Does Silence Equal Consent????


After reviewing the footage of the recent Foothills police involved shooting which lead to the death of Mr. Boyd, the Eye has consulted with a technical expert on the equipment used, specifically the rifle wielded by the helmet camera equipped shooter.

Did anyone notice the level of noise from the flash bang, then the Taser shotgun? How about the bean bag gun at the end? Did you notice the extremely suppressed level of muzzle signature emitted from the AR-15 rifle used by the shooter, compared to the rest of these weapons?

If so, continue reading. 
An AR-15 is extremely loud, and would have been obnoxious had it been fired close to the camera that was filming it, but this one wasn't. Being close to the recording equipment, the AR should have been louder than the shotgun, but less louder than the flash bang grenade. This one sounded like a .22. Why you ask?
Because, if you look closely at the stills in the provided photos, you will see that attached to the end of the muzzle of this officer's weapon is a long fat cylindrical item. That folks, is a sound suppressor aka silencer. Why do you ask would an officer need a suppressed rifle for a situation like this? That's what we would like to know too. 
Chief Eden and the rest of the tactical cool guys will say these pieces of equipment are used by swat teams for sound and flash suppression in volatile environments like in the clearing of meth labs and to preserve hearing in close quarter situations indoors. They can say that, but how many documented cases do we have nationwide of civilians being shot with suppressed weapons, the same weapons that SEAL and SF teams use in warfare. This was not a meth lab situation, and the incident occurred outdoors, so why the silencer? Is this an approved piece of equipment? Was it personally owned? If not, when did the city issue silencers? Is this equipment on the officers range weapon's card? Is this why there was a discrepancy and some confusion on how many shots were fired? Is this why Eden looked so scared?

For our doubters out there, we were advised that this was an Advanced Armament model M4-2000. It is a quick detach suppressor that mounts over the flash hider with a ratchet mechanism to lock it in place. This means that it is easily removed in a few seconds, so the excuse of it being permanent, or labor involving to remove is out the window. Also, something like this makes your rifle front heavy and increases it's length, which is not conducive to operating in rocky vertical terrain. See the provided photos for comparison. 
After comparing, if you still have any doubt, this rifle was also equipped with an Aimpoint Micro T1 red dot sight mounted on a riser to co-witness with the Troy back up flip sights, and Aimpoint 3x magnifier, and a Badger Tac Latch charging handle. Thems some good Eyes!

Some serious questions and soul searching needs to be done into the culture and militaristic mentality of APD. This has to be a first. An Albuquerque citizen shot by police armed with a suppressed automatic weapon.

Mayors have a city phone, and it would be imperitave that A, he was briefed and without a doubt knew that that video was being released, and B he knew that the chief, Gordon Eden was giving a press release, because no brand spanking new chief in their right mind would go off on their own and give a press release on something this volatile without permission from the mayor and CAO.
This was conspired by Berry's handlers to get him out of town in order to have him play the innocent role while the video was released, then come back as the bullshit voice of reason. He is a hypocrit and a liar.
He vetoed the City Council vote to have the DOJ come in and now he wants the DOJ to look at this!?!?
And how many agencies need to investigate this?
State Police, BCSO, IRO, DA'S office and now Las Cruces!?!?

Berry and Perry should just handcuff each other and walk into the US attorney's office to turn themselves in.

Peck must have been working overtime putting the RED file together for the news Spin on The shooting. The guy was a mental patient, and sometimes a public nuisance. It is hilarious watching these guy's drum up what Boyd did years ago as opposed to what he didn't do last weekend.

Hey everyone small fruit Berry finally came out of hiding and now wants a DoJ investigation into APD.

This would be funny if it wasn't so cowardly.

Why cowardly? This guy vetoed the city council request in August 2011 asking for the DoJ to investigate APD. He said Schultz and APD were fine.

Flash foward to March 2014 and Berry sees his political future burning up in front of him. Now , after a week of saying nothing, Berry comes out and asks the DoJ to investigate APD.

Berry you had your chance to change things in November 2009. You decided to keep Ray Schultz and continue APD's march to Hell. Well it is 2014 and it sure is hot outside. Berry has himself to blame and the citizens need to hold him accountable.

