APOA Meltdown

On Monday a lawsuit was filed against the Albuquerque Police Officer's Association by former officers Rob Woollever and John Doyle. Our Eyes have been telling us this has been a longtime coming. In the press release by their lawyer, and former APD officer Thomas Grover, it said:



"With no acknowledgment or thanks to self-serving purposeful actions and omissions by the APOA, Mr. Schultz generated near hysteria as he paraded the video (and misrepresented) Mr. Doyle and Mr. Woolever’s efforts as they subdued an armed fleeing felon without using deadly force February 2011. He terminated them later that year in November. This, not by coincidence, occurred during a time when the United States Department of Justice was conducting a preliminary investigation into Mr. Schultz and his police department for patterns and practices of unconstitutional use of force.

“I thought the APOA and their lawyer Fred Mowrer were there to defend us and all the other officers. Finding out, and realizing, they were just using Rob and I to help Schultz keep his job and to keep feathering their own nest with union money was one of the most cowardly, disgusting, and dishonorable acts I’ve seen in my twenty plus years as a street cop” remarked former APD officer John Doyle. “I truly feel that this lawsuit is only the beginning of what needs to be done to clean up the APOA. This incident needs a full-blown criminal investigation.”

Despite all of Mr. Schultz’s efforts to use Mr. Doyle and Mr. Woolever as scapegoats to avoid a formal Department of Justice investigation, the DOJ still came in upon APD because of the broad and deep failures of Mr. Schultz himself. Noticeably absent from the April 10, 2014, Department of Justice findings letter was the incident involving Mr. Doyle and Mr. Woolver."
 
The APOA has long had a history of granting preferential treatment to some members while openly discriminating against others in the issuance of member benefits. These internal problems are in addition to all of the financial improprieties which were revealed in 2012. With this lawsuit, Mr. Doyle and Mr. Woolever not only seek recovery of damages caused upon them by Defendants Filiberto “Joey” Sigala, Ronald Olivas, Stephanie Lopez, Shaun Willoughby, and their counsel Frederick Mowrer, but relief for all the regular patrol officers and detectives who also have been victimized by the failures of their union.


As we've reported here at the Eye for many years things  in the APOA have been a little too loose with officers money and too cozy with administration. In response to the lawsuit, APOA president Lopez said in today's Albuquerque Journal that she didn't know if the Doyle or Woolever ever asked the APOA for assistance in their case.

Look folks, this is a slam dunk for Doyle and Woollever and we wish them the best possible outcome in their case against the APOA. Since when does a sitting police chief go around promoting the criminal prosecution of his officers and a police union sit quiet about it? And given that virtually every APOA president since Lawrence Torres has had their hand in the union's bank account while Schultz has had them on a leash...we'd say this is a long time coming.

Let's not take responsibility for OUR actions whether they be illegally beating a subject or voting for a bad contract that we did not really want, or participate in meetings to present our views on that contract. For the upteenth time the APOA is you!!!! Don't like the way it's being run? Then attend meetings and participate! Or just maybe run for office in YOUR APOA. But probably you'll shoot yourself in the foot with this lawsuit. Don't throw the baby out with the bathwater, knuckleheads! Eye, you are also being irresponsible for supporting this bullshit tantrum being thrown by these two crybabies! Suggest some solutions, just don't whine. In the long run you will negate anyone from wanting a leadership role in the APOA, there by falling into what Berry wants in the first place.

Fire Fred Mower. Ask the Department of Justice to investigate and indict Joey Sigala and others for misappropriations of APOA money. Disband the current APOA and start over with better safeguards in place.

APOA needs to find a way to settle this before the union is embarrassed any more. The plaintiffs do have recordings and unless the district court is corrupt, a large pay out is headed their way. However, by viewing the comment by 8:46, it is clear that individual is an officer of the union and is displaying the type of small-minded individuals running what apparently is a corrupt union. Let's see, your recent past president took a plea of fraud because of "missing funds", the union turned over their basic operations to Fred Mowrer, a friend of Schultz, Eden, and Berry, and there are individuals who think these cops shot themselves in the foot? What fools you all are. You are corrupt and you're about to be "outed".

