Northeast Drivers Beware

No we aren't referring to drivers in New York or Boston (although you take your life in your own hands every time you put your foot on the peddle while driving in those urban paradises). We're talking about drivers right here in River City (AKA Marty's Magic Kingdom).

Not only does the Northeast Heights have the dubious distinction of being the first part of town to have the red-light scam-eras installed, but now the Northeast Area Command is enforcing the Schultz no plate cover edict with something close to a religious fervor.

Recently promoted Captain Bill Henz is making sure that his troops zealously enforce Chief Schultz's commandment by confiscating license plate covers that foil the "infallible" scam-eras.

Captain Henz is a recent promotion to Captain who replaced now Deputy Chief Kevin McCabe as commander up in the Northeast. Our Eyes tell us that Captain Henz was so "loved" by the officers he was chosen to command that during the most recent bid, all of the senior officers in the area command transferred out leaving behind officer who didn't have enough seniority to choose somewhere else.

Don't take this the wrong way... the new officers in the Northeast work hard, but simply don't have the experience to judge whether or not and enforcement edict sent down from on high (the 5th floor) is a legal order or not. They simply follow orders as one would expect them to do.

The real problem here is that confiscation of property (license plate protectors) could very well be illegal. The New Mexico traffic code does not outlaw license plate covers, regardless of what Chief Schultz maintains. (We explained our position here.) As long as the plates are clearly legible from 100 feet at night, your plate is considered legal according to New Mexico law. Further, there is no city ordinance that we're aware of that outlaws the practice of protecting your license plate (and your behind) with one of these scam-era protection devices.

So, confiscating a license plate cover that leaves your plate clearly legible by law enforcement could easily by considered larceny. We're not hanging this one on the officers of the Northeast Heights - they're just following orders. We're placing the blame upon the people who should know better, namely Captain Henz and Chief Schultz.

Currently, we have no knowledge of a judge making a judgment regarding the plate covers with respect to their legality (The Legislature has most definitely been silent on the issue). And our Eyes tell us that judges will often dismiss charges without prejudice rather than making a precedent setting decision. Therefore, the written law can and is being interpreted by people like Chief Schultz who know that they can get away with it until some other authority (either legislative or judicial) weighs in.

We'd love to see someone whose plate cover was confiscated file larceny charges against Chief Schultz and Captain Henz. After all the Constitution guarantees us the right not to be deprived of life, liberty, or property with out due process of law.

Sorry folks, I hate to remind you again that there is ALSO a City Traffic Ordinance regarding License Plate Covers: Read it & pay your fines!
8-6-4 LICENSE PLATES.
(A) It shall be unlawful for any person to park or to operate a motor vehicle on a roadway unless there is attached to the rear thereof, a license plate for the current license year, unless the state of issuance requires two license plates, in which case such plate shall be affixed to the vehicle as provided by law of the state of issuance; such license plate or plates to be maintained free of dirt, emblems, trailer hitches, or any other obstruction so that the color, state of issuance, years and license number or letters thereon are clearly visible.

(B) No person shall display upon a vehicle any registration evidence, registration plate, or permit not issued for such vehicle or not otherwise lawfully issued.

(C) No person shall display upon a vehicle a license plate altered from its original markings.

Yep - they'll have to rewrite the laws to cover every loophole.....giv'em time. I don't know how they'll ever enforce the trailer hitch issue, since most automotive manufacturers still put the licence plate mounts right behind the trailer Ball mounts....just place two or three balls, and you've got the plate covered!!! :)

Whether or not I run a red light does not change the fact that an officer confiscating a license plate cover IS larceny. If you can see through the cover and read the plate, it is legal. Dirt, no. Trailer hitches? How in the hell do you keep your hitch from obscuring your plate? It's right in front of it by design of the auto manufacturer....emblems? What kind of emblems? Ok, the law you are citing still says that it must be clearly visible. ALL covers allow you to see the plate numbers, that's why they are written so big. How a license plate cover can be construed as illegal is beyond me. If you can read the plate, it is legal....
And Henz has always been a putz. Clearly not loved by the troops. Any captain that has his guys looking for covers instead of burglars, rapists, panhandlers, graffitti artists etc, has been off the street too long. That has got to be the most chicken shit ticket ever. I know they have better things to do, are they being allowed to do them? Doesn't sound like it.