I see it this way, Berry has to be able to say, when he runs for governor 2018, that he ordered this big investigation into this shooting. The DA's Office already takes every case to a grand jury. And asking the DOJ to investigate it, I bet they already had it at the top of the pile.
Berry did leave out the Attorney’s General Office, oh wait a minute let’s see. State Police was over seen by Eden and the Chief is appointed by the Governor, BCSO has a republican Sheriff, and Las Cruces is the Governors home town has a prosecutor. So I guess the Attorney General’s Office just has the wrong party affiliation.
So, the purpose of it being investigated by State Police, BCSO, IRO, DA'S, it's a show. So enjoy the show.
By the way I wonder if the BCSO guys will have the COPS camera crew with them.

Saw Berry's interviews on Channel 13 and Channel 4 and very pathetic, not just for him, but for the stations and its reporters. Berry look uncomfortable, his eyes puffy and his voice cracked in one interview. No hard questions at all by the reporters. No questions as to how much he,Perry and Eden were in the know last week nor why top APD management did not have better control of the situation. No questions asked if he intends to discipline or hold Eden accountable for his quick judgment that the shooting was justified or if he regrets appointing Eden. No questions on Perry's role. No questions as to where was Berry all week.

Berry referring the case to Justice is a joke seeing that it no doubt will be looking at the case anyway. Berry also vetoed the Council's resolution that asked for a referral to the Justice Department. Berry referring the case to Las Cruces Police Department accomplishes absolutely nothing seeing it has no jurisdiction to do anything.

Berry should be calling for a special grand jury investigation of his department, put all the officers involved in the shooting on immediate leave, and relieve Eden of his duties and figure out that he needs to look for another Chief. Berry should also tell the Department of Justice to stop dragging its feet, finish its investigation and take over the Department seeing that Berry's management team, especially Rob Perry, for the last 5 years has not got the job done.

Eden is clearly over his head and should not have been appointed Chief. Berry had no problem saying Eden made a big mistake and Eden should not have said what he said. Berry needs to admit his own mistake of appointing Eden seeing that Eden has now lost all credibility in the eye's of the public except Berry's law enforcement expert and number one Cheerleader Sherman McCorkle. Hey Sherm, way to pick em!

Why is law enforcement the investigative team and another one called in from Las Cruces? This will not quiet the public opinion unless people aren't listening and don't understand the investigative review team is by multi-agency police officers. Should be comprised of citizens, like juries. Not more police calling one on their own. Future ruling-justified by the mayor's team. Sickening.

So Berry brings in Las Cruces PD to investigate because they are the 2nd largest metro department in the state...but hires Eden as chief over two candidates that held the rank of AC at much larger metro departments in Texas. So does size really matter Berry? Maybe he should invite Dallas or Houston metro in to investigate this shooting.

Channel 13 interviewed Eden and he said he was "caught of guard by the question" was it a justified shooting? He said he was wrong with his answer that it was a justified shooting. Are kidding me? He had 5 days to investigate and be prepared. He gave his answer and opinion, was thrown under the bus by Berry and Perry, and now looks like and absolute fool.

A simple question for anyone who works for APD....why do you still work there? I have never met a happy police officer, nor have I ever seen a post on this site that was at all positive. All I see and hear are complaints that the department has gone off the tracks. Any quality officer should be able to leave and find work at a better police department for higher pay. So again, why are you still here? I have never encountered a group of people that hated their workplace yet refused to make any changes with their lives, APD is very perplexing. Maybe we are stuck with the un-hireables....

Good question. The short answer is, speaking for myself, we don't hate our jobs. Most of us are from Albuquerque, we have homes and family here. We do our jobs day in day out never having to shoot anyone. our problem is the current city administration and it's conplex dysfunctionality. We want to see this once stellar department restored to it's prior status and we want the criminal minds running the city and police dept behind bars. we prefer to stay and fight than run and hide. we want our department and city back and we have a constitutional right to express our opinion about that whether you think its complaining and negative is your opinion .

The answer to a simple question.
APD was once a good department. There are good officers on The department. The problem is complacency, laziness and lack of courage in the ranks when it comes to the problems plaguing the agency and pure greed, immaturity, unethical behavior, retaliation, dishonesty, selfishness, perversion, self dealing and general corruption at the upper ranks. A police department is not like a blue collar job where you can smack the shit out of some back stabbing little creep when they cross you. It is also not like a white collar job where you can complain on a supervisor without being retaliated against. So, yes it is very perplexing. It is a place where some people see it as only having 20 years to squeeze out the biggest pension they can. Most places people work till they are 60. Not here. It is not a hard job. You have those that took the job to be a cop for the right reasons caught between those who took the job for what they could get, the power, the connections and other selfish motives and their political owners. The real cops are the ones who can handle the authority without abusing it. The lunch money victims are the self serving scum who have ruined the department, seek rank and politics and financial gain above the oath they took.

