Not Over Yet

Friday, The 5th Floor continued its campaign to shift the blame. The David Young debacle has the brass worried that the apparent multiple civil rights violations and repeated fraud will spur another law enforcement agency to take a long hard look at the department.

We told you that Sergeant, uh... Chief Schultz would try to shift the blame to someone. We just didn't expect that he'd shift it to an entire program. Somehow in the Chief's mind the problem with the program is the program not the paid, sworn supervisors in charge of using the reserve officers.

The 5th Floor has never, ever provided anyone with proof that it has 1,200 officers on its rolls. Our Eyes have contended for some time that their "count" included reserve officers. Now would be a good time to get a full accounting of all full-time, state certified, sworn officers on the payroll. What do you bet that Marty's claim of 1,200 evaporates along with the reserve program?

The Chief's attempt to shift the blame to a bunch of volunteer officers who donate their time to the department in order to make us all just a little bit safer is simply reprehensible.

Meanwhile, the Root Beer Float Queen has flopped and flipped over whether or not it would be appropriate for an outside agency to do some digging on The 5th Floor.
District Attorney Kari Brandenburg said Thursday she will look at the cases her office prosecuted. She also said she feels APD can investigate the allegations involving the reserves making arrests.

She previously said an independent investigation was warranted, but clarified that APD should do its own independent investigation.
It's not exactly surprising that Brandenburg would throw Marty and the Chief a bone - after all, she's carried Ray's water before. (Can you say Ben Kirby?) Besides, she's not exactly known for her prosecutorial prowess.

The last thing Marty and his minions want is an independent investigation of APD. But we'll remind our readers on The 5th Floor and the City Attorney's office that there's plenty of reason to launch a criminal investigation and more than enough evidence to file a series of civil suits that will keep them busy for years to come.

Folks... It's not over yet. If for no other reason than attorney Mary Han isn't about to let it go. One of these days Marty's minions will go too far. Our Eyes tell us that they already have on more than one occasion. Stay tuned...

Why suspend the entire Reserve Program? All the Chief needs to do is follow the law. It's written in Plain English! The Reserves could be working tonight, as long as they are with a Certified Salaried LE Officer and don't make arrests or write citations on their own. See Chief, real simple just follow the law for a change.

Problem Solved! Put them back to work.


However, if you are using the Program as an excuse for the fraud, it's not going to work. We can all see what you are doing.

Almost every player in this debacle is an idiot. Mary Han, whose goal is to line her pocketbook, not help the downtrodden, is saying each arrest by a reserve officer is fraud. On what planet? To have a crime, you must have intent. If the intent is being certified by the government (APD) and going and doing the same things as an officer (making arrests) what intent is there? Stop wasting my oxygen Ms Han.
And now Ray will personally investigate each and every case of a reserve officer making an arrest. The Journal article on 8/28/09 says he was unaware they were making arrests and signing citations. Maybe he missed the huge story the journal ran on 7/09/07, "APD Reservist Patrols Duke City for Fun and Free". Did Ray think his reserve officer spent 30 hours on patrol a week and never did anything? That reservist was actually officer of the month in December 2006. Still Sgt Schultz sees nothing, and damn sure knows nothing! Come on Ray, I'll take up Marty's suggestion for bums and buy you a one way bus ticket outta here if only you'll stay gone!

It's very unfortunate, but the APD is not a healthy organization.

It has been rocked by allegations of corruption, mistrusts and scandal now for over 6-years and with good reason.

Morale is at an all time low! The Officers of the APD have abosolutely no trust that their Chief and his Deputy Chief's will do what's in the best interest of not only the Officers, but the Citizens of Albuquerque. The organization is plagued with top brass and a few Union Members that are just looking out for themselves or that sweet deal!

It's time for Change at the APD, they need a complete sweep of their current administration!

Hopefully, whomever wins for Mayor, Chavez included, will take a real hard look at the APD, seek input from the officers in the field taking the calls for service, not the union! However, it must be done discreately for fear of retribution.

There must be an accurate accounting of actual Officer numbers, as the APD reports being1200 Officers strong. However, the majority of officers would agree they have not seen any additional help in the field, nor have they seen a reduction in crime or calls for service. In fact, it's just the opposite, calls for sevice have skyrocketed and crime is on the rise!

The APD can not take four more years of this current administration, even most of the Union board members will state that fact behind closed doors.

