A Zebra Cannot Change its Strips or Can They?
A person is generally the sum of their habits, passions, and values. Different circumstances may enhance or suppress certain traits, but those distinct characteristics that make a person unique are always there. For example, a general attribute of police officers is their willingness to engage conflict. Persons who fear conflict generally do not thrive in the environment officers work in on a daily basis. The attributes that make a person a successful officer do not simply disappear when they take off their uniform. They remain assertive and direct, and willing to confront challenges. Most people remain aligned with their attributes regardless of the circumstances because it is the healthy and natural thing to do. Recent studies indicate there are serious health consequences when one is being unfaithful to their attributes and out of alignment with them. Such consequences include high blood pressure, weight gain, and diminished immune system.
Why is the Eye concerned about this? For some time we’ve been watching and trying to figure out what is going on with the City of Albuquerque’s Chief Administrative Officer, Rob Perry. APOA Attorney Fred Mowrer recently described Mr. Perry as “…the one actually running the city.” Mr. Perry is lawyer and graduate of Whittier College School of Law (a school perpetually on the American Bar Association’s probationary list for accreditation), and after a brief time with a prosecutor’s office in Florida, Mr. Perry came to New Mexico and bounced around between significant politically appointed jobs and private law practice. In New Mexico, Mr. Perry worked as an assistant to democratic Senator Tom Udall when Sen. Udall was the state attorney general. Shortly thereafter, Mr. Perry’s political contributions came through and in the late 1990’s he became the state’s Secretary of Corrections under then governor Gary Johnson. Mr. Perry appears to have done a respectable job streamlining the state’s prisons and was aggressive in combating corruption and abuses especially in the privately run prisons. Frustrated with actions by the private for-profit companies like Wackenhut, Mr. Perry remarked, “I'm at the point where I don't want to hear explanations or excuses. I want to hear about corrective actions.” (Lubbock-Avalanche Journal 8/25/99)
When AG Udall won his bid for the US Senate seat, Mr. Perry was quick to campaign for the state’s Attorney General as the Republican candidate. Mr. Perry lost that bid to Patricia Madrid. Mr. Perry then went back to private practice focusing on employment and criminal defense cases. This is where Mr. Perry catches the Eye’s concern. As a private attorney BEFORE he was hired by Mayor Berry, Mr. Perry defended criminals, employers in EEOC suits, and police officers. Mr. Perry was most notably known for his defense of Capt. Marie Miranda when APD tried to blame the evidence room scandal on her and other officers in 2005. In dealing with the over 200 cases the scandal compromised Mr. Perry stated,
"The prevailing thought in the chief's office was what people don't know won't hurt them…when you lose evidence in 235 drug cases, you don't tell anybody that is really a problem. They are trying to make excuses to sell to the mayor.” (ABQ Journal 3/18/05)
"I think it is unfortunate this has to be done in a cloud of secrecy. That is what got them in trouble in the first place," Perry said. "The public, as well as Capt. Miranda, has the right to know who did what and what action was taken against the wrongdoers." (ABQ Journal 8/16/05)
As a private individual Mr. Perry continued playing politics behind the scene with his devoted support of Darren White in Mr. White’s failed bid for congress. Mr. Perry was a large financial supporter of Mr. White and contributed $2300 him on 12/17/07 and another $2300 on 7/17/08.
What concerns us at the Eye is that while Mr. Perry has waged a seemingly honorable battle against government inefficiency and abuse he appears to have put this commitment on the shelf as Mayor Berry’s city attorney and CAO. He has consented to abusive employment practices where if he were in private practice he would be representing the officers in their actions against the city. He remains a supporter of APD’s Chief Schultz whom he opposed in heated litigation over a scandal that should’ve subjected APD to the terms of a federal consent decree and continues with the very same “cloud of secrecy” practices Mr. Perry criticized the department of in 2005. When a city hearing officer asserted that the city failed to justify the termination of an officer in a controversial case, Mr. Perry did not order an inquiry into APD’s ineptitude but moved to have respected hearing officer T. Zane Reeves recused from future cases and questioned Mr. Reeves’ credibility. Instead of dealing with APD the same way he dealt with the state’s prison system, Mr. Perry appears to let Chief Schultz continue with his abysmal record of management. Is this the same Rob Perry that streamlined the state’s prisons and increased their efficiency? While APD’s budget continues to grow despite decreasing manpower, we wonder where the efficiency hawk Mr. Perry identifies himself as remains. Where's the advocate for doing what's right when there have been actions by "wrongdoers"?
From recent outbursts with the media, city council, and most notably in defense of Darren White during the WhiteGate scandal last summer, to his general unfit appearance, we wonder if Mr. Perry’s lack of alignment is starting to catch up to him. After all it must be very unsettling to see Chief Schultz, a former defendant, continue to call the shots….