I was at the LEA hearing today, saw Ken Ellis' inspired presentation regarding the integrity of John Doyle and Robert Woolever. His strong presentation obviously frightened Nathaniel Kornfield and his minions on the board so much, they would not let John Doyle or his attorney address the board, which is their RIGHT! Instead, Kornfield stated they would rule on agenda numbers by the record! Doyle's just happened to be in that package of agenda numbers! You see the cockroaches can't stand the light. Kornfield will do anything to protect his and Jason Peck's phony businesses and no-bid contracts! The corruption runs deep!

The corruption in this state runs so deep, we are doomed. People don't vote, they don't get involved, the mayor of our largest city succumbs to graft! But, then, it appears the tax paying sheeple of Albuquerque are so intoxicated by their own self-righteous indignation, they can't see the deep corruption around them. To the good cops of APD, if there are any, you work for a s**t department, ran by foul, corrupt, greedy leaches, who depend upon you NOT stepping up. You should open your eyes and watch that video because that guy wasn't handcuffed until way after the force being used on him was ended. You can clearly see the the cuffs coming out after the one officer kneels on him.

You hope the lawsuit won't be successful because you probably have a vested monetary interest in it failing. Guess what, the only way it fails is if the District Court is corrupt. Recordings of admitted wrong doings cannot be swept under the rug. Ask Mowrer what he said..ask Lopez what she said..yes, the only way the suit fails is if the entire state is corrupt and full of graft...which it may be. But, wait, then the Federal Court can be appealed to!

You know, I just read a story pumped out over facebook by several 34's in APD about a cop that resigned and in his story, lauded Chief Eden. He is a good man, he is concerned about the state of the department, and bewails he has limited power. This officer said that during his exit interview he was impressed by Eden and hoped Eden would be given a second term. If he was so impressed, why did that officer not rescind his resignation? Also, let's use an investigative technique, let's look at Eden's associates, the city administration. First, Berry, a corrupt, lying, POS; Second, Perry, a fat, drunk, lying, POS; Huntsman was brought in, a rather heavy handed enforcer for Berry; at Eden's first opportunity he made a fool of himself by declaring the Boyd shooting was justified! Eden left a good, cabinet job in Santa Fe to join APD (for a large salary). He knew he was coming into a den of snakes but I guess cash disguises a lot of "character flaws". I guess you do need to pump up for your PERA. If you associate with low-lifes, you are probably the same, huh, Eden? For the officers that pump this bilge-water out on facebook, you are all part of the problem. You're not proactive, you milk radio calls as long as you can, drag your feet to urgent calls, in general, you do as little as possible, hide as much as possible, but wear a badge and gun and draw your salary (while milking as much OT as you can get away with). I bet you folks didn't even vote in the recent APOA contract situation. If you aren't part of the solution, you're part of the problem. We know who you are.

I do not think you are retired. I think you are washed out. If the information and evidence possessed that sparked this lawsuit is as lethal as it sounds, then even more information will be garnered through the depositions and incoming subpoenas that will trigger indictments if they are not already on the way.

This particular LEA filling just happened but why are we just now hearing about the other times Lopez was disciplined. I am not a fan of her at all but it's time to step back and stop asking why we are hearing about the other incidents and say why now?
Why was a Chief allowed to oversee the discipline of a Union President during years of contract negotiations? (I'm confident BCSO would gladly do these in partnership since he's had APD brass render second opinions in the past on his people's discipline during contract talks.)
Why was the media NOW informed of past discipline that has nothing to do with what went to the LEA Board?
How very interesting that right after a contract finally passes this all comes out.

The Berry camp is setting up one repeating pattern "those thug protesters that wont work with me" "I had to give in to pressure from someone who protected a thug domestic abuser in the name of the out of control blue wall". Tanoan will be opening their checkbooks again.

I suggest you actually read the Civil Complaint, which you can do online at the District Court website. If you have read the complaint, then you are a bigger moron than you come across who does not know what your talking about.

The complaint is filed against the APOA Union seeking compensation for lost wages with APD, job benefits paid by APD, and promotional, training and employment opportunities with APD, none of which have ever been paid by the Union to these cops. The City and Schultz are were NOT named Defendants and would be necessary parties to get such damages awarded. Failure to name the City and Schultz could be considered legal mal practice. At best these two cops have a breach of contract action against the Union, which is still a stretch when it comes to the awarding and determining damages.

