Big Brother is Not Only In The House, But Big Brother Has Crossed The Line!

The Eye gets many emails every day, some giving us ideas for stories, others bad mouthing us. The Eye reads every single email. The last few emails we have received are from different people, yet all seem to have experienced the same incident. The Eye does not know if this is true, but The Eye can tell you several people have contacted us very concerned and wanting this to finally get out to the citizens of Albuquerque.
For those who don't know, APD has an Tech Services Unit that deals with the department computers and the problems that come with them. The Unit is not comprised of current college students, or computer "nerds". The I.T. Unit(Information Technology) has the newest computer gadgets and are not afraid to use them.
Rumor has it that there was a meeting where a flash drive was placed into a computer that was wired into the city network. This would be similar to an officer placing their thumb drive in any of the computers at the substation, or at the PTC. Let's face it, officers do it all the time. That is how the officers save their files, save their reports, etc. During this meeting the flash drive was removed from a city computer and then placed in an employees personal computer that was NOT hooked up to any city network and not affiliated with the city in any way. What comes next seems almost movie like, very Hollywoodesque. The Chief was able to see all of the files on the employees personal computer. This means if you use your flash drive in a city computer and then insert it into your home computer, the city is able to see what is on your home computer. Is nothing sacred anymore? Is there no line the Chief won't cross? What would justify the need for the Chief to retrieve any information from an employees computer? Where are the warrants?
Employees need to get locked flash drives (ironically the I.T. Unit has them already). Do not use the same flash drives on city equipment and then your personal computers. Password your file folders, do not let it be easy for them.
IF this is in fact accurate, this is more than an invasion of privacy. This is a complete disregard for the constitutional rights of an employee (DEJA VU isn't it CHIEF SCHULTZ)!

Again, The Eye has not been able to confirm these accusations. The Eye contacted a very reliable computer expert who stated, not only is this technology available and very plausible, it is very easy to do (especially in the APD setting). We would love to hear from Chief Schultz about this, however, he will never grant us an interview or answer his questions.

This chief's career is over. The next couple of court cases will seal it for this corrupt manipulator. You can't get away with this type of behavior forever. When you ask why a high ranking official gets away with what they are doing, the answer is always the same. "They got dirt on someone". How pathetic is this place? The impetus that keeps things going here is wrong doings, and the knowledge of those wrong doings by others. This is sick and disgusting. Just seeing Schultz on tv talking with that monotone, Mr. Rodgers voice while using his acting school mannerisms right out of the reporter 101 text book makes me sick. Maybe that is what TJ is hired for. To stick his fist up ray's ass, and work him like a puppet until he graduates the TJ JOURNAL school of theatrical deception. An idiot can see that this chief has a contract with the media aka the Journal and channel 7 to push his propaganda. The rights violator did the same thing in Scottsdale. The next time he's on the tv just watch him as he try's to be the charismatic peoples chief as he bobbles his head side to side like some news anchor, while he uses those corny voice inflections, as if he gives a shit about anybody but himself.
Anyone with half a brain can see through the imitation persona. If you can't, you need an operation. This, coupled with all of the phony baloney feel good bullshit this poser does in the name of fooling people is comically outrageous. Does anyone wonder why there is a filming studio in the main? Ray and his clown posse probably practice in there daily. Well good luck Raymond in your court cases because channel 7 won't be there to filter your random lies into some believable story for you.

Nice to see the shoe on the other foot. Civilians have been dealing with this sort of law enforcement crime since 9/11 and the patriot act.

It is great to see the local cops are no longer immune from their own police state. Remember in post 9/11 America everyone is a suspect until proven innocent.Coincidentally that is the same mantra APD has operated under for decades.

What is Law Enforcement and governments favorite phrase? " if you have nothing to hide ,you have nothing to fear"

buck up APD if the heat is too hot in the kitchen you can always pack up and leave. Now that would be a true public service............it would certainly make this city safer when the city's largest criminal gang is dismantled.