Schultz brought much of this on with his dictatorship. He collected information on his enemies and targets to use against them. He kept certain valuable people close, and kissed political ass. When you stood up to him, he retaliated. Because of this culture, those officers with balls became outnumbered by officers that were afraid of some pink flabby punk chief who would ruin their careers just because they spoke out against him. A person like Schultz can always find people to do his dirty work for lucrative rewards of promotions. As this culture grew and took over APD, everyone started to only worry about themselves.
Morale was lost. The cancer started at the top.
Nobody trusts anyone within APD. I have never seen so many people whisper and look over their shoulders so much.

Considering all of the above along with some officers who don't know anything different, short timers and the ones who truly wouldn't get hired anywhere else, and you have most of your employee makeup. With the downfall do the department, most agencies will not hire from APD now. The place is a cancer and once sucked in you become stagnant unless you just have the balls to pull the plug, and move on, a lot of the good ones are doing just that. Money isn't everything. Schultz and his band of cowards who all retired and ran away the last few years are the reason for this. The mayor's hiring of a spineless non-cop will ensure the legacy.

Let me start by saying I am truely disgusted by the way this scenereo was allowed to play out. This man was needlessly flashbanged, shot and killed. This is not representative of the majority of APD officers, past or present.
This is a total lack of Command and Control by the cowardice Mayor all the way down to most of the APD Sgts.
As many have said, this should have been handled by Field Officers and their Supervisors. I have resolved several similar encounters with Emotionally Disturbed People armed with knives, very similar to this situation with no loss of life or serious injury.
If the Field cannot handle the situation a SWAT callout can and should have been approved.
ROP should never have been involved in this incident, except for gathering intel. Instead, ROP and their "Team Leader" was allowed to take "control" of this call.
When one looks at the TL's resume he appears to be a highly trained operator and sniper, dont get me wrong, he is very good as a shooter. However, when he opens his mouth, you find an immature, loud mouth punk who is an embarrassment to his badge and department. He is ultimately responsible for what occured that day as it was his Team. Even the dog did not see the aggression from the man and did not attack.
Everyone involved in this incident should be relieved of duty and their conduct should be looked at not only administratively, but criminally.
This man should be alive, all be it locked up in Las Vegas with the rest of the violent EDP's these officers deal with everyday of the week in this fucked up city.

Gordon Eden isn't even a good liar. Eden's statement "I realize that my comment on Friday was premature. I was caught off guard by the question. ..." is pathetic. FACT: Gordon Eden had five days to prepare for the press conference and was quick to site case law to reporters. Hey Gordo, what about all those meetings you had with Perry and Toureck to get you ready for the press conference? Eden, Perry and Toureck anticipated the question if the killing was justified. It was probably City Attorney David Toureck or Kathy Levy who gave Eden the case law to cite during the press conference. City Attorney David use to work for the State Risk Management Department after he left the DA's office and they defended State Police Officers in excessive use of force cases. Toureck knows all the defenses in excessive use of force cases. Perry and TJ Wilham orchestrated Gordon's press conference and when Gordon's comments blew up in their faces, Berry and Perry threw him under the bus.

ROP has always been rogue... remember in the late 80's when Polisar's crew killed that guy on Tramway? They couldn't find the weapon the guy supposedly pointed at them. Then, miraculously the gun appeared... of course that was AFTER they had done the search warrant on the offenders house... And of course the one officer on the scene who's statement was the he never saw a gun was threatened and intimidated all the way up to the DC's office...

To 3-25 7:21-I admire your honesty-it's not about hating your job, when an officer speaks out against the atrocities within APD, it's because they love their job, swore to protect citizens and have a right to speak about the corruptness they must work under every day. BTW, I am not a police officer, but feel very strongly that we cannot generalize or stereotype APD officers, based on the actions of those that should not be police officers. Doing so, only makes one as ignorant as the APD officers who violate the civil rights of the citizens. I am as outraged as others by the corruptness and killings as the next person, and hope DOJ takes over.

