DOJ Gives Berry/Perry/Schultz/Banks/Eden an "F" But....

UPDATE!!! Regarding Chief Eden, disgraced former Albuquerque 5-Star Police Director Darren White says Eden should be "scrapped!"

In an interview with the AP today, the city's worst, Darren White had the following to say

Some also want New Mexico to look at state laws on hiring officers and deputies — especially since some officers involved in the 37 Albuquerque shootings since 2010 had questionable histories at other agencies.  Darren White, a former New Mexico Secretary of Public Safety, said lawmakers should immediately scrap a law that allows departments to hire officers or deputies for a year without having them going to an academy.  "This isn't the Wild West anymore," White said. "We have to change."


Funny, Chief Gordon Eden is reported to not have his police officer certification either as it lapsed and hasn't been valid for over a decade. Let's see how Berry & Perry, Co spin this one. Will they hire another agency to hide behind just like they are hiring a Cincinnati company to "negotiate" with the DOJ?

As the analysis of DOJ's report continues in the aftermath of yesterday's release, and we watch in laughter as Berry & Perry, Co. spin in the wind, let's not forget who's been endorsing the prime players of this mess: Kent Walz. Not even two years ago, Walz promoted this editorial:

In the wake of the DOJ report, this really makes one wonder what else, and how far, Kent would go to carry the water for Berry & Perry, Co? All during the window under which DOJ scrutinized APD, it's been nothing but cheers and fandom by Berry and his buddy Walz.

Then there was the time Schultz presented a report card on APD. Remember this goody?

  
So when we here that noise coming out of Berry's mouth that says "we know more today than we did yesterday, or the week before..." is he not simply admitting how ignorant he is? It sure sounds like an open confession of idiocy. And frankly, we're sick of hearing about all the PERF reforms Berry and Schultz implemented. Sometimes it's 40 reforms, sometimes it's 60. Well, our Eyes have been working hard on that little gem. You see, the vast majority of those "reforms" were nothing more than things APD should've been doing by their own SOPs and we'll prove it in the days to come. So reporters you're on notice that when you hear that noise come from Berry's mouth about "PERF reforms" that it's nothing short of saying "yeah they reminded us we had to do these 37 things..."  Sorry, RJ, you don't get to claim credit for doing stuff you were already supposed to be doing....

And thanks to these people, the rank and file of APD are now faced with the brunt of responsibility to fix their mess.

Lastly, our Eyes correctly pointed out the citizen groups moving forward and dancing around as if APD being taken over by DOJ is a good thing. Get real please. You folks are acting like nothing more than opportunists like disgraced retired APD Lieutenant Scott Lopez. While we appreciate your effort to bring heat on the department, let's have some decorum please, because you're starting to look like this:

And let's not forget what Ray Schultz said about his management of APD, and that DOJ would find that he had its "house in order." Ummmmm, not really TaserChief....

Saw the DOJ press conference and read DOJ report. Also saw Berry's press conference and news coverage on 13 and 7.

The DOJ report was scathing as to its findings but closed on a whimper with recommendations that were all predicable on training, internal affairs and identifying management failure. It was the sure staggering number of complaints of excessive use of force (over 1,800) where Internal Affairs found only 1% were not a proper use of force. The DOJ called it a "culture of aggression". When you read other similar DOJ reports like for Seattle and New Orleans, "culture of aggression" is NOT used.

Berry said during his press conference he did not want to play the "blame game" but did just that when he said it all started under Chavez and Channel 13 fell for it by reporting it tried to call Chavez for comment to no avail. The DOJ report sites two of the shootings out of 27 happened under Chavez, one in February 2009 and one in October 2009. During his press conference, Berry assumed NO responsibility for what has occurred under his watch for 4 years and 6 months, only saying "obviously we have not done enough". Berry made no apologies for saying for the last 3 years nothing was wrong with APD. What was shocking was his admission that he was not aware of a lot that went on at APD and that a lot what was found by DOJ was news to him that he heard for the first time.

Berry also said he did not manage the APD and that is why he hires professionals. Political hacks White, Perry, Eden, Wilham are what Berry considers law enforcement professionals. Berry not knowing anything of what goes on at APD must also go for all his other Departments. The job of any Mayor is to know exactly what is going on in each department and holding the Department heads accountable.

This is one clueless and incompetent Mayor. Yet Berry got re-elected sic months ago by a landslide with only 19% of eligible voters turning out to vote. Berry's opponents both said for 10 full months APD was in a melt down and needed a major overhaul, but no one cared, no one listened and too few voted. Why was the Boyd shooting a game changer for Berry? What about all the others, like the Ellis case that cost the city $8 million.

It is going to be three and half very, very long years. At least I can say I voted and it was NOT for Berry.