Hmmmm things are getting pretty interesting. I was eating breakfast at Wecks a few days ago and I happened to see and over hear some prominent local politicians asking Sgt. Paul Heh if he would run for Mayor. They were going on telling him that the corruption within APD needed to be stopped and felt that he was the man for the job. I sure hope he takes the advice. Ray Boy....you will get your ass handed to you! Ha ha ha ha ha ha!!!!!

Word is that DC Paiz pulled her letter of intent to retire after she heard the Chief may not be staying. She didn't want to stick around if she had no shot at his job for two more years. Any truth to this? Also heard Banks is highly interested in the Chief's position??? If there is a problem with the COP there has to be problems with his DC's

We can only hope that the department can get someone with intregrity, ethics and morals to be appointed Chief. And as of now I don't see anyone on the department that can step up and fill the spot. Very sad.....

Pauk Heh is definitly a one trick pony at best. The trick is constant complaining about APD leadership. He has no knowleged about any other areas of city government and absolutely no solutions, just complaints and demanding that people be fired at APD. He has never been in the private sector and has no idea what economic developement is or how you create jobs, let alone have any kowlege on how to manage governement. Paul Heh is generally well know for being paid excessiive overtime and knocking down over $90,000 repeatdely in yearly pay as an APD Sgt. So he is going to run on a platform of "I told you so, Mayor Berry, even though I supported you, voted for you last time, and now want your job" ??? Good luck with that one. I will not respond to any Paul Heh comments and choose to remain Anonymous.

Who cares what Paul Hehs political platform, lack of political where with all, and or his lack of experience is in the private sector?

The point of him running against Mayor Berry is to pull Republican votes away from Berry and he will succeed in doing just that thus putting Berry in a tough position at defending his record against both a Democrat and a fellow Republican with alot of "knowledge, good/bad" about Public Safety.

You can bash Paul Heh all you want but when you run as a Republican in a city where the facts are, Republicans are out numbered by 2-1, couple that with splitting the 'R' ticket with 2 Republican candidates and that most definitely spells a defeat for the sitting incumbent.

It's not hard to figure out... It's elementary math. A little adding, subtracting with basic division involved ... NEXT!

This is the second time I have heard about the City invading your computer and thus your home by illegal spying into your computer. The first time I have to admit I just blew it off as a rumor. When I saw the story on THE EYE I contacted a private investigator I know. This investigator has contact with one of the top computer investigators in the State. The answer I got back shocked me. The answer is YES it can be done and it is easy to do. My advice to everyone is password everything on your computer. DO NOT USE ANY EQUIPMENT ON YOUR HOME COMPUTER THAT YOU USE ON YOUR WORK COMPUTER !!!!!!!!!! I dont know if in fact the City ie The Chief is doing this. I do know it is a criminal offense without a search warrant. We have alot of very smart Officers. I am sure one or more of you could set a trap to catch the City in the act if in fact they are spying on you and your family,friends, attorney,ect. If this is going on, anyone involved,from the person who ordered it to all involved are guilty of a crime. If this is true,and if you are involved, you better come clean now. A defense saying I was ordered to do it, will not cut it at your criminal trial. If you are involved and dont know where to go,come see me. I will take your proof right to the D.O.J.. Chief Schultz is not a leader. He reigns by coersion, fear, and intimidation. HE and HE alone is the reason the department is in complete disarray. The time is long overdo for a LEADER. Bring the morale of this department back up. It is no coincidence that the news is showing officers getting arrested more often, and mostly for stupid things. This is completely due to the lack of leadership. Until you clean up the 5th floor, you will not see anything better with this department. The Chief plays by his own rules, the time is now. I would like to know where Joey Sigala and Ron Olivas were at, when they should have been at the legislative committee that overseas pensions (December 2). The members of the APOA pay these two to represent us, yet they were no where to be seen as the legislature was debating reducing our COLA's and making us work longer. Diego from AFD was there (he did a really good job by the way). But the APOA, the biggest police association in New Mexico, was no where to be seen.

We pay Joey and Ron to represent us in these matters. I know if I end up working longer than 20 years and losing my COLA I will be enraged that the APOA did not think it important to be at this meeting.