The APD needs Change!

Mary Han will do what she always does - for money.

Apellate courts in NM will do what they always do and err on the side of releasing criminals

Politicians will do what they always do and decimate their subordinates instead of taking the sword themselves.

I.E. Mary's office makes money, the courts ensure attnys fees are paid on all the upcoming law suits and people like Dave and his bosses who were getting accolades for something just a few short months ago end up taking it in the shorts from the very guys who gave them the awards

To the person who says, "Fat" and how the "fat person" etc.... well, ok... so, the guy could loose some weight. Offer to help him loose the weight. Invite him to the gym and work out. The Journal ran the story about other APD Reserve officers writing citiations and making arrests because David Young was not acting alone and other Reserves did the exact samething, too. The problem was with execution of the law and interpretation of the law which does happen. Remember, there are tons of court cases where Judges are asked to decide interpretation of the law and judge how the law was executed (carried out).

For example, DWI. A person who has just one drink at a bar and drives carelessly can be arrested for DWI if the APD Officer believes that the alcohol played a factor in the careless driving. That's why you see on the DWI photos in the paper with the .01 with DWI on it. So, though the law says that .08 is legally intoxicated to be driving... it is how the law is carried out and interpreted. When there is alcohol in the bloodstream and a person caused an accident, then a person can be deemed DWI even with .01 in their system. That's why it is better never to drink and drive and why if you have one drink at a bar..., then wait two hours before driving (depending on body weight and sex).

Tell me: does anybody know if the above regarding DWI at .01 if Officer believes led to careless driving or caused accident to be accurate, or did the Journal make mistakes in putting DWI for numerous people showing their photos with .01 BAC and others that were well under .08? Again, the interpretation, mistakes in executing the law, miscommunication etc....

I'm not an attorney, so I have no idea whether an APD Officer and the court system has charged people with a .01 BAC with DWI or not. It is just something that I happen to notice in the paper with the photos and BAC readings for people convicted of DWI.

I bet how that Reserve Program got
out of line with following the correct interpretation of the law is just once one Reserve Officer did it, then others saw that... figured it legal to do also... and without asking about the legality just assumed that it was legal to do it. That's why several traffic cititations were written by Reserve Officers... There has to be more training on a yearly basis as to what powers that the Reserves Officers have. It was sorta like, "join the bandwagon," mentality amongest APD and the Reserve Officers without any person in the APD bothering to make certain that both APD Supervisors of the Reserve Program and the Reserve Officers were clear about the legal powers of Reserve Officers. APD Officers began to have expectations of Reserve Officers that were clearly not within the power of the Reserve Officers to do.

Why does the Chief contuinue to turn a blind eye to what is taking place within APD and when it's found out claims ignorance? For example Monica Wereley fooling around with her Sgt., Bruce finds out and tells the Chief and yet the Chief does nothing about it. A simple action could have saved her life. Marty do something or loose the race, if for nothing else because it's the right thing to do.

The problem here is the ingrained "good ole' boy" system at the APD. From Ray,Ray down, it's not what you know, but who's your bro! Rob Smith has a history of bringing his "boys" into the fold and he is allowed to do that by his chain of command or should I say, lack of one. He commits fraud on top of everything else, (i.e. covering up his ROP unit shooting at a fleeing vehicle), and was still in line for promotion. Ray, Ray and Co. punish beat officers for realatively small violations of S.O.P. and then allow crimes to be committed by Command Staff. Way to lead by example Chief!!!!!!!

If you go to court and lie about your status as an officer to prosecute somebody you've got your intent. It's in the actions by the individual my little brainchild.

I know this will be a stretch but think res ipsa loquitur and you'll get it.

Regarding Kennedy and Han...you're either too new to appreciate the fact that they've represented (and represent) many a cops or you haven't done anything in your career to recognize that for them it stopped being about money many many years ago...

And yes I've seen the other side of a 1983 claim and it's not fun, nor is it when you're being asked "were you lying then or are you lying now" by Paul Kennedy on the stand.

The painful honest truth is that without aggressive litigating attorneys people like Marty, Kari, and rogue cops go unchecked. Do you think any scandal/fuck up in the last 9 years would've been addressed without the counterweight that litigators provide? Not a chance.

