CRIMES at the Crime Lab

****UPDATED: CRIMES & LIES at the Crime Lab

In response to being exposed for the witness intimidating actions perpetrated by APD chief Gordon Eden, he spoke out in defense to explain his actions. Eden and his spokespeon said:

"Regrettably, the method of communication that I chose was not the best." (Meaning: I shouldn't have put it in writing.)

"Officers do not need to get “permission” if they wish to meet with the DOJ. [I] just want to know if they are meeting." (Meaning: I need to make a list of whistleblowers.)

"This is not a gag order but a requirement to let the chief know so the chief office could have a representative in the meeting." (Meaning: I want to know what people are saying so I can make sure videos, like those made by Keith Sandy, are destroyed or know what lies to create.)

Well Mr. Eden, it sure sounds like you're either a liar or a very poor communicator. Either way, explain how we are to read and understand this in any way that is consistent with your statements above:
Can anybody say clear and direct?

The Albuquerque Police Department boasts what should be one of the most credible and effective crime labs in the region. It supports a large staff of civilian and sworn personnel who are recognized experts in court and have resources only rivaled by the state's lab across town. It processes thousands of pieces of evidence each year and functions as a custodian of that evidence for not just our local criminal justice system but for federal cases as well.

But all is not well at the crime lab.

Since the early 2000's the lab has had its issues of guns, drugs, and money being stolen. And then in the late 2000's it had more issues involving guns and other property. Then of course there were those bizarre sex encounters caught on video in the evidence warehouse that went unaddressed by then crime lab director, Marc Adams. And when certain evidence was flagged as "Not To Be Released" by APD Chief Ray Schultz, even Adams saw the writing on the wall and retired along with his co-conspirator Schultz.

So off went Adams and in came John F. Krebsbach. Krebsbach's history with the department is he came over and handled fingerprinting and CODIS work overseeing the data entry. He's been with the city around 10 years and when his pal Adams left he was the only person to put in for the new position.

Yet despite this history of being in control of very sensitive information and overseeing what is absolutely a vital division in the state's largest police department, we are stunned to see the following email Mr. Krebsbach issued to people in his department yesterday, June 9th 2014, at 11:02am:

The director of the city's crime lab is ordering people in his department NOT to speak with federal officials investigating his division of the department under investigation? This is not exactly consistent with Berry/Perry's statements of "transparency" or "full disclosure" is it? In fact, is Mr. Krebsbach issuing an illegal order and threatening people with malicious prosecution courtesy of his little email footnote?

In looking at APD's organizational chart, Krebsbach's supervisor is APD Deputy Chief of Police Eric Garcia. And his supervisor is Assistant Chief Robert Huntsman, who of course reports to Chief Gordon Eden. We all know that Eden can't tie his shoes without instruction from his boss, CAO Robert Perry.

We don't need to comment on what ramifications this little nugget of evidence poses but this email poses some very alarming questions. Questions that make us wonder how upside down is the "Crime" lab? Perhaps our friend from DOJ would like to be asked their thoughts on the Mr. Krebsbach's actions. And did he do this on his OWN or was he directed to by Garcia/Huntsman/Eden?

Questions that need to be answered in a fully public forum....

This mornings paper stated that this is a department wide order from chief Eden... is that right?

More obstruction of Justice and intimidation by high ranking officials. I see two felonies right there.
Something tells me the Feds are just going to have to kick the city door in and start arresting these criminals, extortionists, and liars.

Me thinks the city better brace itself because some shit is going to come down hard on these clowns.

Anonymous said...

The DoJ might be figuring it out that this starts at the very top. The Schultz Taser pay to play kickback is just a beginning. What other pay to play or kickbacks are out there just waiting to be exposed? If you think you have something call the DoJ and send it to the Eye!

This is the only way the truth will get exposed.

Thank you to whoever released that email to the EYE! God bless you for your fearlessness in revealing the truth to the citizens.

And to you, you bunch of crooks, you can run but you can’t hide anymore! You’re naked and the citizens aren’t going to let you put your clothes back on until they are prison garb!

Truth prevails!

There is no doubt this came trickling down from the legal department / city attorney's office. This is really pathetic. Here is a government agency acting like a criminal defendant. There is no level too low for this administration to stoop. They cry victim when the protesters protest, and they play poor defendant when the DOJ shines the light on them. There never was a Goliath. Just a bunch of cowards and bullies that got caught.

The Eden edict to silence all is going national, justice for the Torres family, Thugs at the police union backed into a corner and on their last legs, I'd say things finally coming around a little but more to do. Hope the DOJ seals the deal with the consent decree. They falsified charges on correia obviously. Since when does APD personnel sport full beards on duty? The mayor staff exempt from policy? This is a perfect example of what's wrong at APD. Everybody does whatever they want. Now it's time to cleanup those wanna be gangsters in SID and get rid of the swat team.