Joey and Ron where were you? Do you guys even know, or care, about what is going on?

Didnt you hear? Flip garcia is the current vicepresident and will be a sergeant by the end of the month. After he gets promoted he will be a sgt and he is staying as vice president. that means he will make sgt pay PLUS get the APOA pay. Where are the log books that officer willoughby requested to ensure that they are making their money. Joey and Flip made almost 100k between the two paychecks. to top it off, Joey is giving his wife a paycheck for being there when she was just arrested for DWI and she used APD as her home address on the report. WE NEED JOEY OUT he has lied to officers time and time again.

Let me ammend my initial comment from an earlier post.

After reading todays ABQ Journal Sunday edition (12/4/2011), it's now apparent to me and anyone else who understands local city politics that Mayor Berry being reelected is going to be nearly impossible. Mayor Berry WILL BE a one term Mayor!

I agree with Pastor Smothermon when he says "I'm going to tell you who didn't (stand up to the ACLU), someone who I actually helped and supported when he ran who I will not help again. Our mayor, he didn't stand up... . He runs and hides and he won't stand up for anything."

Police, Fire despise Mayor Berry/Perry and "NO" it has very little to do with paycuts its more about the lack of leadership and more to do with not standing up for public safety and doing what you said you were going to when you were out on the campaign trail from Berry (Schultz, ending the cronyism in APD/AFD, ending the intimidation from the chain). The mayor to date has over promised and under delivered. Sounds a lot like someone else who occupies a certain big white house back east. It's sad. He had so much promise and could've been a great Mayor but he aligned himself with the wrong the people, he didn't rid the city of some key Chavez appointments, he continued the status quo from the previous administration.

Berry is an inch thick and a mile wide in other words he is all talk and no substance.

All Berry appointees should dust off their resume. The hatchet man is coming... tick-tock-tick-tock.

Diego Arencon and couple other members of Local 244 E board do attend these meetings/sessions with a mission and a regularity and I've been there when APD has not had 1 representative at the table but Diego and his representatives always make sure APD is represented and has a voice at the meetings/sessions.

How you ask? The first is by attending the meetings/sessions, secondly by simply mentioning AFD/APD in the same breath when addressing State Reps/Legislators/ or PERA board members whenever the topic is about retirement age, pension percentages, to include COLA increase/decrease discussions.

I've witnessed it with my own eyes, heard it with my own ears.

I find it repulsive that Diegos' own department i.e. Chief Breen and a few of his deputy chiefs who sooner rather than later will be receiving PERA benefits themselves are doing everything they can to prevent him from preventing any and all of these very important PERA meetings which directly affects both departemnts and the benefits ALL of your respective members in current employ and retirement, (APD/AFD, union and non union members)receive.

Diego is not perfect. I disagree with him politically on some issues. He does have some faults but from where I sit (Santa Fe) the man is a doer, a go getter, and polished mouth piece who want's the best for the majority and not the minority.

Just my thoughts.

Berry was recruited to run against Chavez by the Republican Party and his campaign was run by New Mexico's verson of Carl Rove: Jay Mcclusky. One year later,Jay Mcclusky ran Suzana Martinez' campaign and he is referred to in Santa Fe as the 5th floor of the Round House because of his influence over the Governor. McClusky is rummored to be closely aligned with Darren White and he still carrys a big influence over Berry. The Mayors race is supposed to be "non partisan", but do not be suprised if Berry is the only well known Republican running with 2 to 3 Democrats running which will give Berry a real good chance of re-election and avoiding a run off with only 40% of the vote like last time. Mcclusky also ran Republican Trudy Jones campaign and gutted Republican Greg Payne for City Council. Republicans are so loyal to the point of being blind to Berry's poor performance and no doubt McClusky will go out of his way to keep out any well known Republcan, thus keeping the Mayors office in Republican hands. The Republicans want a Republican Mayor just like Berry they can control just for the sake of carying on the Republican Agenda of no taxes, reducing the size of government and destroying Unions, including the Police and Fire Unions and getting rid of 20 year retirment and other benefits the Unions have gotten over the years.

