Malfeasance, Misfeasance, and Nonfeasance



Well it's been quite a week for Albuquerque's Mayor, RJ Berry, his CAO, Richard Perry, and his police chief Allen Banks.

First we had the release of the disgusting open 911-call from 4909 Commanche NE in June 2013, several months before a young Omaree was brutally murdered.

But Banks says he didn't know about that 911 call.

Then we at the Eye revealed that not only did APD officers fail to honor their oath and do anything at the call or follow basic SOPs, but then they milked it for almost 2 hours letting other squademates in their area command hop calls while they did who knows what.

But Banks didn't know that.

When confronted with these facts, Banks was nowhere to be found, and CAO Rob Perry went before the media claiming an IA investigation was under way and the officers had been placed on administrative leave.

Banks was no where to be seen.

Why?

Our Eyes tell us that Banks was in Texas attending a certification by waiver class mandated by the Department of Public Safety so that he is licensed to be a cop in that state.

Of course, Banks reappeared because, our Eyes tell us, the absentee mayor demanded he come back and deal with this mess. And of course in Albuquerque the "mess" means finding out who leaked out the 911 audio tape. Obviously the mess has been left to fester because Banks has been asleep at the job and looking for greener pastures. And Perry is running around being a tough guy. Where of course is Berry, well for 41 days he's been hiding in his little hole hiding.

Berry of course, finally came out, and made about as much sense as, well nothing, "we have to start, and we can't start and finish in one moment in time. We have to, you know, we have to start at the moment where a child died at the hands of their parents, at least that's the allegation."

No RJ, we don't start there. That is where we end.

Because this mess began when APD Officer Jara had a chance to intervene and was nonfeasant in her duties to act and she didn't. Then the following June, we had the misfeasant actions of Officers Vigil and McMurrogh when they intentionally faded a call and milked it for almost two hours.

But worst of all, we've had the malfeasant conduct of APD Chief Allen Banks. This is the conduct that was willful and intentional and has harmed this community and this department. For months, nothing has been done to determine what the failures were that led to this mess. For weeks we have heard no ownership or accountability of the suppressing of this story. And for days we heard nothing about what the city is going to do to hold those in charge accountable.

Well know we know why, Banks didn't want this spilling out and affecting his new job in Round Rock, Texas. It can only be surmised that these revelations were intentionally suppressed because Banks knew they would jeopardize his job prospects there. In other words, he put his private interests first instead of the public he took an oath to serve. And Perry and Berry reinforce that behavior.

Sadly, all across the city there are dozens of Omarees that are going back to their own nightmare's called home. And Berry/Perry are doing nothing to model the behavior that we expect of them. We are being told it's ok to avoid responsibility. Heck we'll just spend $50,000 on a task force that will tell us what we already know: We failed Omaree.

This is not policing. This is not community service. This is not government. This is deception and abuse. While the perpetrators of Omaree's murder will surely face the consequences of their actions, we, once again, are being left holding the bag while our overpaid CAO and the administration of APD rests in total failure.

Why is the APD officer's union president continuing the beating, on the public now, that started with Omaree?

The blind, Berry, Perry, Banks, and the whole of APD's Top Brass, leading the blind, Ms. Lopez and Mr. Willoughby, in circles is getting the public very very frustrated......it is way way past time for them to 'man-up' and admit that they are the problem and resign forever from public office, forfeit their LEO certifications. and turn in their licenses to practice law for violating the public's trust that is owned by the public and only on loan to them.

They have proven over and over again that they are true sociopaths with their glibness and superficial charm and deserve nothing but a long stay behind bars until then can admit to themselves that they are the guilty ones.

Excuse me while I go pray for young Omaree's soul in the hopes that he, along with all of the other innocent souls, will haunt these piss poor excuses for human beings forever and ever...

All you need to do is say publicly that the APOA is charged with providing legal council for the officers to make sure their due process rights are not violated by the city. That's it. Nothing more.

ABQ Mayor Berry finally emerged from the bunker to talk about the storm raging over the mishandling of the APD investigation into the death of 9 year old Omaree Varela. He called the death "sorrowful" and will form a task force to develop ways to address cases such as Omaree's. The internal investigation by APD into Omaree's death continues as questions swirl about the two 911 calls the abused boy made prior to his death in which his mother is charged. Here's a long video interview with Berry and the paper's report. One question: Will that APD investigation include the APD command staff and Chief Allen Banks.

Omaree Varela was murdered December 27 2013. 41 days later Mayor Berry comes out from his bunker and makes a statement. He is going to spend $50,000 and start up a task force. Doesn't he have any ideas? And just what will $50,000 get us? Task force at the city level for a state issue? It seems he is just tossing money at something that he doesn't have a clue what to do with. He wants to go beyond accountability and create a better system. Well at least he said the word accountability. He doesn't know what a better system is so with $50,000 he will bring in "experts" to help him. Honestly this is mainly an APD issue. He runs APD. Please will someone tell him this?

Mayor Berry didn't crawl out from his rock/vacation and take an interest in the child's case until he finds out that there's APD involvement, lapel cameras and a 911 tape. Now the guy finally takes an interest weeks after the incident and rather than bring this community together and make sure some heads roll-- he announces that he will put together a task force. Immediately? No, when he gets a new police chief and it could take more than a year. And he might make the APD chief the head of the task force! Any other mayor worth a damn, would gather up community leaders, stand behind a podium and let the community know this won't stand. He should have said that whether APD was involved or not. Instead, he sheepishly suggests that he'll bring in some experts (maybe) and who knows what they will find out we may find apd is the best at child welfare or our approach is antiquated. What? This guy's got the spine of a jellyfish.