Plate covers to avoid detection are no different than the armed robber or burglar covering his plate with a rag to avoid being identified. Technically it is larceny if the item confiscated is not properly tagged into evidence and available for return upon dismissal. In addition, the officer and APD must maintain a proper chain of custody. Otherwise the state can not prove it's case. Without handling the evidence properly, whose to say that the plate in question is even the plate confiscated?

Bottom line is this. If the city wasn't out to screw the public
(which in 95% of the cases are law abiding),and they followed the state levied fine amounts, there wouldn't be this debate over plate covers. Number 1, we wouldn't be buying them. A resonable amount of $35.00 will get their attention. 2nd; the public sees this for what it is, a shake down by City Hall. We are only protecting ourselves against their sham hearings withhout 'due process' and their violation of our rights granted by the constitution. I wish someone of a law/constitutional backgound would step up and file a class action suit aginst the City on behalf of the public, who is getting reemed.

Why is it that my same exact plate cover that was legal before, or if illegal, was never an issue, (or at least in all my years of driving I've never ever been stopped for or even cautioned about the cover), now has become something that not only will I be stopped for, but it will be removed from my vehicle and taken by officers? Why is that?
I've also never been stopped, or given a ticket for running a red light. My dogs are spayed, and microchipped, have their shots, I don't water during the banned hours, I don't speed through school zones, and I am generally a law abiding citizen. I pay my taxes, I am overcharged for gas, and served on jury duty last year and actually enjoyed it.
I do vote though, and trust me, I will not vote for any official that is tying up my police force having them issue tickets or remove license plate covers when they could be doing other things that are certainly more important than making sure that Marty's camera's are making money, while not serving any other purpose. If I honestly thought that it was about public safety, then yeah, I'd be all for it but this? This is about money. How about this? Instead of putting cameras in traffic, why not put camera's up and down central to film what happens every friday and saturday night? Why not film the crowds going in and out of the stadium, or the parking lots? Parking lots at the malls looking for people breaking into cars? Anywhere there are crowds gathering? Pickpocketing, muggings, fights, assaults and rapes could be prevented this way. THAT is public safety. License plate covers? Pretty damned far down on MY list. And no, I DON'T run red lights. As I said before though, I DO vote.

Personally, I believe that every thing we do to hold people accountable for their behavior; will encourage good behavior and discourage bad behavior.

It is a shame that it had to be so hopelessly screwed up by our "leaders".

We have entrusted control over our power and resources to those who would abuse both.


It is time to regain control over power and resources that are fundamentally our own.

We need to stop electing people that fashion themselves as "leaders" and start electing people who will enable meaningful participation by stakeholders.

That and provide transparent accountability for public servant while in their public service.

(Yes, accepting the consequences of one's "disobedience" NOT "caving in" on one's point of contention. Say for instance non-payment of a red light fine resulted in one's being dragged off to jail. One would simply allow oneself to be taken peacefully off to jail--the consequence for non-payment--one would not simply hand over the money to pay a fine which one is protesting or just run away. The criminal act would be in one's running away not in one's choosing to civily disobey what one might consider an unjust tax to do otherwise would be pointless. Yes, it may be more trouble than simply paying up, but that is not the point of civil disobedience at all.

1 cup butter or margarine
2 cups sugar
4 eggs
1/4 teaspoon salt
2 teaspoons soda
4 cups flour
6 large bananas, very ripe, mashed
1 cup finely chopped pecans and/or walnuts

PREPARATION:
Cream together butter and sugar. Add eggs, one at a time, beating after each addition. Sift dry ingredients together; add to creamed mixture. Stir in bananas and chopped pecans.
Pour banana nut bread batter into 2 well-greased loaf pans; bake at 325° for about 1 hour and 15 minutes, or until a toothpick inserted in center comes out clean. This banana nut bread recipe makes 2 loaves.

You know...there was so much I could have done with this, but I am just going to go back to my head banging!