I respect every persons opinion but, I will predict the outcome of the 2013 Mayoral race.

Mayor Berry will be haunted by his lack of leadership in the areas of public safety and the fact he has not done anything to bring a significant business or created any jobs to speak of.

His adversaries now stand at just about every labor organization within the COA, victims of APD incidents, and according to todays Sunday Journal one of the largest mega churches in the state (20,000) members. To date key members of his administration have already left his staff some of these people were key to his campaign staff (T. Madrid), and to Jay McKlesky well he has been on a run of good luck but, I'm predicting it will end in October of 2013.

Years ago APD was a great agency. It is trashed now thanks to people concerned with their own selfish personal agenda. That IA sargeant is a prome example. Moral turpitude, sueing the department for rank and an overall piss poor attitude towards fellow employees. Officers are getting thrown under the bus for doing their job and guya like this who are active parasites on the department are allowed to thrive and are even rewarded for their disgraceful behavior. This is the culture of the Albuquerque Police Department now. APD is a treacherous place full of back stabbers and people who you can't trust for crap. They say one thing and do the other and they don't care who knows about it. There is no shame in their game. A blatant disgrace. Anyone who would take a job with this snare trap of an agency is insane. Totally insane. Officers are scared to death to do their jobs. There is absolutely no backing. I will go as far as to say that Schultz and company are LOOKING for officers to destroy. Just look at what they did recently. You have two officers who put away an armeed homicide suspect away. APD knew the threat this person posed along with the thret his gang poses. They never mentioned that. They never told the paper that the guy was a suspect of murder. They never told anyone that he was trying to get back into the the hotel for a reason. But what they did do was sling mud, and fabricate some chest bumping crap. I wonder just who the twisted perverted creep was who created that. Nothing about what was done to those officers was factually based, yet you can be a moral snake in the grass and thrive within APD. APD is in a horrific state. SAD!

To the poster at 8:24:00, I could not agree with you more. The department is no longer the same department I joined years ago. It sickens me to see the number of officers who have sued (whined) simply because things did not go their way or that the dues were too high for them. The command climate is toxic with no relief in sight. Truly good officers are looking to leave as soon as possible; the desire to serve has been replaced by the "what's in it for me" crowd looking to pad their own nests. It is a tragedy that such a noble profession and a respected agency has been reduced to where it is now. I wish I had faith in karma,,,

This is a stupid post. The department would not be able to see your personal information just from that flash drive unless A: you are storing personal information from your computer to your flash drive. B: You would need a keylogger or some type of virus/malware to achieve this. Which maybe 1 person knows how to do, but doesn't trust me. Let's not let paranoia get the best of us. If you are this paranoid please drop by Walmart as they are having a sale on foil. You can then use the foil to line your uniform and vehicles so "the man" can't track you.... Except flu shots... that is how they really track you.

Thumb drives can hold a lot of information inclduing executables to download your internet history and remote keylogging software, which can be installed just by adding the execute command to any script that will download. And by remoting into your PC, your home ip is available to that same remote keylogging. (Foil hats mess up my hair so I generally don't wear them)

I personally wrote a letter to Attorney General King regarding the Camacho Case asking him to have someone from his office present during this case regarding Chief Shultz inconsistent statements and now Shultz is bad mouthing the Attorney General's Office. To much of a coincidence. I bet Shultz will be doing a lot of things lately to take the attention off of himself like he did with Darren White's DWI accident.

The Attorney General should as that his certification be brought up after his actions in the Costales case cost the citizens a million dollars! If I recall correctly the federal jury said he violated Costales civil rights. That should be enough to pull Ray Schultz's certification.