Hopefully DOJ criminal white collar has already started a case on Schultz and every vendor he had rigged bids with to do his will. Eg: Tazer contract and now he works for Tazer and Nate Korn whom has gotten questionable size able contracts through the City for APD in return for bullying the NM LEA BOARD into illegal decisions in favor of actions backing the decisions of Ray Schultz.

11th floor sources heard that Berry and Perry were actually taken aback by the extent of harshness of the DOJ report and they actually believed the DOJ was going to report and give APD a clean bill of health. Sources say Berry an Perry both believed Schultz and Banks had contained things with DOJ or at least they had reduced the level of scrutiny. The question now remains how long can Eden hold on and will Perry try to bully the DOJ.

Then former Commander, Nick Backass politicized the PD like no other. All of sudden neither one of them wants to admit the role they played in the Department's demise, they were both in the top tiers of LE in NM but won't admit it now. They are a disgusting example of political whores who will bend over for either party if benefits them, they don't even know what ethics are much less hint at it. The DOJ should have added a clause that says every officer should be tested for steroids randomly after being involved in a shooting or violent confrontation . And i don't believe for one second that Perry & Berry were clueless about how low APD had sunk. They didn't give a s*hit they just want to keep the corrupt money flowing into their pockets. They knew they just didn't care. And as i recall Marty was PO'ed about the 2 shootings in '09. Remember Marty's rant about "Guns and badges answer to suits and ties ". At least he gave s crap about and knew what_ was going on with HIS police dept .

Dinelli has kept his mouth shut for six months since the elections and has not said "I told you so". Dinelli had the balls to run, was right on virtually all the issues: APD mismanagement where he would have cleaned house, support of the minimum wage, support of a woman's right to choose, and support of marriage equality. Dinelli even qualified for public financing of $360,000 collecting $5.00 donations. Berry raised $950,000 in 4 months from Republican fat cats. Voters elected Berry by a landside so now live with it, but do not say there was no alternative.

Last time I checked those hired were adults. Why is it only supervisors responsible for the actions of officers? Last time I checked, adults are responsible for their own actions. Now if you want to fault policy that is required to be followed, then blame those who institute policy. Ultimately, it is the performance of the individual who is responsible for their actions. No matter how flawed the hiring process is, how flawed the training process is, how flawed the mental health issue is, every adult should be held accountable for their own action. This encompasses the citizens, their families, the politicians (city council, state government, and the mayor), the judges and attorneys, the doctors, and every level of law enforcement. To attempt to single out a select group is not only irresponsible but ludicrous. Society needs to accept responsibility and stop pointing fingers. There are several in the above mentioned groups that do a stellar job. It is the malcontents in each category that need to accept responsibility for the failures.

Lay off the Huntsman criticism already, he is not responsible for what has happened over the past five years. Most of the competent supervisors retired well before this mess unravelled. When Marty appointed a Chief who wanted to spend all his time at the FOP drinking and wooing his secretary leaving the department's business to the likes of Chavez, Sauer and Johnson, the ship began to drift off course. Then to boot Gallegos and replace him with Schultz almost sealed its fate. It was when White was appointed to Public Safety Director that APD lost sight of its mission and an attitude of superiority permeated the culture at APD.

Okay, the DOJ report is out and the work has begun (?) The first test will be how many officers will be bidding for field positions in May, how many squads will be the recommended size of 1 SGT and 5-6 officers, and if LTs will be working on weekends. My bet is it will remain status quo with an insufficient number of officers and supervisors in the field.

It appears the general public are finally realizing about Berry what is common knowledge amongst City Hall insiders and observers. Berry is very weak, is no leadeer and avoids stress at all costs. Berry cannot handle confrontation nor critics. Berry physically reacts to stress. When protesters showed up to the Mayors office on the 11th floor over a year ago, it was observed that he got very nervous and his hands physically started to shake and he left through the back door and held all of his meetings on another floor to avoid any contact with the protesters. During the first debate last year, Berry began to sweet profusely and could not guzzle water down fast enough nor put on enough make-up to cover up the sweet. During one of Berry's "one on one" interviews with reporters after the Boyd killing, Berry again could not drink enough water between answering questions. Berry's absence for 8 days after the Boyd shooting was no accident in that he was avoiding the conflict. Instead of going to the City Counsel meeting to listen to the APD protesters, Berry was busted attending a meeting with about 10 friendly young professionals and not meeting with civic groups about APD as was originally reported. There is no way Berry would ever arrange or attend public meetings where he may have to listen to criticism.

The DOJ report notes that in the vast majority of shootings multiple officers were present then adds, “Officers have a duty to intervene to prevent other officers from using excessive force.”

