APD Contract: Backpedaling Berry/Perry Style

On December 15, just 11 days ago, Albuquerque police union president Stephanie Lopez sent an email to members presenting the proposed Tentative Agreement. In her email she stated:


"Voting will be held on December 30, 2013. We will have 1 box located at the APOA office from 8am-4pm and 1 box located at the Moose Lodge from 12pm-7pm."

In the days since this posting of the Tentative Agreement at substations and here, officers from across all spectrums in APD have voiced opposition to it. From supervisors, specialized units, senior officers, to rookies, all have pointed out the obvious: it restores little from what has taken away and makes things worse.

In numerous postings APD personnel have pointed out the seemingly endless deficiencies of the agreement and the obvious rush by the APOA to get the agreement approved.

Yet today, our Eyes tell us Ms. Lopez has confirmed what everybody has been saying. In an email to members she writes:

"[T]he city is still in the process of writing the final draft of the APOA contract to be viewed by the APOA membership. There were a lot of mistakes that still needed to be corrected and addressed within the tentative contract. There is not a final copy of this contract completed yet, however as soon as it is finalized it will be posted for 10 days before a vote will be held."

Ms. Lopez backs away from the 12/30 vote as states that there will now be an informational meeting regarding the tentative contract at 8:30am and 5:30pm at the APOA office on 2nd Street NW. Ms. Lopez then adds in closing to her email:

"The city has been very deceptive in the wording of the language in the contract so I am grateful for those of you who to take the time to read this contract and bring issues to my attention."

Excuse us? On December 15, the summary sheet attached to the tentative agreement that was disseminated and posted at each substation had a recommendation by the APOA Negotiating Team. Their recommendation was: ratification of the tentative agreement. And this is the team supposedly led by the city's former negotiator Paul Broome...

Folks, these are things that make one go hmmmmmm.

Not even two weeks ago APOA "leadership" was promoting the passage of this contract. After years of "negotiating" they presented this agreement as the best that could be done. Now, after the massive dissent expressed here and amongst the rank and file, Ms. Lopez has offered a glimpse of truth: that the city is engaging in deceptive negotiation tactics. That they are saying one thing but writing something else in the contract.

We and our Eyes have been saying this all along: Given that the city unilaterally broke the previous contract, what makes you think they'll honor even this absurd one?

In the Christmas day paper, the local edition of the Albuquerque Journal ran an article about staffing shortages in New Mexico law enforcement. The author sidesteps the fact that while APD is in a staffing crisis because of deceptive practices and the DOJ investigation such practices have invited, APD's sister agency BCSO is not in such a crisis. He also somehow misses the fact that the state's DPS and NMSP academies are full and maxed to capacity. Here in Bernalillo county, how is it that two agencies who share the same geographic footprint have such stark differences of problems? It is because of deception and incompetence by APD and APOA leadership. It's that simple.

What a pack of scrotum sucking prima-donnas! You scream she screwed up and then she listens to the membership (granted she should have done so first) and corrects the mistake. A bunch of instigating vaginas you are. Try assisting in the fix rather then attempting to divide the membership (if you are in fact a member of the APOA or that shitbag president of the FOP who has been attempting an over throw of the APOA for years).

No matter what contract the city produces it will be voted down. They disregarded a current contract and reduced pay so there is no requirement for a contract to replace what was taken. The city council needs to realize this. Once the current (evergreen) contract is made whole, then true negotiations can begin. This should be the focal point of any contention that the membership needs to grasp.

Before any contract is accepted, the current contract needs to be enforced.

For the uninformed. The City has historiclly said they have no money only to find millions after the contract is signed. Showing good faith the City should give back what was taken before you enter into any contract negotiations.

I wonder how many 34s that voted yes on the prior contract and the ones who are complaining today. The prior contract should have been turned down without a doubt and we would not be in the position we are today. As usual we vote into the City's plan and we get fuc*#d. Way to go.

The supreme court ruled this, ruled that. Yes, the issue was appealed by the city, and the SC reversed what the lower court ruled. The SC isn't the end all....there's more appeals...the lawyers will just keep bumping it up the next level. My understanding is this is now what is happening...I know the Clerical Union is trying to get that reversed, I can't speak to what APOA is doing.

What part of the 2000 (law) city ordinance is it that the APOA and APD agreed to don't they understand????? Time for them to cease and desist speaking to anyone anytime anywhere and take a seat in the back row.

9-4-1-14 MANDATORY COOPERATION AGREEMENT.
The City Council believes that full participation and cooperation of all parties involved is essential to the success of the new police oversight process and its IRO, and that APD hereby agrees and understands that their full cooperation is necessary, hereby agrees to mandate that its officers provide honest and truthful responses to all questions by the IRO or the designated independent investigator. If any officer refuses to answer the questions proposed to him or her by the IRO, or the independent investigator, he or she may be subjected to termination or disciplinary action at the discretion of the Police Chief. Compelled statements given to the IRO or the designated independent investigator, by a police officer will be used only for the IRO's investigation. The actual statement will remain confidential and will not be included in a final report or be forwarded to the POC. The IRO may summarize conclusions reached from a compelled statement for the report to the POC and the Chief, and in the public record letter to the complainant.

Loved the article about Banks. He managed to mention Shawn McWethy, Phil Chacon, Coach Hulsman in the same article. Even though Hulsman is the only one who actually knew him.

He also gets in how he also is a victim of the DWI problem in New Mexico.

Then he doubles down with the race comment and how full of faith he is.

This guy wants chief so bad he will do and say anything to get it.

When will Jennifer Garcia be removed from the 5th floor while her husband (or ex) is a Deputy Chief? What happened to the Sargent that shot her officer? What is the status of the Academy Director? Banks was part of the chain of command that approved Begay for hiring. There job is to make sure shit birds don't get in. FSB officers wear lapel cameras and are second guessed on a daily basis regarding their job performance. When will we start holding accountable those outside of FSB who are not doing their jobs? Is field services the only place where there is accountability?

There will always be males and females that make it through the process and become officers on every department. APD is just in the spot light due to all the shootings. The people in this state that have been shot by law enforcement have only themselves to blame. They choose to not do as they are hold. Their family members know they are scum bags but still insist they are such nice people.

Read the minutes of the latest LEA board online. The wonderful Apoa attorney is there to represent a client who is not there. He repeatedly admits he doesn't know the case he is there to talk about. Is this who we want representing us, an attorney who can't bother to learn the case before he is supposed to defend us.
If I were the BCSO guy I'd report him to the ethics board
