citizen's interest first rather than your special interests. STOP USING THE CITIZENS AS IF WE ARE RAG DOLLS YOU CAN THROW AROUND ANY WAY YOU WANT. The leader establishes the atmosphere of the organization. The atmosphere in your organization is POLLUTED. Clean up your act. Read some good books on the importance of integrity and truth and then practice, practice, practice. HBR.org (Harvard Business Review) has great articles, books, etc. on leadership you will find helpful if you really want to lead this city.
The photo of Omaree at the front door watching the officers leave was chilling. That poor little boy was smart enough to dial 911 and not hang up. It appears that the officers/sergeant did not read the call while enroute and it is absolutely disgusting that they did not call dispatch as requested to listen to the horrible things and the tone in which they were being said. Once that was done they would have realized that leaving Omaree there was dangerous. The so called step father more than likely beat him, wonder if Omaree was at school the say after that incident. I would bet he was absent. God has a special place for children like Omaree and there's a place for his so called parents, may they rot in it. RIP Angel...
Channel 4 anchor Tom Jowles noted how haggard Berry looked. Berry had buffy eyes and redness in the face as if nursing a bad hangover. The reporter said Berry had been up all night until 3:00 am in the morning reading reports and listening to the 911 tape on Omaree. Really? The truth is he just got back from a Washington trip talking to White House officials and Republican operatives and probably staying up way too late at night for the last few days. No hard questions from Channel 4 and no leadership from the Mayor. BUT WE GET A $25,000 TASK FORCE AND AN EXPLANATION FROM CHANNEL 4 WHY THE MAYOR LOOKED SO BAD.
Benghazi and Omaree reflect the cancer raging within our national and local government; executive authority without accountability to the citizens.
Both Stevens (other 3 deceased) and Omaree requested assistance and protection in advance of violent attacks.
Both were ignored and abandoned in their time of need by a system where those without power are simply viewed by those in charge as expendable collateral damage.
Both victims deaths were viewed by the executives in charge as inconvenient because Obama and Berry had "important" elections to win and didn't want too have to answer any questions about lax policies and procedures; false narratives (Obama; "Osama Bin Laden is dead & Al Qaeda is on the run" and Berry "Albuquerque is safe city and I have complete confidence in Chief Schultz.")
Deaths in both situations are being brushed aside by the executives as tragic and unavoidable not reflective of systemic incompetence and corruption.
Both situations had massive withholding of evidence to avoid any unnecessary questions from the public (voters).
In both events videos are used as tools to deceive in order to buy time, evade/deflect and to avoid being called out for gross negligence.
Both utilized massive PR campaigns in order to mislead the press and the public and cover their tracks.
In both situations a group of lackeys was or will be put together (at the tax payers expense)to evaluate what went wrong and what can be done to prevent this situation from happening in the future.
In both executive leadership is lacking as no one was fired for failure to serve and protect.
Finally, will the "real criminals" in these events ever be brought to justice? No, Obama and Berry will serve out their terms because other than five dead bodies at this point "what difference it make?"
Someone should do something!
What did channel 13 do, pick up from channel 7. Who watches channel 13 anymore. Come one.

This tortured boy, who knew no peace or love in his short life picks up the phone to call the good guys. Once again little Omaree is denied. The phrase we often hear when someone dies is "they're in a better place now ". I never quite bought into this phrase, but in Omaree's case, I absolutely think it is sadly true . RIP little man. I'm sorry everyone failed you.
Does the DOJ also investigate CYFD? Seems like they're always in hot water for dropping the ball time and time again.

I was being facetious. I don’t believe that Berry has the intelligence and is too psychologically damaged to be able to understand what good leadership is. He needs a psychological exam so he can deal with his personality disorder. Fuera Berry, Perry and Don Harris!
I've posted here several times that i believe Berry has some type of mental health issue which is becoming more obvious the few times he has gone on camera very scripted and only for feel -good stories. As someone in the mental health field, I would ask Mr. Berry to step down as Mayor, seek therapy and take a job that is within your limitations. Sir you are in way over your head .

As I read your comments, I am saddened and hopeful to know there are many APD officers who are heartbroken and angry by the corruption plaquing our city government, the system that they must work for each day. As a citizen and former law enforcement, I honor the courage of the officers who do their jobs right, despite the horrific circumstances they must work under. I beg you to keep fighting this corruption, speak up from inside, to help us on the outside expose the leaders for who they are. How many more people, including our children, will die as a result of the city corruption? I pray none of the officers have been victims to losing someone they love due to the incompetency of those that swear to protect us, but there are many citizens that have; who grieve, whether it's their child, their teenage son who had an arrest, a mentally ill family member or someone falsely imprisoned for false police reports. This is real. These are people that are loved. You can help us, and I beg you, if and when you can step forward, I pray you do. As you can see, it's not getting any better. Thank you for your fight. Thank you for your honor.