No offense but Saenz made ger bed. Sold out the department as the APOA pres and then made her career breaking the backs of other officers on the way up. Never actually earned a rank and retired after being burried in a position away from everyone...one she jacked up anyway. Not a good example as bad as Perry is.
Great article! Don't forget Schultz was a DCOP during the evidedence room scandel. How he came back as chief, to fix the problem he helped to create, only makes sense in the bipolar world of Albuquerque politics.
Perry for the mostpart has been a no nossense lawyer. One has to wonder if the politics has taken its toll on him. Eventually pride gets in the way of everyone and they will fall on thier sword in the end. Too bad
Nice try but incomplete. Mr. Perry's history is dirtier than this. He oversaw the privatization of prisons and allowed the terrible security that caused a Guard's death in Santa Rosa. He never isued any sanctions for any bad performance by the private companies and he could have. He has political connections that he thinks will keep him safe (they won't) and people can see that he gives settlements to some attorneys like his buddy Paul Kennedy ($2.5 million so far). All other attorneys he makes them go to court and fight. Nothing wrong with fighting for what is right but dont give it away to your buddy. Maybe Mr. Perry is afraid of his buddy.

There are agencies (big city departments) where you have to spend 20 years on before you hit a deputy chief position, for that matter a command position also, yet these entitled babies reach that in 8 to 10 years. That is a crime in itself. Your feet aren't even wet at 8 years. They definitely aren't wet when you went to a unit with three years on the job. Don't tell them that though. They are too busy judging officers whom they couldn't hold a candle to, or accomplish half of what they have done on the street.
Mr. Perry and Paul Kennedy had a company together to raise funds for the Republican Party. Wonder if their company gave money to the Mayor's campaign.
Perry must've popped a cork when he found out Liar Levy told the labor board they were gonna appeal unfavorable decisions made by Zane Reeves. So much for at least hiding her prejudicial motivations. Or maybe Perry told her to say that, Levy couldn't be that stupid could she???
The below article is about a hero police chief unlike the one we have here.
Greenland Police Chief Michael Maloney, who was due to retire in less than two weeks, was killed Thursday evening when he and other officers entered the house during a drug raid.
This chief stood beside his men. Not behind them with a knife in their backs or a gun to their heads. He didn't push them in front of a bus. He was a noble leader who took to the trenches with his soldiers. Not this chief. Not his DC's either. It must be an honor to work with a command staff like the Greenland NH PD has. God bless that chief and his men.
That chief was due to retire in three weeks. That is courage. We can't even get a deputy chief to tell the truth here for their officers, out of fear of losing their precious pension. How sad this place is.

What a contrast in leadership for sure. The 4 councilors missed a real opportunity to provide Berry with a suggestion in their letter. They forgot to add the line....please remove Chief Schultz immediately. I think they were implying it, but need to come out and say it. I guess Berry isn't bright enough to take their hint.
My, my. Perry and Berry just approved a $1.7 miillion dollar judgement against the City on a case where the City was going after drug users or drug houses. (Channel 13 report today) Another case that should have been tried but a settlment pays excessive attorney fees to one of Perry's buddy attorney friends. The attorney gets $566,000 in fees and the class members of about 150 each get about $7,500. Why does anyone challenge Perry and the blank checks he habds out to his Plaintiff attorney buddies.

Perry doesn't make sole decisions to settle lawsuits. There are many people involved in the settlement process for the city.
The city isn't ran like the APOA where you have one person writing his wife/girlfriends/himself checks at will.

In the city's motion to remove a hearing officer they state:
"4. The City need not prove that Dr. Reeves is biased. The mere appearance of bias is sufficient to disqualify him"

The typhoon engulphing the City of Albuquerque caused by the actions of vindictive, hateful, deceitful, self serving parasites is spinning out of control. Those shining the light on them have irrefutable evidence of the wrongdoing, yet the guilty are allowed to continue with their cancerous spreading of chaos that engulphs even the unwilling innocent participants of this city; the tax payer who is footing the bill for their indescretions.
The people of Albuquerque should know that their tax money is being used to cover up the wrongdoings of corrupt police officials who lie at arbitrations, lie in investigations, use illegal labor practices and engage in conduct that immoral and unethical to say the very least. The loss of money hasn't even begun yet. At least the the revelation of corruption has. The city officials and their lawyer seem to have no credibility now.
I for one hope Perry is still not listening to D.White regarding R. Schultz.

