PART 4: DOMESTIC VIOLENCE/A SACRIFICE IS MADE

According to the weather almanacs, the weekend of October
21, 2007 was a warm one. The daytime temperature for both days peaked at about
84F and in the evening it dropped to a cool 44F. One might have had a cooler on
during the day but not likely, and they certainly would not have had one on at
night.
From about 7:30pm Saturday October 20th till sometime after
midnight on October 21st, Levi Chavez's whereabouts were unknown and not
confirmed by any witnesses, despite being a police officer.
However, Tera was at her home on Ash Place in Los Lunas.
Sometime that evening, Tera had plans to meet somebody for dinner but that
dinner, for whatever reason, ended up in the trashcan. Since it was supposed to
be Levi she was to meet, and a neighbor reports seeing an APD police car back
out of the driveway, it was in all probability Levi Chavez.
Tera then changed into her pajamas, climbed under her covers, and watched television flipping through channels with the remote in her right hand. In her room, various pictures of her family sat on the dresser and night stand. It’s easy to visualize a picture of one of her children’s’ new born pictures… A picture of both of them. Next to the newborn picture sat a formal picture of Levi Chavez as a new Albuquerque Police Department officer.
Tera then changed into her pajamas, climbed under her covers, and watched television flipping through channels with the remote in her right hand. In her room, various pictures of her family sat on the dresser and night stand. It’s easy to visualize a picture of one of her children’s’ new born pictures… A picture of both of them. Next to the newborn picture sat a formal picture of Levi Chavez as a new Albuquerque Police Department officer.
Ironically, after clearing a domestic violence call on
Central and taking the suspect back to the substation at 7:44pm, Levi's task
were straight forward:
1) Tagging a tape (time allotted for this task; five minutes).
2) Writing two-page misdemeanor domestic violence report and
criminal complaint (time allotted for this task; thirty minutes).
Perea then transported the suspect to the PTC where
personnel there took custody of him at about 9:35pm.
While Tera had fallen asleep with the TV on and all the
houselights off, the remote in her hand and her index finger outstretched,
sometime after 11pm, in front of pictures of her children the killer walked up
to her with Levi Chavez’s APD issued 9mm Glock, thrust the gun into her mouth
almost into her esophagus and fired a single round. The 9mm bullet penetrated
her brainstem and did not exit. Death was instantaneous.
The gun was shoved into Tera’s mouth with such force and
rage that it chipped one of Tera’s teeth. Levi Chavez’s defense wanted everyone
to believe that Tera was some type of contortionist and flipped the gun around
and up-side-down to place it in her mouth.
The gun was forced so far back into her throat that her “gag reflexes” would
have rejected the object far before it could have went in so deep and
discharged.
Was there a conversation between the killer and Tera? Was this murder the act of domestic violence?
Was this murder partially part of a revenge plot? What would be the motive for such
a plot? Did the murderer tell or
threaten Tera with killing or hurting her children? Was Tera forced to allow
the murderer “carte’ blanche” to kill her to save her children? For most people they will do anything to
protect their children from harm. Was this the case with Tera Chavez?
Tera’s nightmare was over in a split-second. Tera's dreams of being free from the terror, horror, pain and hurt that Levi Chavez had caused, was finally over. Her new reality was not the one a loving and caring mother wanted. Did Tera give her life to save her children from a monster who now has them anyway? Was Tera’s sacrifice of death given in vein?
Tera’s nightmare was over in a split-second. Tera's dreams of being free from the terror, horror, pain and hurt that Levi Chavez had caused, was finally over. Her new reality was not the one a loving and caring mother wanted. Did Tera give her life to save her children from a monster who now has them anyway? Was Tera’s sacrifice of death given in vein?
The killer left the scene, but like all violent encounters
between two humans, there were details present. Details that were not
consistent with a self-inflicted gunshot and details consistent with the
actions of a killer.
-There was no “outgassing” spray of matter and/or fluid on
the bed, on her hand, or on her face after the gun was fired.
-Tera's eyes remained closed.
-Her head and upper torso sloped to the right.
-Tera's velvety hair was fanned out across the bed and not crinkled up, or folded under her head, as it should've been had she slid sideways. Tera’s placement appeared staged.
-The gun's muzzle remained almost free of biological material.
-The casing remained on the bed, but not in a position consistent with where it should be if the gun were fired in an orientation proposed by Levi Chavez. Due to the gun’s action, the gun casing will send the empty bullet casing a certain direct each and every time. The position of the bullet casing is consistent with the gun being forced into Tera’s mouth by a murderer and not the up-side-down theory of Chavez’s defense.
-Nor were there lacerations on the tongue that would be present from the sudden action of the slide exploding back and chambering a new round while resting on it.
-Tera's eyes remained closed.
-Her head and upper torso sloped to the right.
-Tera's velvety hair was fanned out across the bed and not crinkled up, or folded under her head, as it should've been had she slid sideways. Tera’s placement appeared staged.