As for all the Sgt Dr Gutierrez type folks, half the academy staff double dip and work at DOE/CTA/OST. Is this the same double dipping that landed some NMSP laterals in hot water, now they're with APD. There's rehires that should be working the field but their in hooked up positions, Defrates snaked his way into the advanced training unit-That was a hook me up from Lt. I'll steal your wife Montano, Dave Bartram is a rehire that should be working the field but he's got a cushy spot at the range spreading rumors and gossip-he must have mondo dirt on the chief because his training is outdated, he lives in the 1980's, will backstab others just for anyones friendship and lies thru his ass. Brian Carr and Art should have canned him when Art booted him from the tacrange. Rehire Kathy Garduno is hooked at the range from her SRO spot at her school. I've heard more than a handfull of folks saying she boinking Anthony Montano, only if Thomas knew, hell they all work at DOE. Folwer has a kickass hooked up CSA spot that allows him to work in russia and still keep his job at APD, yet another person Carr should have gotten rid of back in 2010. Hell the Lt leads by example, he takes time off for DOE training all the time, back when he was the K9 sgt and even now. I think the city council should look into all the double dipping, although it will be hard for anyone to find records of time off from these choosen few. I'd be surprised to see if any academy staff honestly puts in P-30's for time off, they're just like the 5th floor..... Didn't Russ Carter and Ken Ronzone get in trouble while double dipping in Ft Smith. Hey Ray, you need to let that comb over grow longer to hide your shame, you're a very bad man!!!

Re 12-13 3:11PM Dave Bartram did more good police work in a year than some of you will do in a career. Quit your complaining about him being assigned to the range, he knows his job and the poster can use more street time to learn his. Sometimes I wonder about the thought processes of some of you who post. His service deserves his days off as yours will someday.

Thats Apd's problem in a nutshell: no consistency. Some get hemmed up for the slightest infractions while others run amock with NO consequences and we all know about it. Nice leadership Sgt " I know nosing" Schultz.

The 34 Montano was doing was named Casey. Maybe she was ordered by him to date him while she was a P2/C. And he dumped her after probation..... Who knows... Wonder how her monthly evaluations looked on paper? She was married to another 34 with the last name Marquez. It is very sad what goes on..........

Oh yes it was Cassandra Marquez, while she worked for him as a Sgt. and while was married to another 34. Conducting "surveillance" in an apartment in the Foothills I believe. The same Anthony Montano who cheated on his wife repeatedly while he was in motors, to the point where he was in a bad 45 and she didnt even want to come see him at the hospital. Cassandra's husband confronted Anthony at one point, something along the lines of "hows my Di-- taste mother------" and instead of "attempting" to kick his ass, he files an IA complaint..........Pussy. Typical in this department, have an affair with a subordinate and get promoted. Speaking of having an affair with a subordinate and getting promoted, Fernando and his south valley skank wife who wanted to file a restraining order on a Werley because he was afraid he would rip one of his arms off and beat him with it, as he rightfully deserved. He gets removed from the position of her supervisor and reassigned with no discipline, then gets promoted. Yeah I dont know why this department has such bad morale and reputation. Do as I say and not as I do. It starts from the Mayor and trickles down all the way to the Sgt's. I used to be proud to wear my uniform.....what a frikon shame.

Creed of the new APD. Lie, Cheat, defraud, Murder, and fall in line with the administration, get a hansome reward. Have integrity, tell it like it is, be honest, fight for what is right, do the right thing, tell the truth...have everything done to the officer just shy of assasination. They aren't far away from that either. These corrupt vermin are sending a message. They want spineless yes men for cops, that will blindly do as they are told, no matter how wrong it is. They want people who see corruption, but are spineless to do anything about it. They want timid little souls who are so afraid of them that they are easily suppressed. They want cops who will second guess their actions to the point that they get injured or killed rather than their adversary, because then they won't come under scrutiny. The sympathy for of a dead cop is acceptable, over the criticism by people who don't understand police work, for an officers actions in the line of duty.

Today there is a huge line between an insubordinate employee and one that does not stand for wrong doing. The upper command staff of APD proved that they will follow politics rather than what is right. They prove that they will do anything to hide the years of doing wrong, that they fear so much of being called out on. They also prove daily that they are against what this country is all about. They fear freedom of speech, because freedom to speak means that the truth will be told. APD's policies are written to suppress officers from speaking out about the wrongdoing of the administration. It is written to protect them. It is Hypocritical in every way. Top command within APD have retaliated for years against officers for standing up.
It has been proven over and over,
and it will be proven again.