A duty to intervene and EVERYONE failed! With that said, all of you have blood on your hands! The APD house is so dirty, it cannot be cleaned.

The Kennedy law firm is not connected with Paul Kennedy. You should have your facts strait. Let's set it strait shall we. The Paul Kennedy Law firm is on 12th Street. That is the Paul Kennedy who runs interference for Martinez and the same one who is best buddies with Perry. The Kennedy Law Firm is on 2nd street, 10 blocks away. The Kennedy law firm is run by Joe and Shannon Kennedy. They sue the city and expose the corruption. Paul is involved in the bullshit going on in this city. Joe and Paul are brothers and are at two opposite ends of the spectrum. I think that speaks volumes of the integrity of the Kennedy Law firm, not to mention the fact of their track record and that they are among the top civil rights attorneys in the state.
Maybe you should research this before making conclusions and accusations. If the fix was in on cases they would be settled. From watching these cases closely, nothing is settled. The Kennedy's seem to fight out their battles and win them.

Joe and Shannon Kennedy are husband and wife and are two of the biggest ambulance chasers in Albuquerque. Interesting how Boyd's family were no where to be found for some time, but when they did surface, Joe and Shannon Kennedy are their lawyers. You got to wonder who called who first.

Joe and Shannon Kennedy are successful not because they are "among the top civil rights" attorneys, but because the City Attorneys office and in particular Kathy Levy are such poor litigators. Joe and Shannon Kennedy are in it more for the money and not their clients and all too often recover more in attorneys fees than their clients are awarded in damages and you can take a look at the Federal lawsuits they have filed over the years as proof of this point.

Although Paul and Joe are brothers, they do not get along but share the same right wing Republican philosophy. Joe has benefited from his brother's Paul success in getting Rob Perry to change the no settlement policy.

Now there is talk that Berry and Perry want Paul Kennedy to be appointed the Federal Monitor over APD. Lets hope DOJ asks Paul Kennedy about the Mary Han case.

The city has no choice to settle. The steamroller coming down the road is so lethal there is no defending against it, they don't have the resources to do it, and they will be desperately trying to keep their people from ending up in prison. The hammer is about to drop, recordings will be getting released, and charges will be unavoidable. Over the next year they will be trying to pay out just to avoid the little fish being snared, so it does not lead to the big fish being fried. All of it will be an exercise futility.

Perry, Berry, Schultz, TJ, Jay, Martinez, Korn, Eden, Banks, Feist, all brought this circus.

I hope the community leaders and families of the victims of APD 's brutality read this and realize that Kennedy is connected to Rob Perry and that their relationship in questionable as Perry may be encouraging Kennedy to provide kickbacks to him thru large settlement payouts. When you hear professionals speak, especially lawyers, government officials, and supposed legislators, they usually speak professionally and not in street slang. Joe Kennedy is taking up where Mary Han left off, someone had to fill the void. Mary would have been all over these cases!!! Its not the civil rights attorneys that have created this mess, lets not blame any attorney who steps forward to right the wrongs of a hand full of bad shootings.

The reason Huntsman was hired was Chief Eden paniced during the protests when the group started coming towards the command post. Eden had no clue what to do. We were all deployed with no orders of what to do. As the situation became worse, no one was running the scene. We were just standing there in limbo with no orders. Everyone just kind of did there own thing. I have been here 15 years and on ERT for 10 and have never had such poor leadership during a crisis! Chief Eden, TJ and a few others were in the command post on panic mode! I have never seen anything like it! They were all scare and did not know how to react.

That's why they hired Huntsman, so fast, to get him in command before the next protest! they figure his SWAT training will give them the edge next time around!

At least the DOJ will have Chief Huntsman there to answer for all those 1000 plus SWAT call outs he was in command of! Seems that what DOJ is looking at now! Berry and Perry sure know how to pick winners! Leaders that cost the taxpayer's big money!

Wow! That is just WRONG! I have no leadership in my non -LEO city job, difference is my life is not on the line! That is unacceptable for officers in a riot scenario to have NO FREAKING LEADER WITH NO PLAN! Eden is another bad hire which every city department is experiencing right now. Thanks for your service and glad you weren't hurt in that MESS! God help us all.

Ok-so let's talk about the Han scene, the bike officer was not 1st on scene, he did go there but he did not gawk like the others that self deployed. He only touched a few things, so his new DNA and past DNA could not be distinguished. Han was so over him and Paul btw. My question is simple, if my gym partner did not show up to a scheduled work out, I would have found out why not. Hours past with no word, so why did everyone wait so long to check on Mary? That pisses me off! Nothing about what was reported seems right. Why isn't any LE agency with jurisdiction not looking into this further? What about a cold case unit? This just stinks to high heaven!