A group of lawyers protested at one point, after discovering that our officers tested at an average of 33 out of 50 on standardized tests. When pressed those community leaders averred that retention rates among officers suffered when more intelligent applicants were hired. Thus, to keep officers longer, less intellectually gifted is preferable. Go look it up.
Our city leaders have played a very dangerous game. Mayor Berry won’t pay for good police, he gives the job to doormen and bouncers, men who make $9 hourly until they get a dream job @$36k a year…They’re given extra rights and allowed to flex those extra rights by a leadership who are quick to cover for them when they do something illegal they get caught for….ever wonder why?
I’ve been researching these guys for several years now, since my own bogus, costly, run-in, I can tell you what I am reasonably sure keeps our cops safe from retribution:
Our city leaders, DAs, judges, councilmen, the mayor, his buddy Perry..they’re really busy making money off of all of us who the ostensibly, humbly serve. Blah. They steal money(think about city attorney Tourek, and his stealing and auctioning of cars after the ACCUSATION of DWI, and before the verdict of guilty) from innocent and guilty alike, making it a practice to have the cops accuse whoever is standing nearby with some crime, any crime. Most of you won’t have had this experience, because they’re pretty good about going after guys with little or no money. If you’re asked, and you can provide your own attorney, you’re good. If, however, you need a public defender, they’ll pretty much say and do anything they feel to you. What are you gonna do, hire an attorney and sue?
The jail is filled to bursting with panhandlers, jaywalkers, shoplifters. They stay through full sentences, and head out, homeless, jobless…to await the next cop, who can now take them in for vagrancy. The dangerous guys that get taken in? I don’t know why the jail has such pull, but those get released almost immediately. The jail doesn’t like dealing with hardened criminals either, you know. It’s why you are left asking ”What Much of our poorer population spends much time at MDC (I’ve never been given a straight answer regarding their generation of capital, who gets it, where it goes, who pays for inmates, who pays for alcohol treatment programs they force panhandlers to take) based on accusations from these police of ours. I met a jaywalker with a debit card in property at MDC, but with no friends or family listed as contacts, and so who spent 93 days in jail for a $50 ticket they would not let him pay. I could list many more instances just as grievous, but details are too lengthy to detail here.

The point is, your cops are creating criminals to fill the jails. They lie, and innocent people go to jail. The judges and the prosecutors, who used to be tasked with stopping abusive policing tactics, now condone and encourage these criminal behaviors. The DA and hers make careers on convictions. Faced with twelve years worth of bogus charges, almost everyone pleads guilty to one charge, to avoid the risk of having the DA go after them as hard as they can(to keep the next guy from fighting for his rights) while they wait in jail for a court date. The judges, likewise want to see as many hot-button cases as they can be gravely concerned by, hand out harsh sentences for, get re-elected about.

What is the trade off for having cops willing to steal lives and ruin reputations to make money for our “Trusted leaders”? An honest government would never be underhanded to acquire money, they’d just request what they need…it’s our infrastructure, after all.) then you’d better let them get away with stuff like this when they mess up real good, even pay 10 million taxpayer dollars if you have to(and why not let’s go demand our cops pay for their own mistakes through indemnifying themselves, and when they can no longer get a three million dollar policy we dump them?) because if one of these D- students ever got mad enough to talk about being part of a massive criminal machine at the behest of our community leaders, with their tacit approval, well, that won’t work now, will it?
I know, my words are hard to digest, and I get that. The toughest part of realizing how bad, how corrupt our police are, is admitting you were completely foolish, enough to believe in these guys. You’re not so foolish, police, our courts, our “Trusted community leaders” are supposed to be people who rise to their positions because of their exemplary, life proven characters. I assure you, these people deserve to be far higher on the scale than any of the real criminals on our top ten most wanted lists….
In any profession, when it is possible to go further, faster, by being unscrupulous or a criminal, those people at the top of those professions will eventually, inevitably, be unscrupulous criminals.

Yes, innocent people go to jail everyday, with false police reports and abuse of power. If you can't afford to hire an attorney, you might as well plan on a plea regardless. Sadly, the officers who falsify police reports are not disciplined and the wrongly accused loses everything. The DAs office is equally guilty for trying to frame the alleged offenders for political reasons. Beleive me I know...I moved from ALB to CO because of this.