Even if you get the recordings of APOA officers you refer to admitted into evidence, which is a big if, you still have a very weak case. What will overshadow the entire litigation will be the video of these cops beating the hell out of a citizen and kicking him in the head and used by the City to fire them. The ultimate question will be were the firings justified, in which case no matter what the Union did or its officers said, or for that matter, did not do to defend these two, would not have mattered and would have no consequence. The cops still would have been fired. It was the City's and Ray Schultz actions that caused the actual damages.

PS: As a trial attorney with over 25 years experience who never lost a trial, I will now go back and read the Eye and its comments for my morning entertainment, being ever so thankful that I never have to represent people like those who post on the Eye ever again! Have a nice day!!

The civil action that Doyle and Woolever should have taken was one for de-certification of the Union, removal of all APOA elected officers, reimbursement of Union dues with an injunction to stop withdrawal of Union dues by the City, and seeking a vote to select a new Union bargaining unit association like AFSME. But no, these guys are only interested in themselves.

The hospital released him after a cursory examination to go to jail. I support these officers..they brought in a highly dangerous felon, no one else in APD could, and guess what....they didn't KILL HIM! It looks like the Journal Editorial Board just bought themselves a several count Libel lawsuit. After years and a pattern of printing libel against these two, I am glad they are suing this rag. It is obvious that every time these guys fight this corruption, someone picks up the phone to the journal and the Journal prints lies and Libel to cover for Schultz.
Adios Kent Waltz. Collusion with a government entity to promote your business has put a few newspapers out of business. It looks like the journal and Kent Waltz will be answering some heavy questions about why they print an accusation as fact, when the video they are discussing shows nothing of what they said, and Schultz in a previous article stated the opposite. The editorial board of the journal is in a pickle on this one. Looks like everyone who needs to is going to learn a hard lesson.

Very well said and so true. A similar issue is the Union representing lower level Management at Library the union completely dropped the ball (Lee Whistle) and the Library was able to fire a librarian who was classified as permanently disabled due to aknee injury exaserbated by her boss making her shovel the parking lot during asnow storm. This boss did not ask any other employees to shovel, just the librarian with the bad knee. The union did nothing, altho he was asked to come to the disciplinary meetings they kept having on this poor woman! Lee Whistle did NOTHING and now an excellent librarian that admin. hated although this woman had 15 years with the city, Library Administration was able to fire her for her disability!!

That is a city website. I am all for collectively effecting change but the fact that the people in charge of running APD are corrupt and they refuse to remove those with major issues on the fifth floor, is a major concern. They are still up to their same old games of manipulating the media and hiding when the hard questions are answered. This program has the name "Mayor's outreach" attached to it. This is nothing but a pacification tool for everyone fed up about the lies and corruption. As long as this mayor is in office, there will be no transparency or outreach. It is all on his terms and only in a way that he and his people can control.
You will only monitor the shit that they let you see. Realize that. You really need to comprehend the level of corruption here and what is going on behind the scenes. That outreach program is total bullshit. The only way things will get done is with them being forced to do it and then having their feet held over the fire until it is done. This, of course after indictments for their crimes.

I wonder why the Journal did not write that biased inflammatory article about Doyle and Woolever after the KRQE story months ago. Why wouldn't they have written that then? It is obvious that KRQE had their story backed up with facts that these officers gave them, proving that Schultz and the city lied in the investigation and got caught. What is this Journal you speak of? That Tabloid run by that deformed Waldo looking editor? They should call it the Albuquerque Star. In the Smiths down the street, those papers sit in the rack and old folks are always asking to have them to line their bird cages with give their dogs something to shit on, and put in their kitty litter boxes. Very few read that yellow crap, and when they do, it is for amusement purposes only. Comparing it to a real newspaper from a real city one can understand why they are constantly patting themselves on the back. Their own writers admit that their stories are hacked and edited to pieces in favor of the political environment they are supporting at the time. I have heard their staff say that stories have been sent into editing, only to be gutted of anything that is detrimental to their cronies.