The Administration allows major incidents like this to go unpunished while punishing some officers for small S.O.P. violations. When the Chief ignores rulings by District Judges ( graveyard lawsuit ) and continually violates the Union Contract, the city taxpayers have to foot the bill. Four officers not allowed to take the Sgt.'s test in 2006, which was right per contract and they recently won their lawsuit against the Chief and City. Can anyone say major backpay!! Us taxpayers foot the bill again!

call me silly but to file a criminal complaint you have to be a full time sworn police officer a reserve is not that. that is one issue i can see in playing out in a federal rights violation. i agree a lot of rop officers are not elite but we have officers who are expert in traffic accidents doing everything but traffic. it is the apd way, come on.

The negative comments about Mary Hahn. Well lets see first she is a defense attorney and if I ever need an attorney I would go to her or Paul Kennedy. So you fault them for that. The reserve program well the only basic thing that is required is that they work with another officer and they are working under that officers authority. This was not that case with numerous APD reserve 34's. But they were allowed to work in this case by the administration so who is to blame????? Maybe both of them. Regardless, you want to bash attorney's for suing the department well that is part of the check and balance system that this country is founded on. Who is there to to check the chief when he does what he wants and then tells our union president. It doesnt matter you can file suit, I will be gone by the time it is resolved. This arrogance has to be checked, while we may not alwasy agree, right is right.

Reserve officers should only be retired police officers.

The state should change this law in the next legislative session. Police work is a serious profession and it minimizes the risks and knowledge it takes to be a cop when you can be working at Jif Lube for your regular job and then strap on a gun and play cop once a month.

If police officers want to be looked at as the professional profession that we are, we need to not allow those who don't go through ALL the training. You don't see Sandia Labs letting anyone go in once a month and play engineer. Why do we let people come and play cop once a month?

The person who told TJ was an APD Officer being reprimanded. So, if that APD Officer knew all along that David Young was acting outside his powers of Reserve Officer, then maybe it is because he was not doing his job to begin with. If you see or know about an APD Officer/Reserve Officer acting outside their powers, then that APD Officer should have immediately pointed that out and not waited until only he was being reprimanded to admonish the APD Department.

I have noticed that the APD Officers who go to court and listen to court cases hate being involved themselves in anything, so pointing fingers might raise questions.

Were there Officer APD Reserves making DWI arrests? If so, then what is the correct interrpretation of the DWI State Statute. We always hear on the news that so and so won't be charged with DWI because the car accident didn't involve alcohol and/or the driver didn't have a blood alcohol of .08 or greater. So, how is it that there seems to be from what I noticed in the Journal photos of the individuals convicted on DWI charges people convicted for less than .08 BAC? Is reckless driving and wanton driving with a person impaired by alcohol at a .02 BAC the reason? Or, was somehow the law not being interrpreted correctly by Officer Reserves and/or APD?

Actually, this whole incident speaks volumes of this Chief and Mayor mismanagement of manpower. Here you have a civilian doing police work, yet there are dozens of cases where we have policemen doing the jobs of civilians.

We, the taxpayers, are paying police salaries to men and women who:

run the museum
work on computers
do chaplain work

just to name a few places. Police officers are a special class. They are the only ones who, by law, can violate your constitutional rights. Yet this Chief has them doing things that civilains could and should be doing, and for a cheaper hourly rate.

Let's put poliemen back to doing police work and civilianize these other positions.

I'll agree Mary Han, Paul Kennedy and Sam Bregman stick up for officers wrongly accused, and Lord knows we need them. But I still doubt their motivation is to help the little guy. I give great credit to the public defenders who work for nothing to ensure a good legal defense for people. My annoyance with them is not what they do, but how they do it with their ranting and raving in the papers and on TV about how wronged their clients were. Too much similarity to politicians for me.
Mary Han also said it's entirely innappropriate for a police officer to touch a woman's breats. I never worked Vice, but according to a DCOP it is legitimate. She should do her legal work and not make her statements. Each side has their evidence and their interpretation of the law, let it play out in court.
I'll still argue the intent for Dave Young. I agree he did not act as he should. The fraud comes in with the pay for a different job (civilian, fixing radios and managing a fleet) than he was doing (sworn and arresting bad guys). As to his signing arrest paperwork, his defense is that the chief of police down the chain know of reserves actions, it makes it hard to argue he had criminal intent to commit fraud by making arrests.
Look at it from the "fruit of the poisonous tree" doctrine. One excception to it is that the evidence is allowable if it would inevitably have been discovered despite the tainted source. He was arresting prostitutes in John Ops with Vice. If he wasn't there, the John Op would have likely gone on and the arrests would have been made. As long as it is within time, the paperwork could be refiled by the sworn officers involved.
The bottom line is this shouldn't be another politically driven case. Mr. Young will be the big scapegoat, and the higher your rank the less punishment. If he perjured himself, address it. Talking about kidnapping doesn't seem to fit. If so, is everyone at APD who knew of it and didn't report it up for indictment for conspiracy?