We know that power and responsibility go hand in hand. Irresponsible use of power eventually destroys both the power and the wielder – that’s just the natural order of things. Only with vision, care, responsible use, and unwavering ethics can power be maintained or grown long-term.

Here’s where it gets interesting to me: what happens when people willfully shirk responsibility? I’d suppose that Uncle Ben would say that as you choose to forfeit responsibility, power will leave you, too.

When you watch the video of Mayor Berry running away from his responsibility to manger his police department in a manner which does not "horrify" him and his citizens, you come to the inescapable conclusion that he should not have any power over the City, its police department, and more importantly us.

Isn't the shooter in this case the same ROP detective that tried to shoot a suspect in broad daylight in Rio Rancho a couple months ago? Rio Rancho being a completely different county which APD does not have a police commission to enforce the law in. These guys are out of control! I couldn't agree more that APD needs to get rid of all these specialized units and put cops on the streets. If you have a department of 800 officers then why are there only 2-4 officers working patrol in an area command at any given graveyard shift? They need to shitcan the administration and bring in someone from a huge department outside New Mexico and restore APD to its previous department of dignity and honor...

One must have to believe that there must be a least fifty different ways to handle the John Boyd situation. This poor man wasn't going anywhere he was camping in the middle of nowhere with nobody around. What was the rush to get him off the mountain? Why not a least buy Mr John Boyd a last meal before inflicting capital punishment for illegal camping?

If John Boyd would have been a wild bear with razor sharp claws there wouldn't have been six officers and a dog antagonizing him. Mr Boyd would've been shoot with a tranquillizer and later released back into the wild.

I'm left wondering, if all police shooting were captured on video would the term "justified police shooting" be believable?

My assumption why our mayor, Richard Berry doesn't want the Cops TV show filming in Albuquerque is because it would portray the City of Albuquerque administration as a ruthless criminal enterprise with the Real Time crime center as the command center to gun wielding tugs in police uniforms.

I woke up this morning to see that APD response to yesterdays peaceful rally was for APD to shoot another person. I'm hunted by what will happen next. These police shootings are a treat on the American way of life...

Urban Dictionary definition for, Booyah: an exclamatory statement, often said when someone is extremely overjoyed. Often people do a hand movement simultaneously as they say 'Booyah'(clinching fist and thrusting their elbow downward vertically)

This mornings shooting looks like the guy had a gun to his head and then points it down and fires a round or two. In an urban setting that is going to get you shot by the police and rightfully so. Look at the video and you see civilians all over the place. This guy is shooting rounds somewhere, if one of these shots had hit a citizen the police would be blamed for that.

This is a no win situation for the police. Do nothing and risk idiot civilians who aren't smart enough to get inside and out of harms way, from being shot. Shoot the guy to stop his actions and everyone says you are trigger happy.

I told my kids not be become cops or teachers. You get paid like shit, treated like shit and blamed for everything.

Why was Kathryn Levy at the scene of the police shooting last night? Why? This liar is seen at every controversial situation that goes down and she has her filthy hands in every dirty case involving APD. There is no place for a city attorney at a crime scene like that while the investigation is being conducted. None, unless someone needs advisement on what to say. And we all know she is good at that. When the Feds come in and gut the place of unethical liars like this who are pulling the strings from behind cover, that is when there will be a change here.

People put suppressors on rifle in order to protect their hearing. The fact that suppressors are NFA firearm components is a national disgrace. They are cheap to manufacture and should be available at any firearms store for anyone, not just people willing to pay a $200 tax and a background investigation.

There is nothing sinister about using a suppressor.

Public Servants, whether in the police or military, seem to be more and more emboldened to use innocent citizens as live target practice without consideration or care for serious repercussions for doing so, with or without photographic evidence of their wrong-doings.

What are we to think of this worrying turn of events, where it would appear that acting public servants face no serious reprimands or serious criminal action to discourage similar behaviour amongst their ranks, for what most right thinking people would consider unacceptable behaviour.

Is there a way of understanding why this is happening ?

Indeed there is, when we correct our perceptions to help us ‘see’ how it is public servants are able to justify their actions against what appear to be innocent people, or for that matter, why they don’t have to even justify those very same actions.

At the same time, when we explore how relationships are formed, we will come to an understanding of why it can be seen or at the very least considered, that public servants represent occupying forces who fail to identify themselves as being from a foreign jurisdictional territory, and therefore are, acting unlawfully outside of that territory when they act against those elsewhere, when we read -