As a former fed, I am losing all hope that DOJ or anyone will step in and save us. All we can do is keep up the "fight' and not give up until someone listens. We need to send everything to the US Congressional staffers (Udall, etc), so DOJ also steps up. Only way to get a federal agency moving is to get their 'bosses' shaking the tree.

It is interesting to note that, although APD is nothing like the library, except for the fact they are both city departments, thelibrary director does the same thing when a controversy arises in the library. We get the email telling us what to say (i.e. to lie ). He even gives us a script to say (a lie) to tell our customers. Whether it's about a sex offender or about how the library outsourced it's customer service dept. to Oklahoma. We are told to lie to customers about it!

Anonymous said...

I see that a Jennifer Garcia was sent the email. Is that DCOP Eric Garcia's wife? And if so that is a violation.

Tesla? Tesla? Are you there? Pay no attention to this latest controversy. What do you mean you haven't been considering us for a very long time now?

The one sent out to communications was much better. Actually forwarded the part from Chief Gorden Eden. Public Record, yes? Sent on City Email, yes? Time to demand copies of what was sent out to what it sounds like was all APD employees.

So very true-have tried to get feds to investigate corruption in APD for 5 yrs. They need pressure from above.

Anonymous said...

On May 7 2012, a whistleblower from crime lab presented deep concerns about the lack of integrity at the lab, especially in murder cases. Chief Schultz took 40 cops with Jim to watch, and all left at the same time when she finished. Gestapo tactics.

Its good to see that no one takes those don't copy, or share notices for fear of federal prosecution at the bottom of emails seriously! Screw you you feds we copied it and showed it to the world! haha

It was predictable now that there are so many eyes on the Albuquerque killings and that they are being monitored at didapdkilltoday.com, the Martinez/Berry machine is moving forward with their plan to expand their police state outside of Albuquerque, thinking we are only monitoring Albuquerque. Citizens are still paying attention! Is the DOJ investigating these two killings to ensure they were justified and that what is being reported via the old media is true?

Government employees lie at both the city and state level. It's pervasive and surreal quite frankly. You need to record every conversation. Then when you know they are lying, you reveal enough to see if they continue to lie. And then you contact the new media that is bold enough to print it. There are no ethics in either the Berry or Martinez administration. It's all about controlling the masses and protecting their elitist community so the money flows to them.

Try finding out if a roofer has had any previous complaints. They will flat out lie and tell you there are none when in fact there are criminal complaints in the AG's office.

Employees, you need to stand up to their Gestapo tactics. The power has shifted away from them and you have the citizens behind you.

I recorded a conversation with a Bernalillo county employee once. She was rude, arrogant and deceptive. She was a long-term employee who apparently thought she was untouchable. Fortunately her supervisor was very interested in that recording and even came back to get more evidence to support grounds for termination. Government employees ultimately work for the citizens as we pay your salary. Don’t forget that. Be fearless instead of fearful of this administration. And when fear tries to take over, as it does for all of us standing up to this evil, read Psalm 23 so Albuquerque and New Mexico can have greener pastures. They are being exposed more and more each day.

Anonymous said...

What homicide detective doesn't interview and eye witness for two years? What sergeant signed off on this? What LT? What Captain? They should all be disciplined! And how about the city attorney who failed to motion for a jury trial in time. That attorney should be disciplined also!

The only good thing that came from the Torres trial was Berry can't blame Marty Chavez any more. Bacon made it clear, the hiring and training was NOT an issue. Find a set of ball Berry, the last 4 1/2 years of Ray Schultz / Darren White / Rob Perry tearing down APD belong to you because you wouldn't fire any of them.

Anonymous said...

6/11@ 9:08. While it is true that Govt employees ultimately work for the taxpayers, we are also taxpayers and we work for the government. The front line employee you dealt with perhaps is a low level clerk who has to put up with a supervisor that is more than glad to use any excuse to terminate a long-term employee because that's what the administration wants. To clear the decks of high paid, long-term low level union workers who have large pensions built up so they can be replaced with younger, less experienced clueless good soldiers who will work for less pay less benefits no union contracts. The city is now afloat with these types much to the delight of the mayor.

Anonymous said...

Eden, you are so incompetent, please allow me to help you. Instead of the memo you put out, you should correct it and say:

No one is to kill a citizen – no one. DOJ and it’s representatives have issued a report finding that APD has violated the civil rights of citizens. This is a CRITICAL MATTER! No one!! Make it clear to everyone. It’s got to stop immediately.

You should also add that this is a directive from Mayor Berry!

Anonymous said...

12:18

I agree with your assessment. My point is still that the low-level employees, union or not, should be fearLESS and not fearFUL to do their job correctly and not submit to the pressure of lies and deceit that this administration forces upon them. Don’t take on the behavior of an abused spouse and submit silently. Speak out, as A TECH did, and stand up for yourself AND FOR WHAT’S RIGHT. There are avenues, the Eye being one example, where you can reveal what you are forced to do. It’s anonymous. And if you are paying attention to this blog, there are also ways you can reveal the abuse where you have more assurance they can’t identify you. Don’t let them abuse you, SPEAK OUT! Silence is why they have been able to build their corrupt government. And that’s not just happening in the city, it’s also pervasive at the state.