-There was no DNA located on the gun which is consistent
with the weapon being cleaned off before it was placed by the murderer.
-The magazine of the gun was unseated. Dead people cannot
unseat a gun magazine only a live person like the murderer could accomplish
this task. This probably occurred when the weapon was being sanitized by the
murderer.
-There was no cell phone on the bed or nearby.
-There were no tissues on the bed.
-There was no note on the bed.
And lastly, the children were due
home on Sunday.
But the plans for the children to be safe at home with “Mom” would be changed and Levi had to get up to Debra Romero's house. She lived on Purcell NE, up near Spain NE and Juan Tabo NE. Here is another question that must
be asked: what if APD’s Chief of Police, Ray Schultz, would have had a policy
that prohibited adultery/infidelity?
Would this have prevented this murder or did Schultz’s failure to act or
his condoning of extra marital affairs contribute to Tera’s murder?

No, and Perea is a liar anyway.
Listen to what Perea said. There was absolutely nothing definitive. He is covering for a murderer, and eventually he will own up to this. He won't get his job back - he would not even want to get his job back. He is hated, along with all the corrupt politicians and PD employees. The two most hated are RayRat and Levi Chavez. Darren White was in there but he lost his job, and got an even better one, thanks to the governor.

How come the APD officiers that were at the Chavez house after Tera was shot were not charged with tampering with evidence? Or were they? They were totally out of their jurisdiction.

Obviously it wouldn't have mattered if a directive of NO FRATINIZATION WITH A MARRIED PERSON was on the books it still would occur because that is what humans do. It's always greener on the other side of the fence... It starts at the top and trickles down to a wet spot on the sheets.

With all of this I believe your still not at 1st Degree yet. BUT definitely MS or 2nd Degree. Why did they not include those as lesser charges for the jury to fall back on. Seems totally clear McKay overcharged and failed the Cordova family. Disgraceful pompous pick. And he gets his ass handed to him by a lowlife like Serna. Houston we have a problem....
There are lots of theories as to the not guilty verdict. There are those who say that Heather has some pull with her stepmother, others day the jurors don't have much knowledge and/or intelligence, problems with the judge in another Levi case and his being biased. I was as well versed as any lay person could be, and I watched the whole trial. I simply cannot understand how the jury acquited him given five weeks of eye opening testimony. I think they were tired of being there, and wanted to get it over with. To have not sent him to jail for life is beyond my comprehension. The many people I spoke with who seemed to know the case well are positive this jerk killed his wife.
That would have left RayRay out of the mix as he is the biggest manwhore of the bunch.