Does anyone know the statue number that requires someone be a full-time officer to file a criminal complaint. I dont believe you have to be full-time or certified. BCSO had part-time officers for years working at the courthouse since PERA only allowed them to week part-time. They could make arrest. The newspaper also stated you had to be certified to do a criminal complaint. Thats not true since departments all over the state have officer working the first year who are not certifed and making arrest and doing complaints. If the reserve was getting paid, then can he do a criminal complaint? It's floors me that no one knows the answer to basic questions.

How does this happen in a city of this size. The city has a legal department and I would have to question if the attorney's in the legal department have a law degrees? Or are they to busy taking all the cases to court that should be settled. Per the Mayor's policy.

I do think that Martin Chavez shouldn't have rerun again because even if he does win, then that really isn't in the best interest of the City. The City does need
to have a change, like a good shaking of a rug to get the dust off. Let' s see what another leader can do. Maybe, a new leader would be able to not only dust off the rug, but would put the rug outside to air dry and buy all new carpeting. Both Romero and Berry would try very hard to please APD Officers. Martin Chavez
wouldn't run again as Mayor for another term, so would have less to care about midway through about
keeping public safety. Martin's never been able to win as Governor, so Martin would be the least best candidate for the APOA to have chosen to endorse.

It's funny with the APD. I drive by this street and see an APD car parked outside at an apartment complex that is gray in color and looks depressing and think... probably divorced and can't afford another house, yet. Those APD Officers try super duper hard to stay out of trouble... which is why you kinda feel sorry for wannabe cop David Young. Basically, the Reserves were interrpreting incorrectly the state statutes in trying to expand the powers of the Reserves without having authority to do so.

I can just imagine a training session at the one day a month Reserve training between a seasoned Reserve and a Rookie cop.

The first time a Rookie cop goes to court.... the Rookie cop walks away thinking.... "I'm never going to get involved in anything like that..., or my family." The slightest bit of indiscretion that gets the attention of another cop would make that rookie cop feel inferior not as moral. The Rookie cop listens to the talk of the town about so and so and thinks.... he can't possibly be that way. Well, what this story basically is during an election year is a way for those that have been reprimanded to be upset and add fuel to the fire. It' s also a chance for those that haven't been reprimanded to see the need to help foster better communications and training between APD and the Reserves.

What's wrong with this picture. An APD Officer who parks his squad car outside a gray, depressing apartment and Martin Chavez, divorced, but owns a 1,000,000 home in the North Valley? An APD Officer who works in potentially dangerous areas on a daily basis vs. a guy that jumps, skips and runs to Skate Board Parks and press conferences on what seems like a daily basis. A guy that earns 90,000, yet owns a 1,000,000 home? While probably half his income is also tied up in alimony, too just like the (just an assumption, in my guess,) APD Officer that parks his squad car outside the gray, depressing apartments.

A Mayor that operates on local businesses such as Bode Aviation (who's owner is a retired Police Officer) on extortion vs. the APD Officer who through the APOA is graciously accepting a small annual increase in pay. A Mayor who intentionally blocks a long term contract at Bode Aviation and an International flight school because of "inflation," so raises the rent, but provides the very meagerest of increase in pay for APD Officer's even though "inflation."

Berry and Romero if either were elected, then either one would please the APOA as first term Mayor! Martin half way through would just stop caring about what the APOA thinks. My advice: if Martin gets relected, then APOA get everything the first year... because Martin's attitude will change.

Go with Berry and/or Romero APOA because both of those candidates would show the APOA that there skills as Mayor can earn the trust, confidence and respect of the APOA!

I told you they would try and let this scandal die. Nothing has happened to Schultz's top brass friends. They will cover it up.

However, when Capt Suazo told DC Castro he would not bend the rules for a cadet, Suazo was put on admin leave and transferred that day.