Re: Eden’s comments at the Economic Forum:

He said, “Success with the Department of Justice is dependent on the city of Albuquerque and the community, which is the business community,”

Oops, is this another foot in mouth comment or did you forget about the citizens being part of the community? The business community is only one facet of the community. If you continue to shut out the citizens and don’t intend to listen and represent them so that we can have a community -based police force representing ALL in the community, resign.

He said, “Communicate in writing well to all your subordinate staff. The method I chose was not the best. Today, I make sure that that communication was not misunderstood.”

Did you read the memo you sent about not talking to the DOJ which the Eye graciously posted.

Folks, Albuquerque is becoming a comedy of errors!

Anonymous said...

It is ultimately up to the citizens of ABQ to take their city back in peaceful, organized manner. Don't depend on outside agencies to do it for you.
According to Eden, Keith Sandy's video was sent to the FBI early on and 3 months later the citizens are being told there is no video, huh? It is clear to me that they are suppressing evidence. I think they are in fear of riling up the citizens even more than they already are.

Anonymous said...

I see comments from what appear to be cops calling on higher ups to do something. How about doing something yourself? These thugs like Keith Sandy and Jeremy Dear and Chris Brown aren't operating in a vacuum, take action when you see it, on the spot. If your partner commits a crime or violates someones rights in front of you, act! Arrest the offender, regardless if he's a cop or not. That's your job and if you have any integrity, show it. Your integrity has FAR more value than any job does, that is.

You took an oath. Live up to that.

The story behind the story here is, about 40 Community Advocates, including myself, met with the DOJ and the US Attorney pleading for a Community Representative to be at the negotiation table. The response was a resounding "no" due to the need for candor and the possibility information would leak out and be misinterpreted. In the end I had to agree with the DOJ's opinion, but that was before I learned that Chief Eden had laid down an edict to all APD members that they are not allowed to speak to the DOJ without a city designated chaperone. I now say, it is a two way street, how can an APD officer speak with "candor" to the DOJ with a Rob Perry watchdog sitting next to him??? And I feel that this Mayor and his administrative officers have no intention of "retiring", as I witnessed Chief Eden say today at the Albuquerque Economic Business Forum if they do not wish to work wholeheartedly with the DOJ in reforming the APD. In the immortal words of Mayoral Candidate Paul Heh, I call "BULLSHIT"!!!!!

@ 6/12 0743,

I wonder if you typed all that with a straight face.

Next you're going to tell us that TJ Wilhamplanet is going to open up his own Crossfit gym.

Between that and cops EVER acting to prevent criminality among their own ranks, I can tell you which is more likely to happen in the next million years.

The more they try to silence WE THE PEOPLE, the citizens, who both the DOJ and the city work for, the more fuel they add to the fire. This is another clear justification for the Movement. May it grow stronger because of it and continue to expand EXPONENTIALLY!

Congratulations to David Correia for the judge allowing him to be allowed back into the city council meetings!

It is nice to see you refuse to get help for your 10-40isms. Maybe some day they will lock you away in one of those places that smells like pee pee. The rubber room house, where you just get to go on the floor and they just mop it up and give you a cookie. You will have to take your pills then. Hopefully they will take your computer away too so that you can't exercise your multiple personalities on line like you like to do. What is your name today? Calm yourself child. See a doctor. Berry and his ilk have created class warfare. history exempt buddies on 11 & 5 get raises way above what they're worth. But another interesting fact is being ignored. While Perry's raise made the news, our middle managers, directors and assistant directors are also quietly having their nests fluffed while blue collar, the clerical, bus drivers etc still belong to the classification of "the have nots ".Berry has created an environment wherein the people who need the raises the most get the least. Not a whiner...just fed up..Maybe Berry doesn't know that all union membership is automatic when you go to work at the city?

Anonymous said...

Here's the breakdown of your 61,000:

10% are in retirement homes or don't leave their home, only read the government propaganda newspsaper, thinking it has validity, and only watch the 4:00 news at the government tv channel and then go to bed. Most of them will not be on this earth by the next time we vote for mayor.

90% are the elite that the money in this town is corruptly being funneled to, that's 10% of the total population, or 55,000.

And the rest of the citizens, once the collective organizations in the Movement start educating the public, will wake up and realize they need to get some integrity back into our government as it's hurting the economy, the values of their homes, the future for their children and Albuquerque's reputation.

I question if the votes were not tampered with. In fact, it would surprise me if they were honest enough to count the votes! They haven't been honest about anything else.

We should make sure when we vote for King in November our votes get counted!