Can you name the crooked officers who showed up at the Chavez home? How can they live knowing what they did & how come they were helping Levi tamper with the evidence? Who let them know what happened and why were they compelled to go out of their jurisdiction to do such a horrible act? Were they on the clock too like Levi was when he left his jurisdiction to murder Tera?
Alot of good questions in part 4 except at the end when you try to tie Schultz policies or lack thereof to the story. If Levi ignored so many other policies, why do you think he would adhere to a policy prohibiting adultey/infidelity?
Statements or questions like what is asked at the end of part 4 show your distain for Schultz and politicize the story. Kinda takes away some of yer credibility.
For those interested, the case number for the last call Levi and Russell took is 07-120466 and the CAD: 07-1020/1098. The offender they arrested was Cornelio Tafoya. Oddly, on the face sheet, they put the CAD number as: 9719290/1098. I guess dumbass Mares missed that also. I wonder why folks in records didn't have that fixed.....
The scene was ruled a suicide initially by Sheriff's Dept. and by OMI. Did they both drop the ball and should have made it a full callout. Absolutely, to not fully investigate the initial scene was the biggest mistake made. Do women shoot themselves in the head. Yes they do, it is relatively rare, but I have seen it personally, more than once. However, I have never seen ANYONE shove a pistol into the back of their throat so hard that they broke a tooth on the way in. That my friends is what they call a clue....Thats murder. The APD Officers who showed up at the scene were there to console a fellow officer whose wife had "apparently" committed suicide. A cleanup after a suicide using a firearm can be extremely disturbing for any family member to attempt. The Officers cleaned up the scene of a ruled suicide to help a "brother" Officer. Is Levi the person his "brother's" thought he was, absolutely not. Is Levi a sociopath who has lied his way through his whole life, apparently quite well by the count of his "mistresses". Did he kill Tera and coverup the homicide using his very minimal knowledge, I believe he did. The DA's Office dealt the final blow to the case. A prosecuter can make or break a trial as we all know. I do believe My Cousin Vinny could have convicted him, what a bunch of morons, on both prosecution and defense for that matter. So dont blame anyone except Levi and Ray Schultzy for allowing this Piece Of Shit on our Department. This is not the caliber of Officers who make up 95% of APD. There are affairs of course, but not significantly larger percentage than the civilian population. When it is condoned by the Mayor,Chief and the command staff from the last ten years, then it becomes a culture which is part of the APD meltdown. From the Mayor down to Captains, they all need to go. I wish I could include Lt's and Sgt's on that list, but that can be dealt with by a true leader. Their has not been a leader at the helm of APD for a long time. Galvin's not looking so bad now...
Valencia County investigators can tell you who the APD officers were on scene. I have searched around, and the names are probably on the official police report, but I have not been able to find it.
Its all legalese 101, if you charge someone with a higher charge than 'evidence' indicates, later you cannot charge that person with a 'lesser' crime- double jeopardy. The prosecutor was bought and paid for by Levi's corrupt family.
7/30 11:06....I get it, but why did McKay charge him with 1st Degree only and not include lesser charges in the event the jury did/could not convict on the 1st degree. I've seen it all the times in the trials I've testified at. I think you're right. What do the chavez shit buckets have on McKay. Or the judge for that matter????
At least if their was a policy that would clearly state that "affairs" with fellow officers or wifes or husbands of fellow officer would not be tolerated. With discipline upto termination. Yes some stupid people would probably disregard the policy because it's "human nature" but people that are interested in keeping their career instead of satisfying their sexual needs would clearly get the message. If this policy was in place before this case half of the women in uniform would clearly be without a "lover" or a job. Now with all their business out on the streets all that was lost was APD credibility!!!!!
You mention the judge. I keep insisting the judge is either stupid or he is faking being a slack jawed mouth breather and on the take. McKay is green and a puppet for the DA. And by Levi 's family, you mean mob family? His family does not have a pot to piss in..
...Continued,,,,if a lower charge was also included with the 1st degree, by all means he would've been convicted. But, with only the 1st degree charged he gets away with the 'evidence' presented. After this 'lack of evidence' to convict him. He can not be charged for any lesser charges because of double jeopardy. In other words, the prosecution knew very well not to include the lesser charges or 'in the alternative,' because they would've gotten a conviction. And 'poor lil mijo' would've been 'F-d' in prison.
The judge was stupid...