I would agree with you but the Movement fully intends to move forward with THE PLAN that Berry has now locked himself into. Tune in for what's to come. He was such a wuss that they had him on the schedule to do the welcoming speech at 8am but he was a "no show."

Hopefully no one learns of how Steph Lopez tried to interfere with ex-cop Chris Carabajal's DWI when he wrecked his truck at 2/mountain. I think there was a formal complaint against Stepanie by Ret. Ofc. Marissa Martinez (now with Isleta Police Dept). Dont mean to bring crap up but just tired of getting screwed by APOA and losing all the money I put in.

Tampering with cases is an integrity issue.

Funny, I can remember when Chavez initially appointed Schultz as Chief and everyone was so happy. Then Chavez lost mayor's race and Schultz said to give him a chance cuz Marty had shut him down. The Journal Editor owes Ray Schultz dearly for the favor that Schultz did for him. Schultz is a criminal and has a history of tampering with cases. When Waltz's kid was charged with Minor in Possession, of course Waltz arranged contact with Schultz. Schultz put som influence into things by the ways he usually does, and the officer never showed up for court. Because of this the case was dumped. This would have wrecked Waltz's little mijo's schooling, had he been found guilty, so when you are scratching your head and really trying to understand why the journal prints lies to cover for Schultz, this is one reason.

The journal also makes large sums of money from the city and Jerry Waltz is a lawyer who gets big money from contracts with the city. Jerry is Kent's brother.

These people are also so pathetic that they do these things to get the perks of rubbing elbows with these sleazy criminals running the city and to have access to things that are normally not accessible.

It is about time the real dirt comes out.

Many courts have ruled a employer must be forced to recognize a union if the membership votes to join an established commonly recognized entity. If you want to recreate the APOA with no outside oversight the city can reject it.
I say cops go join the real fraternal order of police or follow bcso lead and form an afscme chapter. Then dispatchers leave afscme and join communication workers of america. The one union who is all about what you do. The rest of the civilians, enough of this bull shit c series battling m battling E battling I. One local for all apd non supervisors. I was sick of my needs being overlooked by union concerns at transit and libraries. Plus the leadership didnt have a clue what I dealt with. Many of my coworkers wouldnt join because the union didnt see apd and afd civilians as a priority.... hell I hear back east pd and fd are joining teamsters. One chapter for sworn. One for civilians. Both working together for issues that affect them both.
Youve heard of happy wife happy life. Try happy dispatcher, happy records clerk, equals happy Officer.

Doyle and Woolever totally did the right thing. They took a career criminal off the street with not much more than a scratch. And even obtained the video footage for the report. Their Sergeant signed off on the report and the entire chain of command commended them on a job well done.

Get your facts straight. BCSOA did not join AFSCME they are a stand alone. If you are talking about the court security then you are correct because they did not do their homework and see how others felt about the union. No one wants to hear you pitch your union talk about worthless unions who just want to take your money and spend it on their own management style salaries and a lifestyle most real american workers will never have. All the unions you mention send part of your dues to their national union that does nothing for the local workers issues. The dues you pay go to support political agendas that have nothing to do with workers rights...like voter ID, Illegal imigration, democratic party. You think people like being part of AFSCME or CWA? I say no they do not, they have no choice but to be forced to be part of that collective bargaining unit.
Ask employees who are represented by AFSCME in Santa Fe County how they feel. A few years back, the same union that backed illegal imigration and fought voter IDs was facing having to deal with county layoffs directly due to illegal aliens causing a huge budget deficit because of the hospital having to provide medical care for them at the tax payers expense because they had no insurance and did not have the ability to pay. Get real about most unions they push to take anyone and everyone just for the money train. Ask yourself why and how can this be in the best interest of those they are supposed to represent.

If you are so unhappy in your "critical" position in the library, why don't you just dump the library thing altogether, go get some heels and microskirts, and go stomp up and down SE Central, and Zuni, and Gibson? You could free yourself from the abusive environment of the library, + make some bucks and help relieve the tension in the area, + add some much needed variety for the loser APD knuckle-draggers in the SE Command.

One thing for sure, we won't have to listen to the BS flowing out of Slopez or Willowboy. But then again any lawyer willing to represent them is just as stupid as they are... I'm just trying to figure out where they are going to find one fat enough for them to hide behind.