Why have they not removed the SID chain of command, it's because they are all best friends!

Mayor Chavez does nothing about it! Is this the guy you want to continue running the city, one that lets police corruption run rampant! He can't even contol his police chief!

Even though the APOA has officially backed Martin, the individual Officers and Reserves could make their minds up on the ballot! A vote for either Berry or Romero would allow for the kind of leadership and better improvements that the APD is looking for. For example, the Reserve Officer program could have a change in policy that has two hours of state statutes and how the law is to carried out. Second, the City would benefit in spending more on perks for APD invovling allowances that provide
personal growth for the APD Officer. Instead of having a Mayor with an unpaid personal debt with Bode Aviation, the City would benefit from a Mayor that could have created a "Personal Enrichment" program for APD Officers allowing APD Officers interested in learning to fly a plane free classes via a City contract with Bode. For example, Bode would forgo having to pay rent in exchange for free pilot lessons and instructions with the City covering gas expenses to fly the plane of up to 1,000,000 annually. A better mind makes for a better APD Officer.

Why not actually have APD Officers enrolled in instructional classes at Bode's International Flight School in exchange for City providing a long term lease agreement and free rent. The City Council could approve 1,000,000 annually for gas to fly the planes and APD Officers would soley be responsible for purchasing their own aviation books. Make that billboard not just a fantasy, but a reality in working out a perk between the City, Bode and APD.

The Owner of Bode Aviation who is a retired Police Officer in my opinion would probably enjoy instructing other Police Officers in how to fly a plane if given the opportunity by the City to do so.

Such a deal going through would in my opinion have more of a chance if either Berry or Romero were elected because Martin is too caught up in his own failure to pay his debt to Bode and in denial!

Officer Don Sanchez needs to set up a time to chat with a Sociological Professor at UNM who I'm certain would like to know about deviant behavior, patterns in Don's theory of meth addicts with hypersexual activity. Seeing all that crap probably gets to the typical APD Officer and flight and aviation classes would be a great way to uplift the APD Officer morale.

In collective bargaining: why would the City agree to spend 1,000,000 on gas to get APD Officers knowledgeable on airplanes?

Well, First: The Albuquerque and surrounding areas with the Spaceport near T or C and International Flight people coming in expectedly.... then.... the APD Officers would greatly benefit personally and professionally in having knowledge on the ability to fly an airplane and what that entails. To benefit the security in aviation and to better prepare for the expected international community which will be coming in to go up in Space and taking International Flight School training here in Albuquerque. It is just a way for APD to better familiarize themselves with flying, aviation community, security and not to mention boost the APD morale and spirits.

Who is the Lt doing the investigation? Do you really think it will be a fair investigation where Schultz's buddies, as well as his peers are facing criminal fraud charges????? I think not, if that Lt ever wants to be a commander!

APD needs an outside agencey to come in and investigate DC McCabe, Capt Hudson and Lt Smith. The latter two for sure committed the fraud.

So why has Mayor Chavez allowed this to continue? Is he condoning their actions? Is also protecting Schultz"s friends?

ABQ needs a Mayor that will put a stop to all the issues APD is experiencing. The citizens need to remember that on the day they vote for mayor!

The free rent in exchange for free flight instruction and lessons could be logistically set up allowing Bode to keep open a certain amount of time each week for APD Officers to sign up. First come first serve basis. That way, Bode wouldn't be dolling out 40 hours each week, but maybe 5 hours each week.

decals for City vehicles. That money would be better spent on something that is an actual recycling or refurbishing for the environment. Second: Berry or Romero would stop building anymore Skate Parks which allows teens to be idiots for awhile while at the same time keeps APD working on cases involving vehicles being spray painted across the street from Skate Parks, grafitti, drug activity and gang activity, fighting, noise, smell, etc..... Gee, Marty built 9 skate board parks in 10 years.... hmmmm......
a sport where the feasability study goal was to justify the cost to build skateboard parks, so conveniently left out important categories such as just mentioned above. Third: Berry or Romero would promote the City aviation, flight school and State Spaceport.