Even worse, in several points in the interview he tries to suggest this isn't an unusual issue, it happens in Oklahoma, Texas and around the world. That this issue isn't exceptional to New Mexico. Really? I think everyone who's watching this train wreck knows that New Mexico has a problem with how they treat children--from poverty to abuse to nutrition, we score among the worst. The governor and the mayor showed their true stripes on this issue-they are happy to ignore it and avoid responsibility/blame as much as possible. Sleepwalking through their terms in office. By the way, speaking of weak leadership, where's the city council on this issue?

HEY MR. BERRY!! There would be no need for a task force if the officers would have followed procedures. Even common sense tell us that if there were problems prior and the police kept getting called out and the desperate pleas from a nine year old boy should have been some sort of clue that there was something very wrong with this situation. WAKE UP MR BERRY!!

"As a mayor..." but you're not a mayor. Mayors lead cities. They don't hide from their jobs, they don't scurry and excuse. They get that they're fallible and rather than surrounding themselves with other, scared, incompetent people and harass the good ones who are concerned that the job be done right for the citizens, they hire outspoken critics, and they listen to them....You choose to underpay your rabid dogs, giving the new generation of APD way less money than you should, but offering thugs who could never hope to make $3k a month at any of the jobs they're qualified for(bouncer, mall parking lot security) the chance of a lifetime. Here's the thing. You hire rabid dogs to help you be a criminal, those dogs are gonna get away from you eventually. If you only cared about Albuquerque(and isn't that pretty much your whole job description?)and tried to get us a good police force, and good city leaders, you wouldn't be feeling this crappy, "Who's coming after me?!" feeling all the time. Your life, boy I wouldn't want it. You may be helping your friends, but jeez, to have to always wait for the hammer to fall, for the people to wise up, to figure out how of all the people in Albuquerque, you're one of the most broken, most incompetent......Haunted, is what you are. did you know you can go to Hell any time you choose? Whoever becomes Chief I hope he has the integrity and leadership the position has been lacking for so long. RJ and Ray will go down as the worst tandem in the City's history and are soley responcible for the current state of affairs. Ray's boys club started APD's downturn, RJ increased that ten fold.
We know who ever RJ appoints as Chief will be a soley a political move, not what is best for the department. That does not mean the new Chief cant do a good job and clean house. He has the opportunity and hopefully intelligence, unlike Ray or Allen. APD is in desperate need of a leader, step the fuck up and be a leader, not a powerhungry media whore and an RJ pawn.
What the hell has happened to this city in the last 10 years? Just drive down Central to see the boarded up malls and empty hotels. If Biden thinks JFK airport is 3rd world, maybe he should come look at us. Parts of our city look like a 3rd world country.
Nature at Play cannot be prohibited, but it sure as heck cant be condoned and rampant amongst the dept. If a marriage vow means nothing to you, neither does your word or anything you stand for. Do as I say, not as I do does not work as we have seen.
Rio Rancho got a leader, how about APD? It is sad to see what RJ and Ray did to the once finest department in the SW. It can be again, but will take time. There is no way that will happen without a Leader.
Final thought for the morning....is it just me or are some of the worst people you know the ones who profess their faith the loudest? I dont care what you believe or which god you pray to, how hard is it to have a good heart and be good to the creatures around you....how fukin hard is that???? I'm out.

We don't need an Omaree's law, we don't a task force. What we need are police officers with I.Q.'s high enough to be able read and understand police procedures. Instead of blaming the officers for their failures Berry is trying to take people's eye off the ball. FOLLOW PROCEDURES AND USE COMMON SENSE!!!! Nothing else is needed.

The fact of the matter is that these ladies shouldn't have even been allowed to be police officers. They preach the good word, all the while fucking over everyone to get the best vantage point to either lick ass or prove their undying loyalty and willingness to do ANYTHING to be the fair haired chosen pukes and get to the top. For these sissies, the department is their amusement park. Totally worthless pieces of shit, and pussies to boot. West: given carte blanche because he was a slack jawed good old boy. Peck: jumping through three or four units as a reward for fucking over two officers by intimidating witnesses, omitting justifying evidence and circumstances, coercing witnesses, and testifying as told to by a co-conspiring city attorney. To say this place is corrupt and disgusting is an understatement.

When the Feds link the Mary Han case to the scape goating of officers in order to keep the Feds out, and obstructing them from finding out about the prostitution ring and well known officials, bid rigging concerning a certain police equipment vendor, fraudulent and misappropriated grant funds, conflicts involving inappropriate personal business mingling with city employment, cronyism, lies, and a host of other crimes, it is going to get pretty hot in the kitchen.
This is what they call racketeering, and you go to prison for that. But hey, someone here thinks absolutely nothing is going to happen and the Feds are afraid of a bunch of lying cowards.

I have been an officer for 18 years. I have never had a dispatcher tell me I need to listen to a 911 call. If I was told to listen to a call because of how horrible it was, I would listen!!! Lazy ass officers like that make us all look bad.
