Target Kirby: The End?

We've long believed that former Officer Ben Kirby was APD's patsy in the Daskalos paddy wagon affair. Yesterday, the former officer plead no contest to interfering with a public official (krqe.com). [hat tip: Eye Reader] Kirby was initially charged with 3 felonies - assisting escape, tampering with public records and conspiracy tampering with public records.

We have long believed that Kirby's actions in the August 2006 Daskalos day trip (yeah we know it was night but we couldn't help it - the alliteration was too tempting) from the paddy wagon was initiated by a third party. One of the questions that neither APD nor the DA's office has ever answered is - if there's a conspiracy (even to tamper with public records - something the 5th Floor should know all about) - who are the conspirators (read it here)?

Kirby was drummed out of APD rather quickly following the incident (unlike probationary officer Levi Chavez who's a "person of interest" in his wife's death). However, the DA didn't charge Kirby for some 14 months after the DA had initially decided not to prosecute and after he had filed suit to get his job back (read it here).

A well connected developer - friend and major contributor to The Almighty Alcalde - gets special treatment after a DWI arrest (read it here), and APD would have you believe that Kirby acted alone even after initially charging him with conspiracy. Now Kirby pleads no contest to misdemeanor charges that will be dismissed if he stays out of trouble for six months.

The only conspiracy we see here is the CYA conspiracy to cover-up yet another 5th Floor mess. We hope after six months Kirby files suit to get his job back and spills everything that happened that fateful night - August 25, 2006.

It's a shame that Shultz can just ruin a person's life like he did with Kirby. He should of just received some days off if that, but Shultz swings the ax when he pleases. He fired Kirby before he was charge with anything except for filing to get his job back? Open your eyes people and see what is going on. He has fired other officers before they were charged with any crime and they were later cleared. Where's the due process? Or has the 5th floor finally learned that officers have a due process and that's why they haven't fired Levi?

Are you serious? Kirby ruined his own career. Surely as he was en route the BAT to bail his buddy, he should have been thinking, 'is this really a good idea?'

Hopefully Ben learned from this experience and he can now move on with his life, outside of a LE career.

Kirby is a criminal. It doesn't matter who told him to do what, an unlawful order is an unlawful order. Good ridence.

For the rest involved it will take an investigation by the Feds to get them.

Kirby made a mistake, but his firing was politically motivated, and out of line. Forget the money Daskalos contributed to Marty and Bill in return for things such as $1 million plus access to his new shopping center. Forget all the traffic tickets dismissed by the ADA in his pocket. Kirby got sucked into thinking he was helping a friend and didn't think of the consequences.

APD thinks nothing of promoting officers and supervisors who beat prisoners in handcuffs (violation of civil rights), or forge their timesheets by getting paid for not doing any work. And yet Kirby gets fired and charges filed after he sues just because he tried to get Daskalos a very early release from jail.

If what he did was so awful, why did the DA's office allow a piddly petty misdemeanor plea of no contest? Because there was no case and 3 years later, that's all they could get. I hope he sues and ends up owning Ray's house! I'd include Marty, but his ex-wife already took his.

On the poster above regarding Marty's ex getting it all, he has recovered well with a million dollar home in the north valley. Imagine that, on a Mayor's salary, what is wrong with that picture?

Usually, if there is an unpaid debt, an outstanding debt, then the person who couldn't afford to pay the debt didn't have enough funds. The Las Nochitas trip with a private chartered plane that Marty took (and many other trips) was not paid for the news reported that Bode Aviation is suing Marty on numerous counts.

In 2007, Intel was laying off lots of people. The Stock Market was teetering. People were loosing money. A Portfolio was disappearing even with investments that were widely dispersed. Several companies went under and filed bankruptcy. I'm just saying that I'm not convinced that Marty has accumulated and kept wealth.

This is just an educated guess. Maybe he is rolling in the money because of other things.... who knows? Anybody? I would like to see the interview of the FBI include a section on wealth and questions concerning why he didn't pay his debt and unpaid bill to Bode Aviation.

Has anybody seen Marty at the Casino's gambling? In a private poker game? Or, any trips to Las Vegas, Nevada or Atlanta or anyplace where there are Casinos.

Just wondering if Marty has a gambling problem, too?

Intel Corporation, in the news recently has reported an earnings increase. So, maybe the economy is improving.

We just need a new Mayor to allow
a new way and to give others a better opportunity to see light at the end of their tunnel.

Well, if those Capts an Lts putting up signs get their way, then Marty gets elected and Marty getting elected is going to make the Street Car a nightmare for those Capts and Lts. For example, a Street Car that takes up Central with one lane on each side will make getting around for APD on Central where the Street Car is almost impossible! That will also be a strain for not only APD, but for all emergency response crews! Then, there will be the improbability of APD Officers pay increases to be at the level state wide. So, expect this if you vote for Marty.... don't vote with your eyes shut, but a foreward thinking approach in what will happen when Martin gets elected again!

Somebody said that Lorenzo Montoya's family was out putting up signs for Martin Chavez. You know -the guy who lived 1.6 miles away from the West Mesa graves of 12 women- his family.

Somebody said that the families of the victims of the West Mesa murders 2000-2006 were putting up signs for Berry and Romero.

Somebody said that the Judge that dismissed the rape charge against Lorenzo Montoya after Lorenzo had his family take his baby to court to show the Judge... that the Judge is putting up signs for Martin Chavez. Is that the same Judge that overturned term limits?

Is there an attorney out there that could let me know if I have toilet paper made with Martin Chavez's face with the logo FARTY MARTY to sell, then because he is a public official, then is that allowed? I'm just another concerned citizen for the future of Albuquerque that votes!