Garduno's is going to be greatly missed this year at the Balloon Fiesta. So, what is the City going to do at that location this year? I suggest allowing the Native American culture to utilize the area on the outside to build a traditionally sweat lodge for locals and tourists. A sweat lodge is a tent (can be actually teepee) that has fire going where people sit inside and sweat out their toxins. Sage is usually burning. The story about the Cancer Center that just opened up at UNM utilizes burning of sage. Sage burning is an ancient tradition used to clear up bad or negative energy that might be surrounding the person. It is sold at places like Jackolobes for that purpose. There would be no medicinal marijuana allowed of course. Ha! Ha! The teepees could be outside the Garduno's on the Green. The Native American Graduate Students and/or other affiliated organization could have access to set up concessions instead for locals and tourists, so that people could wait for their friends, family etc.... inside Garduno's and people afterwards the Sweat Lodge would have a place to relax and sip Lemonade (no alcohol beverages).

Just an idea.

People should stay on the issues that are relevant. There's a lot of valid points being made here. To the "cop in a bad mood:" I hope if you're in leadersip you don't think that's any way to treat your staff or others. Good leadership doesn't include threats of violence.

Bad moods usually affect good judgement. If you made that remark and you are a cop you need to leave this line of work, or change your attitude. It isn't too late to change, since you made your threat anonymously no body knows you are the moron who made it.

Well.... everybody gets into a bad mood in almost every occupation out there. The weak people go off and do things like that guy, McGinnis who committed suicide simply because he blew 3 times the legal limit and owned a Driving School. The people that realize their mistakes and voice their concerns don't keep all that inside, but people that do keep all that inside is all right, also.

David Young is being raked, so the comments about his Superiors needing to be reprimanded helps balance out that negative directed just at one person when it is more than just one person who wasn't carrying out the law correctly.

Martin Chavez for years has been the name on all the City stationary, City Event info, City
everything.....Is there really just one person out of a City of over 500,000 that can carry out the role of Mayor or is Marty just trying to pull the wool over our eyes?

As a career manager and administrator I know those reasons are probably why he is unable to run a police department with disciplined, trained and ethical management? An old axiom is that: "Every manager deserves the crew they have." The APD supervisors appear to be an undisciplined, incompetent bunch. The street cops probably hold it together in spite of the poor leadership they get.

I am not a Marty support but did he actually permit David Young to work or any of the other reserves??? The blame lies with the reserves as well as their immediate supervisors who knew this was going on and any other supervisor that knew and stood by. The APOA is there for us and while we might not always agree ( and I don't) we are the APOA!!!! So I have said this a thousand times "If you don't like the APOA leadership then run for office". No I am not a board member or even a rep but I respect the fact that these guys volunteer to serve in that capacity. The decision they make will not always please everyone but they are better for most. They cannot make a decision that will please everyone. Actually, a Tee Pee at the Balloon Fiesta would be a tourist attraction. A Tee Pee that would be a sauna inside would be a welcome relief for tourists at the RV Park. I bet if a group or organization built a Sauana whether it was a Finnish Sauna or a Tee Pee Sauna that tourists would pay money to get rid of their toxins! Imagine, you and your spouse go to the Balloon Fiesta and after watching the early morning balloons take off enter a Sauna. Saunas make the skin healthier and cleanses the pores! Saunas that are wholesome can be great health benefit. And, at the Balloon Fiesta Park where all the campers are that spend like 7 days or more parked in their tiny RV with all their odor..... well, Hawaii is trying to get a ban on Body Odor in public places...., so maybe it is not such a bad idea to put a Sauna at the Balloon Fiesta Park where the new solar light display is located (close to RV Park, too). Ok,... APD, I'll I'm saying is that in reading the above comments... maybe it's time for the APD Officers to do some collective bargaining and get something for stress reduction.... Marty's attitude toward collective bargaining has been.... something like..."well, there is over 1000 APD Officers, so pay increases cost the city money. That's why all those perks were only offered to new recruits in the hopes to attract new APD Officers. Well, Marty lacked creative and modern "welcome to the 21st Century" thinking (in my opinion). You could call an Eight Track player in 2009 "modern technology," only if doing a study comparing 18th century technology with 1970's. Well, "yes" compared to how Police Officers were treated centuries ago, the current APD collective bargaining is very advanced.

Creating Win Win situations takes creative energy and juice. For example, the exchange of bill board advertising space and bicycles for rent at kiosks didn't happen because Martin or Martin's team had creative juice. Martin may be willing to listen.... but he can't come up with anything on his own. Also, either Berry or Romero would also listen and implement great ideas and also: BE ABLE to themselves think creatively and fresh ideas!