Just watched that story on 13 about that Safe City Strike force thing. If any of the families involved in calling for Schultz's removal read this I hope you saw the pseudo "death" cards the criminal nuisance abatement used. In my of the pictures of that video there was an ace of spades. That card among other things were put there by people like Det Ron Surran. They would put that card there as if they landed a big kill. They also took grotesque photos of themselves posing with there guns and shitvin front of the people they kicked out of the house. THIS is the real reason why this case was settled because Chief RaybSchultz also knew this type of stupid disgraceful behavior was going on with certain cops and AGAIN he failed to do anything. They settled this case so all of the evidence of this bullshit wouldn't come out.
The media should make a public records request and air those photos that 6:17 mentions.

Joe and Paul Kennedy are brothers. Perry is the driving force behind all the settlements and huge attorney fee payouts to Plaintiff attorneys. Before becoming City Attorney and then CAO, Perry had an office with Paul Kennedy and worked with Paul Kennedy on GOP issues. When Perry was City Attorney,he made sure to get rid of the no settlement policy in police misconduct cases and Perry quickly started settling as many cases as possible instead of forcing Plaintiff attorneys to trial and making them prove their cases and earn their fees. Both Kennedy brothers make a great living suing the City whenever they can. Between February 4, 2010 and December 5, 2011, $2,553,000 in attorney fees was paid to the Kennedy brothers law firms according to a print out of checks paid for attorney fees from City Accounting. Cases are still being settled with Perry being the driving force arguing that it is saving taxpayer money. So much for transparency in government. The Journal report says the City may pay $1.7 million in a settlement and says 30% is the normal fee, so the Kennedy Law Firm will get at least $510,000 if the article is correct.
Rob Perry has a lot of influence on which cases are settled.
Paul and Joe work together on cases. Joe may be on the front lines but Paul is helping him behind the scenes.
Councelors O'Malley, Sanchez, Benton, and Garduno, I commend you for your courage to stand up to an administration that can't take the truth, an administration that retaliates against you for calling them on their wrong doings, an administration that will stop at nothing to ensure their own parasitic proliferation and political well being. You are right. The problem lies with the LEADERSHIP of the Albuquerque Police Department. They have broken this city. They are the ones solely responsible for the sad state of affairs here. They have been caught in lie after lie after lie, in depositions, under oath, in arbitrations, and to the media. They use the media to spread their lies and to falsly act as if everyone else is the problem. They manipulate facts, lie, and distort their presentations to the media in a concerted effort to fool the citizens of the City of Albuquerque into thinking that they are not the real problem.
The officers know that the City Council of this great city supports them. Every officer also knows, but is terrified to say that the leadership of APD does not. The officers feel no backing and they fear that they will be the next sacrificed for these imposters to protect themselves.
Finally someone is stepping up to the plate. This was a long time coming.
The ones accused in your letter to the mayor again, did what they have always done. They have spun your words around to use against you, acting as if they are defending the police, and you are not. They attack the integrity of everyone who resists their wrong doing, and calls them out. They are pros at this. Do not let them get away with this. DO NOT BACK DOWN. STAND YOUR GROUND. They are the ones lying against officers at arbitrations, violating their civil rights, and rights to due process, creating hostile work environments, suppressing the voices of officers wronged by threats of termination for speaking out, perjuring themselves at arbitration hearings and lying at depositions.
Morale within the PD is pathetic, and it has everything to do with the leadership. The proof is in action. Does a mayor who removes vehicles from his officers, cuts their bennefits, dishonors a binding contract, and badmouths officers who protect our citizens from violent criminals really support them? I think not. Does a chief who blames his officers for everything from the discharges of DWI cases, to taking a bounty for shootings, and using them to make himself look good really back HIS officers? NO HE DOESN'T!
Does a union who cows down to both of these individuals back their officers? NO! They can't even speak out for their officers when this so called "Leadership" bashes them.
Please stand fast. Press them for resignations. Press them for facts and the truth. Keep at them. Chase the evil out of this town like the plague it is. Uncover their misdeeds. Do what no one else has had the fortitude to do. Do it for the city, it's citizens, and the officers of APD.

Consider this: If a lawyer learns something in the course of his representation of a client, he has an obligation to keep it secret, with the exception of pending life threatening criminal acticity. His only recourse is to make a "noisy withdrawl". That's not an option for a City Attorney - short of quitting their job, pension, benefits, etc. For whatever reason, the lawyers in the City Attorney's office have been heading for the exits in droves. Everyone in legal circles dealing with the City Attorney's office knows what a demoralized misery farm its become.
